Bill to Clarify Assistance Animal Documentation
The Tennessee State Legislature convened for the second session of the 113th General Assembly on Tuesday, January 9, 2024. The Tennessee Apartment Association (TNAA) exists to serve and promote the Tennessee rental housing industry through advocacy, collaboration, and communication. As always, TNAA has identified bills of interest to monitor and promote during this legislative session.
Of particular interest is House Bill 2266 by Rep. Clark Boyd (R-Lebanon) and its companion bill Senate Bill
2030 by Sen. Shane Reeves (R-Murfreesboro), initiated by TNAA. As introduced, the legislation specifies that documents provided through a website with the primary function of providing certificates, registrations, licenses, or similar documents for assistance animals in exchange for payment of a fee are not reliable documentation in seeking an exemption to a prohibition on animals in rental property.
In 2020, the U.S Department of Housing and Urban Development (HUD) issued Notice FHEO-2020-01 that explains certain obligations of housing providers under the Fair Housing Act (FHA) with respect to animals that individuals with disabilities may request as reasonable

HUD provided this guidance to help housing providers distinguish between a person with a non-obvious disability who has a legitimate need for an assistance animal and a person without a disability who simply wants to have a pet or avoid the costs and limitations imposed by housing providers’ pet policies, such as pet fees or deposits.
There are two types of assistance animals: (1) service animals, and (2) other trained or untrained animals that do work, perform tasks, provide assistance, and/ or provide therapeutic emotional support for individuals with disabilities (referred to as a “support animal”). Assistance animals are not pets. A housing provider may exclude or charge a fee or deposit for pets in its discretion and subject to local law but not for service animals or other assistance animals.
The Fair Housing Act (FHA) makes it unlawful for a housing provider to refuse to make a reasonable accommodation that a person with a disability may need in order to have equal opportunity to enjoy and use a dwelling. One common request housing providers receive is for a reasonable accommodation to providers’ pet or no-animal policies so that individuals with disabilities are permitted to use assistance animals in housing, including public and common use areas.
By providing greater clarity through this guidance, HUD seeks to provide housing providers with a tool they may use to reduce burdens they may face when they are uncertain about the type and amount of documentation they may need and may be permitted to request when

GNAA’s Johnson Tapped for NAA Leadership Lyceum
Greater Nashville Apartment Association President Ginny Johnson has been selected as one of 34 individuals nationally to participate in this year’s NAA Leadership Lyceum.
Participants will gain a diverse and well-rounded perspective from their 2024 classmates that helps create more inclusive working environments throughout the industry. In addition to earning eight CECs and participating on a local or national committee, participants get the chance to show off their new knowledge and skills at three concurrent sessions held during NAA’s Advocate, Apartmentalize and Assembly of Delegates.
“Being selected for the 2024 cohort of the NAA Leadership Lyceum is an honor and a privilege. I am thrilled for the opportunity to gain invaluable insights and skills that will undoubtedly elevate my leadership abilities,” Johnson said. “My goal is to harness this knowledge to further enhance GNAA, ensuring we continue to set industry standards and provide unparalleled service to our members and the community.”
Johnson has served as president of GNAA since April 2023 and has worked for the association for nine years, when she joined the association as the Membership Coordinator
and was then promoted to Education and Events Director in 2017.
She has been instrumental in growing the GNAA membership and was recognized with the Chairman’s Award in 2015 for growing the number of units represented by GNAA members to more than 100,000. Johnson received her second Chairman’s Award in 2022 for her outstanding achievement in the area of member education.
She also developed GNAA’s annual Women’s Conference and pushed GNAA to be active in career fairs at local schools to educate young people about job opportunities in the multi-family housing industry.

