Neutral Charge Bland, boring, lifeless – neutral colours get a bad rap when it comes to interiors but you know what? You can create an incredible space indoors using layers of various shades of neutral colours, making it chic, sophisticated and allow you to use as a blank canvas to decorate with furnishings and other adornments. So how do you go about using neutrals to create a timeless interior and what should you avoid?

Colour Sounds odd, but once you have chosen your neutral colour – be it beige, grey or cream – using several shades of that one colour will create depth and contrast. This is not limited to paint. Drapes, chairs, cushions, sofas – use many different shades of the one colour to create a layered feel to the room.

Shapes When you take away pops of colour as part of your design element, you need other interesting visuals to break up a room and make it shine. Colour Don't be scared to add a small pop of colour to your neutral palette – but use it sparingly. If you have an all-gray room – a pop of red works perfectly. An all beige room, a pop of blue works harmoniously but stands out to give it a punctuation that can make a huge difference.

So don’t be scared to create a blank canvas and allow yourself to discover the beauty of neutrals. You can achieve a sophisticated look using whites, taupe, beige, natural fibers and most popular in recent years gray and as well as creating an airy space, neutral colours bring with them a sense of serenity, peace and calm – which is what we all seek in our homes.

Chinese investment in Thailand the wake of the dragon? Fleeing away from a stressful and crowded ultra-urbanized world, more and more successful Chinese men and women come to seek shelter for peace and relief, away from pollution and never ending traffic jams on the sandy beaches of Koh Samui. Driven by an important economic growth generating numbers of high income job opportunities, year after year increasing Chinese middle class enforces the demand for all kinds of goods, services and valuable investment opportunities all over South-East Asia, profoundly impacting and reshaping the economic background wherever they are present. A tendency that is likely to be accentuated by the development of the ASEAN free trade zone, strengthening the ties between all the neighbours of the region. Thinking of the real estate market we then may wonder: are the realty investment opportunities offered by paradise tropical jewels such as Samui a new Eldorado in the eyes of Chinese investors? The answer will undoubtedly be yes. Located in the heart of tropical South-East Asia the Island displays 2 main advantages. First: proximity, a few hours flight away from big cities and economic cores of PRC it offers the possibility of an easy and radical change of climate and environment to businessmen that can’t get too far from their CBD skyscrapers office. Second: a very seductive mix between its wild natural beauty, ultra-low air pollution and modern comfort, excellent infrastructures as well as healthcare and international education systems. Above all this, compared to other hot investments spots in the country such as Phuket, Hua Hin or Pattaya, Samui still offers an excellent compromise regarding prices, excellent land plots availability and attractive ROI expectations in a Chinese-friendly and culturally close environment as you already notice by counting the number of Chinese temples on the Island. As persons involved in the real estate business we may then ask ourselves how to catch the dragon’s tail before it’s too late. How to please Chinese investors by presenting them the appropriate selection of goods that will suit their tastes and fulfil their needs? Is there an easy way to picture the ideal house or apartment for a couple of young Chinese white collars? Or for a sympathetic Grandparent whose desire is to receive his family during holidays and enjoy the sea view from his balcony after a life of hard labour? Of course the long cultural tradition of China also has its own rules and habits when it comes to defining the proper way to organise your home. What about Feng Shui? The art of wind (feng) and water (shui), is already very well known all over the world and many have been convinced by the necessity to organise a fluid Qi circulation into the house to increase the good fortune of its habitants and avoid any kind of troubles for the whole family. But studying Feng Shui may plunge us into a lot of complications and we don’t have time to do so here. Of course there are also more simple tips that could be useful when meeting potential Chinese buyers that don’t need too much time to be understood. For example, you should, at any cost, avoid to show a bedroom with mirrors to a Chinese person. A mirror close to a bed would be seen as a sign of evil influence and provoke rejection. In the same perspective, a tree too close to a house wall will be seen as negative and should also be avoided. But what will most surely draw their attention will be the overall quality of the good lighting, materials, and the promise of making a great investment at a great time. Never forget one thing, Chinese are excellent at seizing opportunities and that’s what should be your first concern when dealing with this ever-increasing market. Southern property market comfort from tourism The southern property market has bottomed out after falling rubber prices threw the region’s economy into the doldrums in recent years, says the Bank of Thailand. Wajeetip Pongpech, the central bank’s director of risk management policy, said the property market, particularly in major southern provinces, was recovering thanks to tourism. “There’s still a silver lining despite the sluggish period, as the tourism sector in key southern provinces grew by 25.7% during the first five months of this year,” she said. In Phuket, Songkhla and Surat Thani, the tourism industry rose 7.2%, 61.5% and 24.7%, respectively. Chinese were the major tourist arrivals in Phuket, replacing the Russians and Malaysians that drove Songkhla’s economy. “Government spending is also a major factor that will help to drive the southern economy in the second half if rubber and fisheries remain weak,” Ms Wajeetip said. She said only the strong developers remain in the market, which is growing in emerging destinations such as Phangnga, Krabi and Trang as indicated by the increasing number of construction areas that won construction permits. The Real Estate Information Center (REIC) said Phuket residential supply last year was 73% sold, with single houses and townhouses 75% sold and condos 72%. However, the absorption rate of condos shrank to 4.9% a month from 9.4% last year. Thanusak Phungdet, president of the Phuket Real Estate Association, said the province’s condo supply was worrisome due to oversupply. The REIC reported 5,455 condo units remaining for sale from 19,710 total units at the end of last year, the largest of any destination. Mr Thanusak said a new trend in the Phuket condo market was some projects now offered a guaranteed return to buyers for five to seven years from developers that rent out units to tourists. Despite a tourism recovery in the province, average spending per head remains lower than in past years when Europeans dominated tourist arrivals, he said. www.bangkokpost.com

