It’s the Law

Checking “Legal Status” of Residents Was Proof of Discrimination In September 2018, the U.S. Court of Appeals for the Fourth Circuit held that residents of a mobile home park in Fairfax, Virginia, established a prima facie case for discrimination under fair housing laws because they were disparately impacted by their landlord’s policy of requiring documentation that they were legally in the country. The Virginia landlord in this case required, as part of his leasing and annual renewal process, that all individuals over 18 who live at the park must present either: (1) an original Social Security card, or (2) an original Passport, original U.S. Visa and original Arrival/Departure Form (I-34 or I-94W), which showed legal status in the United States. Prior to 2015, the landlord only enforced the policy against the leaseholder. However, in mid-2015, the landlord required the documentation from all residents over the age of 18. When one or more residents had not complied with the policy, the landlord gave the resident notice that the leaseholder had 21 days to cure the violation, or 30 days to vacate. These notifications were addressed to the entire household, including tenants who had complied with the policy. The landlord also converted these leases to month-to-month leases, and charged residents an additional $100 for each month a non-complying resident did not vacate the lot. The landlord increased the penalty on June 1, 2016, to a $300 per month surcharge. Four Latino couples who lived in the mobile home park with their children sued the landlord for violations of the Fair Housing Act. The four men were all non-citizen Latinos of Salvadoran or Bolivian national origin. The four males each had a Social Security number and provided the documentation to the landlord. The ten children living with the parents were all U.S. citizens. However, the four females could not satisfy the policy because each female was an illegal immigrant.

In mid-2015, when the landlord began enforcing the Policy’s requirement that all adult tenants provide the required documentation, the four female plaintiffs attempted to use alternative methods to comply with the policy, including providing their U.S. government-issued Individual Taxpayer Identification Numbers, which residents alleged can be used to run background checks and credit reports. The landlord declined to accept any alternative forms of identification. In their Complaint, the residents alleged that the landlord’s policy violates the Fair Housing Act because it “is disproportionately ousting Hispanic or Latino (‘Latino’) families from their homes and denying them one of the only affordable housing options in Fairfax County, Virginia.” To support their argument, the residents provided statistical evidence of the “strong link between the undocumented immigrant population and the Latino population” to demonstrate that “a policy that adversely affects the undocumented immigrant population will likewise have a significant disproportionate impact on the Latino population.” These statistics included that Latinos constitute 64.6% of the total undocumented immigrant population in Virginia, and that Latinos are ten times more likely than non-Latinos to be adversely affected by the policy, as undocumented immigrants constitute 36.4% of the Latino population in Virginia compared with only 3.6% of the non-Latino population. On April 18, 2017, the district court granted the landlord’s motion for summary judgment as to the fair housing claim considering only a claim under the disparate-treatment theory of liability. In addition, the district court held that the females’ legal status precluded them from making a prima facie showing of disparate impact. The residents appealed. The U.S. Court of Appeals for the Fourth Circuit disagreed with the lower court. It held that the residents had made out a prima facie case for disparate impact discrimination. Additionally, the female tenant’s legal status did not exclude them from the protections of the Fair Housing Act. The case was sent back to the lower court for further proceedings. continued on p. 19

May Educational HVAC Certification

The GNAA Education Committee has changed things up a bit to give the attendees the best possible opportunity for a successful certification. May 9 will be a full day of instruction covering everything you will need to know about the EPA Certification Exam. May 15 is scheduled for the testing date. The day will begin with a practice test followed by some time to discuss and clarify any “hot spots” that proved to be a little tough on the practice run. The certification exam will be given once everyone is confident they are prepared. If I could write a book… Maybe I need to yell louder?

I hadn’t been in the industry very long and was still kind of green, so one day my boss put me in charge of getting serial numbers off all appliances in all units for insurance purposes. This included the range, refrigerator, dishwasher, water heater, HVAC system and garbage disposal. This was a 444-unit complex and you had to crawl under the sink in about half of them to get the serial number off the disposal because it was on the backside. We had one floor plan that was very large (this tells you how long ago this was!) at about 1900 sq./ft. and the bedrooms were in the far back. I did the usual – knocked three times, cracked open the door and yelled “Maintenance,” entered the apartment and yelled “Maintenance!” a few more times. No one was home, or so I thought, and I went about my business. I was lying on my back on the kitchen floor with my upper body and head under the sink to read the serial number on the disposal when the phone in the kitchen rang (again, this shows how long ago this was as most people at the time only had one phone). All of a sudden I heard footsteps and peered out from under the sink to see a fully stark naked woman standing there. In a very awkward moment, I looked at her, she looked at me and started laughing hysterically. She turned and ran back down the hallway while saying, “Can you get that for me?” I answered the phone and a male voice asked if So-and-So was there. I put the phone aside and yelled down the hallway, “Is your name So-and-So?” She said yes and I said, “The phone’s for you.” I quickly left after that. Towards the end of the day, I was called up to the office by my manager. There was an angry husband sitting in his office wanting to know what I was doing fooling around with his wife! –mark fiscus, freeman webb

Be Careful What You Wear to Dinner!

