lowns have been making the world laugh – and sometimes cry – for centuries. Dwarf clowns, court jesters, circus clowns, rodeo clowns: funny creatures dressed in colorful, comical, showy costumes with faces made up like the icing on a birthday cake. So popular had clowning around become that in 1971, President Richard Nixon signed into law “National Clown Week.” Today, it’s grown to International Clown Week, celebrated throughout the universe during the month of August.

WHO THOUGHT OF THAT? As early as 2500 B.C., pygmy clowns performed as court

jesters during Egypt’s Fifth Dynasty. Chinese court jesters were around beginning in 1818 B.C. In 1520 A.D., after Cortez won the battle against Montezuma and the Aztec Nation, he discovered that Montezuma’s court included jesters like dwarf and hunchbacked clowns, similar to those in Europe. Clowns played a vital role in many Native American tribes. Some Native Americans believed the clowns cured diseases. Some clowns have altered the wrath of dictatorship. Only a clown was allowed the freedom to use sarcasm and humor in the presence of kings and emperors. In 300 B.C., Chinese Emperor Shih Huang-Ti oversaw the construction of the Great Wall of China. Thousands of laborers were killed during the building of the wall. The emperor wanted to paint the wall, which would have resulted in more deaths. However, his court jester, Yu Sze, in a joking manner, convinced him to abandon the idea of painting the wall. Yu Sze became a national hero. One of the great tales about a famous European court jester involved a Rodney Dangerfield-type standup gig. When one of the kings looked in the mirror and began crying at his aging image, other members of the court, including jester Nasir Ed Din, cried along with him. When the king stopped crying, everyone stopped their tears except for Nasir. The king asked him why he was still crying and Nasir said, “Sire, you looked at yourself in the mirror but for a moment and you cried. I have to look at you all the time.”

The Auguste Clown

Clowns take on many different characters. One of the most popular is the Auguste clown. Playing a zany, clumsy, whimsical role; the Auguste clown dons colorful costumes and makeup that exaggerates and enhances facial features. Think of a wide white smile with black lipstick, eyelids caked in white extending to the forehead and that oversized red nose. Auguste is a German word for “fool.” Legend has it that an American clown by the name of Tom Belling was performing with a circus in Germany in 1869. Off stage, he entertained his circus colleagues by putting on mixmatched clothes that mocked his manager. When the manager caught Belling in the act one day, Belling ran and ended up in the circus arena where he fell over the curb of the ring, not once but twice. The audience laughed and yelled “you auguste” and the manager insisted that Belling continue the “act.”

The Hobo Clown

The hobo or tramp is a catch-all for a variety of clown personas. The tramp clown is rooted in America, but there are a few versions of where and who started the character. Some say James McIntyre and Tom Heath created the tramp clown in 1874, when they portrayed African Americans homeless because of the Civil War. Basing their character on the black-face minstrel clowns, the two studied black culture to accurately portray African Americans. McIntyre introduced an African American dance called the “buck and wing,” which eventually became “tap dancing.” Another version is that traveling “hoe boys” – itinerant farm workers – rode the railways town to town, constantly engulfed in soot, which they wiped away from their eyes and mouth – leaving the face a contrast of white on black,

Continued from Page 2 black on white. The hobo or tramp is also a character clown, embracing a variety of roles, from cowboys to little old ladies. Red Skelton as Clem Kaddiddlehopper or Freddy the Freeloader exemplified the tramp and hobo clown with a down-onhis-luck character as Clem – torn, grubby clothes and a painted-on sad face – and a hobo “whatever happens, happens” attitude as Freddie, often in the same garb but with a big smile painted on his face.

