TURNING THE CORNER B y G ar y Pe a r m a i n

After 12 months of doom and gloom, Koh Samui's prospects look to be improving fast. A busy Christmas and New Year period brought significant numbers of visitors to the island, which in turn prompted a resurgence in sales enquiries and property rentals. Caution remains, but there are definite signs that the island is moving forward again. The Samui property sector will certainly take time to recover from a year that saw significantly low transaction volumes, but many real estate professionals feel that as investor confidence returns to the global market, it will be reflected more swiftly on Samui than in other destinations. The fact that the island managed to avoid total collapse, with only a handful of companies jumping ship, means that many projects remain in place with their supply lines open and marketing strategies fine-tuned. The large number of new launches in 2010/11 suggests those with real market knowledge are positioning themselves to take swift advantage of a resurgence. "We've been pleasantly surprised to see some serious buying inquiries on Samui in last 2 to 3 months," says Gary Pearmain, CEO of Project Pacific Co. Ltd. "Although few people have been unaffected by the recession, it seems many are planning to return here and invest. Natural selection is playing a role and Samui still presents an appealing option for buyers, so 2010 looks to be turning a corner." A determination to meet new demand is certainly driving development. On the residential property front, developers with resources have continued to push forward and this means a number of projects are ready to pick up where they left off, with a new customer base to aim at and properties ready to view and purchase. "Our project has moved along at a rapid pace," affirmed Alex Armitage, Managing Director of Horizon Group. "All the infrastructure is now finished and there will be 15 Villas fully completed by March. In the past, many of our customers were from the UK, but now most of our clients are from other parts of the world". Greater client diversity means developers are also having to be more creative in order to appeal to a wider range of potential investors. The market may be stabilising in terms of 14


demand and supply, but the requirements are less consistent as buyer profiles change. Porawan Piyakraivudh, a partner in the celebrity sanctioned Infinity Samui development, which is 80% sold out and also due for launch in March, sees this as an opportunity to improve the quality of properties and services. "Following a series of withdrawals and suspensions, there is undeniably a lack of completed supply," he said. "This means the Samui market can grow. But new entrants will have to be more committed to draw demand for their products." One way to re-inspire confidence in the Samui market is through build quality. The days of fly-by-night developers and sub-standard construction are hopefully past and with high profile companies now making their presence felt, expectations are higher. Fortunately, many of those involved in the building industry are already aware of this and recent improvements in the supply of materials, along with a significant increase in customer feedback, which included the establishment of a Samui court to deal with disputes, have prompted a greater focus on standards. Top named architects, designers and firms with a proven track record are also having an influence. "We are currently enjoying particular success in the design, architecture and construction sector," said Pearmain. "A general increase in the quality of materials, combined with easier product access has enabled us to build ever better luxury properties that represent solid investments." Quality is certainly the benchmark when it comes to branded developments and this year will see some significant additions to the corporate landscape on Samui. W Hotels is one big name brand almost ready to launch residential options, with a full service luxury resort and four of seventeen private villas scheduled to launch in April. Hot on W's heels, Conrad Samui Residences is another major project that will be fully built-out with expected completion by the end of the year. The development comprises a 65-key hotel plus 32 residential pool villas on 63 Rai of beachfront land in Phang Ka. Such big name arrivals will undoubtedly have a significant impact on the Samui market and their influence is likely to extend well beyond an increase in high-end tourism. "The main buzz on Samui is still the imminent round of new 5 and 6 star hotels opening in 2010/11," continued Gary Pearmain. "These projects will not only build confidence, but will also provide a source of future investors. The fact that many branded resorts have residential elements validates the market and this will stimulate interest outside the established names, as people look for returns beyond just rental yields". Augmenting and even exceeding the branded development wave, the continued proliferation of ultra-exclusive private villas has now placed Koh Samui firmly on the high-end map of Asia. With more than a hundred luxury residences now standing proud, many of them available as holiday rentals, the options for extravagant tropical living are endless. "We have added some very impressive properties to our portfolio in recent months," said Marc Ribail, Chief Operating Officer for Samui Villas and Homes. "The quality of private property for sale and rent on Samui is nothing short of exceptional. And there are more stunning residences planned in the next two years." 15

DISPUTE BOARDS:

A BETTER WAY TO RESOLVE CONSTRUCTION DISPUTES? Parties involved in disputes have become increasingly disenchanted with arbitration as a means to resolve disputes due to the cost and the time it takes to conclude the proceedings and enforce arbitral awards. Not surprisingly, parties are seeking alternative ways to resolve their disputes which are less expensive and quicker than arbitration. One such method, particularly in the construction industry, is the use of Dispute Boards.

What are Dispute Boards? Dispute Boards are a pre-arbitral method of dispute resolution where disputes are normally referred to the Dispute Board as and when they arise and not at the end of the project. The constitution and role of the Dispute Board largely depends on the Dispute Board Agreement and covers such matters as (a) the number of persons on the Dispute Board (normally one or three), (b) how the Dispute Board will be appointed, (c) what rules are to govern the Dispute Board’s functions, (d) whether the Dispute Board will periodically visit the project (a recommended procedure), (e) whether the Dispute Board will either make binding decisions, which are appealable to arbitration, or non-binding recommendations and (f) how the Dispute Board fees are to be paid.

The advantages of Dispute Boards The main advantage of using Dispute Boards is that disputes are resolved in a timely and cost effective manner as and when they arise, avoiding the need to refer disputes to arbitration or litigation. A study in the USA showed that from 1995 to 2002 projects which used Dispute Boards resolved 97% of the disputes without the need to refer the disputes 16


to arbitration or litigation. Obviously, the effectiveness of a Dispute Board depends largely on the persons appointed to act as Dispute Board members and the willingness of the parties to comply with the Dispute Boards decisions or recommendations. It is important the Dispute Board members have the background and expertise necessary for them to make the decisions or recommendations promptly after a dispute is referred to the Dispute Board.

