June Scholarship Presentations The Huntsville/Madison County Builders Foundation has traditionally awarded scholarships to students who are pursuing a career in building related fields. Since 1999, the members of the Association have participated in the Crawfish Boils, Shrimp Festivals and Chili Cook-Offs. Due to the participation and donations to the scholarship funds, the Foundation has been able to award $172,517 in scholarships over the years.

At the June General Membership Dinner, the Foundation presented scholarships to 8 students in the amount of $9,750. Below is a list of the students, their field of study and the college or university they will be attending. Nathan Anderton – Welding Technology Calhoun Community College Rachel Guthrie – Civil Engineering Auburn University Jackson Harmening – Building Science Auburn University

Brandon Walker – Civil Engineering Auburn University The Burl & Betty Chandler Scholarship Award was presented to Melvyn Hayley, who is studying welding at J F Drake State Community & Technical College. After the presentations, City of Madison Mayor Troy Trulock gave an informative overview of the economic development taking place in the City of Madison and plans for its future growth.

Housing Hall of Fame Induction The purpose of the Housing Hall of Fame is to honor the men and women who have made significant and lasting contributions to the building industry in the charter area of the Huntsville/Madison County Builders Association.

Summer 2015 is definitely here and another Cornerstone edition released - this is a great magazine to keep you ”in the know”. At our June Membership Social, there were eight scholarships presented totaling $9,750 to students seeking education in the building industry. Thank you members and businesses that help make this event part of what your association is about, promoting the building industry and improving the quality of life while giving back to our community. President’s Message

Congratulations John Allen of Southern Construction & Design Inc. on your recent induction into the Housing Hall Of Fame; you are a true asset to this association. You have done so much for the industry and community you live and work in! May was National Home Remodeling Month proclaimed by Huntsville Mayor Tommy Battle. While TJ Meers and Howell Lee were meeting with the mayor, TJ asked about a PSA (public service announcement) on “Ask To See The Card” before consumers sign a contract to build or remodel their home. The card, of course, is a small wallet size copy of the Certificate of License issued annually by the Alabama Licensure Board. Mayor Battle welcomed the idea and a video was recorded! Watch for it soon on one of the local stations. The HBAA Summer Meeting will be July 16-18 at Sandestin Beach Golf Resort & Spa. This year’s education lineup includes “Marketing to the Next Generation: Millennials” and HGTV experts will be showing their annual design trends report. From numerous committee meetings, a Friday night Dinner/Dance, Board of Directors meeting on Saturday, culminating with a great fireworks show Saturday

evening, I certainly hope you have made plans to attend!

May was National Home Remodeling Month Remodeling is still outpacing new construction in our market. In 2014 remodeling permits $50,000 and above totaled approximately $148 million in Huntsville alone, while new construction was approximately $101 million. Therefore, again this year, City of Huntsville Mayor Tommy Battle proclaimed May as National Home Remodeling Month.

“Ask To See the Card” Initiative

The Remodelers Council continues to diligently work to create a level playing field for its members. In an effort to reach that goal, Howell Lee (GA Liaison) and myself met with Huntsville Mayor Tommy Battle to explain the need for a new Public Service Announcement on “Ask To See the Card,” designed after a similar PSA produced by the Alabama Home Builders Licensure Board following the 2011 tornadoes in North Alabama. The Mayor

I would like to take this opportunity to thank Mayor Tommy Battle for taking the time to tape the spot and for the great support by the City of Huntsville. I also want to thank the Mayor’s Communications Director Kelly Schrimsher and Videographer Blake Hudson. Also, we could not have accomplished this undertaking without the help of Chip Carden, Director of the Alabama Home Builders Licensure Board! A big thank you to everyone involved in this production!

“A New Leash on Life”

The Remodelers Council sold tickets for $1.00 each and raised $262.00 for A New Leash on Life during the Building Home & Remodeling ShowSM in March. HUNTSVILLE TEAM FIVEPEATS WITH FOUNDATION CLASSIC WIN

For the fifth year in a row, the Huntsville/Madison County Builders Association’s team captured the Foundation Cup in the Alabama Home Builders Foundation Golf Classic. The Foundation’s 21st annual tournament was held on May 7 at the Robert Trent JonesCambrian Ridge course in Greenville. Bryan Askew, Max Barnett, Tim Ryberg and Bret Slaton comprised the winning team, which finished with a score of 54. Also, Tim Ryberg won Longest Drive on the Sherling course and Bryan Askew won Closest to Pin on the Canyon course.

The ninety fishermen enjoyed breakfast, a full day of fishing, lunch, and an awards ceremony where tons of door prizes were given away – from gift cards to a roofing coil nailer to coolers, the participants won a wide variety of items. Regulatory Affairs Update Legislation That Passed During The 2015 Session

The Home Builders Association of Alabama (HBAA), with the support of local association leadership across the state, had a very successful legislative session in Montgomery. Bills that were stewarded through the legislative process by HBAA include the following: -HOA (Home Owners Association) bill passed and was signed by the Governor on June 2, 2015; -HVAC legislative bill; and -Plumbers legislative bill. Look on page 22 for a brief synopsis of each bill. Freshman Representative Richie Whorton, a longtime HMCBA member, helped guide the HBAA bills through the House and by all accounts, distinguished himself as an outstanding member of the freshman class of 2015. Thanks to all our local members who provides their expertise to local and state staff during the legislative session.

