Changing Times
I
t is a long time since I wrote my last piece for this column, back in March, just as COVID-19 was beginning to escalate and then the Summer edition of ARCA News was cancelled. Now we find ourselves in September having hopefully negotiated the worst of the crisis and trying to get back to some sort of normality.

ARCA continued to work throughout the lockdown period, providing help and assistance to our members, including almost daily email updates during the fast-changing situations our members found themselves in. Clearly some of the services we normally offer were unavailable during lockdown and some staff were furloughed. In common with many organisations ARCA has utilised available technology in the form of Microsoft Teams and Zoom to deliver many services remotely, in order to comply with the law, aid social distancing and reduce the possibility of infection. Remote training, remote meetings and remote member visits are now part and parcel of our standard service delivery. The regional meetings in July were conducted remotely via Zoom and feedback from members attending was incredibly positive. The next round of ARCA member regional meetings will also be held remotely, with dates having been set for mid-November which are available on the ARCA website.

June 1st saw the resumption of ARCA site audits and ARCA auditors have been auditing continuously since then. A new version of the audit form is being used with one of the new criteria evaluating the COVID-19 precautions present on the member contractors’ site. We are delighted to see that COVID-19 safety precautions are being implemented very well across all the members sites we have audited. On the 22nd June ARCA resumed faceto-face training in a COVID-19 safe manner. This involved marking out areas to ensure and enforce social distancing, providing hand sanitisers and enforcing good hygiene, taking delegates temperatures on arrival and amending lunch procedures to ensure a safe environment was provided. Feedback is requested following our training courses and to date the feedback received has informed us that 100% delegates who have attended our face-to-face courses are satisfied with the COVID-19 safety procedures that are in place. Feedback from members prior to
lockdown informed us that members wanted to see a greater availability of training venues, and since the country has opened up again after lockdown, we have added both Leeds and Southampton to our list of available training venues. On the 1st September we launched ALFA, the Asbestos Labour Feedback App. This has been in development over the last 20 months and promises to be a game changer for ARCA members who use agency labour. The quality of short-term agency labour was overwhelmingly cited as the biggest problem experienced by our members. Working closely with the main labour suppliers within the industry ARCA has developed ALFA. The App now has 12 of the leading labour suppliers in the industry, over 650 short-term agency labour operatives and 138 ARCA asbestos removal contractors registered. Over 800 ratings have been posted and over 50 operatives have now achieved the minimum 5 ratings to generate their overall performance rating. The average rating of all labour agency operatives on the system over the last 12 months is 4.98 where 4 is generally satisfactory and 5 is good. [all stats as of the 10th Sept 2020]. This is a great starting point for ALFA, demonstrating that the problems experienced by ARCA members in relation to labour agency short-term operatives are now beginning to disappear. As more and more ratings are posted, and more and more operatives receive their overall performance rating after 5 ratings, ARCA members will have an advantage over non ARCA asbestos removal contactors as a result of having a detailed analysis of the short-term operatives competency. This will be based on multiple reviews, usually by multiple licensed asbestos removal contractors, therefore providing some reassurance of competency. 2020 has been a year to forget as far as ARCA social events are concerned. COVID-19 has meant the ARCA National Golf day and European Golf event were cancelled, however, we are holding the AGM, albeit remotely on 2nd October 2020. I look forward to many members attending.

ARCA Awarded Investors in People Silver I
n April 2020 ARCA was delighted to announce that it had been awarded the Investors in People (IIP) silver accreditation following its first-time assessment. Through this accreditation, the IIP Board has recognised ARCA’s success as a high-achiever and business-leader, noting its exceptional performance in people management, leadership and development. Investors in People silver accreditation acknowledges that ARCA has been awarded one of the highest levels of accreditation within the Investors in People framework. The
IIP standard is made up of four levels and is assessed against 81 evidence requirements. Having met the recognised core standard of 27 evidence requirements, ARCA has achieved a further 32 requirements, or 59 in total. In doing so, we have leap-frogged the standard award at the first attempt, securing the coveted silver award. “All of us at ARCA are justifiably proud of this achievement. Over the last few years’, we have put into place a number of people and leadership related programmes, from holding regular formal staff meetings to a
performance appraisal system. Also, our Value Working Group, made up of staff from across the business, formulated and communicated ARCA’s core values,” commented Steve Sadley, Chief Executive of ARCA. “We are all committed, not only to maintain the silver accreditation, but to exceed it in the future.”

T
he Association’s Internal Audit App, for Asbestos Removal Members, has been enhanced and a ‘site observation’ audit for contract managers is now available within the App. The App was updated in the summer in line with the latest ARCA Site Audit Accreditation Scheme audit form, which includes the provision to include additional comments for each audit item, so making it easier to record good practices observed during the audit. Also, a new ‘Contract Manager Site Observation Audit’ was made available from 1st July 2020. This provides a form enabling managers to quickly and easily record their site findings when visiting projects. Such as, how the asbestos removal job is progressing and that the job is being undertaken as planned.
“We developed the observations audit following feedback from members, so that managers’ site observations can be reported more formally. Also, the form is consistent in approach to a full ARCA audit, so supporting member contractors’ audit programmes,” commented Geoff Silver, ARCA Membership Compliance Manager. Also, from the 1st July there was a revised pricing structure for when there are more than five registered users, meaning the sixth and further licences will be reduced by 50% to just £25 per user per year. RCA is now holding 1 to 1 discussions with full contracting members either remotely or arranging face to face meetings, following COVID-19 guidance. The remote meetings can be carried out via Zoom or Teams, enabling members to still have a productive discussion with their Association, without the need to travel. “It’s been great to be back talking to members, gaining their thoughts on the new offerings, such as remote training courses, and hearing how the industry is getting back to work,” commented Peter Glossop, Membership and Client Relationship Officer at ARCA. “These meetings are a great opportunity for ARCA members to provide valuable feedback to us as your Association, as we continue to work to deliver the best possible service to you, our members.” When Peter contacts you, don’t miss the opportunity to talk to your Association.