What is the cost and who pays these costs? The cost of using Dispute Boards is normally in the region of 0.25% of the total construction cost on a difficult project. These costs are normally offset by lower tender prices as the contractors would not have to price the risk of referring potential disputes to arbitration or litigation. The cost of the Dispute Board is equally shared by the parties.

Recognised success of Dispute Boards Dispute Board have proved so successful that bodies such as the International Chamber of Commerce (www.iccwbo.org) have published Dispute Board Rules and other institutions such as the Dispute Resolution Board Foundation (www.drb.org) have been established to primarily manage Dispute Board procedures. Additionally, major lenders such as the World Bank require the use of Dispute Boards in contracts where they are the lender and standard forms of construction contracts such as FIDIC also require the use of Dispute Boards.

Conclusion It is well worth developers and contractors having the use of Dispute Boards specified in their contracts, although the precise terms regarding the role and procedures for the Dispute Board may vary between different contracts. Reduce Risk when Investing in

“ Off-Plan” Real Estate

Many investors choose to invest in “off-plan” residential real estate projects in Koh Samui and Koh Phangan. The principal advantages of “off-plan” projects is that the price of the property can be significantly less than the value of the same property once it has been fully constructed. Furthermore, investors may be provided with the opportunity to “customise” aspects of their property as construction progresses. Despite the apparent advantages, there can be some financial dangers involved in buying a property “off-plan” particularly if the developer does not have sufficient finance in place at the commencement of construction to fund complete construction of the project. Investors can take practical steps to minimise the risks of investing in “off-plan” properties. Prospective investors should conduct detailed enquiries into the developer and the project before committing any monies to a project . This is to establish (amongst other issues) the financial standing of the developer and the project. It is important to raise direct enquiries with the developer to establish how the construction of the project will be financed. Enquiries should be raised to establish whether or not construction finance has been secured from a lending institution and on what terms funds will be released to the developer. Investors should also request details of other residential projects that the developer has completed and carry out further research by visiting these projects and conducting investigations through the internet and other sources. Independent enquiries may also be conducted against the developer and the project such as a financial / credit check to establish to solvency of the developer. An independent lawyer should be appointed to undertake due diligence into the land title in order to establish that the Seller is the legal owner of the project land and that the title to the property has been legally issued in accordance with the laws of Thailand and has full legal rights of access. Further checks should be made through the investor’s legal representative to establish whether or not a valid building/construction permit has been issued in relation to the project. Furthermore, it is important for the appointed legal representative to establish whether or not a suitable insurance policy is in place to cover risks during the construction of the project. Investors should be aware that if the project is not 18


insured properly, there is a risk that the investor will lose their investment in the event of serious damage being sustained to the property or project. The effective negotiation of the terms of the Sales Contract can assist the investor to reduce the risk in “off-plan” transactions. The contractual payment terms in the Sales Contract should link purchase price payments to construction milestones so that payments are made as construction progresses. Investors should avoid payment terms which require a large “up-front” payment of, say, 50% of the agreed purchase price before construction commences and instead should seek to negotiate payment terms which allow the investor to make smaller purchase price instalments during the earlier stages of construction with a large final payment upon completion and handover of the property. It is important to verify that the construction stage which triggers each payment instalment has been duly reached by the developer before the next payment instalment is made. Investors should appoint a surveyor to inspect the progress of construction at each construction stage to ensure that the construction has been undertaken correctly and in accordance with recognised building practices. At the very least, Investors should inspect the project themselves or request clear digital photographs evidencing that the alleged completion stage has been reached before handing over the next payment instalment. The Sales Contract should also require the developer to pay penalties or allow the investor to terminate the Sales Contract and receive a full refund of monies paid in the event that construction of the property and communal areas are not completed by a stipulated date, unless an event occurs outside of the developer’s control which causes the delay. In certain circumstances, prospective investors could petition the developer to register a lease over the investor’s land plot in favour of the investor as soon as instalments of the purchase price commensurate to the value of the land plot have been paid to the developer. In this scenario, in the event that the project fails, the investor will at least have a legal interest in the land plot for their money. Investors should be aware, however, that most developers will be reluctant to agree to the registration of a lease over the land plot in favour of the investor because the developer’s rights will be undermined in the event that the investor reneges on future payment instalments. It is worth pointing out that this option will not be available to investors in “off plan” condominium projects and apartment projects because transfer of the unit will not be possible until substantial completion of the project. It is clear that there are some fantastic “off-plan” investment opportunities on offer in Koh Samui and Koh Phangan. The various measures set out above will assist investors to reap the rewards of investing in “off-plan” properties whilst minimising the potential risks. Living on Samui There is a fast growing expatriate community on Koh Samui, with people moving from Europe and beyond to escape the stresses of western life. Thailand is known as one of the most welcoming countries in the world and as Koh Samui has developed over the years it has gradually begun to offer all the comforts of home, but in a tropical island location. Living on Samui is easy; the island now offers a range of excellent locations for shopping, including two large, well stocked supermarkets: Tesco Lotus, Big C and Tops. In fact, with all the modern conveniences now available it's sometimes easy to forget you are in Thailand at all. New shopping malls and entertainment centres are on the way, and Western treats like good wine and imported food that foreign residents may have once missed, are now readily available. People who live on Samui enjoy a vast choice for wining, dining and entertainment. Thai food of course abounds, and is both tasty and extremely good value. There is also a huge choice of international cuisine with everything from fine French cuisine to fast food chains. For those who like drinking and socializing, many Western style pubs and clubs not only serve local alcoholic drinks but also offer many favourite international brands. A number of bars also show live international sporting events, so it's possible to enjoy a cold beer in the sun whilst watching your favourite football team play in the cold wind and rain back home. Of course Thailand wouldn't be the same without its people. It is mainly because of their friendly nature that foreign visitors keep coming back and end up living on Samui. Most local people speak a certain amount of English, which means that speaking Thai is not necessary, although life becomes much easier if you do make the effort. Don't expect tobe living an authentic Thai life though; around 80 percent of the population on the island is made up of visitors or expats. Samui is fast becoming a comfortable, sophisticated haven in the sun, but it is also important to remember that there are significant cultural differences that may cause frustration. Local people enjoy a relaxed approach to life, and this can take some getting used to. As long as you are prepared to meet the local people half way, living on their tropical island can be a pleasure indeed.