The White-Faced Clown

The court jester was a model for the whitefaced clown. Picture a chalk-white face with black lines drawn below and above the eyes or perhaps one or two colorfully painted teardrops. The white face is the oldest style of clowns. In Greek theatres, poor lighting led to the actors wearing white makeup as a base, with black markings to brighten their features. White-faced clowns often have more exaggerated makeup highlighting one facial feature like a mouth or the eyes. They often wear balding caps or partial hair pieces like one of the most famous clowns of all time – Bozo. The white-faced clown also acts as the most intelligent clown, often leading other types like the klutzy Auguste clowns.

Rodeo Clowns

Rodeo clowns take their lives in their hands when they put on their happy masquerade. The primary function of the rodeo clown is to fend off the bull when the bullfighter

If the clown has lived through that experience, he also entertains the crowd between rodeo events.

Circus Clowns The first-ever circus clown debuted in England in 1768. Philip Astley was the creator of the clown act known as Billy Buttons or Tailor’s Ride to Brentford. The circus clown act was based on a tale about a tailor, inept at riding a horse, who tried to ride to Brentford to vote in an election. The impersonation showed the tailor trying to mount the horse correctly but failing over and over. Once the clown succeeded in getting on the horse, the horse took off so fast that the clown (aka tailor) fell off again.

Who could forget Bozo?

Some of the affiliated members were given the task of selecting the first nominees for the hall of fame. The membership of the ICHOF then voted on the candidates, which resulted in the April 1989 induction of Red Skelton, Lou Jacobs, Emmett Kelly, Mark Anthony, Felix Adler and Otto Griebling.

FAMOUS CLOWNS Dan Rice

One of the first professional clowns in America was born out of the Civil War era. Dan Rice began his gig commenting on current events. He also wrote songs and campaigned for Zachary Taylor for president. Rice encouraged Taylor to ride with him on the circus bandwagon in the circus parades. Local politicians wanted to ride on the bandwagon to boost their popularity as they aligned with Taylor. Onlookers often commented, “Look who’s on Taylor’s bandwagon,” which led to the phrase “jump on the bandwagon.” Rice dressed up in a red, white and blue patriotic suit, which he called his “flag suit.” He also wore a goatee. The image of “Uncle Sam” is based on Rice’s character. At one point in history, Rice was the highest paid person in the U.S. – he earned more than Abe Lincoln. With his wealth, he gave generously and was the first to erect a monument to soldiers killed in the Civil War.

Bozo

Created in 1946 by Alan Livingston, Bozo’s character was first introduced in a record album and illustrative read-along book called “Bozo at the Circus” for Capitol Records. Bozo’s popularity with the kids soared, and Bozo became a mascot for the record company. In 1949, a television station in Los Angeles began broadcasting the first live TV show, “Bozo’s Circus.” Pinto Colvig was the original Bozo for both the albums and the TV show. His iconic costume included red and blue garb, a bushy half-head of red hair, a big red nose and white-face clown makeup.

Larry Harmon, a Bozo imitator for promotional purposes, bought the licensing rights to the character in 1956 and called him “Bozo, the World’s Most Famous Clown.” Harmon became the sole owner of the licensing rights to Bozo in 1965 and took the show to a national audience. From 1965 to 1967, he produced 130 half-hour shows called “Bozo’s Big Top.” Bozo was now syndicated but some smaller TV stations still preferred their own Bozo adaptations.

Throughout the country, there were many “actors” portraying Bozo, including the long-time weatherman of the “Today Show,” Willard Scott, who played Bozo from 1959 to 1962 on WRC-TV in Washington, D.C.

Let’s take a look at green flooring materials. Consider products that begin as a natural product (wool, wood, cork) or are made from recycled materials (carpet). Soda bottles can be melted down and recycled into carpet fiber. Certain carpet manufacturers have the ability to take post consumer carpet and break it down to its original raw material. The new material can be manufactured back into carpet without any degradation of quality to performance or styling.

U.S. households account for about 1/5th of America’s total greenhouse gas emissions. The average U.S. household generates more than 80 tons of carbon dioxide every year -- that’s 22.5 tons per person! The average household also creates 3.3 tons of landfill waste every year -- an average of 4.5 pounds of trash, per person, per day!