Member Regional Meetings W
ith pandemic restrictions lifting and member businesses getting back to work, ARCA held its July member regional meetings remotely for the first time. “Over the last months it has been especially important to keep all our lines of communication open and be there to support our members, sometimes in new ways. Therefore, we felt it was important to keep our usual summer round of regional meetings, although remotely,” stated Steve Sadley, Chief Executive of ARCA. In July ARCA reached over 110 member employees, covering items such as the new remote training courses available and reassurance on how practical training was now set up at centres, as well as updates on ALFA and site audits. The member regional meetings in November will also be held remotely. Dates are available on page 7.
Unannounced site audits of members – back on track
A
RCA resumed carrying out unannounced audits of members’ performance on asbestos removal sites on Monday 1st June 2020. What has ARCA seen since then? Over the period of 1 June to 31 August, ARCA’s team of auditors managed to carry out 125 unannounced audits under the Site Audit Accreditation Scheme, which were for 114 member companies. “Contractors have welcomed us on to site, and we have had no issues getting onto client sites. So, for us it really is back to normal,” commented Geoff Silver, Membership Compliance Manager. “Our auditors are undertaking all the COVID-19 safety requirements and
while on site assess arrangements and behaviours; what’s been planned and put into practice. We have seen that contractors have worked hard to make sure their sites are as COVID-19 secure as possible.” Resuming unannounced audits means that member contractors will now have more up to date audit reports to include in their licence renewal applications. Also, it means that the Association’s commitment to its members of increasing their Site Audit Accreditation Scheme requirement from 2 to 3 unannounced site audits each membership year from January 2020, is back on track.
Member Internal HSE asbestos licence Audit App application - new form Update R egistered users of the ARCA Member Internal Audit App now have access to an audit form for non-licensed asbestos work, enabling any observations and actions to be recorded for work, such as the removal of textured coatings, floor tiles and asbestos cement roofing sheets. Non-licensed work still comes under the Control of Asbestos Regulations 2012, therefore the App is a useful tool to demonstrate compliance with these regulations, as well as the general duties under the Health and Safety at Work etc. Act 1974. The HSE has made some small changes to the asbestos licence application form which will be used for licences that expire from November 2020 onwards.

The evidence document/information required is now listed in the pre-populated evidence table, and if an applicant does not use a document which is requested, the applicant needs to record that and briefly explain why. For example, the use of SOPs is not a statutory requirement and may not be part of the operation of a business. Noting that those documents have not been submitted will allow HSE to be clear that a document is not present, rather than being missed off the submission of evidence.
Evidence Guidance V7.2 Guidance is now included for Section 5 (Decontamination / Site Cleaning & Preparation for Reoccupation / Management & Disposal of Asbestos Waste), and emphasises the need to correctly submit evidence e.g. clearly name and reference documents and include the section number in the email title, as well as, clearly referencing the relevant parts of these documents in the application form. The Performance Rating App for Asbestos Labour
New Rating App to support quality of Agency Operatives for Members On the 1st September 2020 ARCA announced the availability of a performance rating app for short-term asbestos removal operatives. The Asbestos Labour Feedback App, ALFA, the first of its kind in the industry, enables ARCA member licensed asbestos removal contractors to rate the performance and behaviour of operatives supplied by ARCA labour supply members. Having an overall performance rating for an operative, as well as certificate information, available in one App, will provide contractors with a better understanding of the competency of an agency operative before they arrive on site.
ALFA, a web-based application, has been developed by ARCA to provide a number of benefits for all parties, including: w Reassurance of labour competence – being able to view an overall performance rating of agency labour enables ARCA Member Contractors to be reassured of the competency and attitude of an operative. w Performance feedback – an ARCA Member Contractor can rate an operatives’ performance across nine categories, with ratings used to calculate an overall performance rating. w Identifies training needs – feedback from contractors can identify areas where an operative can improve, therefore supporting the operative’s development and future selection. w Automated system – ALFA provides labour supply agencies with an online system for the selection and assignment of short-term operatives to asbestos removal jobs. Once operatives are assigned the member contractor can log into ALFA to view overall rating and certificate information for those operatives. w Certificate management – certificate information is easy for an agency to input and actual certificates can be uploaded, so all information is immediately available within ALFA, for an Agency, Contractor and the Operative to view. Also, certificates due to expire within 30 days are highlighted within ALFA, and the Operative is also notified by email, to support renewal management.

