Ask ten architects to design a project and you’ll get ten completely different designs. These designs (and their budgets and construction limitations) could make your project a resounding success or could make it something less than successful. Architecture, by the nature of the business, is a servicebased profession. Architects provide design services and typically bundle other administrative, planning, and construction services into their fee. So if you get ten different designs from ten different firms, how do you decide which architect is the absolute best fit for your development endeavor? Each architecture firm is structured differently, has varied design aesthetic preferences, and is skilled at different subsets of the profession. While not exhaustive, here are a few ways to better understand who might be the best architect for your next project. Get multiple quotes Unless you are dead-set on a specific architect/firm, multiple quotes give you the best understanding for how competitive the market is for architectural design services. Each firm will likely quote different services involved in their work. So, as best as you can, get an apples-to-apples comparison of the quotes submitted based on the services provided. Talk to Previous Clients Ask each firm for a list of clients (both current and previous) that have built projects with that firm. Interviewing clients can give you a high level of insight into the working relationship you’ll likely have with your architect/firm. View Previous Work Take a tour of the firm’s previous work. Look for similarities in design, material motifs, quality of design, and other aspects that give you a hint into how their finished products turn out. This gives you a great opportunity to talk with property managers as well. PMs often know their buildings in intimate detail.

Interview Team (not just leadership) Architecture firms operate like any other organization. While leadership will likely be who you interact with on a day-to-day basis, the team behind the leadership can be just as important to know. Tour their office (look for moments of design brilliance) All architecture firms have the exact same opportunity to showcase their creativity, level of expertise, and design aesthetic–their office. When you tour an architect’s office, look for details that clue you in to their personality and design preferences. Side note: a messy office doesn’t always mean the firm produces messy work. Actually this can be quite the opposite many times. Architectural design is a messy endeavor! Understand Firm Scale/Constraints/Ambition Each architecture firm is structured differently, has different goals as an organization, and can provide different levels of service. It can be a tough decision to

turn down a young, ambitious firm for a more senior one with years of experience. As best as you can, try to gauge the constraints your project will place on the firm. Ask About Other Projects in Their Pipeline This could be a sub-point to understanding the scale and constraints of the firm. If a firm has nothing on their plate at the moment, your project will be at the center of their attention. If they just won three proposals, the level of service for your project might diminish.

An architect that’s a tremendous fit for you, your project, and your development team is a match made in heaven. Great architects often do subtle things throughout the design process that make them allstars in their field. While architectural mistakes and blunders are easy to see, the aspects that set great architects apart aren’t always easy to detect. Hopefully the points above can help you find your all-star architect. Happy building!

Arrange your coffee table nicely. A stack of books, a tray or basket, and a vase of flowers are all you need to make your coffee table look chic and pulled together. Swap photos in frames. An easy way to give your room a fresh look is simply by trading out the photos or artwork in the frames on the wall. Use old black and white family photos, pics from a recent trip or something completely different, like art postcards. Use your best. Don’t wait for a special occasion to bring out the good china or fancy glasses.What’s the point of having it, if it just sits in a cupboard most of the year? Move your furniture around. Move your bookcases into the dining room (or your dining table into the living room) for a cozy library vibe. For a smaller change, try switching chairs, side tables or lamps between rooms for a new look. Use kitchen containers as fancy organizers. Cake plates and tins, teacups and teapots, dessert plates and serving trays can make creative containers. Rearrange your counter. Counters get cluttered up so easily; thankfully, it doesn’t take long to get things looking nice again. Start by clearing everything off your countertop, and replace only the items you use daily. Change the look of a chair or sofa with blankets. For a quick change, try tucking a pretty blanket or another textile tightly around a sofa cushion, or neatly fold a blanket and drape it across the seat and back of an armchair, as shown here. Light your candles. Candles create a lovely ambience like nothing else. Light them whenever you want a little mood boost - try putting one in the entryway, on the coffee table and on the mantel, and a few tapers or tea lights on the dining table. Do something nice for yourself. Brew yourself a cup of your favorite coffee and bring it back to bed with you on a Saturday morning. Or treat yourself to a glass of wine in the backyard. FRESH AND FRUITY As the weather is hot hot hot, a great way to keep cool, but still be healthy is to make your own fresh fruit popsicles or ice-treats. Below is a starter recipe for you to enjoy, or make up your own. Stay cool. Stay healthy!