The entrepreneurial business firmly established itself as a leading provider of website development and photography services in Jersey, and boasts an international client base such as the renowned Hilwood Resorts & Hotels, an eclectic portfolio of bespoke luxury hotels and spas. In April 2009, Stephen went independent and with a firm foundation of website technologies, design and photographic expertise, he has vast experience managing the development of online applications and consultancy skills.

Stephen currently provides Internet Consultancy for selective clients whose objectives are best met through the tools available in today’s web marketplace. Since relocating to Thailand Stephen has been acquainted with a range of new clients in the leisure, hospitality and property sectors that wish to develop these areas to their commercial advantage.

What inspired you to get this consultancy off the ground? During my time at VisualEye I recognised the importance to engage with the online customer. Offline we engage with people every day so there is no difference online. When you engage, you open a door to establishing what people need before you try to sell. Ultimately you have to connect with them. It is possible to use your website introduction to engage with people, for example, just because they they're looking for a room, doesn't mean they're interested in the presidential suite. You can ask what kind of services they like, what they enjoy and what they are not looking for. If you can't meet customer needs, you have wasted their time. Going in with a "SELL SELL SELL" approach first, you're more likely to annoy than satisfy their requirements. If you have a visual product you may wish to consider interactive engagement. One example is virtual tours that provide a unique vehicle for presenting visual information in 360° space – on a website. Nowadays more people are online, doing the research themselves to cut out the middleman. They will land on your website looking for something different and you need to create a unique experience that is easy to use and understand. 46

Unfortunately most websites fail to meet a clear brief and set of objectives, thus fail to meet expectations. This can mean a low conversion rate and a wasted marketing budget. My inspiration is that I know how to fuse business objectives with creativity, to make a website look good and function correctly. I can explain the process in simple terms to deliver a winning website for the client and ultimately their customer.

Do you have any tips to improve a website? Bear in mind that you have to grab people’s attention very quickly. There is a statistic about having just 3 seconds to do so, so you have to have a headline that will make them read on. Keep the content short, simple and crystal clear. Create a ‘more info’ link for points that require further explanation. Use big, bold and bright fonts. Increase the font size of certain words so they stand out on the page. Try to keep the website copy to the screen size and don’t make people scroll down. Keep your visuals consistent and don’t compromise your identity by using poor artwork.

What’s the hardest lesson you’ve learnt since starting out? I make a point of never over-promising and under-delivering. Sadly, many companies don’t employee such an ethos. It also never fails to amaze me the amount of your time people are happy to waste.

What advice would you give to would-be entrepreneurs? Be professional all the time to avoid anything backfiring on you. The basics - know your client, create a good business plan, a supporting marketing plan and detailed financial forecasts. There are always people who know more than you. In these situations, listen twice as hard as you talk but don’t be afraid to ask questions. The Main Event

Event management has long been a lucrative business in Europe, most countries now host everything from rock festivals to corporate brand launches and sporting occasions, with competition fierce amongst companies and venues looking to draw big crowds and therefore big sponsorship. As Koh Samui attracts an ever more diverse spectrum of visitors, the potential to hold events of varying scope and size has increased. In the last year alone, the island has hosted a range of impressive events that not only generated revenue but also helped promote the island as a diverse and appealing international destination. Love or hate it, the Full Moon Party on Koh Phangan is now a major international event that draws thousands of people to Koh Samui, Koh Phangan and Koh Tao every month. Although something of a thorn in Koh Phangan's side, the party has inspired something of an events boom on nearby Samui in recent years, where smaller, more manageable events appeal to a slightly older, more sophisticated crowd. Dedicated venues like Lake View, Nikki Beach, Q Bar, Sound, Mint and Beach Republic now regularly host big name international DJs, while Samui based events companies

organise bespoke gatherings in resorts and private villas, on offshore islands and even aboard boats. "We have seen real growth in the both the number of events and quality of entertainment on offer around the island in the last year," said Steve Bray, Director of The Agency. "In fact, on February 13th we have two world famous artists from the UK booked to play at Beach Republic in Lamai— LTJ Bukem and MC Conrad. These guys usually play to huge crowds in Europe. That's one of the advantages of Samui, it offers a rare chance to enjoy top quality performers in a more intimate setting."

Small is beautiful This niche approach to events management seems to work best on Samui. The logistics involved in organising large scale concerts or festivals can prove particularly difficult on a small island, even with excellent access routes in place, and the costs are often prohibitive. The 2006 Koh Samui Music Festival was a case in point. Although undoubtedly the most comprehensive gathering of international artists ever to grace the island, with legends like Jerry Lee Lewis, The Wailers, UB40 and Jools Holland taking to the stage, the event failed to pull the expected crowds and was never repeated on a similar scale. Since then, the only regular large scale music event has been the monthly Samui Jazz concerts, until recently held at Samui Park Avenue. These concerts are a more modest musical offering than their ambitious predecessor, but still feature big name acts from around the globe and have proved a serious hit with both Thai and foreign audiences. Besides live bands performing in hotels and at private parties, the focus for most entertainment events on Samui has been on dance parties, which involve lower overheads but also appeal to a wide international clientele. A crowd of over 2000 socialites, VIPs and jet setters attended the Nikki Beach ‘White Party’ launch back in April, where any lack of live music was more than compensated for by white gowned hostesses, dancing elephants, aerialists, roving drummers and illuminated balloons floating above the partygoers. Such creative approaches are certain to become more common in the coming year, with local 73


agencies such as Action Arts Alive already offering a full choice of options to their clients, including everything from concept planning to sound production and circus performances. "We specialise in providing something different," said the company's chief events organiser, Asambai. "Whether its a professional vocal host, dancers in full body paint, percussionists perched on giant drums or multi DJ line-ups to shift the musical styles through the evening. The process begins with a consultation and we build the event from the ground up to match our clients' needs exactly and ensure that each event has the biggest possible impact."

