average length of stay (ALOS) dipping below 5 nights, a significant decrease from a high of over 7 nights in 2007. The trend reflects the travel patterns of a shift in source markets from the traditional European and American markets now overtaken by domestic travelers with the Thai market nearly doubling in size to make up 18% of all visitors to the island in 2010. In order to bypass the challenge of the high prices of the feeder airlines to the island, some economy hotels have partnered with low cost carriers (LCC) to stir domestic demand by offering flight-ferry-hotel packages, taking advantage of the landing opportunities in nearby provinces on the mainland.

ecently released research findings undertaken by the hospitality consultancy firm C9 Hotelworks revealed average occupancy rates on Koh Samui reached a healthy 61% in the first half of 2011, a 2% increase from the same period last year. The island-wide revenue per available room (RevPAR) jumped 12% y-o-y, boosted by a 9% increase in average daily rate (ADR) compared with the same period last year.
The same C9 Hotelworks Samui Hotel Market Update warned that despite an optimistic 10% increase in 2010 visitor numbers, the runway length of the airport "restrains charter flights from Europe, Russia, and China which are currently key market feeders to the competing island resort destination of Phuket". China ranks as the top Asian source market to Samui, however, it does not appear in the overall top 5 source nor growth market list for the island in 2010. This reflects a loss in opportunity, with the World Tourism Organization (UNWTO) reporting that China has now nudged its way to number 3 on the list for international tourism's top spenders, an explosive 400% increase in expenditure compared with just a decade ago that would have made up for the decrease in ALOS.
Leading the way for this growth are the upscale and budget tiers, a polarization that has left the midscale segment stagnant, and the luxury 5-star market improving slightly overall. Looking at the strongest segments, the upscale hotels saw an increase across the board for occupancy rates, ADR, and RevPAR, 10%, and 30% respectively, vis-Ă -vis the budget hotels which recorded a 3% dip in occupancy, however compensated with a 15% increase in ADR, resulting in a 9% boost in RevPAR. Not all the numbers spell good news for hospitality operators on the island, however, with the 2010

The same UNWTO report shows a diminishing travel radius trend, with 4 out of 5 tourists opting to stay within the same region, with regional Asia Pacific tourism growing at an average 5.6% per annum since 2000. Bangkok Airways (PG), former owners of the Samui Airport (prior to set up of the Samui Airport Property Fund) and main airline serving the island, recently signed a code sharing agreement with Silk Air with service to start at the end of September. Of the tie-up with the Singapore Airlines' subsidiary, Bangkok Airways' Senior Vice President Peter Wiesner has been quoted as saying "We are planning to capture more traffic from Singapore as well as from long-haul routes connecting from a major hub like Changi International Airport". Silk Air joins other existing code-share partners -- Etihad, Thai Airways, KLM, EVA Air, Air France, and Lao Airline. Bangkok Airways is also reported to be courting additional airline partners for a code-sharing deal, including Malaysia Airlines, and Finnair, which should capture travelers from those source markets respectively. PG is also in talks with Kingfisher Airline, which will allow Samui to get a piece of the lucrative Indian source market pie that Phuket has been enjoying in recent years, the latter boosted by the hosting of Indian Travel Congress 2010 with some 800 travel agents in attendance, a conference capability
that Samui has yet to realize despite years of discussions. PG founder Prasert Prasartthongosoth also revealed in August that the airline is looking at divesting a 30% stake for a possible initial public offering (IPO) in 2013, an SET listing that will pave the way for the self-dubbed 'Asia's Boutique Airline' expand further in the region. Players in all market segments are keeping a close eye on how the Samui airport and PG's situation will pan out, but for the forseeable future, the new arrival of global hotel chains to Koh Samui, with such brands as Intercontinental and Conrad slated to join the hospitality chorus in H2'11, is setting the stage to "inevitably aid in destination marketing, induce demand and inject a sense of excitement into the marketplace," says Bill Barnett, managing director of C9 Hotelworks, with both developments slated to open in the southern part of the island, diversifying from the traditional hotspot of Chaweng and Bophut. With positive numbers from H1'11, and with the international hotel chain's marketing muscles yet to be fully flexed, there are signs that Samui is set for a redefining new chapter.

