t’s been said that if a product is as good as it claims to be, advertising is unnecessary. There may be a smack of truth to that, but there’s a reason advertising is a multi-billion dollar industry. Though, we have to admit, at times it feels as though it is a bit much... surely, we wouldn’t know what brand of deodorant to buy, what presidential candidate to vote for or how to lose 10 pounds in 10 days if it weren’t for advertisements. In an age where people like to think of themselves as in control of their lives and able to make decisions all by themselves, somehow or another, these advertisements manage to persuade us day in and day out.

Advertising techniques have evolved over time, bringing with them new and unique ways to convince the average consumer that their product is superior to their competitors.’ So how exactly do they do that? Well, here are a few tricks the ad guys

A major deviation from the typical ad design was the ads within the “healthcare” industry. Since healthcare in the middle to late 1800s was not well-developed, everyone and their mother was able to come up with a potion or elixir that would cure a variety of ailments. In order

The food in a typical advertisement is often “styled” so it appears more appetizing than reality could possibly produce. Take a roasted chicken, for instance. The skin is often pulled tight and sewn up and the cavity is stuffed with wet paper towels which helps keep the chicken plump but also produces steam, giving it that nice, freshly-cooked look. After spending a few minutes in the oven to crisp the skin, the chicken is then painted a golden brown to create the perfectly-roasted appearance.

The next time you see an ad for a watch, take note of where the hands are pointing. Often, they are set to display the time 10:10. Why? When the hands point to this time, they frame the name of the watch brand and also make a smiley face. Who could resist a watch with a smiley face?

Another tactic used by advertisers who target kids is to use child actors that are older than the target audience for that particular product. For example, if a toy is recommended for five-year-old kids, the actors in the ad might be as old as eight. Why? The idea is that the image of an older child playing with that toy It’s no secret that toy makers target will entice younger children to want kids with their advertisements. Many herbs used for cooking are also great at deterring pests. Garlic repels aphids, root maggot, white flies, carrot rust fly and vampires! Both Oregano and Sage repel the cabbage moth. Cilantro, as well as making great salsa, repels aphids, potato beetles and spider mites and Dill attracts predatory wasps that eat caterpillars. Pennyroyal and Spearmint are both your official ‘Ant B-Gone’ herbs and the Colorado potato beetle can be repelled by Flax and Horseradish. Those slimy slugs and snails can be kept away with Rosemary. Don’t forget some of the big-ticket items, like your property tax. Some municipalities give discounts to seniors. If you’re traveling, ask about a senior discount for motels, airfare and car rental. Ask in places where you routinely spend money, such as the grocery stores, especially the chains. Carry your AARP card in your wallet, because in many places that’s all you need. he important question, “Who am I?” can be answered many ways. When my mother was in her 90s she still referred to my brother and me as “her kids.” So I am a kid, a husband, a father, a grandfather, an uncle, a boss, a writer, a speaker, a basketball player, a sinner (though redeemed), a senior, a teacher, and much more.

W

hat a week! It was hot. It was windy. You know the rest. Once again our community became the center of national news as many of us tried to find our way out of the fire. Watching our friends and family scramble around town was chaotic and heartbreaking. The smoke that covered our skies brought back painful memories, while ushering in new tragedies. The great flame was unpredictable. It went East, then west. It went far and wide. Eventually; it was over. With all the bad news we’ve been hearing lately, I thought I might bring El Paso County a good, positive story! Of course the news doesn’t effect any of us personally, but it’s still good to know that the blessings are falling somewhere. This is the story of an ordinary man named Ricardo Cerezo. Like many others right now, he was struggling financially. In fact, the Cerezo family was on the brink of foreclosure. They were also coming off the heals of a tragic family loss (sorry, this story isn’t all positive. But we’ll get there, I swear). Their 14-year old daughter had recently passed away from health complications. The family was at an all-time low, to say the least. But as luck would have it, the Cerezo clan would fall into good fortune at the time they needed it the most. Savannah Cerezo, like any other 14year old girl, loved cookies. Heck, who doesn’t love the classic baked good? So naturally she bought her father, Ricardo, a cookie jar. The jar never really went to good use, only being used to

store old lotto tickets from years past. After Savannah’s passing though, Ricardo’s wife asked him to clean out the old cookie jar, so that they could use it for something more meaningful. The man of the house did as he was asked, and wisely, made sure to check the old tickets one last time. Ricardo went down to his local gas station to get the tickets scanned. There were alot of them. Time after time the machine declared losing tickets. Then, they scanned the last one. When scanned, the machine responded, “file a claim”. It did not state if it was a winner or loser. It did not state an amount. Ricardo, like many of us I’m sure, had no idea what that meant. He contacted the Illinois State Lottery and to his surprise, had won big on the months-old ticket. The Cerezo family was awarded $4.85 Million! Strange that they had never discovered the winning ticket before. Or, so it seems anyway. Ricardo and his wife have a different feeling about it. They feel it was a sentiment from their teenage daughter. “My honest first reaction was mammoth regret” said Ricardo, upset that Savannah was not able to enjoy the prize. He backtracked though, saying he had finally found peace in what they believe to be one last gift from their little girl. The Cerezo family plans to use the money top pay off their mortgage, start college funds for their other children, and donate to their church and charity. So, lesson learned this week: never give up. Someone around here is bound to strike gold soon enough. The winds of fortune will shift and El Paso County will persevere, rebuild, and find itself stronger than ever before. ather’s Day is fast approaching, but I don’t stress about what to get “the man who has everything” any longer. I’ve learned that a personalized, hand-made gift basket is the best way to go with both my Dad and my husband. One year I gave my husband a basket full of hot sauces. He loved it and enjoyed trying out all of the different, spicy varieties. Since my father and my husband both loves movies, this year I’m making them a personalized MOVIE TIME popcorn, snack and DVD collection as their Father’s Day gift. I’m using a large bowl that I’ll personalize using a computer label and/or write on with a craft pen. I’ll fill the bowl with bags of microwave popcorn and the crunchy, salty snacks they both love.