CHILLING CHECKLIST BUY

You can find ice pop molds at Big C and Tesco, or just use small cups and Popsicle sticks. Each recipe will make 6 to 8 pops, depending on the size of your molds.

FREEZE

To finish each recipe, pour the mixture into molds and insert sticks. If using cups, freeze until partially frozen and slushy, about 30 minutes, then insert sticks. Freeze until firm, at least 6 hours.

SERVE

To remove, run hot water over the outsides of the molds for a few seconds, then gently pull the sticks. This is only one recipe below – you can create your own with any number of ingredients including yoghurt, honey and any fruit you love!

JUICY MADNESS INGREDIENTS

• 2 cups diced fresh mango • 1 cup diced fresh pineapple • 1 cup strawberries cut in halves • 1 cup fresh pineapple juice or orange juice • Combine all ingredients (excluding the strawberries) in the blender for a few seconds. Fill 1/3 of each mold with blender mix and then place a couple of strawberry halves in each and then pour remaining blender mix into each mold.

CentralFestival Samui officially opened on 29th March with mixed reactions from locals, tourists and residents. CentralFestival Samui’s themed mall presents the unique characteristics of Koh Samui and the way of life of residents on the island that has long been known as a world-class tourist destination. The new shopping centre’s architecture is inspired the vintage

The vintage Chaweng Port theme can be seen through the use of charming decorations such as birdcages, which will remind people of Koh Samui residents’ daily lives. OFF-PLAN INVESTMENTS Part 1

For real estate investors in Koh Samui and Koh Phangan, investing in “off-plan” projects is often preferred to purchasing “used” properties. Although there are a variety of reasons for this, a few reasons come to mind: (a) Off-plan villas, condominiums and apartments are commonly offered to the initial investors/buyers at a discounted purchase price, thus providing a potentially greater ROI; (b) Sometimes buyers are able to customize their chosen property; and (c) Off-plan projects generally offer buyers a package, including estate management services and rental management services, although this can be offered in the context of resale properties as well. However, off-plan investments carry certain risks, primarily the risk of “non-completion” or “substandard completion”. This article considers ways in which buyers can mitigate the risks associated with off-plan investments, and is generally focused on off-plan projects as opposed to stand-alone properties, although most of the issues addressed herein apply to both scenarios The Development Team It is important to understand the team involved in developing the project. Who is the developer? Who is the head building contractor? Who is the architect? Does the project have an “independent” project manager? It should go without saying that the team should have experience directly relevant to the target investment. However, it is not uncommon for buyers to

rush into off-plan purchases without fully considering the experience and competence of the development team, which can result in a painful and sometimes costly experience for the buyer. Legal Due Diligence As with any real estate investment in Thailand, due diligence is important in the off-plan context. With respect to off-plan investments, the point of contact is often not the actual owner of the project lands, and the buyer should therefore carry-out checks to determine the registered owner of the land, and whether there are any mortgages or other charges registered over the lands, which could prevent the legal transfer of units to the buyers. The buyer should also undertake a full title history search of the land, determine the zoning regulations applicable to the land, and determine whether the project has full legal access rights to a public road, and also how access rights will be provided to individual buyers within the project (more on this latter point in the next article). Payments and Foreign Exchange Transfer Forms (“FETFs”) It is common knowledge amongst off-plan buyers that the purchase price should be made in staged payments, with each payment (except the deposit) occurring after a discrete stage of construction, in order to avoid the risk of paying for work that is never completed. However, foreign buyers often overlook


the importance of keeping a clear record of payment with the Bank of Thailand and obtaining Foreign Exchange Transfer Forms (“FETFs”, previously “Tor Tor 3”), or similar documentation, which evidence the amount of funds remitted into Thailand. Without such documentation, upon a resale, investors can face problems repatriating funds from Thailand. There are ways of structuring one’s investment using an offshore entity, whereby a resale can be transacted offshore, but that topic is beyond the scope of this article. Legal Transfer Prior to Full Payment Many off-plan projects offer to register the buyer’s legal interest in the underlying land (whether a freehold transfer or a lease) after the buyer makes the first significant payment of the purchase price. While this obviously provides the individual buyer with real security, it can also create problems for the project in general, where delinquent buyers fail to make payments, thereby halting construction of their properties, while preventing the developer from easily reselling those properties. This scenario is clearly not in the interest of the developer, nor the other paying buyers, as neighbouring properties in the project may remain incomplete for an extended time. Currency Fluctuations

