As a client, how can you avoid paying for design work you don’t want? Making sure you know what you're getting before you have it built helps. Today there is no better way to understand and have a feel for new design than to see it in 3-D. Rather than you having rely on imagination to see if the bathroom door will be far enough away from the kitchen, 3-D allows you to virtually walk through your home before even approving any specs or designs. Want to see that living room wall with bay windows? No problem. Want to check out the view from the window? Step right up. Changed your mind and now want no windows? Hold on a sec. 3-D design is a fast and efficient way to get involved in every part of the design process. When architects actually design with you, the client — and present other, different or better options — you'll be better equipped to make informed decisions on a design that's perfect for you. How do you know if your architect works in 3-D? It's always a good idea to ask when you're interviewing potential candidates, and to take a look at their

examples of drawings and 3-D presentations. 3-D design is becoming an industry standard, and finding a great architect who offers it should not be hard. The good news is, most firms don't charge more for 3-D; they either have it or they don't. HERE ARE FIVE REASONS 3-D DESIGN CAN WORK FOR YOU: 1. Understanding traditional 2-D floor plans and elevations can be difficult. Many people can get the general idea from a floor plan but have trouble visualizing how the design is going to look. Being able to see and experience your design in 3-D will help you understand how it is going to work. The more you understand the look and feel of your design, the more comfortable you'll be at making decisions. 2. Designs can change and evolve in real time, during meetings with your architect. Meetings are the best way to be included in the design process and to make sure nothing is overlooked. 3. THE PERFECT ROAST CHICKEN Comfort food, sometimes it’s just what we need and what better than a freshly home-roasted chicken complete with any sides you desire? Follow this easy recipe and before you know it, you’ll have the best bird on the island!

INGREDIENTS • • • • • • • • • •

1 six-pound roasting chicken 2 tablespoons unsalted butter Salt and freshly ground black pepper 2 medium onions, peeled and sliced crosswise 1/2 inch thick 1 lemon 3 large cloves garlic, peeled 4 sprigs fresh thyme 1 cup Homemade Chicken Stock, or canned low-sodium chicken broth, skimmed of fat Kitchen twine Roasting Pan/Dish

DIRECTIONS Let chicken and 1 tablespoon butter stand at room temperature for 30 minutes. Preheat oven to 425 degrees. Remove and discard the plastic pop-up timer from chicken if there is one. Remove the giblets and excess fat from the chicken cavity. Rinse chicken inside and out under cold running water. Dry chicken thoroughly with paper towels. Tuck the wing tips under the body. Sprinkle the cavity of the chicken liberally with salt and pepper, and set aside. In the center of a heavy-duty roasting pan, place onion slices in two rows, touching. Place the palm of your hand on top of lemon and, pressing down, roll lemon back and forth several times. This softens the lemon and allows the juice to flow more freely. Pierce entire surface of lemon with a fork. Using the side of a large knife, gently press on garlic cloves to open slightly. Insert garlic cloves, thyme sprigs, and lemon into cavity. Place chicken in pan, on onion slices. Cut about 18 inches of kitchen twine, bring chicken legs forward, cross them, and tie together. Spread the softened butter over entire surface of chicken, and sprinkle liberally with salt and pepper. Place in the oven, and roast until skin is deep golden brown and crisp and the juices run clear when pierced, about 1 1/2 hours. When chicken seems done, insert an instant-read thermometer into the breast, then the thigh. The breast temperature should read 180 degrees and the thigh 190 degrees. Remove chicken from oven, and transfer to a cutting board with a well. Let chicken stand 10 to 15 minutes so the juices settle. Meanwhile, pour the pan drippings into a shallow bowl or fat separator, and leave onions in the pan. Leave any brown baked-on bits in the bottom of the roasting pan, and remove and discard any blackened bits. Using a large spoon or fat separator, skim off and discard as much fat as possible. Pour the remaining drippings and the juices that have collected under the resting chicken back into the roasting pan. Place on the stove over medium-high heat to cook, about 1 minute. Add chicken stock, raise heat to high, and, using a wooden spoon, stir up and combine the brown bits with the stock until the liquid is reduced by half, about 4 minutes. Strain the gravy into a small bowl, pressing on onions to extract any liquid. Discard onions, and stir in the remaining tablespoon of cold butter until melted and incorporated. Untie the legs, and remove and discard garlic, thyme, and lemon. Carve, serve gravy on the side….and enjoy.

