Life is full of seasons, and some of the seasons we experience are marked by trying times and tragedy. How often do we hear of someone in our city and our nation affected by an auto accident, a terrorist attack, war, addictions, and diseases? When we stop to think about the sobering events that bring tears to our eyes, all of the minute problems in our daily lives seem to fade into the distance. Those long lines at the coffee shop or that pesky cold don’t really seem so bad after all. If you’re anything like me, catching a glimpse of the reality of hardships that many people face every day will make you want to offer what you can to help others find hope. Although some of this world’s problems stretch beyond our reach, breast cancer, which affects millions of women, may be eliminated by early detection and intervention. Life is a miracle, and we want to remind you to make sure that the miracle of life is on your side. Listen to your inner voice and your instincts. And, get it checked out by your doctor. This month, we celebrate the strength of women affected by breast cancer, and we stand with them in the fight against it. We at Orlando Style Magazine love you, and we want you to live a long and wonderful life of health, happiness, class, and style. Style Events, News & Gossip From Around The City By Riesa Pascal On September 4th, “The World’s Largest Paint Party” brought Life In Color to the Central Florida Fairgrounds. Life In Color is a live touring electronic music and paint party music festival, which features some of the top names in the electronic music scene and the world’s biggest DJs. It began in 2006 on college campuses in Florida and has since expanded to more than 200 concerts annually in the United States and internationally. Attendees of Life In Color experienced soaring aerial acts, stilt walkers, contortionists and even fire shows, all of which led up to the ever so famous Paint Blast!
My fellow Virgos and September babies may be a little down that September is behind us, but didn’t we have a fantastic month? The past 30 days in Orlando were abuzz with fun and exciting activities and best of all, October seems ready to follow suit. Here’s a look at some of the great experiences we shared, just in case you missed it! You may have noticed a few extra “celebrities” in town last month. From September 2nd-3rd, the Annual Sunburst Convention of Celebrity Impersonators took over The Florida Hotel and Conference Center at The Florida Mall, much to the delight of the general public. From Elvis Presley and Michael Jackson to Paula Deen and Lucille Ball, no celebrity was off limits as over 100 icons were brought to life over the course of the two day event. Impersonators performed, entertained and took plenty of pictures with their adoring fans. Event organizers donated 50% of each ticket sold to the OneOrlando Fund.
September is one of our favorite months here at Orlando Style because it means the return of Fashion Week at The Mall at Millenia! From September 12-18, the mall celebrated its 11th Annual Fashion Week with various in-store events and celebrations. From luxurious fashion shows and in-store activities to incredible sales and exciting trunk shows, it was a week filled with fashion and fun. Attendees also

News Fashion Correspondent and Project Runway All Stars mentor. September 14th kicked off a spectacular celebration of global cuisines, music and more as the beloved International Food & Wine Festival returned to Disney’s Epcot Theme Park. Held in conjunction with the festival of Food & Wine Weekends at Waldorf Astoria Orlando and Hilton Orlando Bonnet Creek. Designed for those who truly savor the artistry of fine culinary preparations, Food & Wine Weekends is the perfect complement to the Food & Wine Festival. Both casual foodies and serious epicureans enjoyed fine wine, culinary arts and complimentary transportation to Epcot and the Disney Theme Parks. The International Food & Wine Festival and Food & Wine Weekends continues into mid-November so don’t miss out on the food or fun!
THE CITY BEAUTIFUL TOOK A TRIP BACK IN TIME WHEN THE DOWNTOWN ARTS DISTRICT INVITED GUESTS TO LA MASCHERA GOES MOULIN ROUGE! Since 1991, the Southern Women’s Show has been the premier lifestyle event for women in Central Florida. The show hosts over 400 companies and features everything important to women from fashion and accessories to health and fitness. On September 15th, the popular show returned to the Orange County Convention Center and brought in nearly 30,000 attendees! The four day event featured amazing shopping, creative cooking ideas, healthy lifestyle tips, trendy fashion shows, home décor, home improvement ideas and celebrity guests. Attendees delighted in the fun event that was also jam-packed with gorgeous jewelry and handbags, make-up tips and tricks, delicious gourmet treats and much more. On September 24th, Victory Productions was proud to present “An Evening With Peter Cetera” live in concert at the Walt Disney Theater of the Dr. Phillips Center for the Performing Arts. The Grammy Awardwinning singer/songwriter entertained the audience with a collection of his popular, classic songs from both his nearly 20-year stint as a member of the legendary band Chicago, as well as his #1 hits as a solo artist. Peter is currently touring with his 7 piece electric band, “The Bad Daddy’s” and still enjoys performing his timeless hits, which continue to touch the lives of many people worldwide. The City Beautiful took a trip back in time when the Downtown Arts District invited guests to La Maschera Goes Moulin Rouge! Presented by Goose Island, the 12th annual fundraiser was a journey back to Paris in the 1890s, when impressionist artist Toulouse-Lautrec created his most famous works of art and the Moulin Rouge became a symbol of creativity, pleasure, beauty and celebration. Attendees put on their dancing shoes and top hats and enjoyed a spectacular evening at The Abbey with live entertainment, art experiences, dancing, silent auctions, drinks and gourmet food from Arthur’s Catering and Events and Millenia Cafe & Catering. Proceeds from the event benefitted Downtown Arts District Orlando.