5 Legal Tips Estate Planning in Thailand
home jurisdiction will protect assets located in other countries; however, this may not always be the case. According to international law, the distribution of immovable property such as freehold condominiums and villas is governed by the laws of the country in which that immoveable property is located. Conversely, the transfer of movable property such as jewellery and furniture is governed by the laws of the country in which the deceased was domiciled at the time of death. It is important to note that if an individual owns an interest in real estate through ownership of shares in a limited company, the asset which forms the subject matter of the will are the shares in the limited company and not the real estate assets themselves. In other words, Shares in limited companies may be deemed to be moveable property and not immoveable property.

lying into the paradise islands of Koh Samui and Koh Phangnan reveals an array beautifully designed residential homes and estates, many of which are own or available for purchase by international residents and travelers, who have no doubt taken careful steps to plan the acquisition of their tropical homes in order to safeguard their interests. Perhaps not surprisingly, these same persons often prefer enjoying the comfort of their residences in favour of planning for the day when they can no longer enjoy such worldly pleasures. Nonetheless, it is safe to say that these same persons would prefer to freely choose who will share in their estate upon death, rather than let chance and the hand of government decide for them.
Nonetheless, if you have any significant assets located in Thailand, it is recommended that you execute a valid Thai will. In the case of immovable property, if you die without executing a valid Thai Will, the assets forming the estate your estate will most likely be distributed according to intestate succession rules which stipulate that your property is distributed to the following people according to a set formula: spouse; children; parents; siblings; grandparents; aunts/uncles. Only true legally valid spouses are permitted to share in one’s estate according to intestate succession. Therefore, without a valid Thai Will, common law spouses and long-time partners will be totally disinherited of your Thai estate.
Jeffrey Martin, senior associate of the law firm Limcharoen, Hughes & Glanville (Samui) sets out five simple legal tips to consider if you have assets in Thailand and wish to plan your estate wisely.
1. Have your Wills in Order
While the distribution of movable property located in Thailand may not be subject to Thai law, prudent
People often assume that a Will executed in their 10
practice nonetheless dictates addressing such assets in your Thai will. The issues of one’s “domicile” and the characterization of “immovable” and “movable” assets in the court system sometimes produce confusing and contradictory results. Addressing movable property in your Thai Will mitigates the risk that such property will be distributed by Thai intestate succession and does not create any additional risks or disadvantages. However, it is also highly recommended that you consult a lawyer in the jurisdiction of your home or domicile, in order to properly address any movable assets located in Thailand. Subject to certain alternatives, in order to be valid, your Thai Will must be in writing, dated, signed, and witnesses by at least two other people, and should be executed within Thailand. While this process is relatively simply, you should retain a legal professional to advise you on your Will. The law pertaining to the interpretation and effect of Wills is complex, and requires adherence to specific language.
2. Select your Executor Wisely In your Will, you must appoint an “executor”, who will gatherup and distribute your assets when you die. It is generally imprudent to simply name a sibling or close friend as executor, simply because you trust that person. Often, the executor must come to Thailand, liaise with lawyers and Thai officials, and execute an abundance of Thai-language documents. This process that can overwhelming. It is crucial that you carefully select an executor who will be up to the challenge; or if you do not know anyone who is fitted for the challenge, you will have to consider other options, such as naming a law firm or another company to act as your executor. Fortunately, there are a wide range of options available to persons seeking professional or independent executors.
3. Check your Lease Agreements In Thailand, contractual rights, including leasehold rights, generally terminate upon the death of the entitled party, and may not automatically pass onto their estate. However, pursuant to section 374 of Thailand’s Civil and Commercial Code, you may include a clause written into any contract explicitly providing that your entitlements will pass onto your heirs. Therefore before entering into a long-term contract, such as a long-term lease, it is important to ensure that the contract contains a clause directing that your rights will pass to your heirs, the said clause should be carefully drafted in order to comply with Thai law.
4. Check your Corporate Structure Careful corporate planning can ease the burden on your executor. For instance, depending on the circumstances, if you are the director of a company holding assets in Thailand, you may consider appointing your executor as co-director which will allow him or her to take over managing the assets easily 11
after your death. It is very important that you seek advice from a competent professional before making any changes to your existing corporate structure, if any.
5. Review Periodically It is important to review the foregoing matters with your legal counsel periodically and after you acquire additional assets. The laws in any country may change on occasion, often without notice to the general population. Therefore it is imperative that you routinely ensure that you testamentary wishes are still protected. This article is intended to provide a brief overview of estate planning for international residents and travelers in Thailand. As in any jurisdiction, it is important to seek independent legal advice in order to address your specific proprietary interests and testamentary wishes. GOVERNMENT FEES AND TAXES PAYABLE UPON TRANSFER OF IMMOVABLE PROPERTY transfer of immovable property. Each land plot, house and condominium unit in Thailand has such an official appraised value and note, the Land Office’s appraised value is usually much lower than any actual market value/sale price.
(2) Income Tax (payable as withholding tax): When a corporate entity sells an immovable property, a “withholding tax” at the rate 1% of the sale price is required to be “deducted” from the sale price and paid to the authorities on transfer. The legal duty to withhold and pay this tax is the buyer’s. A surcharge on any late or inadequate payment of the withholding tax at a rate of 1.5% per month of the late paid amount is applicable. Since this is a withholding tax it is credited to (i.e. deducted from) the company’s income tax payable for that year.