Beyond entertainment Of course, performance based events are not the only form of gathering on Samui. Sport is playing an increasingly significant role in promoting the island with regular events like the Samui Regatta and The Bangkok Airways Open attracting global competitors along with plenty of media attention. The 9th Samui Regatta is sponsored by Sawadee.com and will take place at the end of May. The event is now a regular fixture on the Asia Yachting Grand Prix circuit and considered one of Asia’s most glamorous sailing events. It has also been called ‘the regatta that gives back’ due to efforts in 2009 to clean up the Samui beach environment and to support children on the island to receive an education through the introduction of ‘The Sawadee.com Regatta Bluewater Scholarship Fund’. Other sporting events organised on Samui have included the first Samui Adventure Race, which took place last September and saw teams compete in a number of categories 74


including biking, running, kayaking and swimming. There have also been several charity runs like the Cancer Care Fun Run organised annually by the Four Seasons Resort, plus similar events hosted by the local government. Samui's largest charitable gathering is the Samui Mala Festival, a multi-day event hosted at different venues around the island. Supported by the host venues, local hotel and tourist associations, private businesses and individuals, the event's aim is to raise awareness of sustainable, healthy living on Samui. It has also created networks of individuals interested in environmental issues and raised funds to support educational and charitable causes. The eclectic mix of events on Samui also now includes more exclusive, private functions and extravagant weddings held almost weekly at private villas and resorts. As a location to party, compete or gather and share ideas, the island has exactly the right locations and facilities to draw ever greater numbers of niche groups and revellers. Choosing a Reliable Agent Whether you choose to live in a gated development, purchase a stand-alone home, or for the even more adventurous, buy a piece of raw land on which to build your future dream house, you will be in need of the services of a good real estate agent. Choosing the right agent is essential as a reputable firm with good local contacts can help you avoid many of the pitfalls that a less informed buyer might encounter. There are now so many different agents on the island, it is difficult to choose between them. Ideally though, your agent should be able to demonstrate a solid background in the industry and offer examples of successful deals they have handled that are similar to your own plans. It is also vital that your agent has good local connections with Thai partners and the authorities. Paperwork and local procedures can sometimes be daunting, but if you have the services of a quality agent with good local knowledge, almost all of the potential stumbling blocks can be swiftly traversed with little or no headaches for you, the buyer. It is vital, for example that you know you are buying or leasing the right type of land. There are various different land titles, the most sought after is the 'Chanote' title. This indicates that the land has been officially surveyed with the use of GPS and its boundaries are now fixed. Be warned that buying land without professional help could mean purchasing what looks like a bargain piece of land that may turn out to be unusable due to the land title. Other pitfalls include road access and the availability of utilities such as electricity and water, not to mention the processing and checking of legal documentation and ownership rights. Once you have found a property, you will have to consider the various purchase options carefully. Foreign individuals may own a property on a renewable 30-year lease, but in the past, many opted to set up a Thai company in order to purchase the property freehold. The latter is less easy than it was a few years ago, but your agent should have a full understanding of both procedures and will be able to explain the pros and cons. Owning a Thai company involves legal and tax issues that you should be well aware of before pursuing this avenue. With so many things to consider, it is easy to see why the services of a good and reputable agent are not just advisable, but essential. By working closely with them to find the solution that best suits your needs, you should enjoy a smooth and painless experience when setting up your new island home.

Building a Property Having a home built to suit your own tastes and needs can be a cost efficient, not to mention rewarding experience. It does take time, patience and energy however, and you need to be absolutely certain that the people you employ to build the property are capable of delivering the house you have in mind.

Once the land is purchased and ready for development, thoughts can turn to the design of your house. Of course, you can be as involved in the design process as much as you wish, from merely requesting certain facilities or features all the way to designing the floor plan in its entirety. Either way, your ideas will have to go through a certified architect in order to ensure the plans are both practical and legal. Many laws exist in Thailand to ensure that buildings do not move too far away from Thai cultural traditions. Once the architect has completed your official plans, your builder, if you have already secured one, should then be able to work out a detailed quote to construct the property to the specifications. When choosing a builder, don't be afraid to ask for references. Some contractors may even offer to take you around some of their previous projects so that you can see the quality of their work and perhaps gain some inspiration for your own home. Several contracting companies are foreign run or employ foreign representatives, which can save time and confusion due to communication problems. It is always good to try and strike up a rapport with the Thai partners and staff too though, as their local knowledge will often prove invaluable. Once you have chosen your contractor, as always make sure your investment is protected by the correct documentation. It would be advisable to have an independent law firm check any paperwork for potential grey areas. If you have ever had a home built in the West, you would have received certain assurances from the building company, including an agreed schedule for completion, a performance bond and a warranty on the finished product. Providing such guaraantees is not always common practice in Koh Samui so the kind of guarantees you are offered should have a significant bearing in your initial choice of construction company. A performance bond is a guarantee issued by the contractor's bank to secure any advance payments you have made. When building on Koh Samui, you will likely need to pay an initial deposit in order for the builder to obtain materials and retain a workforce. Thereafter, you will pay an agreed amount of instalments, which will likely be tied in with certain pre-agreed stages in your home's route to completion. The initial deposit, which could be around a quarter to a third of the total amount, will remain unsecured if no performance bond is issued. In terms of warranty, you should insist on at least twelve months coverage from the completion date. This should be plenty of time for any major building defects to become apparent and resolved at the cost of the building company. With the plans cleared, the paperwork checked and your deposit paid, building can commence. If possible, it is a good idea to make regular visits to your property during the construction phase. This is perhaps the best way to avoid problems or a misinterpretation of your wishes and also means building good relations with the workforce. It will establish your authority as the paying client and seeing your property gradually come together is almost as rewarding as the first night you'll spend in your new tropical home.