“BIENVENIDOS!” That was the first word I saw upon my arrival at Tocumen International Airport, located in Panama City, Panama. I’m not fluent in Spanish, but I do know that “bienvenidos” means “welcome,” and that is exactly how I felt from the moment I landed in the beautiful country of Panama until the minute I left. I sighed a breathe of relief when I saw a Gamboa Tours driver standing near the baggage claim area with my name on a sign, ready to pick me up and transport me to The Westin Playa Bonita. The drive time from the airport to the hotel is about 35-40 minutes, and I came to find out that Panama City was unlike anything I’d imagine it to be. Driving through the city, the massive skyscrapers were so high I couldn’t see the top of them from my car seat window. The city was chic, clean and beautiful – almost like Downtown Miami and South Beach. Once we crossed the bridge getting closer to the hotel, my surroundings became more of what I’d imagine Panama to be - endless green trees that lined the narrow street and emerald mountains in the distance. Natural beauty. Just when I thought it couldn’t get any more beautiful, we pulled in through the gates of The Westin Playa Bonita. Walking into the hotel was unlike anything I’ve ever experienced before. The lobby was grand and spacious, unique and filled with natural light. The first view straight ahead
when I first walked through the doors was the floor-to-ceiling windows that looked out to the palm trees that surrounded the hotel’s beautiful pools and the endless Pacific Ocean in the distance. I really felt like I was in paradise from the moment I laid my eyes through those windows. To make my arrival even more welcoming, I was greeted with a warm towel for my hands and the hotel’s signature punch to put me in the tropical mood (as if I wasn’t already enough).

THE LOBBY WAS GRAND AND SPACIOUS, UNIQUE AND FILLED WITH” NATURAL LIGHT.” This luxurious hotel boasts 611 guest rooms, including 64 spacious suites and three deluxe Presidential Suites, complete with ocean or tropical rainforest views. My 796 square foot room, the Revival Suite, was more than perfect to fit my needs. The suite featured two private balconies with gorgeous panoramic views of the pools and Pacific Ocean, living room area with a sofa, a separate bedroom, dining table for four, Westin Executive Club Lounge Access, and so much more. as I loved the comfort of the suite, there was so much more of the hotel to experience. When in paradise, the first thing to do is grab a cocktail, lay out by the pool and soak up the Central American sunshine. So, that’s exactly what I did. In addition to the miles of beautiful beaches, The Westin Playa Bonita Panamá offers three freshwater infinity swimming pools and an additional spacious pool specifically designated for children. The pools and beach area offer full bar and food services. Speaking of food, I couldn’t help but indulge in the one-of-a-kind cuisine from the hotel’s lavish restaurants. One of my favorite restaurants located on property is Oceanica. Guests can enjoy an international buffet that will satisfy the urge to indulge with classics ranging from madeto-order omelets and hearty sandwiches to grilled specialties and assorted pastas. I may have spent the most time in Pacifica, which offers an eclectic array of flavors and cultures blend together to create Pacifica’s mouthwatering menu. Asiana, is Asian fusion at its finest that offers an extensive menu of Japanese, Chinese, Thai and Vietnamese favorites. When it comes to dining at a laid back restaurant, Starfish Grill is the place to go. Guests can indulge in fresh seafood, flown in from around the world. As much as I love eating, drinking, sleeping and relaxing at the hotel, I knew there was way more of Panama to explore. Luckily, I

was able to tour the beautiful country with Gamboa Tours, the beach hotel’s official destination management company. Guests can arrange group and private experiences throughout the destination. Some of the most popular tours include Monkey Island, the Panamá Canal, Miraflores Locks and the Embera Indian Indigenous Village. I love learning about the history and culture of each place, so the Panamá Canal and Old Town Panama tours were some of the ones I chose to take.