wnership of land, house and/or condominium unit is transferred by a written registration at the authorized Land Department Office. The transaction is recorded on the title deed and/ or other documents. All supporting documents are kept in official records. In general, the current fee and taxes applicable to and payable upon the registration of ownership of immovable property are as follows:
When an individual sells an immovable property the withholding tax is generally calculated based on the appraised value of such property, in accordance with Section 49bis of the Revenue Code, less certain deductions. The deductions depend on the length of ownership of the property to be transferred. The calculation is done through a specific formula created by the legislature which takes into account how long the property has been owned and the progressive tax rates applicable to individuals, but (if the seller chooses so) without including any other taxable income of the seller.
(1) Transfer Fee: The transfer fee is an administrative fee pursuant to the Land Code and not a tax in accordance with the Revenue Code of Thailand. It is payable upon transfer of immovable property in Thailand at a rate of 2% of the Land Department’s appraised value of the property. The assessment of this value is made periodically by the Valuation Committee in accordance with the Land Code. The same valuation is actually also used as the basis for calculating the personal income tax payable upon
Please note that even if the transfer of immovable property is without consideration (i.e. a “gift”) by an individual, it will be deemed a “sale” subject to personal income tax.

(3) Stamp Duty or Specific Business Tax/ Local Development Tax: Stamp Duty of 0.5% of the Land Office appraised or the actual transaction value of the property (whichever is higher) is payable by the seller upon transfer. In general for individuals the Stamp Duty will apply if the land has not been transferred within the last five years, otherwise the Specific Business Tax/ Local Development Tax will apply. The rate of the Specific Business Tax is 3%. A Local Development tax at a rate of 10% of the value of the Specific Business Tax amount is further payable. Therefore, Specific Business Tax/Local Development Tax is payable by the seller at a rate of 3.3% of the Land Office’s appraised or the actual transaction value of the property (whichever is higher). Finally, please note that the above summarizes the government fee and taxes payable upon the day of transfer of an immovable property in Thailand. Koh Samui’s enduring appeal as one of the world’s top holiday destinations has inspired many people to relocate to the island, either choosing to make it their permanent home or spending extended amounts of time living what those in less blessed locations would understandably consider an idyllic lifestyle. In the last ten years, the island has developed into a full service destination and the range of facilities, amenities and services has therefore expanded considerably, making Samui one of very few places in the world where you can literally choose your preferences, both in terms of the way you pass your days and nights and also the amount of money you want to spend. Although the island’s tourist and residential worlds often collide, they can also be very distinctive. But in terms of choice, both groups benefit from the island’s incredibly diverse and eclectic offerings, whether in terms of accommodation, retail, dining, entertainment, health or adventure. As a long term resident on Samui, if you stop to consider the sheer extent of comfort and convenience on offer around the island today it’s sometimes difficult to remember that you are living on a small island in the Gulf of Thailand. As soon as you leave the beach you are spoilt for choice - shopping malls such as Tesco Lotus and Big C stock all the daily necessities and more, specialist outlets like Tops Supermarket and Villa in Lamai offer indulgent imported goods, while 7Elevens, Family Mart outlets and local shops make impulse buying a an easy option, even at 4 in the morning. A selection of fresh food markets also cater to an ever growing Thai community with everything from rice by the kilo to fresh Tiger Prawns sold by the kilo at what are very reasonable prices when compared to the deli counters of most western supermarkets. For those who prefer to dine out, Samui has developed a deserved reputation a s gourmet paradise with an enviable choice of restaurants, their