The Maintenance Gap

Property management firms are turning to training, among other solutions, to help fill the gap by Les Shaver

At this point, we all know what happened to residential construction jobs in 2007 and 2008. From April 2006 to January 2011 the construction industry lost 2.3 million employees—200,000 more people than live in Houston. When the construction market tanked, some of those workers entered the apartment industry to work in maintenance, according to Chris Pilato, Vice President of Construction and Development for CAPREIT. Others moved to other industries, retired or left the United States altogether.

While construction and HVAC companies are often able to offer maintenance technicians more money, they are not the only threat. In areas where a lot of apartments are being delivered, management companies are poaching talent from their competitors. “There have been a bunch of units delivered in most of the markets we are active in,” says Dominic Rechichi, a Principal at Pensam Development. “As these properties are built, there is a demand for quality maintenance supervisors and maintenance technicians. The field is spread thin.”

Now that development is booming, some of these maintenance technicians are moving back to higher-paying construction jobs. For apartment developers, that is a good thing. But for property managers, it presents a challenge.

Multiple Solutions

On the West Coast, Vanessa Siebern, a Vice President at FPI Management, an apartment management firm in California, talks with construction companies and she says contractors are turning down work because they do not have enough labor. “You can swing a hammer and make $20 to $30 an hour,” Siebern says. “Our entry-level salary is definitely lower than that.” At Fogelman Management Group, Chief Administrative Officer Melissa Smith also faces outside competition for maintenance personnel. “The HVAC companies are killing us,” Smith says. “They are hiring anyone they can and getting them certified. With so much development going on, anyone who can find a skilled worker is hiring them and paying them a lot more money.”

The tactics for retaining and finding maintenance talent are about as lengthy as the number of threats faced. For starters, keeping technicians engaged through education is one way to fend off competitors. Hiring new maintenance technicians can be a challenge because there are not as many applicants as there are for onsite positions, according to Kevin Smith, Director of Recruiting for Camden. “The issue with maintenance is that we receive about one-third of the applicants that we do for office jobs,” Kevin Smith says. “I think it is because a lot of these guys do not have a social media presence. They are not well versed using the Internet.” One solution is finding maintenance technicians within your organization. “We would rather train than hire because hiring is difficult,” Pilato says. “For us, it has been easier finding someone we can train to do the job we need.” continued on p. 12

The problem with training, of course, is that you could be improving an employee’s resume and they eventually leave you. “That is something we are cognizant of when we are training for air-conditioning certification and project managers,” Pilato says. “If you train someone to be HVAC-certified, what is to stop him or her from going to a company that pays a couple of dollars more?” CAPREIT understands that its wages need to be competitive while providing a great work environment to retain these employees. For other firms, outside-thebox solutions offer promise. Cortland Partners is using construction teams to help supplement its maintenance staff. “For properties under construction or in renovation, our teams would take over the make-ready process for immediate move-ins, which allows the facilities team to focus on residents’ needs,” says Clay Landers, EVP of Construction at Cortland. When all else fails, sometimes it is best to outsource hiring. The most difficult position for Western National to hire is the Porter position. As such, Western National has begun an initiative with a third-party service to replace its open porter and housekeeper positions at some communities. “Recently, because of the lack of candidates that we have seen, it has benefited us,” says Scott Wickman, Regional Vice President at Western National.

Ways Nashville Communities Can Recruit and Retain Quality Maintenance Professionals Have a clear job description and pay in mind. •

Know that wages need to follow demand and that today’s maintenance person may expect a higher salary than even two years ago. Look for other ways to reward valuable employees – bonus structure, flexible scheduling, etc.

Know where to look for maintenance professionals. • •

Visit or promote your management company or community at one of the local vocational schools, like Tennessee Tech. Advertise on GNAA’s JobSource page to reach people who may be planning on coming to Nashville from their apartment profession elsewhere. Ask your high-performing employees if they have anyone in mind who may be a good fit for a current opening. Word of mouth is a great way to find your next hire! Promote from within your organization and train them accordingly.

Never be afraid to provide continuing education to your maintenance team. •

Some companies are afraid they will pay to train their employees only to have them leave for a better opportunity. Mitigate this by creating an environment that rewards education with extra incentives, like a pay increase or increased recognition. Take advantage of the great educational opportunities that GNAA offers throughout the year for maintenance training and designations.

This is why the CAMT designation is important to him.

NAA/NMHC Release New White Paper on Fair Housing NAA/NMHC have released a new white paper examining the diverging standards being used by the Department of Housing and Urban Development (HUD) and the United States Supreme Court in assessing disparate impact liability under the Fair Housing Act (FHA). The document provides an in-depth review of both recent disparate impact cases and rulings and the current political landscape for fair housing issues. During the Obama Administration, HUD actively expanded the use of disparate impact theory in fair housing compliance and enforcement efforts. Their regulations and guidance documents reinforce an interpretation of disparate impact that conflicts with recent Supreme Court precedent and creates uncertainty in housing providers’ use of long-held business practices.