Thai Baht may become more costly relative to the currency held by the buyer. Currency exchange risks can be mitigated by capping the exchange rate (or setting a range of exchange rates) in the purchase agreement, although this is sometimes unacceptable to the developer, who might have no incentive to share this risk. Alternatively, the purchase funds can be remitted in advance to a Thai bank account, and sent to the developer from that Thai account in the appropriate stages. Some buyers chose to purchase Thai Baht from a financial institution outside of Thailand, although this approach can sometimes cause problems obtaining FETFs or similar documentation (see above) and may therefore affect the ability of the buyer to repatriate funds on resale. The next article will consider further issues relating to the ongoing use, maintenance and management of the off-plan project, which issues should also be considered before investing. This article is only intended to provide a brief overview of the issues associated with off-plan investments, and is not intended to be comprehensive. Buyers should consult with a qualified law firm before entering into an off-plan purchase.

ASIAN HOTEL INVESTMENTS SKYROCKET 218 PERCENT Hotel investment volumes in Asia totaled $7.5 billion at the end of 2013, increasing a staggering 218 percent from the previous year, defying expectations. Last year represented the strongest year in the wake of the global financial crisis in 2007, when transaction volumes totaled $10.3 billion, according to JLL's Hotels & Hospitality Group. Last month, real estate research firm Savills reported Asia hotel investments hit a six-year high in 2013. "Strong investor sentiment and, importantly, the availability of quality hotel assets were key reasons behind Asia's impressive sales volume in 2013 which was hindered only by the availability of additional stock as many owners increasingly hold off selling assets in anticipation of further market growth," Mike Batchelor, managing director Investment Sales, Hotels & Hospitality, JLL said in the report.

Other markets witnessed strong growth due to improved connectivity and improved outbound travel from mainland China, including Hong Kong ($486.7 million, up 19 percent year-over-year), Thailand ($337.0 million, up 31percent) and the Maldives, which recorded $267.6 million in transaction volumes over the year, up a whopping 614 percent from 2012. The firm expects continued investment in Asia's hotel sector in 2014, although with more moderate volumes due to fewer landmark transactions and portfolio deals in key gateway locations.

The region's hotel investments were led by Singapore, Japan and mainland China in 2013, with Japan's overall investment at $2.7 billion, increasing 480 percent from 2012.

"Japan, Indochina and the Indian Ocean may account for the majority of transaction volumes in 2014," Frank Sorgiovanni, vice president, Research & Strategic Advisory, Hotels & Hospitality, JLL, said in the report.

Transaction volumes for Singapore's hotel market reached $2.0 billion in 2013, more than 10 times what was recorded in 2012. Volumes were predominantly led by the sale of Grand Park Orchard hotel and Knightsbridge retail, the city's largest single asset transaction to date, JLL reports.

"Investors are gradually considering emerging hotel markets such as Myanmar and Sri Lanka where deals will be opportunistic. The Singapore and Mainland China markets will also remain strong on the back of robust investor appetite."

Coming in third, China accounted for approximately 13 percent of total investment activity, recording $1.1 billion in transactions, as investor confidence grew in the second half of the year due to improved access to financing from the government.

illa rental is fast becoming the preferred holiday accommodation option for a vast majority of vacationers to Koh Samui and Koh Phangan. Renting a villa as a family or group of friends can prove far more economical in the long run than hotel accommodation and can afford you the luxury and privacy you seek on a holiday without breaking the bank. Generally a deposit of 50% or more is required to secure the villa of your choice prior to your holiday and the remainder paid in full upon arrival, this may vary from agent to agent. What kind of services does Horizon Homes offer?

I have done a lot of travelling all throughout my life and had got to a point where the UK was just not where I wanted to live anymore. So I sold my house and company, bought a ticket round the world and went to find my idea of the perfect place to live. Due to the weather and the people I decided that the two places I liked most were Spain and Thailand. On arriving in Koh Samui I fell in love with the island and at the same time there was a property boom so I found a good law firm and proceeded to put all of my savings into buying a few plots of land.