Building Regulations on Koh Samui In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page) Stage 1. Land up to 10 Metres from the beach. The law states that no construction is permitted within this area. Stage 2. Land up to 50 Metres from the beach. Within this area you are permitted to construct a single storey building only It's height cannot exceed 6 Metres (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Metres. Stage 3, Land up to 200 Metres from the beach. Within this area you are permitted to build up to a maximum height of 12 Metres (including the roof). The maximum allowed size is 2000 Square Metres. Stage 4. Land located more than 200 Metres from the beach. Within this area, buildings of up to 12 Metres in height (including the roof) can be constructed. Land Title Deeds in Thailand There are two main types of land ownership in Thailand which we should explain

Rights of Possession Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

Rights of Ownership Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

Tips for starting a new business Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

Getting started To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder's meeting to reach an agreement on the purpose of your business and set up the company's operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code's partnership and companies section.

Shares Besides the issues of business registration, you must also make sure that your company's shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company's shareholders. The book is evidence that will identify the company's shareholders.

Shareholders and Chairperson A Limited Company's shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company's rights, such as landownership. If less than 49% of your company's shares are held by foreigners, your company is considered a Thai company. However, if foreign nationals hold more than 49% of the shares, your company is a foreign company.

The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department's staff are now required to thoroughly investigate your Thai shareholders' sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

Little things that matter A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company's financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company's board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company's business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. Visas and Work Permits I have recently been asked to clarify the way the Thai system works with visas and work permits if you are opening a company here and would like to have a work permit. Firstly I must point out that each Thai province does follow slightly different guidelines and my information does in no way substitute you actually having a legal consultation with a reputable lawyer's company if you actually intend to work. There are those that believe the little they would do in reality would make a work permit hardly worth the trouble. This is a big mistake and one that could cost you more problems than you would believe. The Thai Immigration takes cases of foreigners working without a work permit very seriously and the penalties are harsh. If you are here on a tourist visa you cannot in any way participate in a job. So let's have a look at what's actually required to apply for a work permit. Firstly you need to have a business class visa which in most cases will have to be applied for at a Thai Consulate outside of Thailand. There have recent changes to the system, whereby smaller Thai embassies such as the one in Penang, Malaysia, have stopped issuing multiple entry visas. Initially there were those who whispered that the only way to arrange these multiple entry visas was for the individual in question to return to their home country and obtain the visa from their local Thai embassy. This however had been proved to be incorrect with the embassy in Kuala Lumpur still issuing multiple entry visas until recently, but currently the situation remains in a state of flux with even legal profession als unsure as to the long term guidelines. We therefore strongly advise obtaining up-to-date legal advice well in advance of pursuing your visa run, to ensure you are fully equipped with the documentation currently required for your business visa. Those working in Samui who earn a salary of 50000 Baht per month however, shouldn't have to face these visa run hassles, as they're entitled to a business visa that only needs to be renewed once per annum at an immigration office. Further details of this scheme can be obtained via a legal professional or at the local immigration office in Na-Thon. Either way, once you have the correct visa, you'll be able to apply for or renew your current work permit. Once again there are procedures required for this, which your legal professional will prepare for you. This process might seem tedious, but it is nothing unusual, with every country having its own procedures and legal applications. Thailand is no different and don't be fooled by the laid back and casual attitude of many Thai people on the island, as this is no reflection of the order required in any formal legal requests such as visa or work permit applications. When it comes to legal matters you need to ensure you follow the correct procedure and can produce the appropriate paperwork. All in all, it is easy to see why the services of a professional and thorough legal company are invaluable, saving you much confusion, stress and potentially time and money.

Essential Design Elements Welcome back to the second edition of our interior design tips. I hope you all had a great Xmas and New Year break and were able to find a space to relax your mind and absorb some fabulous design inspirations from your surroundings. As I mentioned in the last issue, to achieve a harmonious comfortable environment to relax in, you need to have a well thought out, practical design, involving as many sensory elements as possible. So how do we choose which materials to use in our design? To start with take a look around your existing canvas, even a little further a field as to what is surrounding your space. What do you have already existing that can inspire you? Here is a short list to help you understand what things to look for in your existing space, before you can begin your new design journey.

Wind Is there adequate ventilation in your space? Which direction does the breeze blow; do you need to create a flow through your space? Do you need to create more openings or roof ventilation to cool or ventilate your space? Is it an open space that needs to be closed in to prevent wind?

Fire Is your space warm enough? Do you have enough light in your room, can you achieve secondary light from an adjacent source? Is there too much fire, do you need to block out some heat or light from invading your space?

Earth What solid surfaces are present, what is the floor made of? Are there any stone elements present, or in adjacent spaces? Do you have any solid vertical surfaces? Is there too much earth, perhaps you need to soften the space and take out some walls?

Water Is your room damp and require moisture proofing? Do you have a water source close by, or can you see one out the window? When it rains does the water cause excessive noise or drainage problems? Is the room too dry, can you add a water feature? Is there ‘dirty’ water around, do you need to block it from your direct sight or immediate sensory contact? All of the basic elements - wind, fire, earth and water make up the source of all life on the planet. Without one, or with too much of the other, we can upset that balance and cause great harm not only to the environment, but also our physical form and presence of mind. If we can achieve harmony with nature and within our spaces we can achieve a fabulously relaxing serene environment to enjoy with all of our family and guests. So first decide on what is missing from your space, or what you have too much of, and in the next issue we will find ways to correct the balance in your room, as we help you to select a style that suits, and move on with the design process. 111

Bamboo

As an important, beautiful, useful, voracious and culturally symbolic member of the local and international plant community, bamboo is a unique plant, found in abundance, dead or alive, around gardens and homes in our community. Throughout history, these often giant grasses have played an intrinsic role in Thai life as a building material, food and generally versatile multi-purpose material, with countless applications.

