It’s the Law
Banning and Trespassing In 2009, the State of Tennessee’s Attorney General issued an opinion concerning (in part), a landlord’s ability to regulate the individuals that tenants could invite onto the property. That opinion indicated that all tenants have the common law right of quiet enjoyment of the leased premises, and quiet enjoyment includes the ability to invite guests to their home. While the opinion didn’t specifically state that the landlord could ban individuals from the property, the opinion concludes that the right to quiet enjoyment can be negotiated and a lease may contain a provision that restricts the right of tenants to invite certain categories of guests or limits the length of time that a guest can remain onsite. Most leases indicate that the landlord maintains the right to refuse entry to the property to anyone who has been disturbing the peaceful enjoyment of the premises, violating the law, or violating apartment rules. As long as the individuals who are banned from the property fall into a prohibited category included in the lease, that ban will be enforceable – at least according to the Attorney General’s opinion. Both the tenant and the guest need to be notified, in writing, that the guest cannot return to the property. Thereafter, if the banned individual returns as a guest, the tenant has violated the lease and can be sent notice of termination of tenancy. If that person returns uninvited, the landlord could then call the police to have the individual removed and seek trespassing charges. But that may not be as simple as it sounds. According to Metro Nashville Police policy, responding officers are not allowed to remove a tenant’s guest and will not charge that person with criminal trespassing. They take this position because, as stated in the Attorney General’s opinion, the tenant has a common law right to invite guests to their home. They also point out that although a lease agreement may include a provision allowing individuals to be banned, they cannot interpret that lease, therefore that issue is a civil matter and must be resolved in civil court, if necessary. by Nathan C. Metro can remove and potentially charge trespassers if: (1) the person does not have a valid reason to be on property, and (2) the landlord has authorized MNPD to enforce and prosecute criminal trespass violations on the property. A person’s reason as valid is very much a case-by-case scenario. If the person claims to be visiting a tenant and that tenant verifies the same, Metro will almost certainly not remove the person from property and will not file trespass charges. There are a wide range of possible situations that may result in a variety of outcomes, but simply, a person must have a valid reason to be on property. The required authorization form is available on MNPD’s website or in your local Metro Precinct office. The authorization remains in force for one year from the effective date. Although Metro may not strictly scrutinize the effective dates of the authorization before responding to your call, an updated authorization must be filed with the precinct on an annual basis. It is most important to note that the authorization form includes a condition that the landlord agrees to “post and maintain ‘No Trespassing’ signs that are visible at all major points of ingress to the property so that they are likely to come to the attention of the person entering thereon.” Although Tennessee criminal statute does not necessarily require these signs to support a trespass charge, Metro’s authorization requires that such signs are posted. Posting and maintaining that signage enables responding officers to quickly verify that your property complies with their policy. Without that signage, responding officers may not be able to enforce a trespassing violation. If the person does not have a valid reason to be on property and a current authorization is on file with Metro, responding officers should remove that person from the property and could potentially cite the person for trespassing. Because implementation of these policies varies across the county, be sure to speak to your local precinct and/or their Community Affairs Coordinator to understand how they specifically practice these policies. Note that while the statute for criminal trespass applies statewide, the policies discussed in this article apply only in Davidson County. Other counties’ practices vary widely; if you manage property outside of Davidson County, be sure to check with your local law enforcement agencies to understand their trespassing procedures.