How long have you been in Samui? It's been so long now that I often start to forget but about 11 years now. What did you do prior to Samui and were you always in Real Estate? I have done many different jobs in my time from charity fundraiser to real estate developer. I had my own taxi company while I was training at university in Oxford. I also ran my own security company looking after large estates in the countryside before they were being developed. My Real Estate expertise started when my father was developing a country estate in Shrewsbury. I worked as the GM for a few developments within this company for about 3 years before I went to University. How did Horizon Homes come about? About 9 years ago now I was half way through building my first villa on the island and a customer came to see it and wanted on to buy it. He then asked if the land behind the Villa was for sale. It was and he went and purchased 45 Ria. He then called me and said he wanted me to help him sell it. His name was William McClintock, one of the owners of the Guild of Estate agencies and Fine and Country, two very big Real Estate companies in the UK. No doubt about it, crabgrass is the bane of every lawn gardener's existence. But that doesn't mean herbicides are essential to a healthy lawn; in fact, many experts avoid them. The true secret to banishing weeds, they say, is to grow such healthy grass that it chokes out the invaders naturally. Mowing regularly helps too, because it tops off weeds like dandelions and crabgrass before they have a chance to scatter their seeds. When you do find yourself compelled to do battle against a path of weeds, We recommends using one of the new "natural" herbicides that derive their potency from corn gluten, salts from fatty acids or other nonchemical sources.

Air Supply

When grass gets too compacted, nutrients can't penetrate to the root system where they're most needed. That's where aeration — poking holes in your lawn to improve oxygen circulation — comes in. Most people aerate with a simple tool that looks like two hollow tubes attached to the end of a long handle. Of course, you can also just waltz around your lawn in spiked sports shoes — that works fairly well too.

Types of Grass

Some lawns have finer textures (think golf courses), while others feel like Astroturf under your feet. There are hundreds of types of grass available, and new varieties are developed every year. As with all plant choices, climate plays a big role in determining which type of grass will work best for you — soil type, rainfall and other factors also come into it. As a general rule, cool-season grasses go dormant during the warm weather, and warm-season grasses go dormant during the coolest months of the year; in areas where it's possible to have a green lawn all year round, you want a mixture of both these types. LAND TITLE DEEDS IN THAILAND There are two main types of land ownership in Thailand which we should explain

RIGHTS OF POSSESSION Firstly there is the right of possession, for example, land that has been used by a family for generations to the benefit of the land and they have possession rights of the land under the civil and commercial code. Such titles are Sor Kor 1,Tor Bor 5 , 6 or Sor Por Gor 4. These titles basically are only family possession rights and generally only used for farming. These titles can not be bought or sold and no building rights or legal acts would be allowed on the land. I do know of cases where families being in possession of certain pieces of land for generations have been able to upgrade them to regular land title deeds but this is not generally the case and any serious investor would not normally give any credibility to these titles of possession.

RIGHTS OF OWNERSHIP Usually we are looking for land title deeds giving right of ownership not possession. Here there are basically three title deeds:- Chanote, Nor Sor 3 and Nor Sor 3 Gor. The most sought after titles are the Chanote and the Nor Sor 3 Gor as both these titles have legal documents of Rights of Ownership and can be sub-divided into smaller plots and planning permission and any such legal acts can be carried out immediately on the land.The only difference with the Nor Sor 3 is that although legal documents are issued for the land it has not been accurately surveyed which can lead to problems in verifying actual land area. And if any legal act is to take place on this land it must be published for at least 30 days. As we have been saying all the way through if it is not clear 100%, seek the advice of a legal professional in this field, as there are also many other issues that are important to consider such as servitude, access and rights of way.

LAND MEASUREMENT & SURVEY Land in Thailand is measured in Rai, Ngan and Talang Wah. • 1 Wah= 4 sqm • 1 Ngan= 100 Wah or 400 sqm • 4 Ngan= 1 Rai or 1600 sqm In comparison to Western Standards: • 2.50 Rai= 1 Acre • 6.25 Rai= 1 Hectare

TIPS FOR STARTING A NEW BUSINESS Are you planning to start your own business for the first time in Thailand? If so, we hope this useful information will help put your business on the right track. The simplest and easiest sort of company for foreigners to form with a small business is a Thai Limited Company. In Thailand, a Limited Company is a company with up to 100 shareholders, who share the same business purpose and is formed with a Capital divided into equal shares.