SAMUI PROPERTY TOP TIPS Investing in a property or business on Samui is still a realistic opportunity, even for those with a relatively modest budget. For this reason, the island continues to attract a wide range of investors with a vast spectrum of motivations that stretches from owning a beach bar to building a full specification residential development. The island will always attract those in search of a more relaxed lifestyle in a warm climate and in Thailand and property value will almost certainly grow rapidly in the years to come. The downside is that the legalities of foreign property ownership are still very hazy, and recent restrictions have resulted in plenty of cold feet. Here are ten insider tips to help you negotiate the Samui Property jungle. Property in or close to the busy tourist areas such as Chaweng and Lamai has skyrocketed in recent years and most of the land is way beyond average residential purchase levels. Some developments may offer affordable options not far from the bustle of ‘touristville’, but these areas are also increasingly noisy and congested. The beaches and residential areas on the north coast offer a more relaxed atmosphere with amenities close at hand. Maenam, Ban Tai and Bang Por are all popular residential areas but properties tend to change hands less often and newer developments are becoming significantly more expensive. Although rampant development of housing projects characterized the early stages in Samui’s development, many of these were sold off plan and some have yet to be completed. When buying in a large gated development it is important to check when and where further construction is likely to take place so as to avoid finding yourself living on a messy building site. Local land and house owners on Samui tend to speculate on the value of their property, even when a contract is in the process of being finalized. Owners have even been known to up the price after an agreement has been made and landlords will stubbornly hold out for high rents, even at the expense of a vacant. Professional Thai language assistance with negotiations may save you more than it costs in a percentage fee. Many of the houses on Samui were built in the last few years, but the quality of construction both in terms of materials and craftsmanship can vary enormously. There are several qualified surveyors on the island and

it is wise to employ their services before signing any contacts. It is also important to check the credentials and labour source used by construction firms before employing their services. Samui is beginning to deserve the city status it has applied for and is set to get busier and busier. Areas close to the island’s main ring road, as well as those near the airport may suffer noise pollution, which will ultimately impact on the value of the property there. Quieter parts of the island are less developed, both in terms of access to basic amenities such as electricity and water, but also with regard to western influences. If you buy or build within a local village area expect early morning wake up announcements over the loudspeakers, round the clock cockerel calls and late night karaoke bars. Thai people’s sound tolerance levels are much higher than most westerners are able to endure and this should be taken into account when choosing or constructing a property. Gated communities are a popular choice for foreign buyers, they are generally more orderly and secure with less noise, but the houses within these developments tend to be densely packed and a lack of privacy may cause concern. Koh Samui is now easily very accessible both from within and outside Thailand but the island. Flights arrive and depart direct to Bangkok, Phuket, Pattaya, Singapore, Hong Kong and Kuala Lumpur and there are also two ferry piers serving the mainland. However, the island is served by just one airline and ticket prices are considerably dearer than fares to other parts of the country. There is also a domestic airport tax to pay when leaving the island. Although there are several new luxury projects and private villas worth investing in opinions vary as to the security of buying land or property on Samui without a clear legal framework in place. Long-term lease options are beginning to feature strongly as an alternative to purchase through a Thai Limited Company. This approach may offer more clarity but it also reduces the period of ownership to 30-year segments. Check the legal foundations of any purchase or lease agreement meticulously and employ the services of reputable legal professional to ensure due diligence is followed. ESTATE PLANNING ISSUES Most investors recognize the importance of having in place a valid Last Will and Testament. This article considers a number of issues that one should consider before preparing a Last Will in Thailand, although the author’s intention is not to provide a comprehensive survey of this topic. There are a number of issues that are not addressed in this article, and it is highly recommended that investors consult with legal and tax professionals before executing a Last Will. Despite the oft perceived simplicity, the laws relating to estate planning, particularly in a multi-jurisdictional context, can be complex, and the consequences of mistakes, dire.

that his or her Thai shareholders are genuine partners and not nominees. Often times, the foreign investor will hold his or her interests through a company established in a jurisdiction outside of Thailand (e.g. Hong Kong, British Virgin Islands, U.K., Australia, to name a few). For instance, the offshore entity may hold a registered land lease, registered house ownership and/or be the legal owner of shares in a Thai company. In this case, the investor may actually have no direct interests in Thailand, and should consult legal and tax advice in the jurisdiction of the offshore entity, as well as the jurisdiction of his or her domicile (see below).