How products are harvested is critical. Try to select sustainably harvested products

What is Green Flooring and the factors that determine green? Green flooring includes any flooring that is sustainable, eco-friendly, contains recycled content, is recyclable, leaves a small carbon footprint or has low VOC’s (Volatile Organic Compound). There are different degrees of green associated with different types of flooring.

verywhere you turn there is a reference to something green! This reality reflects a growing desire to live a healthy and productive life and to minimize environmental damage for our own as well as our children’s benefit. The demand to “go green is starting us on the path toward resolving many pressing concerns such as global warming, depletion of natural resources, pollution, and the disruption of natural habitats.

Many organizations are making efforts to decrease the nation’s dependence on fossil fuels and to develop renewable energy sources. They are also seeking to minimize their environmental footprint by using products with longer life cycles and less impact on the environment. We can all do our part by making smart purchases; so why not begin with flooring?

ost of us have heard of the saying, “Misery loves company.” This is a true and valid statement. Look at a person who is in a bad mood. Perhaps this person is a coworker. You arrive at work in a fairly good mood and your co-worker gives you a look that says, “Keep your cheerfulness away from me.” So you may avoid that person the rest of the day. Another scenario to illustrate the above quote is look at a group of people who want to complain about an issue. That issue can be valid or not, but regardless of the complaint, the group of people typically get each other wound up. Each person begins making the issue bigger and bigger when it did not need to be. Each person feeds into each other’s negative attitude and focus’ on the problem instead of creating a solution. In fact, what the people, in the group, may do is simply choose to blame and that IS their solution. You may walk into the conversation and want to find a solution that fits the issue and you are pushed aside because you choose not to play a role in the blame game. As a result, you may feel bombarded with other people’s negative attitudes. This can happen in a working setting or a personal setting. Feeling bombarded with people’s negative attitudes and then allowing it to impact your attitude is called “absorbing people’s energy”. You take on the issue of negativity and allow it impact your mood for the day, week, month,

A Tai Yi treatment that works with both issues is called Spontaneous Motion. Spontaneous Motion works for those who have a tendency to pick up on other people’s negative energy and it impacts them.

This issue can also affect your understanding of your own true issue. Because you may use other people’s issues as a cover, your real issue is buried. You may feel that something is off, you simply may not be happy and do not know why-the issue is buried. Because the issue is buried and not healed, it impacts your choices, behaviors, and patterns. You may see that certain patterns create pain, but not understand from where the pattern originates or how to resolve it.

year, or longer. Maybe you continually take on other people’s problems and make them yours. Perhaps you are in a position (relationship, work, or otherwise) that someone else wants and you can feel the negativity from someone else and it impacts your quality of life. It impacts your quality of life because you are absorbing someone else’s energy and not even realizing it. You simply realize the result of it, which is pain.

TAI YI

It is also for those who have an issue and it’s buried. The treatment works with the mind to help it become more sensitive to the issue so it’s more obvious, thus can be worked with. The treatment also brings awareness if the mind attempts to sabotage the healing work a person is doing on an issue. That sabotage can be negative thoughts

and avoiding the issue. The person can recognize the sabotage quicker and end it quicker. Ending sabotage leads to a speedier healing emotionally, mentally, and physically.

Send in the Clowns... Continued from Page 4 McDonald, who became the Bozo cousin in charge of pushing hamburgers on McDonald’s commercials.