The white paper reviews a range of cases involving tax credit allocation, project decision making, mortgage lending, zoning, preference policies, insurance and screening policies. It concludes that nearly all courts have aligned with the Supreme Court’s disparate impact standard and routinely omit reference to HUD’s regulations in determining whether disparate impact liability exists. This document is intended to provide greater clarity on disparate impact implications for the apartment industry and complements NAA/NMHC efforts to reconcile agency enforcement efforts with actual legal outcomes. It’s the Law

Tenant Not Entitled to a Specific Emotional Support Animal The Vermont Supreme Court recently held that while a resident may be entitled to an emotional support animal, they may not be entitled to a specific animal if that animal shows signs of aggression. In this case, the landlord was within its rights to deny the specific dog as an accommodation. The case began in October 2009, when a resident’s son and his dog, Duchess, moved in with the resident. In December 2013, the son moved out, but Duchess stayed. This was a problem because the resident’s apartment lease prohibited her from keeping pets unless the landlord consented or the resident qualified for a reasonable accommodation as a person with a disability. When the landlord asked about the dog, the resident claimed she had a doctor’s note recognizing her need for an emotional support animal as a result of her disability. However, she never produced the note and never completed the accommodation paperwork. The landlord sent the resident a notice of termination of tenancy for violations of the no-pet and no-smoking policies. Sometime after she received the notice, the resident submitted accommodation paperwork to the landlord requesting to keep Duchess as an emotional support animal. The property approved an emotional support animal, but not Duchess. The refusal was based on the dog’s hostility, complaints from neighbors and the resident’s inability to restrain the dog.

Although Duchess never attacked another person or pet, she did display aggressive behavior towards other dogs and people including lunging, flaring up, rearing on her hind feet, and baring her teeth. Additionally, Duchess often went “crazy” when other residents or dogs passed by the apartment where Duchess lived. The resident told one neighbor that Duchess was trained as a guard dog and asked another neighbor to adjust her dog’s walk schedule to avoid Duchess. When the eviction came to trial, the lower court held that the resident was entitled to an emotional support animal. However, she was not entitled to Duchess. The resident appealed to the Vermont Supreme Court. The Supreme Court agreed with the lower court and the landlord. In the case of a specific service animal, a reasonable accommodation may be denied in two circumstances: if (1) the specific assistance animal poses a direct threat to the health or safety of others that cannot be reduced or eliminated by another reasonable accommodation; or (2) the specific assistance animal would cause substantial physical damage to the property of others that cannot be reduced or eliminated by another reasonable accommodation. Landlords may not rely on the breed or size of the dog or speculation or fear that the animal may harm someone or damage property. They may also not rely on evidence of damage caused by other animals. In this case, Duchess had exhibited aggressive tendencies and the resident admitted Duchess was people- and dogaggressive. Additionally, the resident testified she did not know if she could control Duchess because of her medical condition. continued on p. 19

Let’s be honest, it’s not always easy to have a grateful attitude. The day-to-day activity of life can be draining. Very draining. So draining, in fact, that sometimes all I want to do is complain, cry, complain, take a nap, complain again and then just completely shut out the world for a few days. Maybe I’m being too much, but my point is this: Life can be hard. So hard that we can forget to see the good things within it. So hard that we take things for granted. So imagine my soul-searching moment when I came across these words from Zig Ziglar: “The more you express gratitude for what you have, the more likely you will have even more to express gratitude for.” I thought, Obviously complaining is not helping anything. Maybe my perspective is off. That’s true for the majority of us, right?

The court recognized that the resident could obtain another dog as an emotion support animal, but denied the reasonable accommodation for Duchess because the evidence established that Duchess posed a threat to others and that Duchess would cause substantial physical damage to the property of others. The resident had not suggested any steps to reduce Duchess’ aggressive behavior and the court did not have an independent obligation to introduce additional mitigation methods. Plus, since the resident could not control Duchess, any mitigating measures would be limited.

Something that’s good to be reminded of. The idea that there is so much to be thankful for, despite all the evidence that seems to points to the contrary sometimes. It’s these gratitude moments that should become a part of our everyday lives. Those moments of appreciation for what we do have, instead of what we don’t. It’s easy to get down when nothing seems to be going your way: Life is annoying. Life could be so much better. But when you allow those negative thoughts to pervade your mind, you only push yourself into a hole. Your situation could always be worse. Everything is based on your point of view. It sounds cliché, something you always say to people who complain, whine or show a lack appreciation for what they have. But it’s true. No matter what it is that you want and you don’t have, stop for a moment and think about what you do have. Take a moment to yourself to reflect on where you are right now at this moment of your life. Think about the great people in your life. Think about all the unique experiences you’ve had. Think about the dreams you’ve accomplished. Think about all that you can still do. Think about these things and be grateful. I’m realizing there is always something to be grateful for, regardless of the things that aren’t going exactly are our way. No matter what, we can still choose to be grateful. Your life is constantly changing. Instead of focusing on what you want, focus on what you have, knowing that what you want will come.