There is a plaque in my office my husband gave me when I graduated from the University of Tennessee. It simply says, “I am still learning.” He recognized that I would continue to pursue advanced educational opportunities throughout my life and wanted this gift to honor that sentiment.
GNAA offers a variety of education courses. These provide unique opportunities for each student, if you need to learn new skills or strengthen existing ones, as well as learn about new solutions or more cost-effective alternatives to ongoing operational challenges. Personally, I am looking forward to some of the maintenance offerings this year, as I find that the more information I have in these areas, the better I can make decisions regarding improvements and repairs.
Coursework can also be a launch pad for new opportunities. If you desire that next-level promotion, the best demonstration that you are prepared for it is seeking a corresponding designation. Alternatively, it can leverage your advantage in compensation conversations by demonstrating that you are an expert in your current role and thus deserve a top-tier increase.
Staying current is also a goal and objective we should all have. GNAA offers education in updates to HVAC best practices, changes to the legal landscape, LITHC, and collections, to name a few. These classes ensure that we operate with the most recent information, and as a result make the best decisions for our owners, investors, customers, and coworkers. GNAA Statistics Show Nashville Continues to Show Growth in Multifamily Housing
In the heart of Nashville’s vibrant streets, where the sounds of country tunes blend with the clang of construction, a symphony of growth and opportunity has been unfolding in the multifamily housing industry. Against the backdrop of cranes dotting the downtown skyline, Nashville’s multifamily housing sector dances to its captivating rhythm, weaving a tale of resilience and prosperity.
In the fourth quarter of 2024, while cranes continued their graceful ballet across downtown, the latest data from the Greater Nashville Apartment Association (GNAA) revealed a 17.24% decrease in the number of multifamily housing units under construction compared to the same quarter of 2022. With 27,939 units in various stages of development, there’s a subtle shift in the city’s multifamily landscape – a testament to its adaptability and evolution.
But amidst this ebb and flow of construction activity, Nashville’s multifamily housing market remains a beacon of opportunity for renters and investors alike. Last year, the market welcomed 10,955 new apartments, offering a diverse array of living options to residents seeking the perfect blend of comfort and convenience.
Delving deeper into the data, it’s evident that Nashville’s multifamily housing renaissance is not confined to downtown alone. From the bustling energy of Green Hills-Midtown to the vibrant and hip charm of East Nashville, hot-market areas beckon with promise and potential. In the fourth quarter of 2023, more than
31,000 speculative multifamily housing units dotted the local landscape.
As neighborhoods evolve and communities thrive, Nashville’s multifamily housing industry emerges as a dynamic force for positive change. In the vibrant tapestry of submarkets, each with its own unique identity and allure, opportunities abound for residents to find their perfect slice of Nashville living.
Yet beyond the numbers lies a deeper narrative of connection and community. With nearly 11,000 units completed through the fourth quarter of 2023, Nashville celebrated a milestone in its journey of growth and prosperity. From Antioch-Priest Lake to West Nashville, neighborhoods came alive with the introduction of new multifamily housing options, creating vibrant communities where residents forge lasting bonds and build the foundation for a brighter future.
And then there’s the melody of rent prices, a testament to Nashville’s enduring appeal as a destination of choice for renters. Rent prices in the area have been consistently ascending since 2018 when the average rent stood at $1,230, reaching $1,657 by the fourth quarter of 2023, marking a notable increase. With an average rent increase of 4.79% compared to the fourth quarter of 2022, the city’s multifamily housing market reflects a thriving ecosystem of supply and demand.
As the cranes continue their graceful dance against the Nashville skyline, one thing is clear: the city’s multifamily housing industry is a symphony of growth, opportunity, and endless possibilities.