“The Association has a membership of virtually half of all licensed asbestos removal contractors in the UK, and many have told us that their biggest issue is the quality of labour. That is the capability, knowledge, skills and behaviour,” commented Jason Davy, Chairman of the Asbestos Removal Contractors Association (ARCA). “Therefore, supporting better performing labour became a key goal for us [ARCA]. The question was how? ARCA already delivers asbestos training, and has developed and provides qualifications, needed by the industry. So, we held discussions with some member contractors and labour supply members, which resulted in ARCA taking the initiative to resource the development of a performance feedback app.” The development has taken a huge effort from the ARCA team and the developers over the last 20 months. This has been due to the complexity of the requirements, such as the performance rating systems and certificate management, and the number of parties who can use the App [also COVID-19 put work on hold for a while]. The development was completed in phases with feedback along the way from Labour Supply Members. The initial pilot phase, supported by three Labour Supply Members, together with a number of ARCA Member Contractors, was completed successfully earlier this year. Over the last two months ARCA has been contacting member contractors, providing briefings on ALFA and setting up the contractors’ principal users, as using ALFA for short-term labour from ARCA Labour Supply Members is a requirement of ARCA membership. How does ALFA work? After receiving a request for short-term labour for a specific job, an ARCA Labour Agency uses ALFA to set up the job (who for, where and when), and then finds and selects suitable operatives to send to the contractor. They can search for operatives by various criteria, including location, specific training (e.g. confined space) and CSCS Card. Then when an operative is working for an ARCA Member Licensed Asbestos Removal Contractor, the contractor’s site supervisor will receive an email from ALFA requesting a performance rating for the operative. Ratings, which cover nine categories from RPE to time keeping, are requested on the last day of an assignment or every two weeks where applicable. Once rating information is provided, ALFA will automatically update the operative’s overall performance rating. Ratings, which can be from a number of contractors across a number of assignments, are used to calculate the overall performance rating for an operative, which is displayed by stars. An operative’s overall performance rating, and average rating per category, is then available to an ARCA Member Contractor if/when that operative is selected for their asbestos removal job by an Agency within ALFA.

self-employed consultant was fined for breach of legislation for providing health and safety advice on technical and complex matters while not being qualified to advise his clients. Luton Crown Court heard how a selfemployed health and safety consultant provided inadequate and flawed advice to small and medium sized enterprises on the management and control of risk in relation to hand arm vibration, work-place noise and the control of substances hazardous to health. An HSE investigation found that Clive Weal incorrectly identified risk from exposure to hand arm vibration as ‘low’ and advised to use ‘anti vibration gloves’ as an appropriate control measure. He also failed to identify that paints containing isocyanates can cause asthma. The poor and incompetent advice resulted in a lack of remedial action being implemented to prevent employees being exposed to levels of noise, hand arm vibration and chemical substances that may have a damaging impact on their health.
Clive Weal of Torksey, Lincolnshire, was found to be incompetent at advising his clients in the assessment and control of risks from workplace noise, hand arm vibration and substances hazardous to health. He pleaded guilty to breaching Section 3(2) of Health and Safety at Work Act 1974 and was fined £1,400. After the hearing, HSE specialist inspector, Parmjit Gahir said: “Employers are more likely to use external consultants to provide assistance in complex situations where a higher level of competence is required. “How consultants achieve competence is up to them, however they will have to be able to satisfy employers that they have a sufficient level of competence for the job in hand. “Being a member of a relevant professional body, which sets competence standards for its members and operates continuing professional development schemes is one way of helping; as is presenting evidence of relevant experience such as references from previous clients; or obtaining qualifications.”

Although these statistics are not a reflection on Covid-19 related loss of life, it is a pertinent time to reflect.” “Work-related deaths fracture families, they shatter communities, and so many of them can be avoided. The work that HSE does is about more than numbers, we are continually working with duty holders to ensure that they assess and appropriately manage risk to their employees. These efforts are a vital part of keeping essential services going, particularly as duty holders adapt to the current circumstances.” Mesothelioma, which is contracted through past exposure to asbestos and is one of the few work-related diseases where deaths can be counted directly, killed 2446 in Great Britain in 2018. This is slightly lower than the average 2550 over the previous five years. The current figures are largely a consequence of occupational asbestos exposures that occurred before 1980. Annual mesothelioma deaths are expected to fall below current levels for years beyond 2020. A fuller assessment of work-related ill-health and injuries, drawing on HSE’s full range of data sources, will be provided as part of the annual Health and Safety Statistics release on 4 November 2020.
n the 1st July 2020, the Health and Safety Executive (HSE) released its annual figures for the number of workrelated fatalities in 2019/20, as well as the number of people known to have died from the asbestos-related cancer, mesothelioma, in 2018. The provisional annual data for work-related fatal accidents revealed that 111 workers were fatally injured at work between April 2019 and March 2020 (a rate of 0.34 deaths per 100,000 workers), the lowest year on record. This represents a fall of 38 deaths from the previous year, though it is likely that this fall was accentuated by the impact of coronavirus (COVID-19) on the economy in the final two months of the year. In line with previous years’ fatal injury statistics, these figures do not include deaths from occupational disease. Covid-19 infection is therefore not part of these figures and will not feature in fatal injury statistics in subsequent years. While there has been a long-term reduction in the number of annual fatalities (the number has almost halved in the last 20 years), aside from the current fall, the number has remained broadly level in recent years. HSE’s chief executive, Sarah Albon, said: “No one should be hurt or killed by the work they do. In these extraordinary times, we have seen