I’ll place the shakers, popcorn, nuts, granola and retro movie candy, and their favorite or newly released DVDs in their MOVIE TIME baskets. I have recipes for homemade popcorn flavorings below.

Stir the ingredients together with a fork until combined, and transfer the mixture into a large salt or pepper shaker. Make a computer label with the name of the flavor mixture or write on the salt or pepper shaker with a craft pen. Place shaker with flavor mixture in a large popcorn bowl or gift basket. Here’s how to make a specialty Father’s Day Gift Basket. You can use this method to create a personalized basket containing your Dad’s favorite things: 1. Purchase a large, plain bowl or basket, or a container that fits the theme of the gift (for example: toolbox for TOOL TIME gift basket; ďŹ shing tackle box for GONE FISHING basket, etc. 2. Crumple up some Father’s Day wrapping paper and put it in the bottom of the basket. If the basket is very deep, you may want to put some Styrofoam or a small cardboard box under the wrapping paper to elevate the gifts. 3. Arrange the gifts with the largest gift in the back. This is Dustin Hoffman’s first time directing, and he gets the balance just right. The movie manages to hit the emotional high notes without being too sappy. The seasoned actors do not disappoint. Billy Connolly, Tom Courtenay, Michael Gambon and Pauline Collins make up a sound supporting cast. Perhaps old English actors getting snippy about classical music isn’t your thing, but you can still get a kick out of “Quartet.” “Jack the Giant Slayer” (PG-13) -- Here comes another fairy-tale “reimagined” with fancy computer graphics and more fighting. A willful and independent princess (Eleanor Tomlinson) is launched into the sky by a magic beanstalk, trapped in the clutches of angry giants who live above the clouds. The rescue effort is lead by a peasant-boy named Jack (Nicholas Hoult), a knight (Ewan McGregor) and a sniveling noble (Stanley Tucci). While it’s a few hundred feet higher than

“Hansel & Gretel: Witch Hunters,” this new version of “Jack and the Beanstalk” might leave you bored mid-climb. The visuals are spectacular -- you’ll be closer than you ever wanted to be to the pores on a giant’s nose. There are a few good laughs. This one feels like a high-budget, mid-effort attempt to cash in on a trend. “Stoker” (R) -- India (Mia Wasikowska) is an outcast teen with an emotional mother (Nicole Kidman). After India’s father dies in a car accident, “Uncle Charlie” (Matthew Goode) comes to live with them. Charlie is a handsome, charming guy who is very clearly some kind of creepy dude underneath. India is drawn to his just-barely-visible creepiness, and a weird dynamic surfaces between the teenage girl and her “uncle.” The twists and turns are pretty predictable, but the atmosphere and style make this movie worth checking out. “The Brass Teapot” (R) -- Alice and John (Juno Temple and Michael Angarano) are a

young married couple with lots of love and no money. After John loses his low-paying job, they happen to find an ornate teapot that belches out money whenever somebody nearby feels pain. At first it’s just a bit of fun, then it becomes the answer to their problems, then new problems arise. For a dark comedy, it’s not quite funny enough or dark enough. As the cute couple descends into greed, you’ll feel more annoyed than connected.

uring the past few weeks, I have discussed in these articles the fact that, in general, while non-compete agreements are NOT enforceable in Colorado, there are certain exceptions. I have previously covered the exceptions where a non-compete agreement is entered into between the buyer and the seller of a business, and where the former employer provided training and education to an employee who leaves in fewer than 2 years. A third exception arises in the area of “trade secrets”. A non-compete agreement IS enforceable where it is necessary to protect “trade secrets” of the employer from competitors, whether it comes from other businesses or the former employee himself.

The Colorado Uniform Trade Secrets Act (UTSA) defines a trade secret as:

The whole or any portion or phase of any scientific or technical information, design, process, procedure, formula, improvement, confidential business or financial information, listing of names, addresses, or telephone numbers, or other information relating to any business or profession which is secret and of value. The determination as to whether something the employer claims is a “trade secret” actually is a trade secret, and thus grounds for permitting enforcement of a non-compete agreement against a former employee, is very fact specific, and varies from case to case. Colorado courts may consider several factors to make the factual determination of whether a trade secret actually exists including: (1) the extent to which the information is known outside the business;
