Legislative Updates By Catie Lane Bailey On Monday, August 3, Tennessee Governor Bill Lee called for the Tennessee General Assembly to convene on Monday, August 10 for a special session to address COVID-19 liability protections, telehealth services and laws governing the Capitol grounds. After convening for the special session for three days, the Tennessee General Assembly passed a suite of legislation. Of interest to the multifamily industry, the Tennessee COVID-19 Recovery Act implements comprehensive liability protection against legal claims stemming from loss, damage, injury or death arising from COVID-19. The Act specifies that an individual or legal entity will not be liable for loss, damage, injury, or death that arises from COVID-19 unless the claimant proves by clear and convincing evidence that the person proximately caused the injury by an act or omission constituting gross negligence or willful misconduct. This legislation creates a heightened pleading standard which requires a claimant in any action alleging injury arising from COVID-19 to: (1) File a verified complaint pleading specific facts with particularity from which a finder of fact could reasonably conclude that the injury was caused by the defendant’s gross negligence or willful misconduct; and (2) File a certificate of good faith stating that the claimant or claimant’s counsel has obtained a signed, written statement from a physician duly licensed to practice in the state or a contiguous bordering state and competent to express an opinion on exposure to or contraction of COVID-19, which confirms the physician’s belief that the alleged injury

was caused by an alleged act or omission of the defendant or defendants. A claimant’s failure to comply with the above described pleading requirements will, upon motion, make the claim subject to dismissal with prejudice, meaning the case is dismissed permanently and cannot be appealed. In addition, the Act provides specific civil liability protection for governmental entities and public colleges and universities for any injury arising from COVID-19, unless the claimant successfully proves and complies with the pleading standards described above. The Act will apply to all prospectively filed claims arising from COVID-19 and take effect upon signature by Governor Lee. In response to concerns raised about pending COVID-19 related lawsuits, legislators negotiated the addition of a “grandfather clause” that excludes claims occurring before August 3, 2020 in which: (1) A complaint or civil warrant was filed; (2) A notice of claim was filed with the Tennessee Claims Commission; or (3) Notice was satisfied under state law pertaining to healthcare liability claims. The adjournment of the Second Extraordinary Session marks the conclusion of the legislature’s agenda for the year. Members elected and incumbents reelected during the November general election will convene in January 2021 to begin a new legislative term as the 112th General Assembly. Mind Your (Virtual) Manners By Susan Sherfield COVID-19 pushed the workplace into a new world, with many employees working from home and staying connected through online conferencing. While many people previously hid behind the veil of email and phone calls, video conferencing was yet another game changer. We must learn a new etiquette for video conferences.
Smile, You’re on Video Camera You may be connected to a video conference, but that doesn’t mean that will be on camera the whole time, especially if there is a large group on the call. A general rule is that you should be on camera if you are speaking or if you are the moderator of the call. Be mindful of what is behind you. You may either adjust the setting so that whatever is behind you is blurred on camera, or add a virtual “wallpaper” background. While you are speaking, look directly into the camera. This can be a little awkward or uncomfortable at first, but you must speak as if you are face to face with the others. You should also keep yourself on mute, if you are not speaking, in order to minimize noise on the call. Just remember to unmute yourself, and turn the camera on, when you want to speak. While you are on camera, you must also stay very aware of what you are doing. It is generally acceptable to have a beverage, but eating is discouraged (unless it is a lunch meeting and everyone is eating together).
Managing the Call As with any meeting, it is a best practice to send out an agenda prior to the call. Attendees should know what the call is about, and what their role will be in the discussion. If video conferencing is new to you and your team, makes sure everyone knows how to use the functions of the platform you are using such as mute/ unmute, raising their hand, and using the chat box. At the beginning of the meeting, inform the attendees of how/when questions will be taken in order to avoid people talking over each other. Minimize Distractions Not everyone is lucky enough to have a home office that allows privacy and focus. You must make sure steps are taken to minimize distractions. Pets, other people in the home, or any other element that creates background noise or an on-camera distraction should be addressed in advance of a video call. Let others in the home know you will be on a call. If possible, move your computer to the most private location in your home.
Put Your Pants On Most people who are working from home are opting for a much more casual work outfit. Yoga pants are our new best friend! Casual is fine; pants-free is not. Learn from others who have been caught with their pants off, thinking that nobody would know their secret. You just never know when you may need to stand up from a video call to grab a file or address a distraction.
When Nature Calls There are days when your schedule is one video conference after another, so nature may call during one of them. If you must use the bathroom, politely excuse yourself from the call, turn off the camera, mute yourself, and go use the bathroom. Nearly the whole world has seen the video that went viral of the woman who took her electronics into the bathroom with her, forgetting she was on camera. Once again, this is an opportunity to learn from somebody else’s humiliation. The huge uptick in video conferencing may have started as a result of COVID-19, but it will be part of the new normal in the workplace, as many companies are discovering that people can effectively work remotely. Learning a little virtual etiquette will not only benefit you now, but will be skills that will carry you into the future.