menus often created by chef’s of international repute and wine lists that rival those in some of the world’s top city bistros. Excellent Thai food is also readily enjoyed, either roadside at one of the island’s many affordable local eateries or in more opulent surroundings accompanied by five star service and stylised, cultural designs and entertainment. The Samui party scene has also developed in leaps and bounds in the last few years, sophisticated Beach Clubs like Beach republic and Nikki Beach serve top class food and beverage choices in chic poolside surroundings. They also host regular parties with international DJs and performers. Western style pubs and nightclubs line the popular tourist strips, with sports bars like The Islander and Bondi in Chaweng showing live international sporting events. Those in search of a more healthy, green lifestyle on Samui can easily avoid the tourist bustle. The quiet beaches on the island’s south coast still feel relatively untouched by development and many small residential communities have emerged in places like Baan taling Ngam and Lip Noi, where the pace of life is slow and the tropical landscape still untroubled by crowds and commerce. Spas and wellness centres offer a wide range of treatments and therapies to rejuvenate tired souls, while yoga, meditation and other more spiritually inspired activities can be studied and practiced at various centres around the island. Families are increasingly well catered for on Samui and the island now boasts its very own International School (ISS), as well as several other learning institutions catering to to both Thai and expatriate students. The island’s clubs and organisations often organise family friendly gatherings, regular Walking Streets offer festival style outings and there are also several restaurants that cater for children’s parties. With so much on offer to residents, Samui has now become as much a place to live as it is a place to visit. It is now a multi-faceted residential island with an enviable range of services and facilities to choose from, all of which combine to offer permanent and long stay ‘Samuians” one of the most appealing and diverse tropical lifestyle experiences on the planet. 37

THAILAND'S BEST More than 1,300 developers, developments, property agents, architects and real estate companies were nominated by the public and their peers for this year's Thailand Property Awards. Last year's winner of the prestigious 'Best Developer Thailand' award, Golden Land, is up against 36 other developers who have been nominated in the flagship category. The 'Best Affordable Condo Development (Bangkok)' category, a new addition this year, will also see fierce competition, as will the categories designed to feature properties and companies in the country's top resort destinations. A significant number of Samui developers, property agents, and real estate companies are represented on this year's list of entries, plus a number of stand out projects on the island. In September, a select panel of judges conducted a series of site inspections around Samui in order to select a shortlist and their feedback was very positive. "The overall standard of entries is impressive," said Paul Ashburn from BDO Advisory, which oversees the judging process. "Although the rules prevent us from revealing any of the names just yet, suffice to say the entry list reads like a 'who's who' of Thai real estate." Companies and properties from Samui were nominated in a range of categories, including Best Boutique Developer, Best Residential

CROSSING BORDERS Southeast Asia’s residential properties are now counted among the most sophisticated and impressive in the world and Ensign Media launched the first ever South East Asia Property Awards to recognise the crème de la crème of the region's residential real estate industry. Land Title Deeds in Thailand There are two main types of land ownership in Thailand which we should explain
Rights of Possession Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.
Rights of Ownership Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

Tips for starting a new business Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares. Getting started To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section. Shares Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders. Shareholders and Chairperson A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company. However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government.

Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession. Little things that matter A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. VISAS & WORK PERMITS I have recently been asked to clarify the way the Thai system works with visas and work permits if you are opening a company here and would like to have a work permit. Firstly I must point out that each Thai province does follow slightly different guidelines and my information does in no way substitute you actually having a legal consultation with a reputable lawyer’s company if you actually intend to work. There are those that believe the little they would do in reality would make a work permit hardly worth the trouble. This is a big mistake and one that could cost you more problems than you would believe. The Thai Immigration takes cases of foreigners working without a work permit very seriously and the penalties are harsh. If you are here on a tourist visa you cannot in any way participate in a job. So let’s have a look at what’s actually required to apply for a work permit. Firstly you need to have a business class visa which in most cases will have to be applied for at a Thai Consulate outside of Thailand. There have recent changes to the system, whereby smaller Thai embassies such as the one in Penang, Malaysia, have stopped issuing multiple entry visas. Initially there were those who whispered that the only way to arrange these multiple entry visas was for the individual in question to return to their home country and obtain the visa from their local Thai embassy. This however had been proved to be incorrect with the embassy in Kuala Lumpur still issuing multiple entry visas until recently, but currently the situation remains in a state of flux with even legal professionals unsure as to the long term guidelines. We therefore strongly advise obtaining up-to-date legal advice well in advance of pursuing your visa run, to ensure you are fully equipped with the documentation currently required for your business visa. Those working in Samui who earn a salary of 50,000 Baht per month however, shouldn’t have to face these visa run hassles, as they’re entitled to a business visa that only needs to be renewed once per annum at an immigration office. Further details of this scheme can be obtained via a legal professional or at the local immigration office in Na-Thon. Either way, once you have the correct visa, you’ll be able to apply for or renew your current work permit. Once again there are procedures required for this, which your legal professional will prepare for you. This process might seem tedious, but it is nothing unusual, with every country having its own procedures and legal applications. Thailand is no different and don’t be fooled by the laid back and casual attitude of many Thai people on the island, as this is no reflection of the order required in any formal legal requests such as visa or work permit applications. When it comes to legal matters you need to ensure you follow the correct procedure and can produce the appropriate paperwork. All in all, it is easy to see why the services of a professional and thorough legal company are invaluable, saving you much confusion, stress and potentially time and money. 96

Evil Weed The
W
e’re all familiar with the much maligned ‘weed’, or at least the notion of what one is. Weeds are not of any particular species, they merely share the common quality of being particularly adept at surviving attempted annihilation. The weed is defined by its location. It just happens to be in the wrong place at the wrong time. These plants are usually the indigenous species of the area which we’ve decided to cultivate. They are, by their very presence, the most suitable, naturally occurring plants of that locale. The secret of their survival often lies below the soils surface where frequently produced seeds can rest dormant for years before germinating. Some weeds also disperse huge amounts of seeds when disturbed. Many perennial Thai weeds reappear from fleshy root networks left behind after hand weeding.

Hand forks or grubbers (3 or 4 pronged claws) are best used for borders where loosening the soil around the roots of the weed makes removal with a pull at the base of the plant pretty easy in most cases. Regular hoeing of the soil is another method of destroying weeds in regularly cultivated areas. The Dutch hoe, which many Europeans are familiar with, is not generally available in Thailand but the local equivalent; the ‘chob’ performs the same job and is available in a few different sizes. The principal is to chop apart the weeds with a horizontal slicing motion. This will need to be a regular activity, as dormant seeds below the surface will continue to germinate. The ardent gardener will, however, find less weeds appearing over time, as the Stockpile of seeds is gradually exhausted.

