The CDC’S Moratorium Extension
What It Means for You by Jennifer McCoy, Law Office of Jennifer McCoy As you are likely aware by now, the Centers for Disease Control and Prevention recently extended its moratorium on evictions – originally set to expire on March 31, 2021 – to the end of June, effectively adding yet another bump in the already pothole-laden road to eviction we have all been forced to ride.
What You Need to Know
As it stands, the only change to the CDC’s moratorium is its expiration date. No other restrictions, rules, or guidelines have been implemented, which means the policies and procedures you have become accustomed to during these unprecedented times will remain the same. Of course, this is only a small comfort to everyone in the industry champing at the bit to return to “business as usual.” Of special note, however, is a recent ruling by a federal judge in the Western District of Tennessee who struck down the CDC’s moratorium, calling it “unconstitutional.” In his ruling, U.S. District Judge Mark Norris stated that the CDC overstepped its authority, and accordingly, ordered that evictions in Shelby County and West Tennessee can proceed as they had prior to the start of the pandemic and subsequent shutdown.
What Does This Mean for the Rest of Us?
While the ruling is certainly a huge victory for the rights of property owners and managers in these jurisdictions (get

those evictions filed!), it leaves the rest of us wondering how or if this ruling will have an effect on the rest of the state. But whether judges in other jurisdictions will follow Judge Norris’ example remains to be seen. In other words, unless you have a property in Shelby County or West Tennessee, you can continue to expect delays in your eviction proceedings. What kind of delay ultimately depends on where your property is located, as every judge in every county in the state rules on evictions as they see fit, and not necessarily in the manner you would expect. For example, some judges will allow an eviction to proceed to judgment but will halt the process at setting residents out until the expiration of the moratorium. Other judges will grant judgments and set-outs for cases in which the resident fails to appear in court. And still other judges will not bother with the process at all, instead electing to continue all cases until after the moratorium’s expiration, no matter the circumstance. Unfortunately, in many cases, there is simply no rhyme or reason to the rulings that are being handed down.
What You Need to Do
First and foremost, continue turning over your qualifying residents for eviction proceedings, including those residents who may be protected by the moratorium. Although some of the processes are delayed, courts are still accepting new filings, so the sooner an eviction is filed the sooner it will get placed on a docket. Also, keep in mind that the moratorium only applies to those renters who are behind on payments and have subsequently submitted the CDC’s Declaration Under Penalty of Perjury (DUPP) form; therefore, residents who are holding over, have ongoing lease violations, or have not submitted the DUPP are not protected. Perhaps most importantly, however, is keeping those lines of communication open between you and your attorney. He or she will have the most up-to-date information regarding the eviction process and, as always, is available to assist you with all your landlord/tenant needs! 9

Maybe 2020 was a season for you to reset and renew? The latest research shows we are more stressed now than ever. Phone calls to suicide crisis prevention lines have increased by 800% since the pandemic. During the past year, Mental Health America states they have witnessed an unprecedented increase in the numbers of people experiencing mental health problems. In November 2020, the CDC reported that 44% of Americans were dealing with either depression or anxiety. While historically data shows us that 1 in 5 adults will experience a mental health problem, these days it certainly feels like it’s 5 in 5. Stress in the workplace has been increasing. Your industry has been hit hard by the pandemic. I can’t imagine the stress you have been under. What are you doing to take care of your mental health? You may notice work stress manifesting in a variety of ways. You might be having trouble sleeping or experiencing physical aches and pains. You may be ruminating on work issues when you are off the clock, feeling guilty when you take time off, fearing losing a job, or even feeling mentally or emotionally exhausted just thinking about job responsibilities or your work environment. Or maybe your stress comes from outside of work.

Work-related stress “can take away some of our joy,” says Michele Kielty, a licensed professional counselor (LPC) and licensed school counselor in Virginia. “We can be so overrun with responsibilities that we experience a lack of joy in things we have previously found joy in. It’s carrying an ever-present, low-grade, oppressive stress with you all the time. It can take over your life more than you’d like for it to.” If you or someone you know is feeling out of sorts, stressed beyond words, increasing anxiety, depression, isolating yourself, more irritable than usual, experiencing insomnia, increased pain, experiencing panic attacks, feeling suicidal, crying more than normal, then seeking help is a good idea. Research shows that 70-90% of clients who seek proper treatment have a significant reduction in their symptoms. I am a huge fan of counseling, but only if you open up 100% and start the healing journey. If you live in the Nashville area, I refer many patients to The Refuge Center. They have over 70 therapists who specialize in a multitude of mental health conditions. Call them and get scheduled to talk to someone. Maybe you are not feeling emotionally fragile, but maybe a co-worker is. Be the one who notices, who asks the hard questions. You may be the only one who reaches out to that person. You may be the one who saves their life. I have the Suicide Crisis Prevention Line in my phone and share it with anyone struggling. Their lines are open 24/7 with trained crisis counselors on the other end. Mental Health Month is in May, but mental health issues can occur year-round. Feeling Overworked? Tips to Achieve a Better Work-Life Balance by Kelly Pendergrast, The Liberty Group Do you constantly feel like there’s just not enough hours in the day? If you’re like many busy professionals, you’re probably exhausted by the time Friday night rolls around. While there will always be hectic days, there are steps you can take to avoid major burnout and improve your quality of life. As you embark on a better work-life balance, keep these tips in mind:
Make your health a top priority. While a healthy diet and daily workout may not be the most fun things to incorporate into your routine, they can significantly improve your overall health and wellness. Taking care of your body means you’ll feel better and need fewer sick days, and ultimately achieve more productivity and better performance on the job. Additionally, pay attention to your mental health. If you find yourself in a frequent state of sadness or depression, seek a therapist who can help you work through these issues and gain more mental strength and clarity. Remember, neglecting your health can be detrimental to all aspects of your life!
Communicate work-related concerns. Failing to communicate with your manager about feelings of stress or burnout will only lead to a greater downward spiral. If you’ve been under increasing pressure to work longer hours and take on more responsibility than you can handle, it’s time to have an honest conversation with your boss about your concerns. First, it’s important to explain how your mental or physical health is being affected by your job. Second, make sure to clearly define the parameters of your work schedule and responsibilities. If your boss’s expectations surpass the workload you’re comfortable with on a daily basis, some form of resolution will have