I had plans to attend dinner downtown with the owner of my property and my boss. I took an Uber so that I could have a glass of wine. The Uber driver on the way home noticed my uniform jacket and proceeded to tell me that we were evicting him! He hoped there was something I could do because it was ridiculous that he was only a month late and it was his roommate’s fault. I then realized that he had my home address. I don’t know that I have ever been so thankful to be let out of an Uber! –stephanie liston, lighthouse property management

Storm Trooper in Dark Countertop Places

One time I went to a unit to measure a countertop. I was informed the resident was home but hard of hearing. Upon knocking and “Maintenance” or “Mate-nance” shouting at the door, I used the key to enter the unit. Upon entry, an alarm sounded and the unit was dark, indicating to me most likely no one was home. The alarm subsided and it took a minute to find the light switch as it was covered by a shelf that butted up to the door. Most of the walls were covered by shelves that reached the ceiling and were filled with Star Wars memorabilia. All windows were also covered with black sheets so the apartment was still pretty dark after turning on the light. Once the light was on, I stepped in and pulled the front door back to be scared out of my mind. I screamed with my heart already racing due to the alarm episode and continuation of dark ambience surrounding me; the dark hallway now in my direct view had a life-size storm trooper staring me down. I was not sure if this was a person dressed in uniform or costume. Upon further observation from the entrance area, the storm trooper was just a life size cut-out pinned to the wall. I didn’t tarry there for long…I had my fill of dark countertop places. –bridget opfer, contractors, inc.

The Name of the Game: Security! by JD Wright, Universal Media

One of the things we should all pay close attention to at our properties is making sure the staff and residents feel safe. Safety is something that everyone should feel, whether at their home or at their job. Most communities have everything from gates to access controls to video surveillance. Have you taken the time to make sure your security systems are functioning the way they should? There are a few things we need to make sure we do when we have a video surveillance system in place – the first is to make sure that it is posted. Any entrance doors on the property that have video cameras on them are required to have stickers on the door notifying people that the property is under video surveillance. The next item is super important – make sure your cameras are placed correctly. This isn’t as crucial on a garden-style

property as it is on high-rises and mid-rises. Your cameras can capture your property, the sidewalk and the road as long as your camera doesn’t have a clear line of sight into someone else’s property or residence. Be very careful to pay attention to where your exterior cameras are facing – if there is another property close by, make sure your camers are not in any way facing anyone’s windows or doors on the adjacent property. You could be setting yourself up for a lawsuit, and you definitely don’t want that. So make sure you can see only your property and that it is clearly marked that you have cameras and video surveillance. Let’s just make sure that in our efforts to protect ourselves and our residents that we are doing everything legally.

It’s the Law, cont. from p. 7 Since the residents have established their prima facie case, the landlord will now be allowed to “state and explain the valid interest served by their policies.” If the landlord meets this burden, the residents will be allowed to “prov[e] that the substantial, legitimate, nondiscriminatory interests supporting the challenged practice could be served by another practice that has a less discriminatory effect.” In this case, the landlord’s position was that this information was necessary to confirm the identity of the applicants, to perform credit and criminal background checks, to minimize loss from eviction, to avoid potential criminal liability for harboring illegal aliens, and to underwrite leases. These arguments may be difficult for the landlord if the residents had been living there for years without incident of criminal activity or non-payment of rent. Additionally, in 2011 a Court of Appeals held that when a landlord rents to an illegal immigrant, he/she is not “harboring” the illegal immigrant and the rental does not violate federal law. The landlord did not bring the illegal residents to this country. The landlord did not hide the residents from the state or federal government. The landlord did nothing to prohibit the federal or state government from apprehending the residents, and did not lend assistance in procuring any illegal documents. In sum, landlords with policies requiring an applicant or resident to provide proof they are legally in the country need to get ready for a challenge. Be sure you have a provable business reason for the policy and make sure there are no other less discriminatory ways to meet the needs of the company.

The Greater Nashville Apartment Association Trade Show is an excellent way for you to participate in the GNAA. Want to be a part? There are two things for you to consider.

as choosing a venue, choosing a theme for the Trade Show each year, reviewing booth pricing for the following year, and food choices each year.

Number 1: Attend the Trade Show.

History has shown us that active participation helps make this event successful. The team of Joyce Wolfe and Jill Carpenter led the committee for many of the past years. Under their leadership, the committee evaluated the Trade Show and helped make the changes that have made the show such a success today. Some examples:

The Trade Show is coming up on August 15, and this year’s theme is “Where the Magic Happens!” This is one of the most well attended events of the year.

Number 2: Join the Trade Show Committee.

The Trade Show Committee is a great place for you to help make decisions that will impact the success of the Trade Show itself, and the success of your organization at the event. The Trade Show is put together each year by the Trade Show Committee. This year’s committee is co-chaired by Jennifer McCoy and Jenn Mulholland. They are glad to have you join and participate on the committee. To join, simply call the GNAA office and ask to have your name added to the attendees list. The GNAA will send an email that includes the date, time and location of the next meeting. The committee meetings occur monthly and are held at the GNAA office. They take about an hour. The committee is tasked with planning the logistics of the event to ensure a successful show for all members. The volunteers on this committee make an impact. As you participate you will be involved in making decisions, such

Venues In the past, the Trade Show has been held at the State Fairgrounds, the Embassy Suites Hotel, LP Field (go Titans!), the Gaylord Convention Center, and the Gaylord Events Center (where they hold the ICE! show each year). Food Some of the early Trade Shows in the 90’s involved everyone pitching in to bring a dish to share for the food. Now decisions concerning food at the event involve a few more details. Attendance Early Trade Shows with attendance of 100 people and 20 booths have turned into a Trade Show with 150 booths and over 1,000 attendees! Come to the Trade Show and lend your support. Join the committee and volunteer your expertise – we would love to have you!