THE GRANDDADDY OF CLOWNS Remember the clown who persistently swept the spotlight at each of his performances? Emmett Kelly Jr., became wellknown for that shtick, which is a pantomime classic. Kelly performed nationwide until he died in 2006 at the age 83. Throughout his years as a clown, he donated his time to numerous charities and children’s foundations. Born Nov. 13, 1923, in Dyersburg, Tenn., to a circus family, Kelly traveled the circus circuit in his earlier years. His father worked as a clown/mime known as “Weary Willie” for the John Robinson Circus. When Kelly was old enough for school, he was sent to live with his grandparents but returned to his parents’ roadie lifestyle during the summers. After graduation, he enlisted in the U.S. Navy and served three years in World War II. At the war’s end, he began a career as an auto mechanic and railroad switch tender. But life under the Big Top was in his blood. Fifteen years later in 1960, Kelly apprenticed with his father and the circus manager

and made his debut as another “Weary Willie” at the Circus Festival in Peru, Ind. In 1964, he got his big break when Eastman Kodak hired him to represent them during the New York World’s Fair. He became one of the fair’s top attractions, and Eastman Kodak kept Kelly on as their ambassador of goodwill.

Whether you are looking for the perfect gift, or just feel like spoiling yourself, we have something to fit every occasion and personality. Stop in and check out the collections by Mariposa, K Hall, Beth Quinn, Rabbit Moon, BlaBla, Patsy’s Candies, and many more.

CLOWNING AROUND • Coulrophobia is a fear of clowns. Rodney Blackwell claimed he was afflicted with the phobia and set up a Web site for people with the same affliction. He also sold merchandize such as “I Hate Clowns” stickers. The main cause of the phobia is the heavy makeup worn by the clowns, along with the giant nose and orange hair, which is daunting to some. • There are about 40 clown colleges in the United States.

• On Aug. 20, 1804, Sgt. Charles Floyd dies three months into the voyage of Meriwether Lewis and William Clark, becoming the only member of the Corps of Discovery to die during the journey. Based on the symptoms described by Lewis and Clark, modern physicians have concluded that Floyd was probably suffering from acute appendicitis. • On Aug. 19, 1812, the U.S. Navy frigate Constitution, known as “Old Ironsides,” catches the British warship Guerrire some 600 miles east of Boston. After considerable maneuvering, the Constitution delivered its first broadside. The British man-ofwar was dismasted and rendered a wreck, while the Constitution escaped with only minimal damage. • On Aug. 21, 1911, theft of the Mona Lisa is discovered. Investigators and detectives searched for the painting for more than two years without finding any decent leads. In 1913, former employee Vincenzo Perugia was captured attempting to collect a ransom.

• On Aug. 22, 1933, the notorious Barker gang robs a Federal Reserve mail truck in Chicago and kills Officer Miles Cunningham. Netting only a bunch of worthless checks, the Barkers soon returned to a crime with which they had more success -- kidnapping. Their first victim, William Hamm, had earned the gang $100,000 in ransom. • On Aug. 18, 1958, Vladimir Nabokov’s controversial novel “Lolita” is published in the U.S. The novel, about a man’s obsession with a 12-year-old girl, had been rejected by four publishers before G.P. Putnam’s Sons accepted it. • On Aug. 16, 1977, Elvis Presley dies in Memphis, Tenn. He was 42. The death of the “King of Rock and Roll” brought legions of mourning fans to Graceland, his mansion in Memphis. Doctors said he died of a heart attack, likely brought on by his addiction to prescription barbiturates. • On Aug. 17, 1987, Rudolf Hess, Nazi leader Adolf Hitler’s former deputy, is found strangled to death in Spandau Prison in Berlin at the age of 93, apparently the victim of suicide. Hess was the last surviving member of Hitler’s inner circle and the sole prisoner at Spandau since 1966. (c) 2010 King Features Synd., Inc.

About eight of those every year are considered to be major, registering above 7.0 on the Richter Scale. • If you’re a sailor you’re probably familiar with the hazards of being out on the water: high seas, storms, hidden reefs. You probably wouldn’t count whales among the dangers, but you’d be wrong. It seems that on a recent day sail out of Table Bay Harbor in South Africa, a couple on a 30-foot sailboat were whale-

A 40-ton whale they had been viewing breached right next to the boat and landed on the deck, breaking off the mast and then thrashing around before sliding back into the water. The whale lost some skin and blubber, but was otherwise unharmed; the couple were lucky to still have a seaworthy craft and made it safely back to the harbor.