T
he selection and use of protective clothing i.e. coveralls, footwear etc. when working with asbestos, is vital to the health and safety of the worker. Therefore, this article identifies good practices and provides practical guidance on selection, care and maintenance of PPE against risks from working with asbestos. Due to the risks of asbestos removal work, employers and employees must ensure that they comply with both requirements of the Control of Asbestos Regulations 2012 (CAR 2012) and the Personal Protective Equipment at Work Regulations 1992.
Supply of Protective Clothing PPE must be supplied by the employer, free of charge, when an employee is expected to be exposed to a risk which cannot be controlled by any other means. Where staff work under the control of an asbestos licence holder, they are considered to be employees. This is covered in CAR 2012 and the Personal Protective Equipment at Work Regulations 1992. These regulations require that: w PPE must be appropriate to the risks and not increase the risk. w PPE must fit the wearer. w When wearing two or more items of protective equipment, these items must be compatible. w When employees are required to wear PPE, they must be trained in its use, care and maintenance. w PPE is required to be ‘CE’ marked as this signifies that the PPE satisfies certain basic safety requirements and, in most cases, will have been type tested and certified by an independent body. w All PPE used at work must be certified with the letters CE followed by the Category of Approval.

Selection of coveralls for work with asbestos ‘Managing and working with asbestos Control of Asbestos Regulations 2012 Approved Code of Practice and guidance’ L143 requires that the selection criteria for coveralls for work with asbestos should include the following: w They should fit the wearer w They should be comfortable w They should be one piece including the hood w They should allow for the effects of physical strain w The cuffs, wrists and hood should be elasticated w They should have no pockets w They should be easy to decontaminate w They should resist penetration by fibres Coveralls for use when working with asbestos meet most of these criteria; however, the subjects of durability and fibre penetration of coveralls continue to be an issue for contractors. Most contractors who work with asbestos use disposable coveralls, both inside the enclosure, and when in transit. Disposable coveralls are not durable but may meet fibre penetration standards. Non-disposable coveralls are more durable but do not meet fibre penetration standards, they also require specialist handling, decontamination and laundering. It should be noted that all clothing worn within an asbestos contaminated area must be laundered at a specialist laundry or disposed of as asbestos waste.
Durability The durability of a coverall depends upon three factors: w Size – coveralls often split because they are too small w Fabric strength – disposable coverall fabrics are not robust w Seam strength – seams which are single sewn will pull apart easier. Under stress it will be possible to see daylight through the seam. Seams should be over sewn to provide additional strength.
Fibre Penetration While coveralls reduce the amount of contamination to asbestos removal operatives, they do not totally prevent fibre penetration. Therefore, operatives undertake full decontamination at the end of each shift. PPE is required to meet common standards of quality and performance. Therefore, must comply, and be CE marked, to indicate conformity with health, safety and environmental protection standards. The following CE standards currently apply: w Category 1: ‘Simple Products’ – which are not suitable for protection against any hazard w Category 2: ‘Intermediate Products’ – which fall into neither category 1 or 3 w Category 3: ‘Complex Products’ – which are worn in order to provide protection against any hazard which may be life threatening

Therefore, when working with asbestos, coveralls must meet Category 3 standard. There are several ‘types’ of coverall, within CE Category 3. w Type 2 EN 943:1995 – non-gas tight suits which retain a positive internal pressure to prevent the ingress of dusts, liquids or vapours w Type 5 EN ISO 13982 -1 – protective clothing for use against solid particulate chemicals w Type 6 EN 13034 – reduced spray suits, suitable for protection against hazardous sprays and splashes as find droplet, non-directional sprays When using overalls complying with both Types 5 and 6 consideration must be given to determine that they are ‘breathable’ and that the Type 6 property has not compromised their ‘breathability’. Many brands of ‘Type 6’ coverall achieve their splash resistance by increasing the “plastic content” of the fabric, reducing their ventilation ability. Coveralls for work with asbestos both inside enclosures and when transiting should exhibit properties consistent with Class 3, Type 5, in order to minimise body contamination leading to a more effective decontamination on leaving the enclosure. ARCA recommended guidance is that transit overalls should be used on a single use.
Selection of underclothes and footwear Disposable underclothes should be worn to allow for the effects of chilling in low temperatures. All disposable underclothes should be disposed of as contaminated waste in a manner similar to the coveralls. What type of footwear should be worn in a particular situation? This is determined by the employer who should carry out a risk assessment to determine the type of footwear to be used in a given situation. When removing asbestos inside enclosures, steel toe capped wellington boots are the preferred footwear, as they can easily be decontaminated. Lace up boots, with the laces taped up, are not recommended. When transiting between the airlock of the asbestos enclosure and the hygiene unit, footwear should be easy to decontaminate. Rubber slip-ons are recommended, however, the specific environment must be assessed, considering issues such as work at height or slip hazards, for example.

Towels used solely in the clean end of the Hygiene Unit are classified as non-contaminated; however, the operatives should not take them home for laundering as this must be carried out by the asbestos licensed contractor.

Licence renewal application support on-going A
fter over 10 years of supporting members prepare for their licence renewal, a lockdown due to COVID-19 did not stop ARCA continuing to support members. Applications for asbestos licence renewal still had to be prepared and/or electronically submitted to the HSE during lockdown, and ARCA was there to assist members by holding remote meetings, either by using Teams or Zoom. ARCA plans to continue this remote approach where it is deemed an effective means of assistance. Some face-to-face meetings have taken place, as this approach was considered the most appropriate and COVID-19 safe working arrangements were in place. Planning a licence renewal application is crucial, and so is asking for support early in that process. By asking for assistance early enough there is time to implement any suggestions, gather further evidence, as well as gaining a better understanding of the application process and how to submit evidence.

