2017 Lifetime Achievement Nancy Morris

The Greater Nashville Apartment Association is honored to award the 2017 Lifetime Achievement Award to Nancy Morris. This prestigious and well-deserved award recognizes her 32 years of dedicated service to GNAA and the multifamily industry. Nancy is a native of rural St. Louis, MO area, where she grew up with four brothers and four sisters. After eight years in retail management Nancy was pretty well over working nights, holidays and weekends, but she still had a desire to meet new people. Nancy went to her first and only interview for a leasing position and was immediately hired. That started her career with Sentinel Real Estate in 1985. She got a fast start in the business and her love of the industry began. Two years later Nancy transferred with Sentinel to Nashville and as manager for a brand new lease-up property, Polo Park Apartments. Nancy immediately became involved in GNAA when Polo Park won a beautification award in 1987. In 1994, Nancy was promoted to District Manager with Sentinel. Nancy achieved a Vice President title in 2000 and accepted the position of Regional Marketing & Trainer Director, traveling to 15 states and 34 properties. She gained significant expertise in overseeing out-of-town properties, marketing strategies and training to build dynamic teams. Following her 25-year career with Sentinel, Nancy went to work for First Management Services under the leadership of Kirby Davis and was responsible for six diverse residential properties in Nashville, TN. First Management Services merged with Freeman Webb in 2014 where she continued to manage a portfolio of 11 assets. In March of 2017, Nancy took the leap into retirement – well, “semi-retirement” – as she continues to perform consulting work in the multi-housing industry. Nancy has served on the Greater Nashville Apartment Association Board of Directors since 1989 and has chaired most of the committees for GNAA. To highlight a few, she was instrumental in developing the Apartment Tour Program, the GNAA website and the website “Discover the Choices in Apartment Living” to promote apartment community members. She also chaired the first Banquet Committee in 1992. Nancy was part of the three-person committee that formed the Managers Council, which launched the Associates Appreciation event. In 1996, she was elected as Chairman of the Board and since then has chaired the Ethics Committee. Nancy has served as a member of the NAA committee for Units magazine. She has taught many educational and marketing classes throughout her career for GNAA. Nancy remains an active past Chairman of the Board and is presently responsible for the expansion and redesign of the GNAA offices, working through each intricate detail to ensure that the GNAA office and training facility will be in a position to serve our members’ needs for years to come. She is presently responsible for construction build-out and redesign of the GNAA offices and is a member of the Governance Committee. While serving on the Board, one of the Nancy’s greatest experiences was meeting her husband, Harold Morris, in 1989. Harold served as Chairman of the Board for GNAA in 1990. They were married in May 1991 and they have the distinction of being the only married couple to have served as Chairman of the Board for GNAA. Congratulations, Nancy, on your Lifetime Achievement award!

It’s the Law

Promise to Pay or Agreed Order It doesn’t take long for tenants to accrue rent arrearages. It’s not always easy to decide how to proceed. Without your quick action, the rent balance can soar. Should we begin eviction proceedings immediately or should we allow the tenants a week or two for another pay day? In instances where the tenants have a good payment history, have not caused any non-monetary breaches, have communicated concerning their cashflow problems, and have demonstrated to you that their financial problem is only temporary, there could be another option. We believe that the tenants’ timely, voluntary communication is key. If the tenants are conscientious enough to come forward prior to a late rent problem, it stands to reason that they have a great desire to cure their breach. Always remember, you are in a position where you could immediately proceed to eviction. But that may not be the most cost-effective option. Another option may be to offer a “promise to pay.” A properly worded “promise to pay” will not forfeit any of your rights, reinforces your ability to immediately start legal proceedings if necessary, and can be used as evidence to easily prove the balance due at the time of execution of the agreement. When drafting this agreement, the first step is to exactly calculate the balance due. This amount must include each and every charge due at the time the agreement is to be executed. Be aware that it would be near impossible to increase that balance if you accidentally omit any past due amounts.

We must also be sure that the document is not a note in lieu of rent. If we accept a note in lieu of rent, the note brings the rent account up to date. You would then have to wait until the lease contract is breached again for non-payment, thereby delaying the issuance of a detainer warrant. The balance due on the note would have to be pursued in a separate cause of action. The right to pursue possession would be based solely on any balances that accrued after the note. It is easy to see how cumbersome this procedure would be. This problem is easily overcome by referencing the subject lease agreement by its date, parties, and the subject premises. You must also be sure to keep the lease in full force and effect by retaining your rights under the lease. The rights that should be specifically identified are the right to evict without notice for non-payment of amounts due under the repayment agreement or the lease agreement, and the right to terminate tenancy for any non-monetary breach of the lease. Remember that notice of termination of tenancy for nonmonetary breaches cannot be waived. Finally, it is imperative that this agreement is executed by all parties to the lease. A “promise to pay” is not very often the solution to a late-payment problem and should be used sparingly and in accordance with your company’s fixed policies and procedures. The best way to get the tenants’ attention is to file a detainer warrant. Once in court, a court-ordered “promise to pay” may be entered as an agreed judgment. The agreed order can precisely recite the total of all amounts due, the due date, and place of payment. The order would specifically state that if the repayment terms are breached, a writ to physically remove the tenants from the premises shall be immediately issued with no further notice or action required by the landlord. This type of agreed order is the ultimate “PAY OR GO.”