GETTING STARTED To set up a company, you must first have the memorandum that can be acquired at the registration office. To properly register, you are required to provide the authorities with details of your company and list a minimum of three shareholders (who can either be Thai or foreign nationals or both). At least seven days after you first approach the department, you can call a shareholder’s meeting to reach an agreement on the purpose of your business and set up the company’s operational rules. Having agreed on the purpose of your business, you can then apply for business registration at the same department. If you cannot agree on company rules, you can refer to those stated in the Civil and Commercial Code’s partnership and companies section.

SHARES Besides the issues of business registration, you must also make sure that your company’s shares are worth no less than 5 baht each. These shares can be transferred or even sold if the company has no regulations on this matter. Every shareholder must be given a share certificate, a document that guarantees their status as a shareholder. Should anyone wish to transfer their shares to another party; they have to fill in the share transfer form that confirms the deal between the transferor and transferee. The company also has to have in its possession a register of shareholders that contains a record of all the company’s shareholders. The book is evidence that will identify the company’s shareholders.

SHAREHOLDERS AND CHAIRPERSON A Limited Company’s shareholders can be either Thai or foreign nationals or both, but the percentage of shares held by foreign national plays a significant role in determining the nationality of your company, which may impose serious limitations on the company’s rights, such as landownership. If less than 49% of your company’s shares are held by foreigners, your company is considered a Thai company.

However, if foreign nationals hold more than 49% of the shares, your company is a foreign company. The significant differences between Thai and foreign companies operating in Thailand lie in their rights to buy and own properties or other businesses. It is therefore important, especially for those in real estate and development businesses, to know and remember that unless your company is Thai, you are restricted in the ability to possess and obtain land and property in this country without an exemption granted by the government. Foreign companies are also restricted to certain activities and to proceed with certain operations the company will have to apply for permission from the government. In such instances, applications will be considered case by case. They will also face tough scrutiny and strict restrictions on their right to operate and ability to run their business. These companies will be treated in the same way as foreign nationals seeking jobs in Thailand. If you are registered as a Thai company, you are automatically granted the right to purchase and own properties and other business and will be treated the same way as a Thai citizen. However, according to new legislation that has recently come into effect, the Land Department’s staff are now required to thoroughly investigate your Thai shareholders’ sources of income. Thai shareholders in a company wishing to purchase properties in Thailand have to declare their income and provide the authorities with evidence that proves their ability to co-invest with other foreign shareholders in the same company. Only those successful in convincing the authorities are granted the right to purchase and possess land. Companies with approval from the Land Department can then proceed with their applications for land title deeds or other certificates of use and possession.

LITTLE THINGS THAT MATTER A company limited has to have its own board of directors to act on behalf of the company. This panel will, however, act under the regulations and agreements approved by the shareholders. Appointing directors or removing any of them requires shareholders approval. At the end of the company’s financial year, within five months, it shall be the duty of the company to present the balance sheet to the Department of Business Development (DBD). If your company fails to present the balance sheet, the company will be fined up to 50,000 baht and the company’s board of directors may also be fined up to 50,000 baht. If the committee refuses to pay the fine, the police can appeal to the court for a warrant and file a lawsuit against the resilient parties. Withdrawal of the company’s business registration is also another penalty the company may face, should they not provide the authorities with the necessary statement. BUILDING REGULATIONS ON KOH SAMUI In order to build on Koh Samui you must first obtain a building permit from the municipality office and your building must meet certain requirements, depending on the location of the land on which you wish to build. There are 4 defined areas for land depending on its distance from the beach. (See diagram on opposite page)

STAGE 1. Land up to 10 Meters from the beach. The law states that no construction is permitted within this area.

STAGE 2. Land up to 50 Meters from the beach. Within this area you are permitted to construct a single storey building only It’s height cannot exceed 6 Meters (including the roof) and the building cannot exceed the maximum allowed area of 75 Square Meters.

STAGE 3. Land up to 200 Meters from the beach. Within this area you are permitted to build up to a maximum height of 12 Meters (including the roof). The maximum allowed size is 2000 Square Meters.

STAGE 4. Land located more than 200 Meters from the beach. Within this area, building of up to 12 Meters in height (including the roof) can be constructed.