I am not clear what you mean by a cyst causing the degeneration. In what part of the eye was the cyst? I have not seen a link between cysts and macular degeneration.

DEAR DR. DONOHUE: Is it possible to get wet macular degeneration from a scratch on the left eye during cataract surgery, or could it have been a cyst that caused wet macular degeneration? I am 85, and my right eye is perfect. I had cataract surgery on that eye also. -- C. ANSWER: A scratch on the eye isn’t likely to cause macular degeneration. The possibility of cataract surgery leading to macular degeneration is a remote one. More than 6,000 people who had had a cataract removed were followed for five years after the operation. Slightly more people who had the operation developed macular degeneration, dry or wet, in the operated eye than did a similar group of people who had not had an operation. This isn’t proof that cataract surgery leads to macular de-

generation. The same risks that cause cataracts also cause macular degeneration. The numbers that do develop it after cataract removal are small. A cause-and-effect relationship has not been proven.

The retina is the back layer of the eye, the layer that converts incoming images into nerve signals that can be transmitted to the brain so we can see. The macula is a small, round area of the retina where there’s an aggregation of cells that are essential for central vision -- the kind of vision needed to read a paper, watch TV and drive. Dry macular degeneration, accounting for 85 percent to 90 percent of cases, is a wasting away of macular cells. Wet macular degeneration results from a sprouting of blood vessels in that region. Those newly formed blood vessels leak fluid and destroy macular vision. Procedures are available that can halt the progression of wet macular degeneration.

arms. I am terrified that he will pull their arms out of joint. I know this isn’t the proper way to lift children. Would you give your opinion about this so I can show him? Maybe he will listen to you. -- A Worried Grandpa ANSWER: Sons-in-law should listen to their fathers- and mothers-in-law. They have experience in child-rearing. Lifting young children by grabbing onto their hands or arms can cause the radius (the larger of the two lower arm bones) to slip away from the ligament that keeps it in place. This disruption has the name “nursemaid’s elbow.” I guess nursemaids must have lifted children in this way. It’s painful for the child,

“A man travels the world over in search of what he needs, and returns home to find it” George Moore said that (it’s okay, I haven’t heard of him either). Debbie Cohen is not a man. whether she touched your heart, or told you to stop touching your girlfriend (because it is, after all, a family place) there is an aura of respect all around her. When I found out I would be writing a short tribute to Debbie this week, I came up with the brilliant idea of asking locals to give me goodbye quotes recognizing her. But then I thought, ‘no, tell her yourself’. So you’ll have just that opportunity. This Saturday, August 21st, we say goodbye to one of the definitive people of our community. It’s a going away bash, from 9pm-2pm, with the band Trademark Infringement, featuring heartbreaking goodbyes. Let her know you’ll miss her; her whit, her laughs, and her command over the room. FREEZING SAVES THE BEST OF SUMMER

I

t’s August, and that means I’m busily trying to figure out a way to preserve the smells and flavors of my favorite vegetables. I enjoy stocking my freezer with the vegetables I’ve grown or bought in large quantities from local farmers. Your freezer is one of the best ways to preserve the color and flavor of summer produce all year long. Here’s some great tips for freezing the best selection of your favorite summer vegetables and herbs: Can I Freeze Bell and Sweet Peppers Raw? If you’ve picked a peck of peppers and have too many to eat, try freezing them. Peppers are one of those foods that can be quickly frozen raw without blanching them first. The National Center for Home Food Preservation, hosted by the University of Georgia Cooperative Extension Service, offers these guidelines on freezing bell and sweet peppers raw: Select crisp, tender, green or bright-red pods. Wash, cut out stems, cut in half and remove seeds. If desired, cut into 1/2-inch strips or rings. Good for use in uncooked foods because they have a crisper texture, or in cooked foods. Package raw, leaving no headspace. Seal and freeze. NOTE: To make it easier to remove only the amount of frozen bell or sweet peppers needed at one time, freeze sliced or diced peppers in a single layer on a cookie sheet with sides. Transfer to a “freezer” bag when frozen, excluding as much air as possible from the bag. Can Tomatoes be Frozen Raw? Like peppers, tomatoes can be frozen raw. Frozen tomatoes are best used in cooked foods such as soups, sauces