When removing weeds form borders and lawns, it is important to uproot the whole plant. This is not always an easy task due to the slender stems of the

this is so easily achieved since producing lush, verdant lawns is a full time occupation in this part of the world. Nevertheless, without going in to too much detail, timely fertilizing with a good high nitrogen, time release fertilizer is a good start, as is watering at the best part of the day to promote maximum absorption (about an hour before sunrise). Hand weeding is, for those with strong backs, the best way to remove weeds from the lawn. Be sure to wear tough gloves for this as some local weeds have sharp thorns. One of these is a type of Mimosa, prevalent in the region, which often appears in lawns, clinging low to the ground and particularly unpleasant when discovered with bare feet. This weed can be identified by its ‘seismonastic’ movements, an ability to open and close it’s leaves in response to being touched as well as other stimulus. Taking hold of the base of its woody stem and gently pulling removes the plant with its roots in most cases. It may help to soak the ground should the roots resist.
Herbicides These chemicals should be avoided if possible and viewed as a last resort. Post emergence herbicides kill weeds, either by contact, or by being absorbed by the plant and destroying it systemically. They are also classified as being either selective or non-selective. The most commonly available herbicide is Glyphosate familiar to many Westerners by the trade name ‘Roundup’. This is a non-selective herbicide and will systemically destroy any leafy plant. Henceforth, great care should be taken in identifying the chemicals you may purchase and appropriate research of their classification and recommended usage must be undertaken.
Alternatives For small areas, weeds may be attacked with boiling water, although one dousing may not be sufficient. A thick layer of mulch or clippings on weedy patches can also be effective in starving weeds of light and moisture. The determined and regular gardener, with some effort, can stand back at the end of a hard day's work and enjoy a garden free from weeds. The secret life of Cockroaches Though most people don't give cockroaches a second thought, other than where the closest broom is, here are some trivia facts about one of the world's most primitive winged insects. • The world's largest roach lives in South America, and is six inches long with a one-foot wingspan. • American cockroaches can run up to three miles in an hour. • There are some 5,000 species of cockroaches worldwide, including the North and South Poles. In extremely cold places, they survive by moving in with humans. • Roaches can go without eating for a month but will only survive a week without water, which is why a cockroach can live for only a week without its head. • It's hard to sneak up on a roach. They have one big nerve connecting their tails to their heads, alerting them to dangers from behind.