Beyond Compliance In order to obtain a licence to work with asbestos, an asbestos removal contractor must be able to demonstrate to the Health and Safety Executive (HSE) that they have excellent health and safety management systems, and that the required knowledge is put into practice on site. Once a licence has been obtained, the management of the Licensed Asbestos Removal Contractor (LARC) will need to monitor all of their activities to ensure compliance with all relevant legislative requirements and associated guidance. Such compliance is seen within the asbestos industry as a minimum compliance level. As asbestos removal is part of a permissioning regime, the normal forms of regulation (on their own) are considered insufficient, and the extra demands imposed by the regime are considered justified by the benefits it brings.

So, the effective management of a LARC, and therefore licence continuity, depends on moving beyond minimum compliance. For example, licence holders: w must identify the hazards, assess the risks, review the extent to which health and safety is part of the process, develop effective control measures (for those hazards which cannot be eliminated) and record these in their health and safety documentation, which should be reviewed and kept up to date w must ensure that control measures recorded in the health and safety documentation cover design and hardware, systems and procedures, and human organisational factors as a collective whole; and should include the licence holder’s safety criteria and performance standards, as well as plans for improvement w must properly resource their processes for producing and maintaining health and safety documentation w must implement the control measures, review them regularly and keep them up to date with a view to continuously improving them to reduce risks w must make and test arrangements for managing emergencies and mitigating their consequences. In addition to effective leadership from top management, ARCA and the HSE would expect LARC’s to demonstrate competence at all levels of the organisation, both office based and on site. They would also expect LARC’s to make full and proper use of all information gathered from site activities, and use their findings to feed their assessments and planning of future jobs. Minimum compliance would require certain records to be kept, e.g. daily inspections of: w enclosures (including airlocks and baglocks) w hygiene facilities w vacuum cleaners w air extraction equipment w wet injection equipment (when in use) w respiratory protective equipment. This would include the reporting of defects and remedial actions taken.
What it looks like when done effectively Going beyond minimum compliance would ascertain the accuracy of the records kept, as well as patterns, trends, identification of root causes, and implications for the future. Other information gathered and kept from site activities may include air monitoring, which becomes far more meaningful if planned with forethought and purpose. A LARC may consider having leak tests or personal monitoring conducted during asbestos removal works as compliance (i.e. data has been gathered). However, the data is of little use if it can’t provide much useful information. Leak tests may therefore be planned for the first part of the first shift of actual asbestos removal, in specific locations such as adjacent to air extraction equipment (especially if extracted air cannot be vented directly to external atmosphere) or next to areas of the enclosure that may have been potentially difficult to seal. Such specifics are the level of detail required at the planning stage if LARC’s intend on moving beyond minimum compliance.
Leaders w Maintain attention on the significant risks and implementation of adequate controls w Demonstrate their commitment by their actions; they are aware of the key health and safety issues w Ensure consultation with the workforce on health and safety w Challenge unsafe behaviour in a timely way Management of Health and Safety w A systematic approach is used to manage health and safety w People understand the risks and control measures associated with their work w Contractors adhere to the same standards w Appropriate documentation is available: current, organised, relevant w People understand their roles and those of others w Performance is measured – to check controls are working and standards are being implemented, and to learn from mistakes after things go wrong
Personal monitoring, per se, may be thought by some as compliance, but to be meaningful and go beyond mere compliance will require taking personal monitoring a step further. One example could be determining the actual airborne fibre concentration surrounding the operative when removing the first four ceiling tiles, which may disturb debris above or introduce a sudden influx of air from the unsealed, potentially contaminated void above. How does this concentration differ from the operative placing the ceiling tiles into the waste bags?
Beyond Compliance w If a formal system (such as ISO 45001, ISO 9001) is used, has it been externally certified – is the certification accredited? w Health and safety is integrated into business processes w Benchmarking is used to compare performance with others w Supply chains are influenced to improve health and safety w A ‘wellness’ programme is in place
Site audits, well designed, can also be a vital source of meaningful information. The current ARCA Site Audit has been designed with this in mind, and future reviews will continue to investigate further ways to enable the LARC to maximise the usefulness of the audit findings.
What it looks like when done badly or not at all
LARC’s should not confuse an abundance of data with meaningful information. LARC’s should absolutely meet the minimum compliance criteria, but in addition, should always be seeking ways to exploit the information gathered, thinking through ahead of the job what information is required. A key element of effective health and safety management is leadership. While management may be seen as ‘doing things right’ (i.e. doing things by the book, or the company procedures), leadership is about ‘doing the right things’ (i.e. moving beyond mere compliance and rewriting the book if that is what is required). When leadership and management work effectively together, the end result is ‘doing the right things right’. HSE publication HSG65, Managing for Health and Safety, provides examples of what effective and ineffective leadership and management look like to check you are doing what you need to do, and also gives some examples of going beyond compliance. These are reproduced in the tables shown.

