It’s the Law

Communication With Residents Must Be Consistent Communication is key in any relationship. When communicating with residents, it is important to be clear and precise about the message that is being sent. Whether the communication is a verbal conversation with a resident you see while on the property, a friendly written reminder concerning late rent, or a formal legal notice, vague, confusing, or contradictory language can have unwanted consequences. The most common example, as it relates to legal matters, concerns breach of your lease. What means of communication are we concerned with when going to court? The list has become longer as multiple methods of communication continue to develop. Further, as statutes and regulatory measures force our policies and procedures to expand, those policies and procedures also become relevant to our communications with residents. In what should be the simplest of court cases – a breach of lease by non-payment of rent – our written documents, forms, and communications must all deliver the same message. With the great number of ownership and/or management changes in the Greater Nashville area, many of our communities have residents who are accustomed to the former management company’s practices. As part of a transition, with a friendly, proper notice, we should inform our residents of the new policies and procedures. If new management immediately attempts to suddenly shorten the length of time allowed before beginning a non-payment eviction, the resident may have a viable argument concerning the prior established business practices by Nathan C. of previous management. course, any reference in the resident’s existing lease regarding these time periods must be recognized. As technology continues to expand its role in our daily business practice, we must be mindful of the new features this technology brings, such as automatic late payment reminders, text and email blast capabilities, and online portal access. While these features increase efficiency, be sure that the automated messages parallel and remain consistent with established practices and procedures. For example, during the eviction process, the resident receives a text, email, or billing statement reminding them to pay their rent immediately to avoid late charges. The resident now wonders, “Do they want me to move or pay?” While the answer may be both, these kinds of mixed signals give a resident an opportunity to claim that they were totally confused by this inconsistency. While we understand that these arguments are just excuses for failure to timely pay rent, when these facts are brought out in court, it could possibly buy the resident extra time, or it may alter the outcome of the case entirely. We don’t want to give any reason for the denial of our eviction demand. The solution to avoid the resident’s use of these kinds of excuses is simple enough. Make sure that every level of your management team understands the community policies and applies them consistently. If there is an automatic system that reminds residents to pay their rent online, be sure these communications, and the ability to pay, are deactivated while a resident is under eviction. With appropriate training, good communication among management team members, and careful attention to the message delivered, you can avoid derailing an eviction case. Be clear, precise, and consistent.

Spring Has Sprung! Spring officially started a couple of weeks ago, but we in the multifamily industry have months to work on creating success during this busy season. We would like to thank our three board representatives (Managers Rep, Suppliers Rep and Maintenance Rep) for sharing their perspectives on what we all can be working on this quarter!

Spring Has Sprung… for Managers by Giovanna Suastegui, GNAA Managers Representative

Spring is the time when the rental market comes back to life – we have people staying, or starting to look for their new home. After months of rain, wind, and even some snow, exteriors need a lot of attention. A few simple measures will keep your property in good condition which adds value and maximizes its appeal to tenants, prospect and future residents. Here are a few things you should consider for your spring checklist: • Walk your property to look for any damage. Walk the outside of your property to check any damage that weather may have caused, from leaky roofs to chipped paint and clogged gutters. • Bring back unfinished projects. While a lot of improvement projects couldn’t get completed due to weather, this could be a perfect time to start planning. Make a list and prepare a timeline to start knocking them down. Look back at last year and find common projects you need to repeat or change. • Get your team involved. Preparation is key. Involve your maintenance team in getting things ready and organized with the right tools and inventory needed for any projects you have planned. • Bring back color. Curb appeal is in the details. After a cold winter, your grass and flower beds need love and tender care. A fresh layer of mulch, new flowers and clean pool furniture does the trick. This will help catch the eyes of prospective renters as they drive through the neighborhood.

• Refresh your office. Springtime is the perfect excuse to spruce up your office. Research color trends, fragrances and visual prints. Simple updates such as colorful new pillows, a new area rug, new fragrance diffusers or a couple of colorful vases will do the trick. • It’s all about preventive maintenance. As the warm weather approaches and the work orders are still slow, get a jumpstart on replacing A/C filters and checking smoke detector batteries. This simple action will keep your residents happy.