• Roaches can swim and hold their breath for 40 minutes. • Roaches shed their external skeletons several times a year. If you see a white cockroach, it has just shed its skin, and will regain its regular shell coloring after 8 hours. • Processed cockroaches have been used to cure illnesses and physical disorders for centuries. Cockroach tea has been used to treat dropsy, powdered Oriental cockroaches as a diuretic cure for stubborn urinary tracts, fried cockroaches to help with indigestion, and cockroach mash as a poultice for sting ray wounds. • Cockroaches spend 75 percent of their time resting. How can you tell if a cockroach is resting or trying to remember what it came into the room for? Resting roaches point their antennae up and forward, at about a 60 degree angle from one another. • Cockroaches can crawl into some astonishingly small spaces. Young roaches need only a crevice .5 mm wide. Adult males can squeeze into a space of 1.6 mm. • The cockroach was once considered a guest of honour in European homes, and it was customary to release them in new dwellings. • Some people develop allergies to cockroaches, including skin rashes and respiratory problems, such as a condition similar to asthma. Stunning beaches, an affordable lifestyle and an appealing island environment have drawn a growing number of visitors and residents to Koh Phangan’s tropical shores. Many of the island’s visitors choose to stay longer than they originally planned and this has led to the establishment of a sizeable foreign community of long stay tourists, working residents, business owners and retirees. The number of foreign investors choosing Koh Phangan as their second home is increasing every year, with easy transport access, a fast developing infrastructure and a range of lifestyle and hospitality services all adding to the island’s growing appeal. Koh Phangan is a rare island escape just a short boat ride from Koh Samui’s more developed and commercial environment. This means residents and visitors can enjoy the unspoiled beauty of some of Thailand’s finest beaches while still having access to the comforts and benefits of a modern lifestyle. The recent growth in the number of luxury hotels and private villas on the island has prompted the emergence of more upmarket retail, dining and entertainment choices, with cool nightspots and restaurants opening in the more popular beaches like Haad Rin and Thong Nai Pan. As Koh Phangan evolves from a backpacker haven into a full service destination, the island is attracting those with the spending power to combine natural escape with a sophisticated island lifestyle. On a practical level, the opening of a modest Tesco Lotus Supermarket, combined with a significant increase in the number of foreign run businesses has had a real impact in terms on the ease of living on Koh Phangan. Designer boutiques, international cuisine, real estate agents and developers are all gradually changing the island landscape, yet the laid back lifestyle has thus far survived and the local people are known for their commitment to 127
preserving their traditional culture. Whether selling the daily catch from their boats, chatting with friends in the shade of the village ‘sala’ or celebrating weddings with dances and local music, local people remain distinctively Thai in many ways. As for the foreign residents, the ease of life, natural beauty and diversity of lifestyle choices make Koh Phangan a unique destination as either a permanent or second home. Koh Phangan real estate Koh Phangan’s real estate sector has grown as the island has developed and become more popular with visitors from around the world. Investment opportunities abound, whether it is raw beach and mountain land, off plan residential purchases or completed luxury villas for sale. Restrictive ownership laws in Thailand, however, mean buyers are advised to go through reputable law firms when considering any purchases on Koh Phangan. As is the case on Koh Samui or Phuket, it is important for anyone considering an investment to thoroughly research the laws and regulations, as well as to ensure that any land titles are thoroughly checked and that the most secure method of purchase is found to guarantee a trouble free, long-term investment. Investors should also look into the track record of any construction firms they employ to guarantee that their reputation is solid and that any previous projects have been successfully completed. Island development Recent road improvements have made Koh Phangan significantly more accessible to visitors and potential residents. Work is ongoing in several areas, particularly on the road that links Ban Tai with Thong Nai Pan, as well as the mountain pass that connects the west and east coast beaches. This means it is much easier to travel around the island and therefore also more convenient for long stay visitors to base themselves on a particular beach and head out for shopping, dining or entertainment. A planned airport has yet to be confirmed on Koh Phangan with local people both for and against such a move. Various plans have been discussed, but the island’s geography 128
means construction of an airport would be expensive and complex and may even involve land reclamation or the creation of a floating runway. Phangan Hot Spots Haad Rin was made famous by the monthly Full Moon Party and consists of two sweeping beaches known as sunrise and sunset and connected by a small but thriving tourist town on the east tip of the island. Haad Rin has become a bustling centre for shopping, with a large selection of retail outlets offering beach wear, jewellery, crafts and souvenirs. Haad Rin also boasts a handful of modest medical centres, but for serious conditions patients are transported to the larger and better equipped hospitals on Koh Samui. Baan Tai beach is a small oceanside community situated around half way between Haad Rin and the port of Thongsala. Most of the beach resorts in the area have their own Thai and western restaurant, and the village that lines the road has developed into something of a modern hippy enclave, with a bakery and a handful of international cafes. Haad Yao has long been a popular holiday location and is easily reached by road from Thongsala. The beach is known for its fabulous sunsets and the laid back feeling that Koh Phangan is well know for. A good selection of beach and village restaurants serve both tourists and long stay residents, with tasty Thai food and western favourites all available. There’s also a good bakery serving fresh bread. Chaloklum is one of the island’s largest fishing villages and still offers fishing boats a safe harbour during the storm season. The long, secluded beach is a picturesque idyll and the village that has grown along the coast now boasts a diverse bar and restaurant scene, known to many residents and regular visitors for its fine seafood restaurants and water sports centres. Haad Salad is on Koh Phangan’s west coast is known as a quite, family oriented beach, lined with resorts but with some new residential offerings in the surrounding hills. Located down a steep hill from a hillside road, the beach has retained a remote feel but still offers plenty of good food and recreation choices. Thong Nai Pan on the North East coast of Koh Phangan is home to what many people feel are two of the best beaches in Thailand. Tong Nai Pan Noi (small) is the location for some of the island’s most luxurious accommodation, while Thong Nai Pan Yai (big) features a range of mid-range resorts-restaurants and a luxury private development at Thong Nai Pan Estate. Both beaches are also the chosen location for new residential projects in the nearby hills. Other popular beach areas on Koh Phangan include Bottle Beach, a peaceful desert island destination, Sadet beach, home to Koh Phangan’s most famous national park, as well as Had Thien and Had Yuan beaches, only accessible by boat and famous for their wellness centres and peaceful tropical surroundings. 129