and stews as they become mushy when they’re thawed. Select firm, ripe tomatoes with deep red color. Wash and dip in boiling water for 30 seconds to loosen skins. Core and peel. Freeze whole or in pieces. Pack into containers, leaving l-inch headspace. Seal and freeze. TIP: Dip just a few tomatoes at a time into the boiling water or the water temperature may be lowered too much to remove the skins without overheating the tomatoes. Place hot tomatoes in a colander and rinse under cold water to make them easier to handle. A knife with a serrated edge works best for cutting tomatoes. How About Freezing Fresh Herbs? Wash, drain and pat the herbs dry with paper towels. Wrap a few sprigs or leaves in freezer wrap and place in a freezer bag, then seal and freeze. The frozen herbs can be chopped and used in cooked dishes. After freezing, the herbs usually are not suitable for garnish, as they become limp when thawed. TIP: To extend the time frozen fruits and vegetables maintain good quality, package foods in material intended for freezing and keep the temperature of the freezer at 0 F or below. It is generally recommended that frozen vegetables and fruits be eaten within eight months for best quality.

1. To peel the tomatoes, submerge them in boiling water for 15 seconds. (Dip just a few tomatoes at a time or the water temperature may be lowered too much to remove the skins without overheating the tomatoes.) Place in a colander and rinse under cold water. The skins should slip right off. Core the tomatoes and gently squeeze out the seeds. Chop half of the tomatoes coarsely and puree the other half in a food processor. Combine the puree and chopped tomatoes in a large mixing bowl. 2. Add the cucumber, bell pepper, onion, vinegar, olive oil, lemon juice and zest,

parsley, basil, hot sauce, salt, pepper, sugar and nutmeg to the tomatoes. Mix gently to blend the ingredients. Cover and refrigerate for several hours before serving. 3. Serve chilled. Garnish with the avocado and herbed croutons, if desired. Makes 6 servings. *** Angela Shelf Medearis is an award-winning children’s author, culinary historian and the author of six cookbooks. New DVD Releases for Week of August 16, 2010 PICKS OF THE WEEK “Temple Grandin” (Unrated) -- “Temple Grandin” is one of those little gems of a film that most people haven’t heard of or seen -- but should. Unless you have HBO, you’ve probably never heard of this delightful biopic. Claire Danes stars as Temple Grandin, a woman born in 1947 with classic autism, one of the most severe forms of the affliction. At

the time, autism was diagnosed as a type of schizophrenia and mothers were blamed for the child’s condition, often being accused of being too cold and unfeeling toward the child. When Temple is finally properly diagnosed with autism, her mother (Julia Ormond) rejects the doctor’s suggestion to institutionalize the girl and instead devotes her energies to raising Temple to live a normal, fulfilling life. And Temple does just that. She not only attends university, eventually earning a Ph.D, she also becomes the foremost designer of humane slaughterhouses. “Temple Grandin” is a better-than-average biopic, mostly because it treats the subject with gentle humor and respect, and doesn’t fall into the trap of sentimentality or hagiography. Claire Danes’ performance is brilliant, and she definitely deserves an Emmy. If after watching the film, you want to learn more about Temple Grandin, I strongly recommend renting a copy of Errol Morris’ doc-

umentary series “First Person.” One of the episodes is devoted to Temple, and she tells her story in her own words as to how her autism gave her a unique insight and empathy toward cows, and how it gave her the ability to design the slaughterhouses so humanely and efficiently.