Living bamboo When living, bamboo can serve as a useful screening element in the garden, although to some, the regular leaf fall can prove an annoyance. Stands of bamboo near swimming pools will keep the maintenance contractor busy, and its fast growth rate brings pro’s and con’s. Newly planted bamboo quickly establishes itself and creates dense coverage. In fact, some species of bamboo can grow over a metre a day, and common green bamboo is no exception. Pruning bamboo, as incessant a task as it may be, can produce nice architectural shapes for a more formal look and can be impressive in mass plantings for lining drives and walkways. In areas where space is less constricted, shoots can be left to grow wild. The resulting effect of long, graceful stems and feathery shoots can soften hard lines of buildings or even act as a stand alone feature.

In addition to the wildly occurring green variety, fine leaved bambusa multiplex and Yellow Running bamboo, with golden stems and broad leaves, are both widely available species for landscaping usage. Buddha Belly Bamboo, with its swollen nodes and attractive foliage, is also an easily obtainable species. Bamboo illuminates wonderfully. When up-lit, the shadows created cause atmospheric ambience, especially when animated by a breeze. Light fittings can be fitted with sleeves of broad, dead bamboo nodes for an inexpensive, practical and relative finish.

Cut bamboo Thai green bamboo, Dendrocalamus Asper, can be harvested for building and general usage, although some considerations should be employed to achieve the best results. Cut bamboo is susceptible to rapid insect infestation, which can render the material useless in no time. Attracted by the high sugar levels in the sap, insects bore into the hollow nodes, rapidly reproduce and weaken the structure from within. To reduce the food supply, cutting should take place in the evening when concentrations of sugars are lowest. The cut stems are then placed on a hard surface and kept upright. Shoots should be left intact, and the leaves left to yellow and fall over a week or so. This process allows the leaves to use up the maximum amount of sugar in the sap, whilst the stem cannot produce any more. The practice of leaching bamboo in sea-water is common on Samui. Holes are drilled into each node and the stems are bailed and anchored down, to be submersed by the tide. A period of around 2 weeks is usually required to leach out the sap. Having drained water from inside the nodes, the waxy, hard outer skin of the bamboo should be prevented from cracking during the drying process. Keeping the stems away from strong, direct sunlight is the best approach and patience should be exercised leaving plenty of time for stems to dry thoroughly. Holes drilled in the nodes should be filled at the earliest opportunity. Further treatment by long submersion in water, preferably running, is required to complete the extraction process.

Bamboo shoots New bamboo shoots are edible and used extensively in Thai and many other Asian cuisines. The shoots of many species, however, contain toxins, including cyanide. Common Thai green bamboo, contains as much as 842mg/kg of hydrogen cyanide, mostly at the tip, with content increasing with the size of the shoot. Cooking for up to an hour, leaches the cyanide from the shoots, rendering them safe for ingestion.

How much

rain?

Have you ever wanted to know how heavy the rain was last night or how much fell in a day? Well you can easily make your own rain gauge with materials already in your house or easily sourced from local shops. Here's a list of equipment and instructions.

Equipment A large jar. - the kind used used to store mayonnaise is ideal, or any cylindrical-shaped jar. A transparent, 6-inch plastic ruler. A funnel - the mouth should be bigger than the jar’s opening. Transparent waterproof tape or elastic bands.

Instructions Follow these simple instructions to make your rain gauge: First, clean the jar and remove the label if it has one. The jar should be as clear as possible. Then attach the clear ruler to the jar using the elastic bands. Make sure you put one at each end of the ruler to secure it. The ruler’s base, should be at the bottom of the jar as you will use the gauge to measure from the ground up. You can also put the ruler inside the jar and keep it in place with transparent, waterproof tape. If you do not have a clear ruler, simply mark measurements on the jar using a permanent marker and tape measure or wooden ruler. Next, put the funnel into the jar. The funnel should cover the entire mouth of the jar to make sure you catch as many raindrops as possible. If you want to get creative or make measuring rainfall fun and enjoyable for the kids, decorated the the jar with colourful marker drawings. Once the rain gauge is ready, position it in a place where it can collect as much direct rainfall as possible. For example, in the middle of the garden or on an open terrace. Make sure the gauge will not catch water dripping from a roof or tree, as this will affect your results. Record the amount of rain collected after each rainfall and empty the rain gauge after each check to ensure accurate measurements. It is also helpful to note how many minutes or hours the rain lasted. This way, you’ll also be able to calculate the exact volume of rain per second or minute. Making a rain gauge is not only enjoyable, but can also be a useful way to measure changes in the weather. If you keep a record on your computer or in a notebook, you can make comparisons between particular weeks, months or even years. This allows you to protect your house from heavy rain and make sure the garden is getting enough water. What's more, you will be armed with accurate knowledge whenever the topic of weather comes up in conversation. 114

Snagging for

Defects A service has arrived on Samui that will help set the construction industry on a new course. There are countless horror stories detailing unscrupulous developers and fly-by-night contractors, not to mention careless builders. This worry may no longer be an issue for those people with foresight and good sense, for they know that a professional "snagger" will save them from potential problems and help to guarantee a successful dream home without fuss and frustration. Snagging is a term used in the construction industry in the United Kingdom and Ireland and refers to the production of a list of quality defects at the end of a build process, phase or stage. Typically, each defect listed will carry a description of the issue, as well as detailing who is responsible and a target date for rectification. Snagging is carried out by the main contractor during the build and the responsible parties are generally the sub-contractors. The client for the construction project will receive a final snag list at the end of the build. Back-snagging or de-snagging are the terms used for checking that defects have been successfully rectified, which is followed by an updated snag list. In the UK, some home buyers employ the services of an industry qualified expert to 'snag' their new home. A 116