I sit here and look out my office window as the doom and gloom of winter still hovers overhead. I can’t help but find myself daydreaming about what’s to come. Then out the corner of my eye I catch the clouds starting to part and sunshine trying to break through. The flowers and trees are starting to bud and the sun warms my face as I run out into the rays beaming down from the heavens. Spring is here! Spring is finally here! Let us shed the darkness and embrace light! Farmers spend the winter planning for the spring to start planting their seeds to yield a bountiful crop. Suppliers, just like farmers, must spring into action and cultivate our relationships and begin new ones. Let the sun and the promise of new and great things to come be your motivation and inspiration. Let’s use the opportunities we have been working on and make this spring the beginning of something amazing we can share in the fruits our labor. The sun brings and gives new life to all things, and we can use that energy to full effect. I encourage you to join a committee, and introduce yourself to new people you’ve continued on p. 11

There’s no time like the present to work on growing your network and business, and the GNAA is one of the best resources available at your fingertips. So grab your sunglasses and get out in the sun and let’s make this the best year! If we work together toward a common goal, just as the farmer, we will reap benefits that will come to serve us for years to come. See you out there and look forward to sharing some sun!

A/C season is not far off. It will really pay off in the long run to start preventive maintenance early. Pick a building a week and do a filter change, flush condensate lines, lube fan motors and inspect lines and wiring. Ideally, if you pick a warm day turn on the A/C. It’s much easier to repair one or two now than twenty the first time it hits 80 degrees. This is also a great time to conduct a maintenance shop inventory. Check your A/C supplies, freon, filters, relays, capacitors and freon logs. If you have the ability, have extra condenser or blower fan assemblies – it can save a lot of time, especially at two o’clock in the morning.

The list seems to be a lot of work, but starting it early makes it much more manageable. Since I have learned that it’s very difficult to plan much in this business, my best piece of advice is just make the time and “Do It.” I guarantee it will pay off and make your life easier.

The start of spring and the warmer weather that comes with it is a critical time for apartment maintenance techs. Now is the time to start your preventive maintenance checklist, since it is generally a slower time of year. Taking care of small issues now will ensure that they don’t balloon into larger problems. If you address issues now it will ensure your property is in top shape for peak leasing season. Spring is the best time to check the physical condition of the property itself. It’s ideal to walk the entire outside of every building. Check the roofs for any missing shingles, ridge vents or flashing (I have used binoculars to get a better look). Look over all the siding, trim, gutters, downspouts and even window screens. If the gutters haven’t been cleaned, have them cleaned early in the year. Take notice around your condensing units – landscapers love to pile leaves and mulch around them, weedwhack low voltage wires and step on the line sets. Check around for any tree damage, overhanging limbs and dead or overgrown shrubs. Storm drains are a great leaf collector – now is the time to clean them. If you have a playground, grilling area or pet park, check all the equipment for wear or damage. It’s also is a good time to pressure wash the equipment. Pool season won’t be long in coming. If your pool looks like a frog pond, start getting it ready now – it’s much easier than two days before pool season. Clean out any debris in the pool, skimmers and filter baskets. This is also a

Ad Blockers: A Millennial’s Friend, an Industry Enemy by Dee Wilson, Freeman Webb

As an industry we spend millions of dollars yearly on online advertising, whether through social media or publishing sites like Apartments.com or Apartment Guide. We expect a return on our investment, and when we don’t get that we pour more money into the advertising monster which follows a customer from site to site in hopes that they will click on our ad so we can see our PPC numbers increase, which gives us hope that it’s working. Last year 63 percent of millennials used AD BLOCKERS when surfing the internet and only 6 percent think online advertising is credible, so what does this mean for all the money we are pouring into online advertising? It means we have to find a back door. With 40 percent of Millennials referring to online reviews and testimonials before purchasing, we can depend on advertising that costs us no money, like reviews. Testimonials will impact a buying decision before a pop-up ad, especially if it’s from a relative source like a friend or colleague. So the next time you’re thinking of putting money behind an ad on social media, consider a real live testimonial from a current resident or send your new move-in a referral link to share with their friends and co-workers.