TRUTH IN ASPHALT WRITTEN BY MATT BURTON Imagine you open up a new complex and soon after the first tenants move in, they begin noticing cracks in the walls. After many attempts to reach out to your contractors, they finally review the damages, only to state that the issue is common and most likely due to the structure settling. You are not satisfied with this answer and feel as though there’s more going on behind the wall that you can’t see. You get a second opinion only to discover that the buildings have been built with 2”x2” studs and not the standard 2”x4”. The GC “saved” you (and themselves) tons of money by cutting corners that are invisible on the finished product, but these savings will cost you tremendously in the long run. This story is extreme and likely never to happen in building construction, but it’s happening everyday in asphalt maintenance and parking lot construction. The standard topcoat thickness of a parking lot is a minimum of 1.5” average compacted depth. Anything less than 1.5” will not withstand normal usage, and especially not the common trash truck. Like the walls in your apartment buildings, cracks begin appearing, and the edges will begin to ravel. No building can stand on 2”x2” studs, and no parking lot will hold up with a half-inch overlay. As you can see in the core sample images provided, some companies are applying asphalt as low as half an inch thickness. This makes the asphalt brittle and unable to hold up under a trash truck and other heavy vehicle traffic. Short cuts are taken in sealcoating as well. Most companies propose two coat applications but consider overlapping during one application as two coats. Without two separate coats, the sealer will wear quickly. AMI Construction wants to bring these practices to light and change what has become the sub-standard by many in our industry.

1. Specify a minimum compacted depth of 1.5” (industry standard) 2. Require product delivery tickets. 3. Inform contractors you will be doing core sampling after the project is complete.
SEALCOATING & STRIPING:
1. Sealcoating requires a minimum coverage of two coats with the second coat applied after ample time for the first to dry. 2. Seal cracks when they are wide enough to accept sealing material. 3. Require specialty traffic paint for all striping.

IN MEMORIAM
Ulysses Grant Browning U. Grant Browning, GNAA’s first President in 1968, died August 4, 2020. He was 89 years old. He is also survived by his wife of 66 years Elizabeth (Betty) Browning and daughters Barbara Browning (husband David Kazmerowski) and Beverly Browning. In 1965 Grant became active in his first real estate ventures. He became a developer of apartments, condominiums and office buildings. He and his partners Sanford Lovely, and later G. T. Scott, developed many projects throughout the Southeast. Some of his most noted developments in Nashville were in the Green Hills area of Nashville including Georgetown, Hobbs House, Village Green and Jefferson Square. He also developed the corner of Nolensville Road and Old Hickory Boulevard and dubbed it “Brentwood East.” In later years, he co-developed Nashville’s first “Brownstones” called West End Close. Grant was the founder and the first president of the Nashville Apartment Association and served on the Board of Directors of the National Apartment Association. He also founded and was chairman of the Board of Hope, Inc. for forty years. Hope Inc. is a “not for profit company” helping lower income families obtain housing. Grant developed the first “suburban” office buildings in Nashville: The United Artist’s Tower on Music Row and the airport area’s International Plaza. He and his partners were instrumental in designing and developing a “year-round” housing system in North and South Dakota jointly with the Bureau of Indian Affairs.