The Marine Department will also examine what facilities would be required to service the operation. Mr. March Chidtaphon Pongprueksa - Real Estate Manager of Luxury Villas and Homes to find out where he fits in the Samui world of Real Estate. What brought you to Samui?

I call it destiny. All my life, I had lived in Bangkok. However, when I met my girlfriend at college (who is my wife now), I didn’t know that her home town was Samui - I then had the chance to visit this paradise island. I realised I had no reason to go back to Bangkok.

What did you do prior to Samui and have you always been in Real Estate? I was in the hospitality business for almost 10 years both abroad and in Thailand. However, I have worked in Real Estate for almost 5 years now and mainly in the Samui Market.

How did the samui villas & homes come about? Samui Villas and Homes (SVH) was established in 2001 by a group of individuals who had already built villas on Koh Samui in the early 1990s. The initial idea was to use the company to manage and market these villas as short term vacation homes. However, due to the long property experience and background of the partners involved, combined with market demands, SVH has expanded to provide a full range of property services including luxury villa management, project management, estate agency and property consultancy. After having opened an office in Phuket the company rebranded and is now known as Luxury Villas and Homes (LVH).

Where are your offices located? Our office is located in Bophut about 5 mins from Fisherman's Village.

What kind of services do you offer? We have several arms to the business

Estate Agency LVH, through its dedicated agency department, EPSamui has acted in the purchase of many high value sites on Samui, mainly on beachfront land, in Bang Rak, Choeng Mon, Maenam, Lipa Noi, Lipa Yai and Laem Sor. Villa Management LVH now has under management on Samui some 100 completed villas in various parts of the island. Weddings and Events LVH has operated for some years a team which is dedicated to the provision of quality Weddings and Events under the Brand name, The Signature Weddings.

Any tips your recommend to anyone looking to build? My main tips would be • Choose your architects and contractors wisely to minimize mistakes and unwanted costs. • Understand the location and weather in Thailand and especially Samui and build/ design accordingly eg. Being a tropical region avoid using materials such as wood as much as possible. • Last but not least, choose the right water system, there are 3 ways to get to water in Samui 1. Town’s water supply 2. Deep-well water 3. Rain water You should preserve and purify your water wisely.

Clean Freak Cleaning can feel like a never-ending task – thankless, boring and repetitive. We’ve put together some tips to make the job easier and make your home more sanitary. Scrub-a-dub-dub!

