COVID-19, Courts, CARES Act and the CDC What It All Means for Your Property by Rob Hill & Gary Rubenstein
“Would you tell me, please, which way I ought to go from here?” “That depends a good deal on where you want to get to.” “I don’t much care where.” “Then it doesn’t much matter which way you go.” –from “alice in wonderl and” If you feel like you’ve fallen down a rabbit hole this past year, you’re not alone. Tennessee courts are closed for us through March 31. There is a backlog of cases. First available hearing dates are in April, May and later. File now to save a place in line. Maybe the knock of a deputy or a call with your lawyer is all it will take. Many leases waive notice of non-payment of rent. Nonpayment can be a quick basis for eviction. But we’re in the rabbit hole. Local relief agencies funded by the CARES Act paid out billions of dollars for rent assistance last year. They ran out before the holidays, but December stimulus money has arrived. Metro Action Commission recently received $20 million and the United Way recently received $725,000. Reach out to agencies and tenants now. If agencies help tenants catch up, maybe they can stay caught up. The CDC has extended its moratorium order against non-payment evictions through March 31. It could be extended further. Once a CDC Declaration is presented, the eviction process will stop. A deputy in the middle of a set-out will stop. Consider every option. Talk with your lawyer. Maybe the eviction process can resume. The Landlord/Tenant Act has not been amended in response to COVID-19. The CARES Act and the CDC News & Events
order are new federal laws being interpreted differently by different judges. Their rulings determine, among other things, whether and how you can challenge a declaration. The Courts have closed and reopened and closed again. Dockets have been capped. Dockets have been added. Procedures and practices can change daily. Fortunately, the attorneys representing many GNAA clients communicate with each other and share news of breaking developments. What can you do? As much as possible, proceed with business as usual. Talk with your tenants. What’s changed since you placed them? Without making their issues your own, what can you do to help them address the change? To the extent you can, help them help you. Seek resolution, then move forward with evictions, if for no other reason than to get in line. Cases that are resolved can be removed from dockets, opening up room for others. While you may not be able to appear in court until April, May or later, you should use all remedies available under law. When possible, rethink old options. The CDC order doesn’t apply to non-renewals, so maybe month-tomonth leases can reduce risks. Everyone needs cash to move so maybe cash-for-keys will get some movement. Putting aside rent, sometimes it’s just better to keep places occupied. Be grateful to be alive and working. COVID-19 has hit the apartment industry hard. Lack of assistance and staff illnesses, unemployment and unpaid rent, regular problems are exacerbated. Many of the decisions that impact multi-family housing are the result of political decisions and influence. Your attorneys will continue to report to you regarding changes in the legal landscape. Effective Communication with Residents There’s no shortage of effective ways to communicate with residents in an apartment community. Clear, simple and effective communication is paramount, while still being able to maintain a level of sanity from the sheer volume that is necessary. On-site teams are inundated with multiple tasks to keep the property running smoothly. Management companies want satisfied renters and strong retention rates. Having a wealth of amenities, a well-maintained property, and clear guidelines are important, but without effective communication with your residents, the relationship suffers. Gone is the era of flyers or mailers being placed in the resident mailboxes. Today, residents expect a certain level of electronic means to the community and with the staff. The amount of time, energy, and expense necessary to draft a flyer, have it printed, and then have staff tape or post the flyers throughout the community can be expensive and time consuming. Having a digital method to post community events, announcements and concerns is crucial to having effective communication with residents. While at first this may appear to be a simple issue, it is one that converts to dollars. Having an effective line of communication with your residents causes a sense of community within the residents and increases the renter-retention rate within the community. According to RentPrep.com, the average apartment turnover rate is around $1,750 per month – although that number can be drastically different depending on what your property costs, where it is located, and how much work needs to be done.
The most common costs associated with apartment turnovers are: • Rent loss during vacancy • Marketing costs to find new tenants • Time and money cost of screening tenant applicants • Maintenance (repairs, upkeep, etc.) • Paint and carpet improvements • Cleaning • Utilities (for the ones that need to be kept on) Each of these costs occur every time a tenant decides to move on to another property. Following up with residents regularly helps build longterm relationships with them. Moreover, having positive relations will also lead to more harmony and fewer conflicts to which managers would otherwise need to dedicate their time. Some effective methods of communication include: • When a resident moves in, send them a welcome packet that contains information on amenities, policies, service expectations, contact information, how to pay rent, and other local services to help get them settled into the area. • Check in with new tenants regularly. Ask them how their move-in experience has been and if the transition could have been better. Be open to constructive criticism. • Build tenant engagement by sending monthly communication via email or social media that talks continued on p. 18

