Unauthorized Tenants and Poor Housekeeping Although these may be among the most common lease violations, they are two of the most difficult to prove in court. While it may be easy to prove that an individual is visiting or occasionally staying at an apartment, it takes much more than that to prove that the person is occupying the unit as a residence. Similarly, while providing pictures and other proof of the condition of a tenant’s apartment is simple, establishing that the condition is bad enough to require eviction is a different story. Unauthorized tenants are a constant problem. Proof that someone was present on the property at a given day and time will not be enough to establish them as an “unauthorized tenant.” It will take more than testimony of the management staff. With smartphones and surveillance camera systems all the more prevalent, you’ll want to make sure to have pictures or video of the individual coming to and from the premises on a daily basis, or pictures and videos that show the tenant repeatedly remaining in the unit overnight. The same can be used to show the repeated presence of the individual’s vehicle, and more specifically, remaining on property overnight and on consecutive days. In addition, you must also investigate: (1) record of the office’s package pick-up log, (2) if any maintenance requests have been received from the unauthorized tenant, (3) if utility services are established in the name of the unauthorized tenant, (4) police or probation records indicating the apartment address for the unauthorized tenant, and (5) if the unauthorized tenant has previously made any rent payments. Remember, if the person has been an unauthorized tenant for an extended period of time and rent has been accepted month after month, it will be much more difficult to suddenly terminate tenancy, as our right to evict for that violation will very likely have been waived due to our acquiescence and/or acceptance of rent.

The tenant is allowed to have guests as part of their right to use and enjoy the property; therefore, it is up to us to convince a judge that the person is not a guest but an unauthorized tenant. As always, testimony of disgruntled neighbors who have been inconvenienced, disturbed, or even confronted by unauthorized tenant(s) carries much more weight than our statements. The Landlord Tenant Act requires that the tenant “keep that part of the premises that the tenant occupies and uses as clean and safe as the condition of the premises when the tenant took possession.” Furthermore, it requires that the tenant “dispose from the tenant’s dwelling unit all ashes, rubbish, garbage, and other waste to the designated collection areas and into receptacles.” When the premises arises to an unacceptable condition, this too becomes very difficult to prove. The statutes’ requirements are not specific, but our proof must be convincing. Announced, permitted inspection(s) of the unit and documentation of its condition (including pictures, notes, and/ or videos) are necessary to successfully show that the tenant is violating either or both of those statutory requirements. These records must support our decision that the housekeeping problem was bad enough to require eviction. The court will need to see a history of notices to the tenant, establishing without question that the tenant knew the landlord had a problem with their behavior. In addition, if there have been violations that materially affect health and safety, a 14-day notice will need to be sent allowing the tenant that time period to remedy the problem. If the problem has persisted beyond those 14 days, the landlord may enter the premises and complete the repairs and charge the cost of those repairs to the tenant. Note that, as is true in many cases, testimony of neighbors goes a long way. Proof that the problem is so bad that it has caused nuisance or danger to the property and other tenants is vital. There may not be much sympathy for the management staff in handling these issues, but if the negligence of one tenant is disturbing the peaceful enjoyment of others, the violation is generally considered more severe. Proving these violations is difficult and requires a lot of sound investigation. If we are going to assert that a violation has occurred, let’s be sure we can do more than just say that it happened. We must be able to prove to the court that the behavior is so egregious as to require eviction.

General Membership Meeting Preview

Anything Is Possible! By every measure, HK Derryberry’s life is truly a miracle. Born July 8, 1990, in Nashville, Tennessee, HK arrived three months premature due to an automobile accident that took his mother’s life. The tiny two-pound baby boy would spend the next 96 days fighting for survival in Vanderbilt University Medical Center’s neonatal intensive care unit. Although doctors offered little hope for survival, this miracle baby proved them all wrong. Because of the accident and his premature birth, he was born blind, with cerebral palsy and countless other medical problems. Raised by his grandmother, some people might say HK faced too many mountains to climb. Quite the contrary! At an early age, HK displayed an extraordinary will to overcome his disabilities and at age three enrolled at the Tennessee School for the Blind, becoming one of the youngest students in the school’s history. His right arm, paralyzed from a stroke suffered soon after birth, did not stop him from learning to read and write Braille with just one hand, another first for the 150-year old school! Since age ten, HK had displayed signs of a remarkable ability to recall dates and other facts surrounding events in his life. In 2012, the mystery of his memory was unlocked by medical researchers at Vanderbilt Medical Center’s Memory Clinic. They discovered that HK is one of only five or six people in the world with a medical diagnosis of hyperthymesia, otherwise known as Superior Autobiographical Memory. He has the ability to remember every event including time and place that’s occurred to him since he was 3½ years old. HK successfully completed every high school curriculum requirement established by the State of Tennessee and in May 2013, at the age of 21, graduated from the Tennessee School for the Blind with a high school diploma, one of the first members of his immediate family to accomplish this goal. Jackie Ramstedt Jackie Ramstedt, CAM, CAPS, CAS is a nationally renowned Motivational Keynote Speaker, National Trainer, Operations Consultant, and Performance Coach who has more than 29 years experience in the multi-housing industry. She is a “requested repeat” presenter speaking to thousands of industry professionals annually on a national level for the National Apartment Association, the Institute of Real Estate Management (IREM), National Affordable Housing conferences, and numerous state and local Associations, including various management and investment companies throughout the United States and Canada. Mike Smith has been a Nashville resident and enthusiast since 1994. Before starting Conjure LLC, Mike served as the group publisher for Nashville Scene, Nfocus magazine, and Nashville Post – publications that play large roles in shaping the economic and social development of the city. His emphasis on branding and non-traditional marketing has opened doors and revenue steams for the Scene’s parent company, SouthComm. Mike led the company in local and national sponsorship sales and developed a consultative training program that has proven successful in the changing media landscape. Mike is also the co-founder and managing partner of Nashville Fashion Week, a city-wide event that is in its sixth year. With his fellow fashion week co-founders, he launched the Nashville Fashion Forward Fund, a non-profit to support emerging designers in the Nashville market. Golf Tournament Who’s ready to scramble? This year’s golf tournament is taking on the wilds of the safari! The 2017 Safari Scramble takes place on Thursday, May 18 at the Hermitage Golf Course, General’s Retreat.