IDENTIFY YOUR ASSETS This may seem an obvious point; however, it is recommended that the investor periodically take an accounting of his or her assets based in Thailand. For the foreign investor, common interests in Thailand include registered land lease, registered house ownership, registered usufruct and superfices. It is also common for the foreign investor to hold shares in Thai companies, and in this case, the investor should exercise caution to ensure that he or she is in compliance with foreign investment laws generally, and

For the foregoing reasons, you should always take an accounting of your assets, determine what jurisdiction the assets are based in, and seek legal and tax advice in all relevant jurisdictions. IDENTIFY YOUR DOMICILE The issue of one’s domicile is somewhat complex, although relevant to estate planning issues. According to generally accepted private international laws, the disposition of all ‘immovable property’ (e.g. interests in


land and fixtures on land) of a testator will be governed by the law of the jurisdiction where the immovable property is located; although the disposition of all ‘moveable property’ (i.e., non land-based assets) is governed by the law of the jurisdiction where the testator was domiciled at the time of his or her death. Company shares, whether in Thai or offshore companies, are generally considered movable property and should in theory be governed by the law of one’s domicile. For tax purposes, the issue of your ‘residence’ or ‘residences’ (a person can have multiple residences and only one domicile) must also be considered. LAST WILL AND TESTAMENT If you have assets based in Thailand, then you should seek legal and tax advice within Thailand in order to execute a valid Last Will and Testament in respect of your Thailand estate, even in the case where your only assets in Thailand are shares in a Thai company or companies. Notwithstanding that the law of your domicile may technically govern, ultimately, your assets in Thailand, including company shares, will need to be administered through a court within

Thailand. To this end, a court is likely to rely on a valid Last Will drafted in accordance with Thai law, and it can be particularly helpful to have the Last Will drafted in both Thai and English. Subject to certain alternatives, in order to be valid in Thailand, your Will must be in writing, dated, signed, and witnesses by at least two other people, and should be executed within Thailand. While this process is relatively simply, you should retain a legal professional to advise you on your Will. The law pertaining to the interpretation and effect of Wills is complex, and requires adherence to specific language. This article is was not prepared with the intention of being comprehensive, but rather aimed at highlighting a few issues to consider when contemplating the preparation of a Last Will in Thailand, and the reader should be aware that there are a number of other important issues to consider. TALLEST SKYSCRAPER IN ASEAN PLANNED FOR BANGKOK G Land's 615m, 125-storey 'Super Tower' set for completion in 2020 Real estate developer Grand Canal Land Tuesday unveiled plans for a 125-storey office and hotel tower that would make Bangkok home to the tallest skyscraper in Southeast Asia. The 18-billion-baht 615-metre "Rama IX Super Tower" is set for completion by 2019 on 73 rai of land in the Grand Rama 9 mixed-use development site near the intersection of Ratchadapisek Road, the company, known as G Land, said at a press conference. The Super Tower may become the second tallest building in the world with 615m. The 320,000-sq-metre "Super Tower" - the name is not final and a naming competition will be held later - is being designed by Architects 49 Ltd. The mixed-use project will offer 90,000 sq metres of office space and house a "six-star" hotel with 260 rooms. Other amenities include an observation tower for tourists and garden on the rooftop of a lower floor. "It will rank as one of the top 10 tallest buildings in the world," said Grand Canal Land chairman Yotin Boondicharern. "We expect to attract business from all around the world, with Thailand strategically located in the region's centre once Asean becomes a single market." Since 1998, the Petronas Twin Towers in Kuala Lumpur have stood as the region's tallest building at 482 m. In Thailand, Baiyoke Tower II is the tallest at 304 m. The Super Tower will begin construction next year for completion in 2020. The company's huge investment for 2015 derives from strong confidence in the new government and its economic policy, said Mr Yotin. Mr Yotin resumed active investment in Thailand in 2009 after the 1997 financial crisis drove him to pursue investments elsewhere. His international investments include development of a high-rise building in Hong Kong, a joint venture with Chinese authorities to develop property projects in Shanghai and Shenzhen and land reclamation in the Philippines. The Super Tower will be among several buildings planned for The Grand Rama 9, a megaproject with