If I could write a book… Don’t we all have some funny stories from our time in multifamily? The News & Events Committee thought we could get so many that we could make it a monthly department so we all have a good laugh. If you would like to share something that has happened to you, please send it on to scottmeert@gnaa.org. We would love to hear from you! Here are just a few of the ones we received this month:

bathrooms kept backing up. If Maintenance could not clear the drain, we would call the plumbers. We finally decided to have a plumber camera the lines. I will never forget the look on the plumber’s face when he walked into my office to inform me of his findings. After minutes of hesitation he said, “It looks like a monster or some kind of alien!” I was in complete disbelief and had to see for myself. Once I laid eyes on the camera footage, I realized two things: One, the man was NOT exaggerating, and two, I had no idea how I was supposed to explain this one to my boss. I called my Regional Manager, who laughed and laughed and laughed at me, who then called the Director of Renovations who was getting on an airplane. He dropped his luggage and laughed so hard that the stewardess had to check on him to make sure he wasn’t having a stroke. After more disbelief of what I had seen and much research, we discovered that the “Sewer Monster” was actually Tubifex Sewer Worms…aka a Real-Life Sewer Monster. YOUTUBE IT, PEOPLE! – a non ymous

dishwasher. When I went to the apartment to check it, I realized it was a new dishwasher I had put in two weeks earlier doing the turn. I checked out the dishwasher and ran it through the cycles and it was fine. One week later I got a work order for the same dishwasher. I went to the apartment, turned it on and sat through the complete cycle, with absolutely no problems. One week later another work order came in for the same dishwasher. This time I told

the office to tell the resident to call the office when he was home. The next day he called so I went to his apartment. He let me in and in very broken English told me about his dishwasher and how it was not working. I proceeded to open the dishwasher and it was filled with clothes. I told him I’d be right back as I didn’t want him to see me doubling over laughing. –ron ko m a n

in property management, one chapter would be about the time I toured a very cute guy who really liked the apartment and decided to lease. Once we returned to the leasing office and he completed the application, I reviewed it to confirm he had provided all the required information. I noted he included “Sawyer Brown” as his employer. I then said, “I love Sawyer Brown, what do you do for them?” which he replied “lead singer.” Awkward! I would also tell the story about the time as a brand new manager, I bravely started eviction procedures on a resident who had not paid rent and had told me to expect evidence of drugs in his apartment should I ever enter, as he did work for Drug Enforcement (which turned out was not true). When he received the eviction notice he came storming into my office screaming at me, leaning over my desk. On shaky legs, I stood up and asked him to leave or I would call security. He backed off, turned around, and left the office. I was so proud of myself as I turned around and noticed my maintenance staff was standing behind me (a door to the maintenance shop was behind my desk and they heard the resident yelling). 90’s when things were not so scary – I had a police officer come to the office wanting information about a resident (female). I asked him for identification and he said his uniform was identification enough. Trying to be tough cop, I said no, that I need to see his badge and ID info. He pulled out his driver’s license and I said that did not prove that he was a police officer. I said he would have to have a warrant for the information and he huffed out to his pickup truck and left. Come to find out he saw the girl at his nephew’s ballgame and thought she was cute, and heard her tell a friend she lived at Polo Park Apartments. He was hoping we would give him her name so he could ask her out on a date to the next ballgame. By the way, he was a real police officer, off duty at the time, and they eventually went out on a date with no help from the office. This would be scary today! – na nc y morris

a gentleman failed to pay rent on time and was

turned over to my office for eviction. Upon receiving service of his detainer warrant, he called me to advise that he didn’t pay rent because his son had been kidnapped and he had to use his rent money to pay the ransom. I asked if he happened to have a copy of the police report. Of course, he didn’t have a police report. Turns out, he didn’t even have a son.
