Evictions in the New Normal Slowly but surely, life in the Greater Nashville area is getting back to “normal” after an unprecedented shutdown as a result of the coronavirus pandemic that gripped an entire world. Businesses are reopening, restaurants are getting back to dining in, and people are emerging from their homes eager to get back to work and to their daily routines. But what does this new normal look like, and more importantly, how will it affect rental properties and the eviction process going forward? Your friendly neighborhood evictions law firm (i.e. The Law Office of Jennifer McCoy) is here to help with the following tips and guidelines that will assist in navigating through these post-pandemic waters.
Federally Backed Mortgages and The CARES Act The CARES Act is legislation passed by Congress and signed by President Trump designed to help individuals weather the coronavirus pandemic by providing financial assistance and placing a moratorium on evictions. With the courts preparing to reopen soon, this moratorium will be lifted – but with a few exceptions. First, it is important to note that the CARES Act applies only to those properties whose mortgages are backed by the federal government. If you are not a federally backed

property, these exceptions will not apply, and it will be back to “business as usual” once the courts reopen. For those properties that are, here is what you need to know: • The moratorium is scheduled to end on July 25, 2020. However, evictions cannot be filed on this date. The CARES Act requires that 30-day Notices to Pay are mailed to those residents who are behind on their rent due to the pandemic. • Notice to Pay letters can be mailed beginning on July 25, 2020. This means that if there is no response to a letter, the earliest an eviction can be filed with the court is August 26, 2020. • Evictions due to lease violations are excluded from the CARES Act, regardless of a property’s mortgage status. In other words, if you are a property with a federally backed mortgage, you may proceed as usual if an eviction is the result of a resident violating his or her lease.
Anticipated Challenges and Tips on How to Handle Whether you are a CARES Act property or not, do not expect smooth sailing once the courts reopen. There will be a backlog of detainer warrants and writs as well as on executions for both. Dockets will be overfilled and limited. Judges will be sensitive to the plight of residents; especially to those affected by the virus. For the foreseeable future, residents will continue to use the pandemic as an excuse not to pay their rent. Understanding these challenges exist and keeping an open dialogue with your attorney are essential for ensuring your evictions are being handled properly and as expeditiously as possible. Most importantly, patience will definitely be a virtue during this entire process. As always, when in doubt, ask your attorney!

They joined forces with another catering company in the area nd have had a lot of donations to carry them through. Donations have consisted of food, flowers, signs, and desserts from local bakeries, and of course, monetary donations!
The Liberty Group (Taylor, Joy, Kelly, DJ & Brandi) stepped up to help with cleanup efforts after the 2020 tornado ripped through Middle Tennessee.
BluSky handed out 750 Chick-Fil-A boxed lunches as a thank you to healthcare professionals, in light of COVID-19.
Music City Removal used their trucks to deliver items from a local organization to a church in North Nashville. Mike also told us they rescheduled all jobs the day after the tornado and sent their trucks out to East Nashville to clean up debris in the streets.

We live for these events – the relationships, experiences and smiles made are a big part of what we want all our Bridge Residents to have when they come live in any of our Bridge communities across the country. Bridge Resident Events are full of creativity while trying to give our residents something to look forward to that’s different. When COVID-19 hit, our teams took what they already knew how to do and made their events brilliant during this pandemic where anything social felt like a blessing! There are so many events to share as there have been so many great ones! We had a number of our properties throw Pandemic Patio Parties where our residents came out to the patio dancing to the music our teams had. Our teams were throwing prizes while some were having contests for best patio decorations for the party. One of our largest properties outside Dallas, Texas created a “Bear Hunt” event based on the book “We’re Going on a Bear Hunt.” They had teddy bears hidden throughout the community for the kids to find and keep! Another one of our properties in Chino Hills, California has been cranking out the events on social with pet picture contests and best decorated home contests. Keeping residents connected to others has been key. We want to make sure they know we are there for them! We have also had a lot of our properties partner up with all sorts of food trucks, making it a party with fun music for their residents while they waited in line for some pretty incredible food! We’ve done Stay Home Carwashes, Virtual Movie Nights, Virtual Game Nights, Virtual Craft Nights, Virtual Dance Contests and Recipe Contests, to name a few more things. We have been busy!