a total construction area of 1.2 million sq m worth a combined 120 billion baht. Grand Canal Land has worked on the 73-rai site since 2009. The completed projects include eight condo buildings of Belle Grand Rama 9, with 2,000 units worth a combined 14 billion baht and one building remaining for launch by year-end. Retail projects include The Shoppes Grand Rama 9 with 150,000 sq m of retail space and Central Plaza Grand Rama 9, which has been rented to Central Pattana Plc for 40 years. Three office towers have been completed — two buildings of The Ninth Towers with a total area of 68,000 sq m and 90% occupancy and a 40,000-sq-m building to house Unilever's regional headquarters by year-end. Besides the Super Tower, the three other new projects are a condo complex near the Miracle Grand Hotel with 17 buildings of 16-storeys each worth a combined 6 billion baht, a single-house project in Don Muang district worth 2 billion baht and a condo project near the single-house project with seven 16-storey buildings worth 10 billion baht. If completed, the tower would dwarf the tallest building currently in Thailand, the Baiyok II tower, which tops out at 328.4 metres on its 85th floors. The second-tallest structure, to be completed in 2016, is Mahanakhon condominium at 314 metres. If built today, the tower would be the third-tallest in the world and the highest in the Asean region, planners said. Asean's current tallest building is the Petronas twin towers in Kuala Lumpur at 375 metres. Planners said the project will be accessed by a six-lane private road linking Rama IV and Rachadapisek and lie within 500 metres of an expressway exit and have a direct MRT connection. They added that the building will be built to the platinum-level certification of the US Green Building Council's Leadership in Energy & Environmental Design (LEED). illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. For longer term lets, there is a multitude of options from private owners to agent lets ranging from basic to 6 star luxury – all you need to do is spend some time finding the right villa for your long-term living needs. Holiday villas are generally fully furnished and include a full western kitchen with appliances, towels and bed linens, water and electricity and will normally include a maid service who will come once or more a week to change linen and tidy the villa, as well as a maintenance person to take care of the gardens and pool if included. Koh Samui is a long way from home, what brought you to this island paradise? To me Koh Samui really is a paradise island and I love living here. I came here 7 years ago and I have now lovingly come to see it as ‘home.’ My motivation for moving here was searching for a new challenge and a different way of life. I felt the natural beauty and charm of Samui, and its tropical island location was the perfect fit. Moving from the hustle and bustle of a busy city, Koh Samui offered a much more relaxed and tranquil way of life. When I was invited to move here to help create a new school on the island, I instinctively knew that Koh Samui was the right place to relocate to. How long have you been in Samui? I moved here in August 2007. It always amazes me how quickly time has gone by. However as the saying goes ‘time flies when you’re having fun…’ Tell us a bit about yourself and your career prior to Samui... I am a British qualified teacher and prior to moving to Samui I taught in a primary school in Birmingham, England. Whilst at university I studied Theology but always knew that my passion lay in teaching and helping to inspire the next generation. I am very lucky that I have been given the opportunity to build on this passion and to share it with others through my role as Headmistress at The International School of Samui. ISS is one of the most reputable schools on the island – what makes it stand out, what makes it exceptional for the students? Our vision is clear: the students come first. This means aside from teaching within the classroom, lessons need to be thoroughly planned, students work assessed to inform the next steps in a students learning journey, creating fun and interactive learning displays… the list goes on. Needless to say teaching really is a vocation and if you’re looking for a 9-5 job, then teaching really isn’t for you! What do you consider the best part of your job? Easily, the students! I love it when you have been teaching something and it clicks. When you see that light bulb moment when the pupil says - oh I get it! This is a magical moment and very rewarding! For some students you really are changing their lives and this is a very powerful tool we have been given. What does the future hold for you and ISS? I see a very bright future ahead for The International School of Samui. We are embarking on some wonderful projects which will help enhance the experiences we offer to our students. For example, having just completed our new 25 metre swimming pool, we are now able to offer competitive team events to the new ISS swim team. We are also working closely with our students to redesign and create a new learning playground, complete with new play equipment. ISS is very much evolving and we are very committed to providing a first class learning experience for all our students.. On a personal level, I look forward to continuing to do the job I love and leading ISS into its next phase of development. All of our electrical and plumbing works are carried out by fully qualified Western trades people as this is a vital area of construction that can have a detrimental impact on a villa if done incorrectly or cheaply in the first place, so at Palm we do it right the first time. BOLD FORECAST FOR 2015 CAR PRODUCTION INSTITUTE PREDICTS HIKE OF HALF A MILLION UNITS Thailand's car production is estimated to rise by 500,000 vehicles next year, propelled by the second phase of the eco-car scheme, says the Thailand Automotive Institute (TAI).

The existing five manufacturers are prepared to invest 86.8 billion baht for the production of 753,000 ecocars, while the five newcomers will spend 52 billion to make 828,000.

"Although some car makers may put off their production because of the sluggish car market, there are still some makers who are ready to start their assembly line for the new phase," TAI president Vichai Jirathiyut said.