Biomass gasification offers an alternative to conventional fuels with wood, charcoal and other materials gasified to create a so called producer gas for power, electricity generation and even products. In the second of a two part feature, Samui Phangan Magazine explores a process that could help the world's resources last longer. The essence of bio-gasification is the conversion of solid carbon fuels into carbon monoxide using a thermochemical process. The gasification is quite complex, but if successful, Biomass energy can be used in different ways for both heating and cooling systems. In recent years, the biofuels industry has received a lot of attention from small companies, many of them developing new technologies to produce bio-based alternatives to gasoline. The industry is also now poised for the large scale commercial introduction of fuels with multinational companies such as BP and Shell developing bio-based processes for large scale production.
Air saving biofuels Ethanol and biodiesel are the two mostly available biofuels, the former prepared from the starch present in corn grain, which can be added to petroleum-based fuels for the reduction of toxic air emissions as well as increasing the percentage of octane. This type of biofuel is already available as a commercial fuel commonly called E-85.

Biodiesel, which is also a a popular renewable alternative is made mostly from soybean oil. Although it is not quite as popular as ethanol yet it has noteworthy benefits to air quality. Biodiesel, when mixed with petroleum diesel at a ration of 20%, it is then referred to as B-20.
Bio-products save energy The same process used to create biofuels can also be applied to create antifreeze, glues, plastics, artificial sweeteners as well as toothpaste gels. Bio products require a small amount of energy for production when compared with petroleum based products and a process known as biosynthesis can also be used to make photographic film. When biomass is heated in the absence of oxygen, it produces pyrolysis oil and combustion tests have showed that fast pyrolysis oils can replace heavy and light fuel oils in industrial boiler applications. Heating and cooling systems account for over 56% of the energy used by domestic consumers and are also the largest energy expense for the majority of homes. Biooil has been approved and successfully used as a fuel for utility boilers in some heating applications in Sweden, while here in Asia on a larger scale, a Malaysian Company, BTG, has routinely used Bio Oil to replace expensive diesel in a combustion plant near Kuala Lumpur International Airport.
A great leap forward Researchers in the US recently created a gasification process that doubles the amount of fuel that can be converted from biomass. In traditional reactors, only around half the carbon in the biomass was converted to carbon monoxide, but using a new type of reactor, researchers have been able to convert all the carbon dioxide in the biomass and methane. This means all of the carbon dioxide in the biomass can be used to create biofuels, a huge step forward in boosting the process’s efficiency. Scientists are still perfecting the system, but they say it could be market ready in as little few as two years. Bang Rak Health Care Centre Bang Rak Health Care Centre was officially opened last month by Mr. Ramnate Jaikwang, Mayor of Samui, who presided over the opening ceremony. The planned construction of several new Health Care Centres is designed to provide better public medical services on Samui for easy-to-treat illnesses such as colds, fevers, stomach-aches. The municipality has provided a budget of around 20 million Baht for the project in order to offer one-stop health service care for the island. Another important project for the Department of Public Health is the "ten-thousand patient hospital".The Division of Public Health has made ground inspections for this new project already with doctors from Koh Samui Hospital and volunteer health workers. In the meantime, the municipality suggests that if anybody has trouble reaching the Health Centre in Bang Rak, the municipality can provide an emergency ambulance to pick them up. The Deputy Mayor, Khun Surapong is also preparing a medical team to help patients who cannot help themselves or ones who have difficulty reaching the hospital. The municipality would also like to invite residents to subscribe to its Senior Health Care Programme and the Division of Public Health and Environment has accelerated the development of a volunteer team who are being trained to provide emergency care and can help people on the island when they require fast medical attention.