A word of caution to landlords: While this case may support your decision to deny an “aggressive” breed of dog as an emotional support animal, you will need solid proof that the particular dog is aggressive and not just the breed.

Our special guest and speaker for the January GNAA General Membership meeting on WEDNESDAY, JANUARY 31st, 2018 is none other than local Nashville legend Jimmy Carter. Jimmy Carter’s Nashville credits include an Emmy for his public service TV work and multiple Emmy nominations for his news, children’s, sports and public affairs specials. He was the recipient of an IRIS award for his special on the celebrated Iroquois Steeplechase. His affiliation with Barbara Mandrell productions as a writer/producer brought about two of the highest rated specials in The Nashville Network’s history. He has been recognized by Who’s Who in America and Who’s Who in Entertainment, and if all this isn’t enough, was most recently honored by Who’s Who Among America’s Teachers, an honor given to only the top 5% of all teachers. Somehow, he finds time to teach two very well-respected classes in the Mike Curb School of Music Business at Nashville’s Belmont University. Let’s fill the Marriott for Jimmy in January!

Busy day for plumbers

The day after Thanksgiving is the busiest day for plumbers, according to Roto-Rooter. Meal prep and cleanup can clog drains and garbage disposals, and guests requiring “additional clothes washing, showers, and toilet flushes put a strain on household plumbing,” the company says. It experiences a 21 percent increase in calls over the four-day weekend than any other Thursday to Sunday period in the year.

Big Bird is a…turkey?

Big Bird’s suit on Sesame Street consists of turkey feathers that have been dyed yellow. The American Plume & Fancy Feather company is responsible for making the suit, and Big Bird is its toughest customer, owner Anthony Trento told CNN in 2008. “His tremendous costume uses feathers from the rear end of a turkey, which are rarely clean. Sesame Street rejects nine out of ten feathers,” said Trento.

Gobble, gobble

Male turkeys, also called toms, are the only ones that can gobble. The females, or hens, make clucking or clicking sounds.

Unusual eats

Americans prefer the white meat of the turkey, like the breast. Other countries prefer dark meat. Pacific Islanders, however, prefer a whole different part of the turkey: the tail. In a news report from the University of Michigan, researcher Sela Panapasa says that many islanders love the turkey tail, or more accurately

“a gland that attaches the tail to the turkey’s body. It’s filled with oil that the turkey uses to preen its feathers.”

Thanksgiving didn’t officially start in the 1600s

Though the first Thanksgiving took place in 1621, it didn’t become a U.S. holiday until 1864; President Abraham Lincoln announced it after the Union army won a battle at Gettysburg. Thanksgiving was set as the fourth Thursday in November, and has been since, except for a brief period towards the end of the Depression. President Franklin D. Roosevelt moved Thanksgiving to the third Thursday in 1939, in an attempt to boost the economy by giving shoppers more time between Thanksgiving and Christmas. This was reversed in 1941.

Flying turkey?

While domesticated turkeys cannot fly, wild turkeys can, for short distances, and at up to 55 miles per hour, according to the NTF. They can also run up to 20 miles per hour.

Canadians have Thanksgiving, too

Americans aren’t the only ones who celebrate Thanksgiving. The first official Thanksgiving in Canada was in 1879, though traditions of honoring the fall harvest predate both the official American and Canadian holidays. The date was moved around until 1957, when Thanksgiving was set as the second Monday of October.

Neighborhood Overview

The Nations Post-Flood Boom by Jo Pulcini

In 2010, the Nations, a neighborhood west of downtown, was mostly underwater. It seemed impossible to imagine that this working class neighborhood would stage any kind of meaningful comeback. However, less than a decade later, the area is growing beyond the wildest of expectations. Its proximity to both the downtown and major highway intersections made the neighborhood primed for a boom. As East Nashville, 12 South and other areas filled to capacity, the Nations became the next target for urban renewal. “This is the most convenient neighborhood in Nashville. It’s close to downtown and has multiple highways to access. We saw that potential early and thankfully it has paid off,” says Justin Canfield, owner of Centennial Bar and Grill. More than simply bars, the area has a robust mix of old and new businesses such as design firms, breweries, fuel and lumber. “It’s not unusual to see a group of guys get off work at the old lumber yard and walk down to the Fat Bottom Brewery to get a drink,” observes new resident Tabitha Davis. “It’s a turning into something special.”
