Man behind bars for stabbing brother

(Seguin) -- A local man reportedly stabbed by his brother remains in critical condition.

Seguin Police Detectives say on Saturday, Sept. 9, officers responded to an assault in progress at a home in the 1100 block of Clark St. The caller advised that her son had been stabbed.

Upon arrival, officers found Terry Simmons Jr., 26, of Seguin, inside the residence with multiple injuries consistent with stab wounds.

Detectives say witnesses advised that Terry and his brother, Trey-Vel Simmons, 22, of Seguin, got into an argument that further escalated into a physical altercation.

Trey-Vel was taken into custody without incident.

Terry Simmons Jr. was transported to a San Antonio hospital.

Trey-Vel was transported to the Guadalupe County Jail, where he was booked for aggravated assault- family violence with weapon/serious bodily injury.

Officials say this case remains under investigation.

Stricter punishments in place due to fire disaster declaration

Declaration extended in Guadalupe County

(Seguin) -- If your negligence during these extreme drought conditions leads to property damage, then expect those consequences to double.

Recent action by Guadalupe County officials only reinforces those consequences.

Last week, Guadalupe County Judge Kyle Kutscher issued a declaration of local disaster due to the extreme drought and wildfires. This week, the county upheld the declaration and extended it through next month.

Patrick Pinder, Guadalupe County emergency management coordinator and fire marshal says one of the ways that this disaster declaration hopes to make an impact is by increasing the punishments for failing to be safe.

“With the disaster declaration put into place, it’s still a Class C misdemeanor with a fine that currently was $500 but now with this Local Government Code that the judged signed -- with the disaster declaration, that fine can go up to $1000 and also up to a

time of 180 days in jail. So if you are burning during the burn ban without consent from the fire marshal’s office or if you are caught burning a brush fire or something like that you could be cited $1,000 or be taken to jail,” said Pinder.

Pinder says it’s just too dangerous to not be careful.

“The KBDI which is the burn index for the drought ratio measures the depth inside the soil, the soil is dry. We are in the high 700 which means there is no water in the dirt so when these fires are occurring, they are just running across the dry vegetation that is dead on the top of the ground and they are just moving and that’s what we are seeing in these fires and so what we are urging residents to do is be cautious. The burn ban is in effect. You are not able to burn. The only way you are allowed to burn is in a burn barrel and it’s household rubbish and you have to have a cover on it but if that burn barrel gets out of control, you are liable Fire, pg. 3

Seguin ISD joins lawsuit against TEA

(Seguin) -- The Seguin ISD board of trustees unanimously approved the administration's recommendation to join a lawsuit against the Texas Education Agency (TEA). Titled Kingsville ISD, et. al., v. Morath, the suit asks the TEA to stop the release of this year's accountability ratings, slated for September, due to unlawful changes in the state accountability system designed to downgrade student achievement.

Seguin ISD Superintendent Dr. Matthew Gutierrez explained the reasoning behind joining the lawsuit during the Aug. 29, 2023 school board meeting.

"I appreciate your support on this effort. It is not fair to change the rules of the game after the game has been played. It is an injustice to our schools. It is an effort to say and show that our public schools are failing and to push vouchers," he said.

A major sticking point of the "refreshed" A-F accountability system

is that TEA is raising the threshold to earn an A in college, career and military readiness (CCMR)

a high C. Instead, TEA has decided that it is necessary to change their rules after the conclusion of the school year, which would put us as a high D. This is in spite of our students realizing gains and making progress over the past school year. Yet as a result of those gains, our students, our teachers, and our schools get penalized, he said.

"Moving the goalposts is not fair for our Seguin ISD students and teachers, or for the student and teachers across the state of Texas."

performance from 60% to 88% for 2023. Yet the 88% threshold for the fall 2023 accountability ratings will be based on the performance of 2022 graduates-former students who matriculated 15 months ago.

"Using the established accountability baselines that were in effect for the duration of the 2022-23 school year would place our district as

Seguin ISD is one of many Texas public districts to join the lawsuit that specifically names TEA Commissioner Mike Morath. The lawsuit was originally initiated and filed by Kingsville ISD and currently includes Canutillo, Crowley, Del Valle, Edinburg, Fort Stockton, PecosBarstow-Toyah and Pflugerville ISDs.

The motion to approve was approved by Seguin ISD trustees on a 6-0. Board member Joshua Bright was not at the meeting.

Scavenger hunt in downtown Seguin

(Seguin) — It’s a downtown scavenger hunt during the September Third Thursday on September 21 from 4:00 p.m. to 8:00 p.m. Check in at Central Park to get your clue card and then head out to find the answers to the clues.

Over a dozen downtown businesses will be participating in the scavenger hunt with more being open for shopping and dining.

“Come out and explore your downtown, shop with the downtown merchants, and have some family fun during our September Third Thursday,” said Amber Ehrlich, Marketing Chair for the Downtown Business Alliance and owner of Keepers Interiors & Furniture, “The scavenger hunt is something the whole family can participate in completing.”

After you complete your clue card, you can turn it in with the last business you visit or drop it off back

criminally and civilly if you damage somebody else’s property. So right now, the best advice we can give at the fire marshal’s office is do not burn anything,” said Pinder.

Average residents, however, are not the only ones being reminded to be careful.

