Sexual Harassment Claims Are On the Rise The #MeToo movement has made its way to the landlord’s doorstep. More and more landlords are finding themselves being accused of sexual harassment by residents and applicants – so many, in fact, that the Department of Justice and the U.S. Department of Housing and Urban Development have taken notice. Lawsuits are being filed and settled in alarming numbers. In June of this year, the DOJ filed a lawsuit alleging a New York landlord sexually harassed female residents and applicants in violation of the Fair Housing Act. The lawsuit also names the landlord’s wife, who is also his business partner, along with two residential property companies, as defendants. The DOJ alleges the landlord: • demanded or pressured female tenants and potential tenants to engage in sex acts with him in order to obtain or keep rental housing; • subjected female tenants and potential tenants to unwelcome sexual contact and groping; • offered reduced rent or deposit payments in exchange for sex acts; • refused maintenance services when female residents rejected his advances; and • made unwelcome sexual comments. If proven, these allegations would meet the definition of harassment under fair housing laws. The DOJ settled a sexual harassment lawsuit against two St. Louis landlords also this year. The amount: $625,000. The lawsuit alleges the property manager sexually harassed female tenants by: • conditioning housing and housing benefits on female tenants’ agreement to engage in sexual acts; • coerced female tenants to engage in unwelcome sexual acts;
• subjected female tenants to unwanted sexual touching and other unwanted sexual acts; • made unwelcome sexual comments and advances to female tenants; and • took adverse actions against female residents when they refused sexual advances. Under the settlement, fifteen women will receive $600,000 and the landlords will pay a $25,000 civil penalty. Neither landlord will not be allowed to continue to serve as property managers. Just two days following the announcement of the St. Louis settlement, the DOJ announced it has sued two Cincinnati landlords for similar acts. The Cincinnati lawsuit alleges unwelcomed sexual advances and comments, unwanted sexual touching, offers to reduce rent and overlook or excuse late or unpaid rent in exchange for sex, evicting or threatening to evict female tenants who objected to or refused sexual advances, and entering the homes of female tenants without consent. HUD also announced three settlements in April 2018, involving allegations of sexual harassment. The settlements total approximately $125,000. Florida - $75,000 – A Jacksonville, Florida Housing Authority paid $75,000 to settle a claim that a female resident was sexually harassed on multiple occasions by a Housing Authority employee. The alleged harassment included unwelcome sexual comments, requests for sex or sexual favors, and threats of eviction if the tenant did not submit to the requests. Virginia - $37,500 – HUD settled a complaint made against an independent living facility alleging the facility failed to take reasonable steps to prevent sexual harassment of a female resident by another resident. The female resident alleged that a male resident harassed her with unwelcome and unsolicited advances, made suggestive comments, whistled at her, and followed her around the apartment complex. The facility agreed to pay the victim $37,500 and adopt a sexual harassment policy. continued on p. 17

How the “Internet of Things” (IoT) Will Make Us More Like “The Jetsons”! by Jason DiStefano, COO and JD Wright, CEO, Universal Media Group
Remember the funny cartoon series when George Jetson lived in a world that was fully autonomous? Food materialized in a machine. Conveyor belts replaced walking through buildings. Self-driving flying cars ruled the sky. Robots assisted in daily life. In an Orwellian twist, science fiction is becoming a reality. Welcome to the “Internet of Things” – (IoT). In the very near future, everything that has a “sensor” will be connected to the Internet and connected to anything else that has a “sensor” or “edge devices.” Previously, each device operated independently of other devices. They haven’t all been connected. That is all about to change! Before you wake up in the morning, your phone is already counting down with an alarm to start your day. In the near future, lights automatically turn on slowly and the temperature in the house adjusts, followed by the coffee maker starting your first cup of coffee. The hot water heater turns up temperature an hour before you wake, so the water is hot and ready for your shower. This is followed by an alert that the self-driving car is on its way to take you to work and a reminder of all the things you need to complete for the day. And your refrigerator messages you that you are low on milk, juice and eggs. So those groceries are purchased with the credit card on file and scheduled for delivery to your house within minutes of your arrival home,
at the end of the day – meet George Jetson! Actually, it’s you! In just a few short years… With the introduction of “Fifth Generation (5G) wireless connectivity” and a surge of new “sensor” connected “edge devices,” daily life will be very different in a world with the “Internet of Things.” This is not just connectivity, it is hyper-connectivity that’s cloud based, so devices that were once static and stationary become part of something much larger. This is similar to how 4G LTE made social media a world-wide phenomenon. Prior to 4G LTE, most social media was constrained to the PC or laptop. Today, social media and the mobile phone function is a gateway to the world and everyone in it. The evolution of 5G and “edge devices” will change everything we do and the way we do it – again! It is interesting to consider where we are going as a society and how these new “edge devices” and technologies will affect our lives. But one thing is for sure, and that is we will be connected more than any time in history, to everything.