Get Ready for the 2018 Apartment Tour!
Plans are underway for the 2018 GNAA Apartment Tour. After a successful tour in The Boro last year, we are bringing it back to Nashville as we highlight the up-and-coming Charlotte corridor and Midtown area. We have added three great communities – Charlotte at Midtown, 2400 Charlotte Avenue and The Shay – and are in the process of finalizing plans for more. The Charlotte corridor and Midtown area has undergone a resurgence in recent years, as have many areas of Nashville as we deal with our unprecedented growth. There are a number of new restaurants, shops and venues that show the diversity and vision of the area. Restaurants include the likes of MLRose Craft Beer and Burgers, Hattie B’s Hot Chicken, Farm Burger Nashville, Hugh Baby’s, Taqueria del Sol and Bro’s Cajun Cuisine. The proximity to the healthcare offices, St. Thomas Midtown and TriStar Centennial and Vanderbilt helps Midtown support the growing multifamily presence as well. If you’re one of the few apartment managers or leasing professionals who feels like they have a manageable workload and your inbox is always at zero, then high five to you. But it’s more common that people generally feel the opposite. The challenge is to prioritize, put out fires, but also make sure you stay on top of the important stuff, not just the urgent stuff. No matter how busy you are, it’s pivotal to keep learning and stay inspired. Continuing to grow and learn will not only increase your value to the company you work for, but it can also improve your satisfaction and enjoyment of the job. Here are some ideas for busy multifamily professionals to keep learning and stay inspired: Integrate exercise with learning by listening to a business, apartment industry or personal growth audiobook while you jog or talk a leisurely walk in the evening after dinner. Take initiative to be the expert at your community on the newest technology tool you’re using. Whether it’s the back-end of your website, the dashboard for your lead tracking or mobile app, learn everything you can about it so that you are the go-to person who understands that tool and can leverage it at your community. Choose one topic to learn about each month. Even if you don’t make it a weekly or daily habit, you’ll at least be working on your own development with a structure that can keep you engaged. Small progress is still progress.
Write down your career goals for the year and select specific areas that you want to learn more about. Make a plan for how you will spend time investing in your own learning and career off the clock. When you have a goal, it’s easier to invest in learning and growing because you specifically see where it’s going. Next time you’re watching a required training, certification class, make a note of two or three specific things mentioned that you want to learn more about. If there was a word mentioned you’re not familiar with, or a resource that seemed interesting, write it down. Then google the topic and read more than one article on the subject. Listen to a podcast on your commute, or even at home in the morning while you get dressed and ready. If you’ve been especially bogged down by negative reviews or complaining residents, be sure to spend your commute or lunch break focusing on positive things. Find ways to laugh and reset your focus, instead of just venting or complaining. Be intentional to get some perspective and not take it personally. Spending five minutes like this can transform your day and your attitude. Ask your manager, regional manager, or marketing director for their suggestions about how you can grow your career. Ask for feedback about the areas that they see you have potential to grow. Ask for their ideas about specific opportunities to learn so you can go above and beyond. There’s no end to the ways you can take responsibility for your career and your attitude at work. Of course, the challenge is just doing it. If you make the small shifts, you’ll experience the benefit and be motivated to continue making even more effort so you can stay inspired, focused and having fun as you learn and grow.

Getting Ready for Nashopoly! Thursday, August 16 from 5:00-8:00pm It looks like this year’s GNAA trade show “Nashopoly” is going to be the biggest yet! There’s still time to sign up if you have not already…just visit gnaa.org and register on the trade show event page. You’ll want to hurry so you have time to pick up your name badges at the GNAA offices. Here are some tips for you so you get the most out of your night at the show!
Save Time – Pick Up Badges BEFORE the Show Instead of waiting until the day of the event and having everyone stand in line, we have simplified the name badge pick-up process. Starting August 1, registered attendees can pick up their name badges at the GNAA offices at 2 International Plaza, Suite 201 during normal business hours (7:00 a.m. to 5:00 p.m.). All tickets should be picked up by August 13 to make sure you have time to disperse them to your teams. There will be a table at the entrance to the venue for those who may have registered late or forgotten to pick up their name badges at the office. No door prize tickets will be included if you pick up late.
Show Spirit – Storm the Stage! If you remember the new layout at the Events Center, the stage is a focal point for the event. Door prizes and announcements both come from this area of the venue. This year, we encourage management companies to pick a time slot (one every 15 minutes) and gather at the appointed time near the stage. Pick a rocking song and then “Storm the Stage,” showing why you deserve to win this year’s Team Spirit award. Reach out to the GNAA staff to select your song and your time slot so the DJ can get everything lined up for you.

Gain Knowledge and Exposure – Networking Once you’ve planned your way around the show, make sure to come in with one or two goals of what you would like to achieve. Are you here to seek out more companies to use for services you may be interested in adding at your community? Are you attending to meet new members and get to know what they offer? Are you looking to network and increase your peer group within the industry so you can have some friends to bounce ideas off of when needed? All three of these, and many more goals, are great things to be focused on as you spend the evening at GNAA’s biggest networking event of the year!
Supplier Members – Keep an Eye on Competition! Everyone likes a little friendly competition and the multifamily industry has a large enough member base to handle many vendors that may specialize in the same thing. GNAA supplier members can use this opportunity at the trade show to see what others are doing in their area of expertise and make sure that they are keeping up with the expectations of our management company and apartment community members. You may see or hear about a product or service that you aren’t offering that may expand your portfolio and make you more attractive for future business. Don’t be afraid to build relationships with the other supplier members – you never know when you may need to call on them for something else.
Come Prepared! Attendees of the trade show will want to make sure you come prepared for the night’s events. You will be doing a great deal of walking, so wear comfortable shoes! Try to get to the Gaylord Events Center as close to 5:00 p.m. as possible – there are 145 booths of supplier members that are eager to spend some time with you. BRING PLENTY OF BUSINESS CARDS! Many of our supplier members will need your business card to enter you into their drawing at their booth or to make sure they get your correct contact information. Last but not least, plan on enjoying yourself! There is complimentary food, great people and the chance to win some awesome door prizes at the end of the evening. We are so excited about this year’s trade show and hope that our members are too! With the proper planning and the expectation of a great night, this could be a night to take your career to the next level as you increase your knowledge and network.