With a driver and a tour guide that picked me up from the hotel lobby and took me around, I was really able to experience the Panama Canal, and learn the history behind the 48-mile long canal. It is one of the most significant waterways ever created and is truly awe-inspiring for anyone who gets the opportunity to see it in person. If you’re reading this Style Magazine article, chances are you either live in Florida or are currently visiting us. If you fall in the latter category, please allow me to be the first to welcome you to the beautiful Sunshine State! From alligators and oranges to beaches and lightning, there is never a shortage of things that come to one’s mind when they think of Florida. One thing that isn’t usually at the top of that list, however, is celebrities. Florida has produced its fair share of the rich and famous, but that’s easy to forget when Hollywood shines the light on New York and California first. Fortunately, we’re here to remind you that Mickey Mouse isn’t the only celebrity to call Florida home!
Ashley Greene, born in Jacksonville Actress Ashley Greene was born in Jacksonville on February 21, 1987 and attended University Christian School before transferring to Wolfson High School when she was in tenth grade. As a student, Green took a commercial class and an acting class, which led her to discover a hidden passion for acting. She worked diligently to earn excellent grades and extra credits, which allowed her to graduate high school early and follow her acting dreams. At just 17-years-old, her parents allowed her to move to Los Angeles where she eventually scored her breakout role as Alice Cullen in the Twilight movie franchise.

They say to be a successful writer, you must write what you know. Fortunately for Sia, songwriting subject matter is something in which she is well-stocked and well-versed, as she has come to know much in her 40 years of life. Unfortunately, the most popular songs often come from the raw and rugged terrains of the human soul, and only the artists who have lived them can wear the crown of fame. If anyone were to earn that crown, it would be Sia Furler, a feminist hippie from Australia with a voice too big for her town, who probably never imagined that the darkest of roads would lead to the limelight of Top 40 radio. From David Guetta’s “Titanium” to Rihanna’s “Diamonds” (which Sia wrote in a short 14 minutes), much of the hits over the past few years that bear Sia’s lyrical fingerprint were written in what she likes to call a “victim to victory” style, expressing a high-spirited celebration burning upon the coals of heartache and hardship. Sia definitely has much to celebrate, with over 25 million copies of her songs sold—not including her current solo work—but that’s not at the top of her to-do list. For Sia, it’s all about the art of overcoming. Life has taught her that without a difficult uphill journey, there’s rarely enough celebratory fire for a standout melody or captivating lyric to begin burning. This was never the plan for the songstress, who was born to a peace-loving musical family in a creative bliss of nonconformist ideals, yet this seemingly idyllic paradise was not free from failure. After her unmarried parents separated, the young Sia Furler did not maintain a strong relationship with her blues guitarist father, who left her with inherited musical talent and moved to Sydney. Statistics estimate that during the year 2016 there are 246,660 new cases of invasive breast cancer that will be diagnosed. Of these 246,660 women diagnosed about 40,450 of them will pass away due to their breast cancer. Although the number of women surviving is far greater than the number on the other side of the spectrum 40,000+ is still far too many women to have their lives end due to this disease. Cancer is one of those things that we are constantly fighting for new discoveries. Scientists, doctors, cancer patients, and loved ones of cancer patients are constantly dreaming of a world in which this devastating “C” word can be eradicated from their vocabulary once and for all. Luckily, increased experimentation of the idea of personalized medicine may help all of the people who’ve been touched one way or another by breast cancer. Personalized medicine, also called precision or individualized medicine, is an emerging medical procedure that is focused on diagnostic tests that help physicians to determine the correct treatment for each patient’s individual genetic makeup. While some 246,000 women will be diagnosed with invasive breast cancer this year, no two of these women will have the same experience
with the disease, nor will their bodies have the same chemical reaction. U.S. News describes it as, “making the treatment as individualized as the disease” and that is exactly what personalized medicine aims to do. The diagnostic tests involved in the practice of personalized medicine show the patient’s biomarkers, which then helps the doctors to be better able to predict how the patient’s body will respond to a variety of different treatment options. Personalized medicine works not only to help doctors create better plans for targeted treatments but also with pharmacogenomics, which is the study of genes to see how an individual responds to specific medicines. Through personalized medical procedures doctors should ideally be able to create a unique plan for each patient that will be able to rid them of their cancer faster while also minimizing the amount or level of negative side effects. Specifically the revolution that is personalized medicine can be linked instrumentally in the success in treatments fighting breast cancer. The use of testing breast cancer patients for their specific biomarkers could limit the amount of broad treatment plans such as surgery and chemotherapy, thereby limiting risks and side effects and increasing success levels by targeting the particulars of each cancer at the molecular level. This shift in