Bridging Career Pathways and Charitable Endeavors in Residential Property Management

As members of the GNAA, our shared commitment extends beyond industry advocacy and education to fostering a vibrant community that thrives on networking, camaraderie, and collective progress. Within this dynamic framework lies the Residential Property Management (RPM) Careers Committee, a driving force dedicated to not only fulfilling association goals but also illuminating the diverse career opportunities within the multi-family housing industry to our surrounding communities.
At the heart of our mission lies a profound realization: Many individuals are unaware of the multitude of career paths available within our industry. It’s a common refrain at our outreach events to hear exclamations of surprise and curiosity: “I never knew this existed as a career!” Our committee stands poised to bridge this gap, reaching out to students and prospective professionals alike to illuminate and connect these pathways.
Collaboration is key to our success. Working hand-inhand with the NextGen Committee, we’ve engaged with local schools and participated in career fairs, introducing the next generation to the rich opportunities in retail property management. Beyond these efforts, our goals have led us to forge impactful partnerships with local charitable organizations whose visions align seamlessly with ours.
Take, for example, EntryWay of Nashville, a beacon of hope dedicated to aiding individuals and families
transitioning out of homelessness. Recognizing the natural synergy between our industry and their mission, we’ve seen over twenty individuals find stable, full-time positions within the multi-family sector since October 2021. Our commitment to this partnership remains steadfast as we continue to build and nurture this vital relationship.
Similarly, the Omni Family Foundation has become a new partner in our endeavors. Focused on empowering youth transitioning from the foster system, their dedication to providing essential resources and career development aligns perfectly with our goals. Recently, we’ve had the privilege of exploring avenues where our committee, alongside the GNAA, can offer support and guidance to these deserving youths, marking the beginning of a promising collaboration.

Embracing Neurodiversity
Insights from ADHD and Beyond in the Multifamily Industry
In the multifaceted world of the multifamily industry on both the owner/management and supplier sides, embracing diversity and inclusion is crucial. While much attention has been paid to traditional forms of diversity, the potential of neurodiversity, particularly the inclusion of individuals with different forms of neurodivergence, such as ADHD, autism, dyslexia, and others, is increasingly recognized as a source of strength and innovation. Speaking from personal experience as someone with ADHD and extending the perspective to include other forms of neurodivergence, it’s clear that neurodiverse individuals bring invaluable benefits to the multifamily industry.
ADHD: The Creative Catalyst
My journey with ADHD in the multifamily industry has underscored the unique advantages of hyperfocus and creativity. ADHD can foster an ability to concentrate intensely on compelling tasks, driving forward innovative projects and problem-solving with unmatched dedication. an individual seeks to keep a support animal in housing.
Some websites sell certificates, registrations, and licensing documents for assistance animals to anyone who answers certain questions or participates in a short interview and pays a fee. Under the Fair Housing Act, a housing provider may request reliable documentation when an individual requesting a reasonable accommodation has a disability and disability-related need for an accommodation that is not obvious or otherwise known. In HUD’s experience, such documentation from the internet is not, by itself, sufficient to reliably establish that an individual has a non-observable disability or disability-related need for an assistance animal.
By contrast, many legitimate, licensed health care professionals deliver services remotely, including over the internet. One reliable form of documentation is a note from a person’s health care professional that confirms a person’s disability and/or need for an animal when the provider has personal knowledge of the individual.
House Bill 2266/Senate Bill 2030 mirrors HUD guidance and seeks to specify in state law that documents provided through a website with the primary function of providing certificates, registrations, licenses, or similar documents for assistance animals in exchange for payment of a fee are not reliable documentation in seeking an exemption to a prohibition on animals in rental property. If passed, this act takes effect July 1, 2024. TNAA will continue to advocate for its passage and will update the membership as additional information is available.

Utilizing platforms such as social media, email newsletters, and resident portals allows managers to maintain transparent communication channels and solicit feedback effectively. By building trust and rapport through authentic communication, property managers can forge lasting connections with Gen Z renters and cultivate a loyal resident base.
Leasing to Generation Z presents both challenges and opportunities for us property managers. By embracing technology, prioritizing convenience, fostering community, promoting sustainability and wellness, and communicating authentically, we can successfully attract and retain Gen Z renters. Adapting to the preferences and expectations of this demographic not only ensures the continued relevance and competitiveness of rental properties but also fosters a dynamic and thriving living environment for all residents.