snagging company may be able to find more faults and be able to ensure the developer puts the faults right within a reasonable time. Obviously, the advantages of having a snagging company assist your build are numerous, but one of the more useful services is the quality control offered buy snagging. Gone are the days when you have to rely on the honesty of the developer, snagging will expose any corners cut, as well as sub-standard workmanship, general faults and future problems - before you pay the final bill. Developers, contractors and builders have a deep-seated dislike for snagging professionals for obvious reasons, but snagging should not be ignored, especially in the early stages of your build when it is necessary to select a suitable contractor. Once the contractor knows that you are employing the services of a professional snagger, you will see the chaff fall away from the proverbial wheat as quickly as leaves fall in Autumn. This also means buyers and sellers know their property was not only built by professionals, but checked by professionals. A win-win situation. Snagging will also help in the sale of a property. Once it has been snagged and recorded as such, the buyer can be sure that no major defects exist and that the property was developed and built to a high standard. It's important to remember a proposed build will be best served by the early involvement of a snagging company. Snagging services offered generally start with the foundations and go right through to completion checks (back snagging). They can also be tailored to suit the needs of the particular project, so stage payments can be set-up in line with a snagging report, ensuring good workmanship and contractual compliance throughout the entire project. "Both big and small developers tend to ignore due diligence with regard to snagging procedures. In fact, some small sub-developers offer excellent snagging procedures, while some large developers make a poor effort," said Raff from SIMS Property Management Services. "Previously, because of the development frenzy on Samui, developers at times ignored snagging altogether. Now that the market has stabilised, there is no excuse left for ineffective snagging procedures." According to SIMS, during the hand over process, buyers should get a Defects Liability Period (DLP), a kind of warranty from the developer that lasts one year from the handover date. But The DLP only covers specific equipment like air-conditioners and water heaters for failure. Maintenance is not covered under the DLP and other defects such as fixtures are the onus of buyers to replace. In addition, some developers may not provide their clients with updated project documentation. If these documents are missing, then it will be difficult for owners to confirm promises made in the original contract. "If developers do not undertake snagging on their properties with the intention of clearing any cosmetic errors, they will only look at it from a construction point of view," continued Raff. "Snagging from an owner's perspective should therefore only be carried out by a professional property and facilities management firm." Renting a Private Villa Information provided courtesy of Samui Villas and Homes LTD Koh Samui is becoming one of the private villa capitals of South East Asia, matched only by places like Bali and Phuket in terms of the sheer number of luxury private residences for short and long term rent. As a result, agencies abound and competition is fierce for owners hoping to generate and income from their property while they are not in residence. Fortunately, the concept is taking off worldwide, so demand for these personal retreats is on the increase. Marc Ribail is Chief Operating Officer for Samui Villas and Homes Ltd, the island's biggest and most successful villa rental and management Akuvara company. He believes that even with last year's economic slow down, people increasingly see villas as an attractive holiday option. "It's no more expensive to rent a villa than stay in a good hotel," he said. "Families don't mind sharing a property if it means they can enjoy a more personal, independent holiday experience. Most of the villas on our books offer the same or better facilities than a resort, but with the bonus of privacy and the freedom to choose a bespoke vacation." SVH pioneered the concept of full service villas on Koh Samui, an approach that has now become an industry standard. Private villas come with a team of staff to clean, prune and take care of guest requests, while the low cost of provisioning means it can actually be cheaper to have meals prepared in-house by a personal chef than to eat out every evening. Self catering is also an option that appeals to many guests, particularly on Samui where shopping for food is as easy as it is back home. This makes the overall cost of renting a villa surprisingly competitive. One thing that gives Samui Villa and Homes a serious edge over the competition when it comes to villas rentals in South East Asia is that 90% of the properties in their portfolio are located on the beach. This makes them popular not only for families but also for people in search of a dream wedding location or special celebration. "The wedding business has helped us enormously during the recent downturn," explained Ribail. "The option to get married in your own private beach residence is definitely high on most people's wish lists. On Samui, you're spoilt for choice." Of course, designs, facilities, locations and therefore prices for villas vary considerably, with super luxury 5, 6, even 10 bedroom palaces costing anything from two to five thousand dollars per night. But there are also plenty of mid-range options and these still boast special touches like private infinity pools, dedicated TV lounges and outdoor bathtubs overlooking the views. With a little research, sharing with friends you can enjoy all these privileges for as little as $50 a night each. For vila owners and property investors, of course, being able to compete with resorts is a major factor and as people look for more options and offers, the private villa market looks set to grow and diversify. Flash Packers Over the last few years there has been a shift in the types of tourists coming to Koh Phangan. In years past it was backpackers who stayed on the island for two to three months at a time looking for cheap beer and budget bungalows. These days it is the “flashpackers” and tourists that can only stay on the island for less than a week but who have more money to spend while they are here. This group are keen to be more active and experience some of the more expensive excursions the island has on offer. Fine dining establishments are also getting a boost from this more refined group. As a result of the changing tide of tourists, the island has seen upgrades in its infrastructure, resorts and restaurants. Several new well planned roads have been built on the island, making travel between destinations a lot quicker and easier than before. The island has seen upgrades to many of the existing resorts as well as many new high-end resorts starting to appear around the island catering to those with a little more money to spend and looking to spoil themselves. Restaurants have also followed suit, with a much larger range of choices now available to travelers and locals – so whatever your taste-buds are calling for, you won’t be disappointed! The stand out feature of Koh Phangan is definitely its ‘green’ appeal. With over 70% of the island designated as National Park (and therefore not able to be developed), the island will continue to have that tropical island feel even as it becomes more developed in the future. Many new residential developments on the island are staying true to this idea and are incorporating eco-friendly features in their building designs as a way of promoting the island as a natural destination to holiday and live on. Koh Phangan does not fall short on attractions and activities for all types of tourists. Of course for party goers the island offers many opportunities to let loose. However, Koh Phangan offers so much more than the party scene. There are some wonderful hiking opportunities, snorkeling and diving locations, year-round waterfalls, pristine private beaches, beautiful temples and boat trips to offshore islands. Since the new Samui government was elected last year, there have been definite signs of positive change. Infrastructure issues around the island are being addressed more quickly, grievances are being heard and greater co-operation with provincial departments, businesses and individuals is producing results. Asphalting the roads is the first of several projects planned for the island and the Samui Municipality says it is determined to push forward with effective solutions. It's been a long time coming, but finally Koh Samui has its asphalt road and according to the Thesabaan (Municipality), the entire island will be a much smoother drive by the end of the year. After lengthy discussions with the Highways Department, the current Samui administration managed to a secure a joint budget and set a realistic schedule. The first phase was designed to complete most of the Ring Road in time for a planned visit by Crown Prince Vajiralongkorn in early 2010, to officially open the Samui Court. Phase Two will begin later in the year, with the aim being to tarmac all the island's main access routes, including the most popular side roads. The initial road work was carried out by three separate contractors selected from the mainland, all of which have extensive experience laying asphalt roads. According to the engineers, laying tarmac over the existing concrete is a viable approach, as long as the correct bitumen mix is used and tests were carried out to ensure success. "We applied the tarmac first on the stretch of road from the main ferry terminal," explained Khun Sinn Muenslip