TAX RELIEFS for contaminated land and R&D How ARCA Members and their clients can benefit
M
ost ARCA members routinely work at bringing brownfield sites back into use. But what isn’t always obvious is that much of this work attracts tax reliefs that make it much more profitable to do so. The issue of tax relief has come to the fore lately as companies around the UK focus even harder on defending cash flow and revenues in the face of the economic impact of the coronavirus pandemic. Derelict brownfield sites litter the country but many sit idle far longer than they should because of the costs associated with removing different types of contamination, ranging from asbestos to Japanese Knotweed. However, there is a government incentive scheme that can help, making the prospect of cleaning up contaminated sites — which are often much cheaper — far more profitable. The tax relief in question is Land Remediation Relief. ARCA members stand to benefit greatly from better use of this tax break, but they can also play a major role in helping clients understand what is available to them too.
Remediation of Contaminated Land (RoCL) — the answer to removing asbestos and more When viewing a derelict brownfield site, contamination problems are not likely to be immediately obvious to the untrained eye. They can lie deep in the ground or among the overgrown grass. There are significant costs associated with even beginning to consider regenerating a piece of land like this, with detailed surveys needed to first examine a range of common problems. The good news is that you can claim tax relief on all the costs associated with bringing a piece of derelict brownfield land up to scratch, including the initial surveys. The relief also applies to the subsequent remediation work and removal of contaminants.
Land Remediation Relief — also known as Contaminated Land Tax Relief — allows companies to claim relief of 100% of the cost of this work against their corporation tax bill. An additional 50% can be claimed for qualifying costs associated with cleaning up land acquired from a third party that is in a contaminated state and causing, or has the potential to cause, harm to people and animals, or water pollution. Qualifying activities under this additional relief include: w the removal or treatment of Japanese Knotweed w removal of asbestos w treatment of gasses and chemicals within the land w removal of underground contaminated tanks w and removal of concrete foundations, pillars and bases. If you or a client have carried out work that you think may qualify, you may still be able to benefit. Claims for Land Remediation Relief can be backdated two years, so firms that have been badly affected by the pandemic can return to work done in 2018 and 2019 with a view to boosting their bottom line. But Land Remediation Relief is not the only tax incentive that ARCA members are likely to be able to exploit. Many members will be creating new methods for decontaminating buildings and land, and this work could well qualify as Research & Development.
R&D Tax Credits The Government’s R&D tax credit scheme means any company investing time and money in new products, processes or services that seek to resolve a scientific or technological uncertainty can claim either a reduction in their limited company’s corporation tax bill or a cash lump sum.
The relief is designed to incentivise innovation in all industries and for companies of all sizes. R&D does not need to have been successful to qualify, and claims can be backdated up to two years from the end of the tax year in which the work took place. Examples of past claims in this sector include: w inventing a new method of securing asbestos panels as they were removed from an aircraft hangar where dust and debris was a major consideration w developing a new software platform to coordinate activity and information for a firm in the commercial property sector specialising in fire, water and asbestos (FWA) risk assessments and training w creating a software platform that automatically produces client-friendly reports following asbestos risk assessments and removal.
Cost of claiming Unlike site surveys, it is possible to find out how much your benefit could be from these reliefs without spending any money. Most consultant companies, including Catax, will assist clients on a contingentfee basis so there’s no risk that a company will incur costs if they are not entitled to tax relief. Both R&D tax relief and Land Remediation Relief can make a huge difference to a company’s financial strength. With so much uncertainty hanging over the economy, it’s crucial that firms take advantage of the money they are owed before the time left to claim runs out. CHAS Accreditation New process and pricing via Association R
ecent changes to the CHAS assessment process, in line with the SSIP (Safety Schemes In Partnership) requirement for providing more extensive evidence of compliance, have resulted in the development of a new submission process. The Association worked closely with CHAS to facilitate an online submission process through an ARCA and ATaC CHAS portal, to allow ARCA licensed asbestos removal members and ATaC members, to achieve or renew a CHAS (H&S) accreditation. This new application process was implemented from 1st July 2020, along with a new pricing structure for Association members. Members can complete the online application process, which includes a declaration, and upload documentation as evidence to support the application, through
the new portal. Following this, an ARCA/ATaC assessor will be able to access and audit the documentation, prior to CHAS confirming accreditation. When applying for CHAS (H&S), organisations need to confirm total number of employees, as the cost of accreditation is banded. For example, companies with 16 - 30 employees (office and site staff) would pay £465 if applying directly to CHAS. However, ARCA/ATaC members can obtain a 25%
discount (available across all bandings) when applying via the Association. ARCA’s aim then, was to introduce good practice standards to enable clients to have confidence in the way asbestos removal work was carried out. Shortly after being formed the Association formed a technical committee, which began writing guidance to support member contractors. The reputation of ARCA and its aims soon spread across the industry and in the early 80’s the number of members rose considerably; soon exceeding 50 companies with many more wishing to join. During the 80s the industry continued to develop; with the licensing of asbestos contractors introduced by HSE in 1983, requirement for annual training, and the introduction in 1987 of the Control of Asbestos at Work
ARCA was formed to promote a professional industry and support its members. Something that ARCA has, and continues to work tirelessly towards. Members have access to a range of services, which have been developed to provide expert support for the management of safe operations. Also, ARCA has supported members in many other ways, such as taking the initiative to develop qualifications and develop a unique member internal audit app.
Developing Training and Qualifications – A Career Path Today ARCA’s team of trainers deliver all the training courses asbestos removal operatives, supervisors and managers need to fulfil their roles and regulatory obligations, at 7 centres across the country. Also, ARCA has been key to the development of qualifications for the asbestos removal industry, with the most recent development being a Level 3 NVQ Diploma for Supervisors. Through ARCA, each of the key asbestos removal job roles; operative, supervisor and manager, have a clear career path of training and competency recognition.
High standards on site The Association launched the Site Audit Accreditation Scheme (SAAS) in 2000, under which ARCA would audit members’ performance on-site. The SAAS is still central to Membership of ARCA and the Association has continued to enhance the scheme over the years to continue to support high standards across membership and provide a strong level of reassurance to all parties, including end-clients. Today the scheme requires member contractors to have three satisfactory unannounced (meaning contractors have no prior notice of when or where an audit will take place) site audits in every membership year. Participation in the SAAS is a mandatory part of membership for licensed asbestos removal contractors.
Quality of Labour With virtually half of all licensed asbestos removal contractors in the UK as members and the majority telling ARCA that their biggest issue was the quality of agency labour. ARCA took up the challenge and in September 2020, saw ARCA Members have the capability of ALFA, the Asbestos Labour Feedback App. The first of its kind in the industry, ALFA enables ARCA member contractors to rate the performance and behaviour of operatives supplied by ARCA labour supply members. So once an operative is assigned to a specific job in ALFA the contractor can view an overall performance rating (which can be from numerous assignments for numerous contractors) for the operative - providing reassurance of competency and attitude.