DOG OF THE WEEK

“Furry Vengeance” (PG) -- Sometimes I imagine that Brendan Fraser’s idea of a perfect evening is having someone jangle a set of car keys just out of his reach whilst chiming, “Oooo! Shiny-Shiny!” It’s the only way I can justify in my mind why he makes such stupid movie choices. “Furry Vengeance” is about a guy (Fraser) who takes a job overseeing the development of a subdivision in Oregon. The wee woodland creatures aren’t too happy about having their forest mowed down, so they band together and find ways to attack Bren-

14

dan Fraser’s crotch. By the end of the film, Fraser’s character learns Important Lessons About Family and The Environment. You, however, will want to hunt Fraser’s crotch down and finish the job.

ou have heard of the old saying, “buy low, sell high. But have you heard of “sell high, buy low? In today’s stock markets you are able to sell before you buy. This is called going short. There are certain rules depending on which market you are trading in, but the principles are the same. You sell a stock at a set price and by it back at a later date to fill the order. This type of trading can be very profitable when the market is in a downward movement. A great example would be John Paulson who earned in the neighborhood of $3.7 BILLION in 2009 by mostly selling short on Bank stocks. Mr. Paulson had the foresight to see that the banks were going to suffer from the downward move of the economy and be left holding unpaid mortgages. He sold bank stocks at a set price and then bought them back at a lower price when their value dropped. Selling before you buy is very prevalent in the futures markets. A futures contract is a standardized contract between two parties to buy or sell a specified asset of standardized quantity and quality at a specified future date at a price agreed upon today (the

of dollars can help you decide. There is a 55-page book by Barbara H. Morris called “Moving for Seniors, a workbook that could be very helpful. It costs $15 but could be a real sanity saver. It’s available at www.movingforseniors. com, or at Amazon.com for around $10. If you fear you’re going to be “helped in your move by some grabby, uncaring people, consider getting this book, too: “Don’t Toss My Memories in the Trash -- A Stepby-Step Guide to Helping Seniors Down-

As you can see this type of trading has been around for almost 150 years. Yet most people do not understand it. These futures contracts are a very big part of the financial markets around the globe today. Every day millions of contracts are bought and sold or sold and bought. It surprises me how many people with a large portion of their assets in the market have little or no knowledge of how the market works. With all the movement in the market, you have probably heard the term “YOYO Market. I heard a great definition of the YOYO Market the other day. It stands for “You’re On Your Own. Take the time to understand how the market works, after all it is your money. futures price). Since the contract is for an asset to change hands at a future date it can be sold first and bought back later to fill the contract. The Chicago Board of Trade (CBOT) listed the first ever standardized 'exchange traded' forward contracts in 1864, which were called futures contracts. This contract was based on grain trading and started a trend that saw contracts created on a number of different commodities as well as a number of futures exchanges set up in countries around the world.

MVEA has a new look!

There are many strategies to explore when saving for your retirement and your child’s education. To implement the right mix of options, it’s important to discuss your situation with a professional financial advisor, but here are some options to consider: Contribute to your 401(k). Since many people don’t have unlimited funds available to save for retirement and college, it’s important to get the most mileage possible from the money invested. Try to utilize the tax-advantaged retirement accounts available to you. For starters, contribute as much as you can afford to your 401(k) or other employer-sponsored retirement plan. Not only can your earnings grow on a tax-deferred basis, but your contributions are generally made with pretax dollars, so the more you contribute, the lower your annual taxable income — which, in turn, could give you more disposable income to invest for college. In 2010, you can contribute up to $16,500 to your 401(k), or $22,000 if you’re 50 or older. Fund your IRA. Depending on your income level, your contributions to a traditional IRA may also lower your taxable income, again potentially freeing up resources for college. Plus, your earnings can grow tax deferred. If you qualify for a Roth IRA, your contributions are