OK, Google, What’s New with You?
A Look Into the Google Core Updates and Google Analytics Updates by Heather Johnson, DevDigital Throughout 2020 Google was busy. Releasing three separate core updates and the GA-4 Google Analytics property in one year was no easy feat. All these changes certainly kept marketers and business owners on their toes adapting and changing strategies to keep up with the updates.
But what is a Core Update? A Google Core Update is a significant change Google makes to its search engine algorithm in an effort to enhance the user’s search results. The goal of these updates is to bring more quality results to your search queries and to try to minimize irrelevant content coming up higher on search results. In other words, to provide more relevant, useful, and trustworthy content. The quality or authority of your site is measured by what Google calls your site’s “Core Web Vitals.” These “vitals” give marketers a guideline of what Google focuses on when ranking your site to determine your site’s relevance to a search query.
2020 Core Updates in Review A little behind on Google’s updates? Not to worry, there is still time to adjust your marketing plans to keep up with what’s new with Google. Here’s a recap of 2020’s core updates: January 2020 – A look into the E-A-T algorithm update. This Google Core update focuses on content and these News & Events
three web vitals: Expertise, Authoritativeness, and Trustworthiness. Page speed also played a crucial factor in this update. May 2020 – By far the May update was the broadest and most impactful update of the year. Thanks, Covid! This update was intended to fact-check sites and protect users against possible harmful information related to COVID-19. This update was a broader form of the January update looping in Link Quality as another ranking factor. December 2020 – Google decided to close out 2020 with a bang launching its largest core update of the year. This update had a strong focus on authority and CTR (click-through rate).
A Look Ahead to What’s In Store for 2021 Google has started leaking out information on the next core update coming up in May 2021. This update is gearing up to be one of the most impactful of the last few years. Its main focus? Mobile-Friendly websites! According to Google, there are 27.8 billion more queries performed on mobile than on desktop in 2021. Google has taken notice of this and has warned marketers that now is the time to focus on your site’s mobile responsiveness and overall mobile experience. Keeping information in the same place consistently helps improve your overall user experience.
Google Analytics New GA-4 Property Google Analytics has recently announced a major update to its software. The new version of Google Analytics 4 (GA4) comes with several new features that are entirely different for web and mobile tracking. The new version may be a bit overwhelming, but don’t let this discourage you. Google Analytics is one of the most popular digital marketing software tools that track users, monitor marketing channels, and provides valuable insights that can help grow your business. It’s completely free and used worldwide by millions of marketers and businesses. Some of the new features include: Customer Journey: Google’s advanced machine learning models can automatically provide helpful insights into your data and can anticipate the customer’s future actions. The AI fills in gaps within the data for the user’s journey that Universal Analytics was blocking. Events: GA4 will now allow you to edit events without having to edit the code on the site. The original platform was required to modify the Analytics tracking code or gtag.js script. With this new feature, it will now reduce the time for any internal changes. Goals/Conversion: You can now refer to Goals as Conversions. The new feature will now be event-based

and not the URL. Once your property is set up and installed, the enhanced measurement event tracking must be enabled to capture more events as conversions within the property. Google Ads: Users can now build and maintain the channels from visitors across the web and app. If a user is taken off the web and redirected to the app, the list would be automatically updated and the user removed so they are not targeted with ads. Don’t feel comfortable upgrading to GA4? Don’t worry. As of right now, Google has not announced when they will discontinue the Universal Analytics version of Google Analytics. All new Google Analytics accounts created will have to be Google Analytics 4, but there is no date for when a user would have to convert the old accounts over to Google Analytics 4. You still have time, although it is encouraged that you create a new Google Analytics 4 property (previously called an App + Web property) alongside your existing properties to start collecting the data now in order for the AI engine to pull that data. Just be very careful when upgrading your account to avoid any disruption with your analytics.

Zoom meetings and conference calls are increasingly acceptable means to conduct sound business and safe court. Digitized documents and e-filing are coming soon to a state court near you. Like businesses, the courts are using technology to reduce queues. We welcome these conveniences that increase access to safe and speedy justice. In recent news, the Metro Action Commission and the United Way have received a new round of federal funds. Davidson County General Sessions Court has established a new housing court. Approximately 1,800 eviction cases are being transferred to the housing court. The stated goal of the new court is to mediate cases and use federal funds to catch up rent. Tenants can avoid evictions and landlords can put money into their pockets. The details are being fleshed out as this article goes to press but this partnership between the court clerk, the Metropolitan Action Commission and presiding Judge Rachel Bell will hopefully help ameliorate this housing crisis. 18

Each of these options can build a strong sense of community, which equates to better retention, which equals cost savings for the property. The bottom line is that a better relationship and reputation for honest and open communication equals a better experience for you and your residents.