At present, five eco-car makers have won Board of Investment (BoI) privileges for the second phase.

"Overall production is thus likely to hit 3.35 million units in 2015." Ten car makers including five existing eco-car producers applied for the second phase of the government's eco-car scheme, with total expected investment of 139 billion baht. All 10 participants are set to produce 1.58 million eco-cars.

Japan's Mazda Motor Corporation, the first eco-car maker to apply for the second phase, is set to kick off its local eco-car production on Nov 6 after winning BoI privileges on July 18. Four other car makers — Ford, General Motors, Nissan and Mitsubishi — have already won BoI privileges, while the investment applications of Toyota, Honda, Suzuki, SAIC Motor-CP and Volkswagen are under consideration.


In related news, Matt Bradley, Ford's president for Southeast Asia, yesterday said Ford was committed to moving ahead with its eco-car production.

In Asean, Ford now runs production facilities in Thailand and Vietnam that make 280,000 and 20,000 units a year, respectively.

"Despite this year's sluggish market, Ford expects domestic sales will recover next year," Mr Bradley said. Ford's investment application for the eco-car scheme gained BoI approval on Oct 3.

Ford entered the Thai market in 1995 and has invested US$2.4 billion in production, design, distribution and services.

The company will spend 18.2 billion baht to make environmentally friendly cars, with annual production capacity of 180,000 vehicles and 2,000 engines at Ford Thailand Manufacturing in Rayong province. Mr Bradley said once it begins eco-car production, Ford wanted to use its Thai factory as an Asean manufacturing hub.

The Michigan-based giant runs two plants in Rayong. One is under Ford Thailand Manufacturing that was set up in 2012 at a cost of $450 million with annual production of 160,000 vehicles. HOW TO COMBAT NASTY HOUSEHOLD ODOURS A clean-looking home is one thing, but a clean smelling home is another. The two do not always go together, especially if you have pets, children or do a lot of exercise. So we’ve rounded up some of the best ways to remove nasty smells in your home so it smells as good as it looks: SMELLY SHOES Depending on the strength of the smell, you can try a few things. Leaving them outside overnight will help for mild odours. But if they are truly epic, shake a little bicarb soda over the (dry) soles and leave for at least 8 hours. Shake them out and vacuum up any last dregs of bicarb. And if you can, leave a day in between wearing a pair of shoes (especially sporting shoes) so the odours have a chance to dissipate rather than build up. STINKY FRIDGE Empty some bicarb soda into a shallow tray and keep this at the back of your fridge, away from fruit and veggies; otherwise they may wilt very quickly. If your fridge smells awful, a good clean out of spoiled food is in order and you will need to wipe down every surface.

LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain

RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.

SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.

SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)

STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area. STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.

STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.

STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.

In addition, all buildings must now be constructed with peaked roofs, flat roofs are no longer permitted.

ENVIRONMENTAL REGULATIONS ON KOH SAMUI AND KOH PHANGAN There are defined areas relative to the distance above sea-level (i.e., reference to height above sea rather than set-back from shore-line), pursuant to the Regulations of Resource and Environment, 30th May 2557 (2014) (“Environmental Regulations”). Level 1 - Land less than 80 metres above sea level. In general, no additional rules apply in this level, subject to rules relating to hotels (50 percent of hotel land area must be left un-built on and “green”), residential projects consisting of 10+ units (must have water and waste treatment facilities), in addition to rules relating to water-dams, golf courses and airports. Level 2 - Land between 80 – 140 metres above sea level. Within this level, a single family home may be constructed on land that is 100 square wah or greater (if the land is less than 100 square wah, construction is prohibited). Structures cannot exceed 6 metres in height and must leave 50 percent of the land un-built on and “green; must have an architectural design based on traditional Thai, tropical or local aesthetics; must have a roof consisting of 80 percent of the total building area, and that matches the natural surroundings; and must include an approved water-drainage system, to prevent flooding. Level 3 – Land greater than 140 metres above sea-level. Within this level, the same rules apply as in Level 2; and in addition, structures in Level 3 cannot exceed 90 square metres. Slope Rules In all levels mentioned, where the land has a slope of between 35-50 degrees, only a single family home is permitted, which cannot exceed 6 metres in height and 80 square metres in area, and which must leave 75 percent of the land un-built on (50 percent of the un-built land area must be “green” with native trees). Furthermore, the land area must be 120 square wah or greater, otherwise construction is prohibited. If the slope is greater than 50 metres, construction is likewise prohibited.