not tax-deductible, but your earnings grow tax free. Withdrawals are also tax-free, provided you’ve held your account at least five years and you don’t start taking withdrawals until you’re at least age 59½. Also, you can withdraw Roth IRA contributions without paying taxes (since you’ve already been taxed on this money), so you could use these funds, if necessary, to help pay for college costs, although ideally you’d like to leave your account untouched until you retire. If eligible, you can contribute up to $5,000 to your traditional or Roth IRA in 2010, or $6,000 if you’re 50 or older. Open a 529 college savings plan. Contributions to a 529 plan are made with after-tax dollars. However, when you contribute to a 529 plan, your earnings grow tax free. Withdrawals are also tax-free, provided they are used for qualified higher education expenses. (Withdrawals for expenses other than qualified higher education expenditures may be subject to federal and state taxes plus a 10% penalty.) Furthermore, 529 plan contributions may be eligible for a state tax deduction or credit in certain states for residents who participate in their own state’s plan. Also, the lifetime contribution limits for 529 plans are quite generous, and you can gift $13,000 per year, per beneficiary, without incurring gift taxes. To make sure you understand the tax ramifications of a 529 plan, you’ll want to consult with your tax advisor. It may not be easy to put away as much as we’d like for retirement and college. But you do have some attractive savings and investment options. Don’t delay, because when saving for any goal, time is a great ally. THE MARRIAGE ZONE: DIVORCE PROPERTY DIVISION By Christopher C. Meyer © 2010

I

f you are thinking about getting divorced, or even if you may be thinking about getting married, it is useful to understand something about how your property will be divided in a divorce. Marital property in Colorado is divided in a divorce or legal separation by means of “equitable distribution”. “Equitable” does not necessarily mean “equal”, but for most purposes, and absent unusual circumstances, it is practical to assume that marital property will be divided 50/50 between the parties. In contrast, marital property (community property) in community property jurisdictions such as California is always divided 50/50. How do you distinguish marital property from other types of property? Marital property is all property acquired during the marriage, such as the parties’ earnings and things acquired with such earnings. However, inheritances and certain gifts acquired during the marriage are not marital. “Separate property” is property acquired prior to the marriage, or an inheritance or certain gifts acquired during

the marriage. The Court has no power to divide separate property. However, any appreciation of separate property during the marriage is marital. Separate property may become marital property if it is commingled (combined) with marital property in such a way that it is no longer practical to determine if the funds are marital or separate. Don’t put your inheritance in your general personal checking account unless you want it to become marital property! Here is how the property classifications work in real life. A married couple save some earnings during the marriage and buy a house. The couple pay the mortgage with the husband’s earnings. The wife receives an inheritance during the marriage and is careful to maintain this inheritance in a separate mutual fund account in her name only. The equity in the house is marital, as is any appreciation included in that equity. The amount of the wife’s inheritance is her separate property, but any appreciation of the inheritance during the marriage is marital. In most instances, determining what is marital and what is separate property is not difficult. However, the analysis can become complicated in some situations, especially regarding changes to title to separate property during the marriage. For example, if you own separate real property titled in your name only but change the title to joint tenants during the marriage (a common occurrence), you may have gifted one half the value of the property to your spouse by changing your separate property into marital property! For example, Mary owns a condo in her name only, but changes the title to joint tenants after she marries John. John may now be entitled to one-half the value of the condo.

How you title property that it already marital is not critical. For example, the parties buy a car during the marriage with money earned during the marriage. They place the title to the car in the husband’s name only. The car is still marital property. Even when determining what is marital and what is separate is relatively easy, calculating the marital and separate shares can be difficult. This is true for retirement accounts and pensions earned both prior to and during the marriage. Special Court orders may have to be drafted to accurately divide such assets. Property division law in a divorce is the same as other law. You must remember that: you may not understand the law; you may not like it; and you may not think its fair; but it’s the law! You should also remember that if you are married, or you are thinking about getting married, you should be very careful about re-titling separate property and commingling separate property with marital property.