ust before Coronavirus hit the UK, J&L Recruitment arranged and hosted a Charity Pool Competition in aid of The Mavis Nye Foundation. The whole day was focused on raising as much money as possible to donate to The Mavis Nye Foundation to help with Mesothelioma treatments and research into this life limiting illness. The day included numerous competitive ‘knock out’ pool games and a raffle with lots of prizes to be won. The competition started with over 30 contestants until two players remained. It was an exciting final match with Mavis cheering them both on. The day was incredibly successful, raising an amazing £4,262.22 James Johnson, Director commented, “The day was not stop! The first match was at 8:30 and the last was at 4:30, with our office neighbour George collecting the trophy in the last match! Thank you to everyone who took part and to our sponsors.”

Supporting those on the front line during COVID-19
A
t the beginning of the COVID-19 crisis Clifford Devlin wondered how they could show support for the teams on the front line. They found the Contractors Appeal, a great initiative which had been set up primarily by two demolition contractors, and donated around 2,000 pieces of PPE. Near the Clifford Devlin head office is ‘Doorsteps’, a well-known food bar, particularly used by the emergency services; the police, ambulance/NHS workers and fire service. So, in mid-March the company agreed to pay for a breakfast or lunch for the first responders who visited the food bar, in uniform or with appropriate ID.

Unfortunately, within days of this offer Doorsteps’ service was limited and then they shut down completely as the country went into lockdown. However, when lockdown ended in June, the company reinstated their offer to show gratitude to NHS workers and first responders. “We all agreed we wanted to recognise the unbelievable dedication and service from those on the front line in some way. We received a huge thanks from the first responders using Doorsteps, which was humbling given what we felt was a very small effort,” commented Tim Clifford, MD of Clifford Devlin.

Children create COVID-19 safety posters
W
hen the COVID-19 crisis hit the UK, businesses were closed, and children were off school - safety was a priority. With this in mind, Clifford Devlin staff asked their children if they would like to create COVID-19 safety posters using templates provided. The aim was to produce some ideas into posters for use on-site. “We had a great response. Children from ages 3 to 12 years old, designed some amazing posters from ‘keep 2m apart’ to ‘don’t touch your face’. In fact,
a 2-month-old girl sent in a wonderful ‘wash your hands’ poster, using a print of her tiny hands,” commented Tim Clifford, MD of Clifford Devlin. “I hope these children keep creating master pieces with the art sets they received as a thank you.” A number of the images were converted into signs and can now be seen on Clifford Devlin sites. Clients have the legal responsibility to appoint competent asbestos removal contractors
Appoint - Plan - Remove It is vital that property owners and managers – commercial properties, NHS, schools, housing groups - take the risks from asbestos seriously and deal with asbestos in a controlled and safe manner. Still today it is the greatest cause of work-related deaths in the UK, with currently approx. 5,000 asbestos related cancer deaths per year.
O
wners and managers of properties constructed prior to the year 2000 need to manage the risks from asbestos, as they are responsible for ensuring that employees and non-employees are not exposed to health and safety risks as a result of the presence of asbestos. If asbestos containing materials (ACMs) are found within a building and the condition of the ACMs means it needs to be removed, or the building is being renovated/demolished so therefore the ACMs need to be removed prior to work starting, there are legal responsibilities on the clients to manage the project and appoint a competent contractor.
Client duty to manage a project Clients have explicit responsibilities on managing construction projects under the Construction (Design and Management) Regulations 2015 (CDM 2015). As they are at the head of the procurement chain, the law requires that clients make suitable arrangements for managing a project, and maintain and review these arrangements throughout the project, to ensure health and safety risks are managed appropriately. Clients do not need to be ‘experts’ in either construction work or asbestos work, and do not need to directly manage or supervise the work themselves. However, they are responsible for ensuring appropriate arrangements are in place to manage and organise projects during both the ‘pre-construction’ and ‘construction’ phases of the project. This means appointing suitably competent people and providing them with sufficient information, time and resources to do the job properly. If asbestos removal is required, the client needs to appoint a competent asbestos removal contractor. Therefore, they need to make reasonable enquiries to satisfy themselves that contractors are appropriately resourced and competent for the work.