healthcare could help patients diagnosed with breast cancer by providing them with detailed diagnostic tests and better guidance with their treatment plan. As we continue to make genomic discoveries we continue to better our chances in saving the lives of those affected by breast cancer and limit the amount that will be affected in the future. The process of moving towards personalized medicine within every breast cancer case is still a few years off but through helping with funding or simply raising awareness of this type of treatment we get closer and closer to a place in which there will be a year whose estimated women diagnosed with new cases of invasive breast cancer is zero.

The second phase of the trial involved 127 newly diagnosed breast cancer patients, who were split into three different groups. One group was given the two drugs, Herceptin and Tyverb, another received Herceptin only and the third had no treatment for 11 days after diagnosis and before surgery.

A new treatment for a particularly aggressive form of breast cancer can make tumors “disappear” in just 11 days, scientists have said, as they hailed a “mind-boggling” breakthrough in the fight against the disease.
A total of 87 percent who took the two drugs were found to have gone through biological changes suggesting that the number of cancer cells had fallen.
A trial of the use of two drugs in combination found that tumors were completely cleared in 11 percent of patients with HER2-positive breast cancer and were reduced to a “minimal” size in a further 17 percent. Nearly 90 percent saw a reduction in the number of cancer cells.
In 11 percent of those women, no active cancer cells could be found and the tumors in a further 17 percent had shrunk to less than 5mm in diameter. All of those given just Herceptin still exhibited signs of cancer, while tumors shrank below 5mm in three percent of cases.
It means that women with this type of cancer may not need to undergo weeks of chemotherapy if they are given the drugs straight after diagnosis and before surgery.
David Cameron, an Edinburgh University oncologist who took part in the research, spoke of the scientists’ shock when they realized some of the tumors were gone.
Nigel Bundred, professor of surgical oncology at Manchester University, who presented the study at the European Breast Cancer Conference in Amsterdam, cautioned that they would need to carry out further trials to confirm the results but could barely contain himself over the treatment’s “ground-breaking potential.”
“It was only when the pathologist was scratching around in the lab, saying ‘Where is the tumor?’ that it became apparent that there was no tumor,” he said. Samia al Qadhi, chief executive at Breast Cancer Care, said the findings were “astonishing,” adding: “Although an early study, this has game-changing potential.”
“For solid tumors to disappear in 11 days is unheard of. These are mind-boggling results,” he said. “We are pretty certain that we are not only getting tumor disappearance – we are getting an immune response as well. These results are so staggering that I suspect we will have to run another trial to prove that they are generalizable.”

The teenager, who won the Google Science Fair in 2015 for creating an Alzheimer’s test, which can spot early signs of the disease, has been working on the therapy in his school lab.

“Most cancers have receptors on their surface which bind to treatment drugs like Tamoxifen but triple negative don’t have receptors so the drugs don’t work,” Krtin said. “The prognosis for women with undifferentiated [where the cells get stuck in a dangerous aggressive form] cancer isn’t very good so the goal