It will change everything residents do on property. Following is a short list of the IoT “edge devices” to prepare for: continued on p. 13

The multifamily industry will need to prepare for more infrastructure development than ever before, to assist with the transfer of data. Existing properties with only the traditional coaxial copper cable will want to fully upgrade with fiber throughout the property. In addition, IoT will run largely over the 5G “wireless” network, with national deployment projected by 2020. Since 5G operates in the millimeter wave bands, it is “short wave” and will require additional 5G nodes/modems installed within the building to handle the additional data traffic coming from “edge devices” within the building. In other words, it’s time to build a bigger information “super highway” inside the property, to handle a lot more traffic than ever. It is interesting to note that a recent survey showed more than 40 percent of Millennials would forgo a parking space for a “Smart Apartment.” This desire has been fueled by the explosive growth in transportation apps like Uber and Lyft. Many young Americans who live in urban centers in multifamily properties do not need to own or pay for a vehicle. As a result, they have extra income to put towards the amenities that “Smart Apartments” provide. To understand the massive change that is about to take place through the Internet of Things via the deployment of 5G, look no further than a quote from a recent Forbes

The multifamily industry will change with it, because residents will want and demand these new services in a world with the Internet of Things. So maybe you might feel a little more like George, Jane, daughter Judy and his boy Elroy as you all zip through town in your self-driving Uber, on a predetermined route to your favorite restaurant, where the food is already waiting when you arrive! It’s the Law, cont. from p. 5 California - $12,000 – California landlord agreed to pay $12,000 to settle a HUD complaint he made repeated unwanted sexual advances towards a male tenant with a mental disability and ultimately evicted him for refusing the advances. The landlord also agreed to attend fair housing training. The DOJ and HUD take allegations of sexual harassment very seriously. The DOJ’s Sexual Harassment in Housing Initiative (SHHI) was launched in October 2017. HUD joined the Initiative in April of 2018 and it expanded nationwide. The Initiative specifically seeks to increase the Department’s efforts to protect individuals from harassment by landlords, property managers, maintenance workers, security guards, loan officers, or other people who have control over housing. The DOJ alleges it has filed or settled ten sexual harassment cases and has recovered over $1.6 million for victims of sexual harassment in housing since January 20, 2017. What does all this mean for landlords? Mixing Business with Pleasure! At GNAA, we are all about making work fun. We are part of a great industry here in Nashville, growing by leaps and bounds each year, and we work hard to make sure our members get the most out of our association. But we also like to plan fun networking and educational opportunities throughout the year as well. One of the biggest and most important of these events is our annual Election Night. Each year GNAA members are charged with the task of electing new representatives for the GNAA Board of Directors. This board oversees the many committees and the financial strength of GNAA, so it is both an honor and a tremendous responsibility to be nominated and win a spot. Election Night is obviously the culmination of the entire process as we gather to cast our official ballots for the open positions. This year we have the following positions which voters will elect: Chairman, Chairman-Elect, Vice Chairman, Secretary/ Treasurer, Management Director (3 open this year), Associate Director (3 open), Maintenance Director (1 open), and then one Managers Representative, Maintenance Representative and Associates Representative. Make sure you cast your ballot this year! Even though our election is a very important and serious matter, we can’t help but make it a fun night for all. That is why it is combined with our Halloween theme each year…and this year’s theme is one of the best. Get ready for the Masquerade Ball! Come in your fanciest Masquerade costume to try to win one of the many prizes given away throughout the night. Will you be Best Costume? Scariest? Funniest? We can’t wait to see who comes as what!

nce a year in a location downtown, magical things begin to materialize. All things with sparkle and bling begin to shine. Everyone pulls out their very best apparel, outfits that shimmer in the night for the ladies and black tie for the men. They all are drawn into the evening for festivities and recognition. Everyone greets old friends and colleagues and admires the festive attire. We wonder at the lovely setting of the ballroom and can’t even imagine how it was transformed in just one day. As we sit down to a delicious feast and toast each other with tasty cocktails, we only dream of the accolades yet to come. What is this event that captivates our industry? It’s the GNAA Awards & Installation Banquet (also affectionately known as the Apartment Prom). Once a year, our membership gathers together to salute the best and brightest of the Nashville multifamily industry. The Banquet provides an outstanding opportunity for the membership to come together in a social setting and celebrate the past year. The newly elected Officers and Board of Directors will be duly installed so that our organization continues to move forward with the outstanding staff led by Diane Carter in the upcoming year. Then comes the eagerly awaited moment when award plaques and trophies are handed out from the stage to deserving members, communities and companies. The sought-after Beautification Awards put the spotlight on the best of flowers, clubhouse, pools, maintenance shops, models and renovations along with overall beautification awards. The Supplier Members look forward to the Trade Show Awards! They work hard on the booths each year.
The Membership Committee also presents the Go-Getter Awards for recruiting new members for GNAA. Members excitedly congratulate each other as they make their way to the big stage for well-deserved acknowledgement by their peers. The prestigious Diamond Awards are announced for the professionals from our industry who have gone above and beyond in the past year for GNAA. These awards are given to all levels of management professionals, supplier partners and their companies. The Lifetime Achievement Award is presented to a member whose leadership and commitment to GNAA and the multifamily industry has been exceptional throughout their career. This year’s event is entitled “All that Glitters” and is even more special as GNAA celebrates the 50th anniversary of the association! There promises to be moments during the evening when we look back and salute the past years together. The Banquet Committee started working on the event almost before last year’s event was finished. The committee has been led by Linda Page for many years and this year Tracey Crowe serves as co-chair. Together the volunteer members and the staff are tasked with every detail that makes this affair appear effortless. At the end of the evening they will draw a collective sigh and toss the evening’s agenda over their heads as they enjoy the music from the dance band Burning Las Vegas.