Therefore, being unannounced, ARCA site audits are an even stronger system of reassurance for all parties, including clients. From January 2020 ARCA and members commited to increasing the SAAS requirement from 2 to 3 unannounced site audits each membership year.
Asbestos removal work Once a contractor is appointed, the client will then need to provide the contractor with sufficient information, time and resources to do the job properly. For example, an asbestos removal contractor will need appropriate preconstruction information in order to prepare a suitable Plan of Work, and contractors need time (and access) to assess the premises properly and discuss key site information with the client. Clients’ decisions, actions and inaction have an enormous impact on how work can be delivered. The contractor will need to submit notification of work to the HSE two weeks prior to work commencing. That is, the work must be planned before it starts.
How can clients reassure themselves of competency? Firstly, does the type of asbestos containing material require a contractor to have a licence from the Health & Safety Executive (HSE) to remove this material under controlled conditions? A list of licence holders is available on the HSE website. Secondly, is the contractor independently audited, that is, undertakes on-site verification inspections to ensure compliance to requirements. How can a client check this? One way to check is to see whether the contractor is a member of a trade association, as some clients expect a trade association to maintain industry standards and provide a safe guard. Asbestos removal carries a high level of health and safety risks, so clients should look behind a trade association logo to see what reassurance that membership actually provides. To provide reassurance for all parties of compliance with relevant legislation, ARCA introduced the Site Audit Accreditation Scheme (SAAS) in 2000, to support members’ performance and therefore maintain standards. ARCA member contractors are required to have a satisfactory site audit to join [and an office audit], and then two satisfactory site audits every year to maintain membership of the Association. ARCA took a further step towards supporting consistent high standards and a higher level of reassurance, by enhancing its audit scheme in January 2017. Members still need to complete two satisfactory site audits every year to maintain membership, however, these audits are now unannounced. This has been made possible by the HSE providing ARCA with some details [name of licensee, site location, dates of work and nature of work] off the licensed contractors ‘notification of asbestos work’ form. Using this information ARCA can arrange site audits, so that ARCA members (excluding Ireland) have no
A Plan of Work It is the duty of the licensed asbestos removal contractor to produce a suitable Plan of Work (PoW) and comply with Regulation 7 of the Control of Asbestos Regulations 2012 (CAR 2012). A PoW should be a practical and useful document describing the site, location of asbestos, access and waste routes, etc. so providing a safe working method for site staff to follow. Also a PoW should be complete but manageable in length; for example the use of diagrams, photographs and flowcharts can all help make PoWs less wordy; and should be easy to read and straightforward to follow. This is supported by HSE, as their position is that generic information about frequently used company procedures (such as standard ways of bagging waste, standard enclosure construction materials etc) will not need to be in the site-specific plan. Keeping generic information out of the site-specific plan means the standard procedures on which it is based need to be available on-site in a readily accessible and readable format, be that electronic or hard copy. The asbestos removal contractors’ manager should create the PoW with the client, so both parties are aware of any site constraints, other trades on-site, etc. Finally, a PoW is there to primarily support site staff, but should also be available for the analyst, manager, auditor, HSE inspector and client. Good coordination and cooperation between all parties is a must for a project to be successful.

What’s different about this NVQ Assessment to other things you’ve done?

When you first turned up, I had butterflies! I told myself that you were not here to catch me out, just to make sure I knew what the job is all about. I wasn’t expecting a practical assessment. I do visual inspections all the time to keep an eye on the guys, but it was good to go into an enclosure and remove asbestos alongside my colleagues.
How does it feel now that you have almost finished your NVQ?
How did you find being assessed on site? When I was being assessed I thought I may make a mistake, as nerve racking at first. But this is something I’ve done for years.
Did you find the second assessment day on site easier than the first? Yes. It didn’t help that the first day was horribly wet and windy, and it was a smaller site which had a number of activities going on. The second time was a lot easier. Even with

If you could give one piece of advice to others what would it be? Don’t feel like you’re on trial because you’re not. The assessors are there to give advice and assess what you do know. Just be yourself and don’t panic. If you do make a mistake, take note of it to learn in the future.

Over the last few months, many ARCA members have continued working on projects supporting key worker organisations including the NHS. So, refresher training for operatives and supervisors was required as certificates needed to be kept up to date. By early May, ARCA had put together remote training to support those who needed refresher training and began delivering these courses, some of which were free to members. The remote courses cover all the theory elements of centrebased training, and numbers are limited so that a high level of interaction is possible. Now ARCA offers 13 remote training courses for asbestos removal operatives, supervisors and managers, to complement the centre-based classroom/practical training.

On 22nd June, ARCA reopened its centres and resumed practical asbestos training. All ARCA training at its training centres is being delivered strictly in accordance with guidance on safe working during COVID-19. This includes; reducing the number of candidates per course to ensure 2m social distancing can easily be achieved, in the training rooms desks are spaced out and candidates’ areas marked on the floor; for practical training individual areas have also been marked out, and there are hygiene stations. The images above show the set up at the Burton training centre. Since reopening practical training centres 100% of those candidates who gave feedback said they were satisfied with the COVID-19 safe working procedures in place.

The Certificate Checker is available to ARCA members, nonmembers, and individuals, who would like to check the authenticity of an asbestos removal operative, supervisor or manager’s ARCA training certificate. Certain information on a certificate is required, including the individual’s unique ARCA ID number. When all the information has been inputted, the tool will check the information against the ARCA database, and if validated the original certificate information can be viewed on screen.
