The Tennessee General Assembly passed Public Chapter 1017 (2024) enacting the “Modernization of Towing, Immobilization, and Oversight Normalization Act,” a comprehensive law designed to overhaul and standardize regulations surrounding vehicle booting and towing in commercial parking lots. This legislation seeks to enhance consumer protections and regulate the practices of parking lot operators.
Key Provisions of the Act
The act introduces several important measures:
• Commercial parking lot owners are restricted from booting or towing vehicles unless they are abandoned, immobile, or unattended. This aims to prevent unnecessary immobilization.
• Parking lots must adhere to local ordinances, if they exist, while also complying with the new state regulations.
• Violations of these regulations are considered breaches of the Tennessee Consumer Protection Act (TCPA), with enforcement

Inside a new Tennessee law that impacts towing, booting
by the state Attorney General. Individuals have the right to pursue private legal remedies.
• Local ordinances will require annual licensing for parking lots and attendants. These ordinances must detail permissible actions (booting, towing, or both) and set standards for signage, payment methods, and response times.
• The Act mandates visible identification for operators, accessible payment options, and timely removal of immobilization devices. It also limits removal fees to $75 and requires compensation for vehicle damage if proper notices are not posted.
Additional Provisions
• Licensed parking lots cannot charge removal fees to individuals who have paid to park but were improperly booted. Violations can lead to license revocation.
• Local governments can enact stricter regulations than the state’s minimum requirements and can boot vehicles on public
property, provided they adhere to specific notice requirements.
• Parking lot owners must post clear signage before using automatic license plate readers and cannot charge excessive penalties for nonpayment. Late fees are capped at $50.
• The Department of Revenue must create an online platform by July 1, 2025, for police to log abandoned vehicles.
• Consumer Rights and Enforcement: Violations of the new provisions are subject to penalties under the TCPA. The attorney general is empowered to investigate and enforce these violations without incurring costs. Individuals affected by violations can seek injunctive relief, actual and punitive damages, and attorney fees.
• The act defines “curbstoning” as selling vehicles without proper title endorsements or exceeding a threshold of sales for unlicensed dealers.
• Police can seize abandoned, immobile, or curbstoned vehicles from both public and private property. They can also hire resources for vehicle removal and storage. Curbstoned vehicles are subject to seizure and forfeiture under state law.
• Police departments must verify ownership and notify registered owners and lienholders within a specified time frame after seizing a vehicle.
• Requires a tow truck operator to immediately release a motor vehicle that the operator has begun to tow but which has not left the parking area if the motor vehicle owner arrives and pays a release fee.
Notice and Appeal Procedures
• When a vehicle is taken into custody, the notice must include details such as the vehicle’s year, make, model, and identification number; the location where it is held; and the right of the owner and lienholders to reclaim the vehicle within 20 days upon payment of all associated charges. Failure to reclaim the vehicle within this period is deemed a waiver of all rights and consents to the vehicle’s sale at public auction.
• If a vehicle is found to be abandoned, immobile, or unattended, a preseizure notice must be sent to the last known address of the owner and lienholders. This notice must include similar details as the post-seizure notice and inform them of the right to appeal or remove the vehicle within 20 days.
• If a vehicle is towed, the towing entity must notify local law enforcement of the vehicle’s details within 15 minutes. Failure to do so is a Class B misdemeanor.
• Prohibits a commercial parking lot owner from booting or towing a non-abandoned vehicle until 12 hours have elapsed since it was first observed to be abandoned.
•Unless the vehicle is creating a hazard, blocking access to public or private property, or parked illegally.
• Entities involved in towing must verify vehicle ownership through the Tennessee Information Enforcement System (TIES) or, if necessary, the Department of Revenue’s title and registration division. A garage keeper must also verify ownership and notify the owner within three business days after taking possession of the vehicle.
• Garage keepers must verify ownership and notify the vehicle owner within set timeframes to claim storage fees. Failure to comply could limit storage fees to six days and may result in civil liability for failure to release the vehicle upon payment.

She has been active in the multifamily industry since 1992. Before joining Willow Bridge in 2017, Tammy served as a regional manager at Riverstone / Greystar, Brookside Properties and held community manager roles at RAM Partners as well as JLC Southeast.
An active member of the Greater Nashville Apartment Association (GNAA), Tammy has been a member of the organization’s board of directors since 2009, serving as a member of its executive committee from 2010 to 2015. She serves as a past chair of the GNAA board and has chaired and/or served on the organization’s governance, apartment tour, golf tournament, community service, communications, and membership committees.