“We are seeing some smaller fires that are kicking up on the roadsides and those are just fires that we will see from dragging chains and things like that and so we are mitigating those as they come through. The agriculture community is still cutting hay and things like that so right now, some of the fires that we are seeing are because of those hay cutters and stuff so we are asking those farmers to carry a fire extinguisher with you, make sure you are getting those fires out early, call 9-1-1 right away if you see you are having a fire or kicking up some sparks and things like that because we want to make sure that we get these fire departments in route to you soon,” said Pinder.

Pinder says one of the added benefits of the disaster

at Central Park. Winners will be selected from the completed clue cards for some great prizes.

In addition to the scavenger hunt and shopping, five food trucks will be set up around Central Park while music plays from the bandstand.

“The monthly themed shopping event, Third Thursday, have been a great addition to the downtown calendar,” said Kyle Kramm, Seguin Main Street & CVB Director, “It gives those who work during the day, a time to shop and explore downtown Seguin.”

After September’s scavenger hunt, the following months will be Fall Fun in October, Shop Small in November, and Last-Minute Holiday Deals in December. Third Thursday is an event hosted by the Downtown Business Alliance of Seguin, a nonprofit membership organization working to promote shopping, dining, and enjoying downtown Seguin.

declaration is being able to offset the cost of having to battle these fires each day.

“That allows for opportunities for cost tracking and tracking expenses for fire responses. We’ve had several large fires over the last few weeks where we’ve had to get in-state resources, and teams from out of the state. We’ve had people from Florida. We’ve had people from Louisiana come in and help Guadalupe County residents fight fires and the volunteer fire departments in these areas and what this does is it allows for when disasters make it to that threshold that the county has, we can get some eligible funding sources through the state grants for wildfire mitigation and fire department resources,” said Pinder.

Pinder says county officials this week have aligned the disaster declaration to run concurrent with the burn ban which runs through Oct. 9. At that time, he says the county will either reconvene before or on a court date to discuss an extension of a burn ban and/or an extension of the disaster declaration.

Martinson

Helen Hope Balch Martinson passed away peacefully, surrounded by loved ones at her home in Seguin, Texas on September 3, 2023. She was 57 days shy of her 104th birthday.

Helen was born to Lillian and Berta Bach on October 30, 1919 in Elba, Alabama. She grew up in nearby Fayette, where she began her life-long love of music.

Helen graduated from Montevalo College for Women, where she became an expert on both piano and organ. After graduation, she began her career both teaching and performing her talents in Greenville, and Birmingham; all the while, maintaining the grace, etiquette and charm of a true lady of the South.

It was in Birmingham where music led to her meeting the love of her life, Roy, who was an accomplished cellist. Roy lived in Iowa, and was visiting his brother, a colleague of Helen’s, in Birmingham. They were set up with a blind date by his brother, and that was it - they started making beautiful music together until Roy’s death in 2000.

After their marriage in 1947, Roy and Helen moved to Evanston, IL, where Roy completed his education at Northwestern University. After graduation, Roy was selected as a cellist for the Houston Symphony,

necessitating their move to Houston in 1950.

In Houston, Helen and Roy started raising their family - Ed and Marty, and became involved in the formation and founding of Christ the King Lutheran Church, where she served as organist and choir director for 31 years. She also taught in the Houston ISD elementary system for several years, as well as giving private piano instructions in her home.

They moved to Seguin in 1989, and she soon became involved in many volunteer activities including Seguin Conservation Society, Mid-Texas Symphony, Christian Cupboard, Lazy Daisy Garden Club, multitudes of groups and committees at her beloved St. Andrew’s Episcopal Church, and substitute pianist/organist at several local churches.

She was preceded in death by her husband Roy Martinson, parents Lillian and Berta Balch, and her brother Crawford Balch, and his wife Ruth. She is survived by her son, Ed Martinson of Houston, daughter, Marty Keil and husband Don of Seguin, granddaughter Morgan Stubbs and husband Cameron of Georgetown, and several nieces and nephews.

A celebration of Helen’s life will be held at St. Andrew’s Episcopal Church on Friday, September 15, at 11:00 a.m. at St. Andrew’s Episcopal Church, 201 E Nolte St., Seguin, TX. A reception will follow at the Parish Hall.

Memorial contributions can be made to St. Andrew’s Episcopal Church, Mid-Texas Symphony, The Seguin Conservation Society, or The Christian Cupboard.

Fauci: COVID “Tsunami” Unlikely

(Washington, DC) -- The man who spent nearly two decades as the nation’s top infectious disease expert says a repeat of 2020 is unlikely, despite a recent uptick in COVID cases. Speaking on ABC’s This Week, former National Institute of Allergy and Infectious Diseases Director Dr. Anthony Fauci also said he doesn’t expect a federal mandate to wear masks again. Fauci did say there could be recommendations by government agencies to wear masks if there is a “significant uptick.” Fauci stepped down from government service last December and is now a professor at the Georgetown University School of Medicine.

Justice Dept Appeals To End Abortion Pill Debate

(Washington, DC) -- The Department of Justice is filing an appeal to the Supreme Court, asking them to end the legal battle over Mifepristone. The commonly used abortion pill has been the subject of a nationwide legal fight since the Supreme Court overturned Roe v. Wade last year. The Justice Department filed the appeal last Friday, urging the Supreme Court to maintain broad access to the abortion medication. The paperwork noted this case is the first time a court has ever overlooked the “expert judgment” of the FDA. The move comes just hours after the manufacturers of Mifepristone filed a similar appeal.

California Lawmakers Proposal 2 Legalize Psychedelics