2016 Is an Election Year

Next year is an election year for a few state court races but is primarily Presidential and local county/city election year. HMCBA must “reload” its ABPAC funds for 2016 to continue its outstanding record of endorsing winners. Selecting to support the right candidate is a difficult and sometime gut wrenching process.

The Governmental Affairs Committee (GAC), interview committee and Board of Directors do an amazing job of vetting candidates. They have the highest percentage for selecting winners of any trade association in the area and that doesn’t happen by chance. The 2016 tentative election schedule is beginning to fall into place. Primary elections for President and state/county races will be held on March 1, 2016. Party qualifying will begin this fall and the HMCBA interview committee will begin interviewing candidates to recommend to the full Board in November with a goal of recommending a final slate of candidates to the Board at their January 2016 meeting. Funding for the endorsed candidates will be distributed before the end of January. City elections will be held on August 23, 2016 and candidate interviews will begin in the June 2016 timeframe. General election for President, state and county offices will be on November 8, 2016. If you are not currently participating in the Dues Check-Off program for your ABPAC contribution, please do so. Currently over 80% of our members participate in this program. By contributing to ABPAC events and asking your employees, family and friends to vote for our slate of candidates, HMCBA will continue to enjoy success at the ballot box in 2016.

The City of Madison has revitalized their Construction Board of Appeals and is conducting their organizational meeting on June 17th. HMCBA was successful in filling five of the seven slots on the Board with HMCBA members. The Madison City Council appointed John Allen, TJ Meers, Charlie Murphy, Jim Wright and Verrick Green to the Board. HMCBA appreciates the confidence shown by the City Council in their appointments and the commitment of these members to serve.

Synopsis of Recently Passed Legislation Alabama Homeowners’ Association Act HOUSE BILL 241 / SENATE BILL 418

Alabama Homeowners’ Association Act HOUSE BILL 241 / SENATE BILL 418 For the past several years, efforts have been made to address concerns raised by members of homeowners’ associations (HOA) about operation, financial disclosure, and transparency. This bill addresses all of these concerns, as well as the concerns of the builders, developers, real estate professionals, and lenders who take all the risk in developing the communities Alabamians call home. This Act: • Creates the Alabama Homeowners’ Association Act. • Establishes law that will regulate how homeowners’ associations are established and operated, while mitigating any unnecessary burden to the developer/ builder. • Requires all home owners associations (HOA) formed after January 1, 2016 to organize in accordance with the Alabama Nonprofit Corporation Act. • Leads to the creation of a searchable database of HOAs via the Alabama Secretary of State’s website which will give consumers valuable information when considering where to buy. • Provides transparency for home owners and potential home owners who are or may become owners of property subject to an HOA declaration through access to budgets, financial documents, organizational materials or other pertinent information. • Gives prospective home owners an opportunity to make a more informed decision when purchasing a home subject to the provisions of an HOA. • Has broad support from Alabama’s housing industry, including the Alabama Association of Realtors, Alabama Bankers Association and the Home Builders Association of Alabama.

Plumbers and Gas Fitters Law SENATE BILL 307

These revisions to the Plumbers and Gas Fitters law have been recommended by the members of the Plumbers and Gas Fitters Board and are supported by the plumbing and gas fitting industry. Similar to the bill that passed the House in 2014, this bill makes changes to streamline the licensure process, promote trade education, and enhance consumer protection. This bill: • Deletes the bond requirements that have been mandated by the board. These bonds have never been accessed by the board in its history. Complaints are routinely handled through a consentagreement process and do not require access to the bond. By eliminating the bond requirement, plumbers will save $150 -$200 each and consumer protection will continue as it has through the consent-agreements or license revocation process. • Allows for excess funds to be transferred to a 501 (c) (3) nonprofit foundation. These funds will be used expressly for plumbing and gas fitting educational programs at state approved technical training facilities.** The Alabama Plumbers and Gas Fitters Board has NEVER had excess funds that reverted to the Alabama General Fund. This bill ensures that if, at some future date, the board has excess funds, those funds would go to help educate the next generation of plumbers in Alabama. • Requires business names on all service and construction vehicles to easily identify certified Plumbing and Gas Fitting contractors. • Requires all company names to be registered with the Board. This change gives the board the ability to identify unlicensed, out-of-state plumbers and ensure that they come into compliance with Alabama’s law. It also ensures that contractors are not able to avoid disciplinary action by voluntarily canceling one license and then obtaining a new license.

Revisions to Alabama’s HVAC Law HOUSE BILL 231

• Allow for the registration of Duct Envelope Tightness (DET) Testing Contractors pursuant to Alabama Residential and Energy Code Board and corresponding federal requirements. • Clarify that the definition of Certified Heating and Air Conditioning Contractor includes all legal entities engaged in the business of heating and air conditioning contracting. • Allow the Board the ability to print promotional materials as a form of public outreach. • Clarify the Contractor’s ability to carry forward 4 hours of continuing education credits for the next renewal cycle. • Allow the Board to transfer excess funds* to the Alabama Home Builders Foundation to be used exclusively for education of those wanting to become Heating and Air Conditioning and Refrigerations Contractors.*The Board has reverted less than $100,000 to the general fund in the past 10 years.