to be made going forward. Don’t wait until your annual performance review to express yourself – the sooner you take control of the situation, the sooner you’ll feel better!
Create a schedule. Failing to adhere to a schedule is essentially failing to manage your time in the most productive way possible. Even if you’re somebody who likes to fly off the cuff, having some sort of weekly or monthly schedule to live by will help you maximize your time while making your time off from work more fulfilling. From scheduling workouts to planning meal prep, establishing a calendar will keep you organized and allow you to keep track of how you spend your hours each day. While there’s no such thing as a “perfect” balance, implementing the practices above can be instrumental in helping you attain a better sense of well-being. The sooner you take control of your time, the healthier and happier you’ll be both at home and in the workplace.
Separate your work life from your personal life. Even though it sounds easy, separating your work life from your personal life can be a major struggle for some people. The key to a perfect balance is setting boundaries for yourself. Although your job is important and fulfilling, it should not be your entire life. Creating a schedule is imperative, especially with our new norm of working remotely. Working from home makes it a lot to easier to get caught up and forget to take a break, but designated “me” time is a must for your mental health. Setting these boundaries will increase your efficiency at work and help eliminate stress in your personal life.

NAA Advocate 2021 How It Went and Why It’s So Important
By Nathan Lybarger, Law Office of Hall & Associates Each year, as a spearhead to its ongoing advocacy efforts, members of the National Apartment Association (NAA) from across the country descend onto the streets, halls, and offices of our legislature. NAA’s Advocate Conference gives local GNAA membership the opportunity to meet face-to-face with our Congressional representation. These meetings are not only an effort to lay out NAA’s legislative goals in the immediate future, but more importantly to share our personal experiences in order to explain to our Congresspeople why these goals are important. Our legislators hear from lobbyists constantly, but to sit and talk with their constituents helps them gain a deeper understanding of the bills and policies that are brought forth in their offices and on the floors of Congress. While 2021 was a different experience, our Tennessee Apartment Association (TNAA) members made the most of the virtual version of the annual conference. During the week of March 8, 2021, TNAA members met with six Members of Congress (or their staffs) virtually. While the virtual format might have made a personal connection more difficult, it also encouraged more member participation because travel and accommodations were not necessary. Since the meetings with our Congresspeople could extend beyond one day, it also made it more possible for the Congressperson to meet with our group personally. Based

on the feedback provided, we found the meetings to be an effective substitute to our normal in-person format. While attendance year after year may help build a rapport with the members of Congress, it’s equally important that we encourage new attendees to speak and meet with legislators. The more diversity we have among our personal experiences, the more we can educate Congressional members about the issues affecting our industry. Hearing the same angle from the same person each year starts to dull its effect, but to consistently hear new experiences from new voices gives strength to our narrative. If you haven’t participated before or if it’s been a while, we’d encourage any who are interested to join us next year when we (surely) will be back in Washington, D.C. If the Washington experience is too great of a commitment, the Tennessee Apartment Association organizes a similar event in early spring of each year: TNAA’s Day on the Hill. That day follows a similar format, wherein our local members get to meet with Tennessee State Legislators, usually on specific bills our industry is either supporting or opposing. And in the same way, putting personal experience within our industry’s position helps our legislators understand what kind of unintended consequences might come as a result of their well-intentioned bill. It also helps to address potential concerns the legislators or their constituents may have regarding the impact of our bills our industry supports. Our advocacy role at the state level is even more magnified because TNAA is the only agency representing the interest of landlords across the state. Have something to look forward to. • Automate, eliminate and delegate everything you can in your life. Get rid of the unnecessary. • Start cultivating community. About Our Volunteer Day
Volunteers will be paired up with shoppers. They will walk the
aisles together, making sure each shopper is able to select the foods they need. After they’ve chosen the items they can use for the week, our volunteers will help them pack their items into bags. Some volunteers will be asked to help carry what could be up to 70lbs of groceries to the bus stop for shoppers without transportation.