"That section bares some of the heaviest loads and sees the most continuous flow of traffic on the island, so we were able to see exactly how well the mix coped with constant use. It was particularly important to find the right level of elasticity, but also to prevent the tarmac shifting too much under pressure. " Such attention to detail is one of the Samui Municipality's priorities. In order to avoid the mistakes of the past, the current administration is keen to make sure the projects and solutions they apply last well into the future. "Thorough research, consultation with experts and clearly structured project plans are essential," continued Khun Sinn. "The road project also includes improving drainage and widening the roads where possible to ease congestion in the future and allow space for possible mass transit solutions." The expected life span for the new asphalt roads is between 5 and 8 years. Obviously, on a tropical island with extreme heat and heavy rainfall maintenance is more difficult than it would be other locations. Water could seep under the road and cause subsidence, for example. But there is a budget set aside for repairs and the works department will make regular checks. "As long as we have a mandate to manage the island's development we will follow up and maintain all the projects we start," Khun Sinn affirmed. "It is important to take a long term view and make improvements that will not only benefit us now, but also help future generations of residents and visitors." As part of this forward thinking approach, officers at the Municipality are also working on a proposal to give Samui more autonomy and therefore greater control over its projects and budgets. The island was given intermediate City Status last year, but based on other locations such as Pattaya, local leaders feel that applying for full City Status is not necessarily the right option for Samui. Standard local government structures do not take into account tourism as a major factor. They are therefore hoping to secure special status for the island that will allow for a dedicated Department of Tourism, as well as other administrative systems that specifically apply to Samui. "We need to apply policies and laws that make sense for Samui, " said Khun Sinn. "Taxes should be used to benefit both the local population and the tourist infrastructure. We are keen to apply our inside knowledge now to create a more beneficial system of local government that is not only relevant to Samui, but also balanced and fair." The road project is one of several pressing issues facing the Samui Municipality this year. Having inherited some serious problems, they have now set priorities to research and address. The next big project is waste management. The island's incinerator in no longer functioning, so a lined land fill site has been created to deal with rubbish. Meanwhile, garbage separation systems are being developed to prevent further damage once the incinerator is repaired. "When it comes to infrastructure, we started with a serious deficit," explained Khun Sinn. "Now is the time to apply all the resources we have to find practical, lasting solutions."

These small creatures are available throughout Thailand to purchase and work as very effective pest controllers. Hedgehogs are a powerful form of pest control. A single hedgehog can keep an average garden free of pests by eating up to 200 grams of insects each night. Hedgehogs feed on insects, snails, frogs and toads, snakes, bird eggs, carrion, mushrooms, grass roots, berries, melons, and watermelons. They hunt cleverly , even when it comes to dangerous prey such as snakes. The hedgehog runs towards the snake and bites its tail, then immediately curls up and becomes a thorny ball. When the snake attacks the hedgehog with its head to force it to leave, it impales itself on the thorns. Once the snake is wounded, and loses energy from blood loss, the hedgehog starts unfolding and eventually eats the snake. One problem with using hedgehogs for garden pest control is the use of chemical insecticides. While the hedgehog is large enough to resist most insecticides, it cannot withstand

them if it eats insects that have become full of poison. This causes many hedgehog deaths where pet hedgehogs eat contaminated bugs within the house and garden, so it’s best to make sure that any sprays used around the home or garden where hedgehogs are present are non-toxic and eco-friendly. Hedgehogs are also nocturnal. They become most active at dusk and hunt through the night. Their natural food supply should also be supplemented and it’s generally best to feed them at dusk, after all the flies have gone. Any leftover food should be removed in the morning before any flies arrive.

Koh Phangan News Flash Koh Phangan is heading into 2010 full steam ahead. Major works and upgrades are planned for the island's roads this year, with the biggest news from the local government being the planned upgrade of the road from Ban Tai to Thong Nai Pan, which will improve access to two of the island's best beaches. The government has committed 107 million THB to this project and construction is already underway. Property prices are likely shoot up in Tong Nai Pan the near future. A new restaurant has recently opened in the Big Buddha area of Samui called the Dancing Crab. Its location is right on the beachfront overlooking the actual golden Big Buddha. The name itself comes from the small community of little fiddler crabs on the beach just next to the restaurant. They have one large oversized white claw and the local Thai people call them dancing crabs because they consider it similar to the way traditional Thai dancers hold their hands. Depending on who you talk to they are called Bpuu Manora- Manora is a variety of Southern Thai Dancing or Bpuu Raam Thai which is generic for all Thai Dancing. This great restaurant is a new venture from Mark Cullmore of the well known BBC CafĂŠ and you will find the food and staff as good as you would have expected at BBC.

The restaurant has a wide variety of seafood available in a fantastic setting and some special Dancing Crab dishes. Only the freshest ingredients are used, so while they want to satisfy all tastes it could be that sometimes a certain variety is not freshly available. Specialties of the restaurant are some of the secret sauces that go so well with the various crab dishes. These sauces are specially prepared for the Dancing Crab restaurant on Samui and cannot be found anywhere else on the island. You will find the location about 100m after the Big Buddha entrance, look out for the Dancing Crab and BBC signs.