With an impressive career spanning over two decades, Stephanie Burns brings a wealth of multifamily experience and expertise to her role as Vice President for NTS Development Company and as an Active Past Chairman for GNAA.
Stephanie has served on GNAA’s Board of Directors since 2012 and served as Chairman of the Board in 2019.
A few of her notable achievements during her tenure at GNAA include creating the NextGen Committee and collaborating with the Communications Committee to overhaul the GNAA website and social media channels.
In addition to her NTS and GNAA duties, Stephanie actively participates and volunteers on the State and National level, currently serving as a TNAA Nashville Board Member and proudly represents NAA Region 4 as a 2020 NAA Leadership Lyceum graduate.

As VP of Operations, Eddie brings over 30 years of experience in multifamily housing beginning his full-time career in 1994. Prior to joining Freeman Webb, he served as Vice President of Conventional Housing for SPM in Birmingham, AL, where he oversaw a diversified residential portfolio that included high-rise, mid-rise and garden-style apartment communities. His significant experience in new construction has led to the successful lease-up of over 30 communities. Annie began her multifamily career in 2013 with Greystar in the Northeast market as a full-time Leasing Professional for a 635-unit, stabilized, garden-style community in the suburbs of Washington, DC. As her experience progressed, she realized her desire and drive to pursue her career further within the multifamily industry.
After leaving Northern Virginia in April 2015, she relocated to Houston, Texas where – within seven months - she advanced from Leasing Professional to Assistant Manager of a 240-unit, stabilized, garden-style community in the Central South Division for Greystar. During that time, she trained several leasing professionals earning her a nomination for Leasing Professional of the Year for the market in 2015. In 2017, she relocated to Nashville, Tennessee - working at Cumberland on Church - garnering her experience in the high-rise sector of the industry and earning the award of Leasing Professional of the Year for the Nashville region. What brought you to the apartment industry?
I was previously in retail sales for quite some time, and a friend who was already a manager in the industry told me I should look into it. She was able to help me get an interview with my first company and the rest is history. I started at a 635-unit community in the suburbs of Washington, DC and have experienced quite a bit since 2013!
Was this career path something that was always on your radar?
It actually was not! I had always thought it would be an interesting job to undertake, but didn’t think I had what it took to be in the industry. Boy, was I wrong!
Did you have any unrelated jobs growing up that unexpectedly prepared you for the apartment industry?
I would say working in the food service industry prepared me for days when there is high demand, whether that be high traffic days or residents who can, sometimes, be a bit overwhelming.
Why is property maintenance an attractive career path?
I have a lot of respect for my maintenance team. Without them, I would not be able to do my job; neither would any of my office staff. If you’re asking about property management being an attractive career path –it’s lucrative, it’s rewarding, and it’s ever-changing.
Best professional advice you have ever been given?
Read the lease. Know the lease. “Reading is fundamental.”
What is your favorite thing to do on the weekends?
On the weekends, you can find me spending time with friends, hanging out with my cat or taking short road trips around to explore.
Do you have any pets?
I do! One cat – his name is Scott! And he’s the most handsomest and sweetest boy in all the land!
Coolest place you’ve ever traveled?
Coolest place, thus far, would have to be Puerto Vallarta, Mexico. However, ask me in January when I return from London for the first time!

I’m a native Texan, but I have lived in five different states since I was 19: Texas, Utah, Florida, Virginia and Tennessee.
What upcoming GNAA event are you excited to attend and why?
GALA! Gala is my absolute most favorite event out of the entire year. Seeing everyone all dressed up and snazzy is just so much fun!
Do you have a motto you live by?
“Be fearless in the pursuit of what sets your soul on fire.”
If you could get a “do over” for something in your career, what would it be and why?
Being an Assistant Manager was, by far, my favorite position in my career. I enjoyed it the most. If I could do that all over again, I absolutely would. Is there anything I regret doing in my career? No, absolutely not. That’s because everything I have experienced and learned has brought me to where I am now. “You learn through what you grow through.”
Any advice you could give to the rising stars of GNAA? Be patient. Be kind. Be observant. Just breathe.
“I feel like people get lost when they think of happiness as a destination. We always think that someday we’ll be happy. When we get that car or that job or that person in our lives who will fix everything. But happiness is a mood and it’s a condition. Not a destination. It’s like being tired or hungry. It’s not permanent. It comes and goes and that’s OK. And if people would think that way, they’d find happiness more often.” –Julian Baker, One Tree Hill
Do the ends justify the means? It kind of brings me to my answer for the next question. Integrity is what you show, even when nobody is looking. Do the right thing, at all times. What you do in the dark, comes to the light. In my opinion this is a slightly controversial phrase in that aspect.
If you could see a measuring scale above people’s heads, what would you want this scale to measure?
Integrity. Because that is something you show, even when nobody is looking.
When in your career did you reach success?
I feel successful overall. I wouldn’t say I’ve reached my pinnacle just yet, but I am certainly – and constantly – working toward it.