Buckingham Companies Buckingham Companies is striving to keep some normalcy in our communities. The past few months have proved challenging for everyone; however, we hope our virtual and in-person distancing events created some smiles and hope. Whetstone Flats had a pizza delivery event providing all their apartments with a free pizza delivery. In addition, they also had a Whetstone Flats Cribs event where residents submitted a 10-second video of their apartment décor, with a gift card presented to the winner. They also had residents email their top favorite inspirational songs during COVID to create a property playlist. Each resident who sent music (three categories: music that inspires, music to dance or work out to, and a throwback song) was entered into a drawing for a $25 gift card. Aertson Midtown had Tiffs Treats delivered to their residents’ doors, because everyone loves a warm batch of freshly made cookies. Their residents also participated in a social distancing event where essential items were given away as well as fun board games, paint-by-number kits, and coloring books.
Capitol View Residences at Capitol View has been thinking outside the box for their residents. They transformed a unit into a “wellness room” equipped with zero gravity chairs, essential oils and diffusers. The idea behind creating the space was to give residents a home away from home – a place to read, do yoga, meditate, hang out, or simply get out of their apartment. In addition to the wellness room, they host courtyard concerts where local artists perform in the courtyard or Zen garden. Residents are able to practice social distancing by enjoying the show from their balcony or on Instagram live. In addition to supporting the Capitol View restaurants, the property hosts food trucks every Tuesday. All orders are placed online to practice social distancing. These are just a few examples of how they are using their space to make the most out of the current situation.

GNAA UPDATE
GNAA Is Working On Our New Normal The Greater Nashville Apartment Association is excited to be back in the office and serving you, our members, with the excellence you deserve. We are working hard to create a new normal in our offices while providing education courses, meetings, and events to keep you engaged with GNAA. GNAA is striving to continue to bring you the Gold Standard in Education. Doing our part to keep you safe in our Education Room, we have made these changes and additions: • Our seating has been arranged to accommodate social distancing for our student-participants. • We have added the availability of masks, hand sanitizer, and have a touchless thermometer on hand. • Before every class we sanitize the desks and chairs. • After every class we use a disinfecting fogger to help keep the room germ free. On May 19 we re-opened our Education Room and were pleased to hold our first class with 13 attendees for the Through the Eyes of an Asset Manager training. Then, just a couple of days later, we had 34 attend the HVAC Certification Course. It feels good to be back and doing what we do best!
Virtual Classrooms We have started adding more virtual classes to our lineup. Virtual Classrooms will allow safe and convenient access to the important training you need to stay at your professional best. New classes are being added every week, so keep an eye on your email for the most current offerings.

Zoom Meetings GNAA has added Zoom for committee meetings. Currently, all our meetings are being held through this platform to keep in compliance with Davidson County guidelines. However, we are hoping to keep this option in the future to allow folks to attend in person or “zoom-in” when needed. We believe this will make it easier for more people to participate in this vital part of Association Membership.

The Roaring 20’s Trade Show is a great time to reconnect with old friends and meet some new ones too. We have a lot of new members and leaders who have joined the Association this year, and the Trade Show is the perfect setting to get to know them. With over 150 supplier exhibitor booths, there will be lots to see and learn as you meander through the Gaylord Opryland Event Center. As in the past, there will be free parking, door prizes, and food. Plus, there will be an award for Best Management Company Team Spirit! Greater Nashville Apartment Association Reports: 14,149 units are currently under construction in the Greater Nashville area (includes 14 counties in Middle Tennessee) according to the 1st Quarter 2020 report. Through the 1st quarter 357 new apartment homes (units) were completed and ready for residents. Occupancy and Rents:
Overall occupancy was 94.17%. Occupancy ranged from 92.03% to 98.86% in the 20 tracked zones. Overall rent was at $1,279/month with a range of $1,023 in Dickson and Robertson Counties to $1,965 in Downtown. View details on occupancy in the charts below.