On the go If you plan on cooking dinner or lunch, fill up your sink with soapy water and as you cook, you can place used pans, pots and plates in the sink so they have the chance to soak while you eat, making it a much easier job when you’ve finished your meal. Also, any spills while you work – clean when you make them – or they can stain and be hard to get off later.

Sink Sanitary The kitchen sink has more bacteria than your toilet! You should regularly clean your sink to keep the nasties at bay – start with soap and water first then follow with some vinegar and hydrogen peroxide and let air-dry. If your sink is stainless steel, make it sparkle afterward by putting a few drops of mineral oil on a soft cloth and buffing. Not only does this prevent water buildup, but it deters mould and keeps the sink looking clean longer.

Dishwasher Do’s Food and stains can stick to your dishwasher, so once a week, get a damp sponge and shake some baking soda on to it and scrub all the edges and remove all the stuck on bits. You should also run an empty cycle once a week with a specialized dishwasher cleaner (there are a few available from Home Pro) – this will get rid of bacteria and keep your dishwasher safe and sanitised after the rinse cycle is finished.

Oven Lovin’ There is nothing worse than having to scrub your oven, all that oil and grime that builds up – so keep this to a minimum by lining your oven with a non-stick ovenliner which can then be cleaned and reused time and time again.

Sponge Blaster Sponges are the biggest breeding ground for bacteria, so at least once a day you should disinfect yours by squeezing it out and putting it in the microwave for a minute. It’s that easy! When it’s falling to pieces and looks like it no longer should be used…then don’t – throw it out and by a new one.

Swept Away To sweep, hold the broom like a canoe paddle, with one hand on top of the handle and the other toward the middle. Push your hands in opposite directions to get the most out of every sweeping stroke. Sweep from the outside in so that you don't miss any spots, and move the dirt to the center of the room, where it will be easy to pick up.

Door Shiner If you want shiny doors, rubbing a teaspoon of lemon oil on shower doors or windows once or twice a month makes water bead up and roll right off them, keeping them shiny and clean.

Drain Strainer Keep drains free of hair and clogs by using drain cleaner once a month – these come in handy sachets or big bottles. Simply put the recommended amount down the drain and then pour boiling hot water down them once a week to keep them clear.

Sweep Deal Start with top down. Always clean off benches, countertops, window sills and all items high off the ground – that way all dust and bits drop to the floor and can be swept away at the end.

Ditch the Paper There is no need to use paper towel – it’s simply a waste of product and is harmful to the environment. These days microfiber cloths are the best answer. When wet they can sanitise and clean floors, countertops, glass and eliminate the need for many cleaning products – plus they are machine washable which means you can use them over and over again.

LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain

RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.

SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.

SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)

STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area. STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.

STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.

STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.

In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited. illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. There are a host of other optional services on offer such as a private chef, babysitting, pre-arrival shopping, laundry, driver or car hire, butler, island tours, personal training, massage and spa treatments, Thai cooking lessons...simply do your research and ask lots of questions when selecting your villa to see what is available to you during your stay. If booking your villa from outside of Thailand, it may be wise to use one of the more established

and recognised agents to ensure you are getting what you pay for. While it may seem cheaper to go directly through the home-owner, agencies usually have representatives in Samui and Phangan who can advocate on your behalf. That can include minor repairs or even moving you to another property if you’re not satisfied with your original choice. That’s something that the owner can’t help you with. Prices can vary greatly depending on the location of the villa (closer to the beach or beach-front means you will pay for the access and view!), the size/bedroom numbers, the facilities, services and the standard of the villa - with several levels of luxury available! There are hundreds of villas available on the islands starting from basic, mid-level, luxury and beyond – it’s truly reliant on your budget and your requirements - either way, you will not be stuck for choice. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. Read the rental agreement very carefully to make sure you understand what’s provided as well as any and all conditions, exclusions, inclusions, costs and penalties. When you decide on the ideal holiday villa to suit your needs, you can relish in the fact that you will enjoy privacy, space and of course the beautiful tropical surrounds of Koh Samui and Koh Phangan.