Generally, a prospective employee is in a less advantageous position to know the law as it relates to contract principles and specific employment law provisions, which can (and does) make the new hire feel unsure or uncomfortable when signing an employment agreement. To make matters worse, the new employee is often fighting for a coveted position and may not want to “rock the boat” by bringing independent counsel into the mix. But this power move may have the opposite effect: the employer may view this, as a sign that, not only is their candidate serious about the job, but is cautious in conducting business. No matter the approach, one should be familiar with some of the terms that are bound to pop up during the negotiation of an employment agreement. First, let’s clarify one thing: Florida, among many other states, follows the “at-will employment doctrine,” which means that either the employee or the employer can terminate the employment relationship at any time and for any reason. Do NOT get this confused with Florida’s constitutional “right to work,” which essentially protects an employee’s right to join, or not join, a labor union. It is because of this “at will doctrine” that employment agreements are actually a good idea. Expectations and boundaries are set, termination clauses such as notification requirements can be specified, and relationships can start off with both parties understanding what it is that is expected of them. Better yet, these terms eliminate an employer’s discretion to terminate the employee for any reason – good, bad or ugly. When employers are given ample discretion, issues such as discriminatory decisionmaking processes tend to be more prevalent.
Generally, prospective employees are most concerned about the non-compete provisions, however, (IMHO) the most restrictive covenant is one relating to confidentiality or non-disclosure of confidential information. This is the only restrictive covenant that can last indefinitely, so long as the disclosed confidential information or trade secret remains valuable, protected confidential information to the employer. Disclosure of trade secrets can happen so easily, and regardless of whether it was intentional or not, it can and does injure businesses that work hard to protect their methods, data, client lists and other “secret sauces” that they may use to get ahead in the marketplace. Restrictive covenants such as non-compete and non-solicitation clauses are governed by reasonable timelines and are not able to exist indefinitely. Legally, the courts presume RCs such as these are reasonable if effective for 6 months to 12 month after termination of the employment relationship. This does not mean that employers cannot require these provisions to remain binding for longer than 2 years, but in Florida, an enforcing party would have to make a very strong argument in order for the provision to be upheld. And those are the basics, folks. Florida has a healthy body of case law relating to these issues because they are hotly contested and litigated often. Which can only mean one thing… an attorney wasn’t consulted during negotiation of the employment agreement! (Just kidding. Sort of.)
Florida hasn’t enacted specific state legislation relating to employment law. It has, however, enacted statutes specifically addressing restrictive covenants (“RCs”). RCs generally include non-compete, non-solicitation and non-disclosure provisions. These provisions have become extremely commonplace, and are usually the driving force behind the decision to require an employment agreement be signed. RCs are disfavored by courts since they restrict competition. Because of this, the courts are not liberal in enforcing these provisions and require, at a minimum, these three things be present in order to enforce an RC: 1) the restrictive covenant must be in writing and signed by the party against whom enforcement is sought; 2) it must protect a legitimate business interest; and 3) the RC must protect the legitimate business interest in a reasonable scope and manner. Florida’s statutes provide examples of legitimate business interests, and they are all quite logical.

over the last year. One client acquired a deal that included three buildings that totaled 51,000 square feet on Sand Lake Rd. for $1,850,000. Within four months of closing, they were able to sell one of the buildings for $2,350,000. Now they are left with two buildings totaling almost 30,000 square feet and they got all their initial investment back and then some. In Vegas, they call this playing with the house’s money. Another client acquired a 149,000 square foot shopping center on 15.5 acres for $1,525,000 in January of this year. This shopping center had some very well known national tenants and a Mcdonald’s ground lease. With only 50% occupancy, some investors might have seen the glass as half empty. We saw the glass as half full and believed this asset had nothing but potential. That potential didn’t take long to realize as we have taken the net operating income from $166,000 a year to almost $300,000 a year. Not to mention the Mcdonald’s ground lease has just been listed for $1,500,000 dollars. Mcdonald’s ground leases don’t last long since they are as safe as an investment gets. only a matter of time before this investor is playing with the house’s money as well. When investing in real estate, you make your money on the day you buy it. That is if you bought it right. The 2008 economic crash drastically affected real estate values all across the country. Prices are still very low and there is plenty of opportunity out there. Artist Albin Polasek, head of the Sculpture Department at the Art Institute of Chicago for thirty years, built this home, chapel, and gallery in 1949 along the shores of picturesque Lake Osceola as his own retirement villa. In the 1960s, Polasek opened it all to the public to share his life-long love for the arts. Our outdoor sculpture garden is the largest in Central Florida, featuring carvings of serene women with their children, playful mythical figures, religious icons, and classic figures. Our guests can explore Polasek’s home and studio, participate in a workshop, or gather together on his expansive lawn after enjoying one of the curated exhibits from visiting artists.
The Polasek Museum also actively promotes the creation of new art through the annual Winter Park Paint Out. Plein-air artists arrive from across the country to set up their easels all over the city for the week. Their “wet works” are brought back to the museum and available for public purchase. This unique event is capped by our ever-popular Garden Party, one of the highlights of the season. In 2015 we were excited to open Winter Park’s historic CapenShowalter House to the public. A community team moved the house across the lake in 2013 to save it. Built in 1885, this gracious Southern home combines the beauty of Old Florida with the splendor of the 1920s, when the Showalter Family expanded the house. We restored the original wood floors and updated everything to make our guests feel at home for all-new events and as a place to create your own special moments.

Bode | Photos By Walt Disney World Swan and Dolphin Resort The Walt Disney World Swan and Dolphin Food & Wine Classic will celebrate its seventh year October 28th – 29th at the Epcot Resort Area hotel with its largest event to date featuring 50 food and wine stations, 10 seminars and opportunities to meet the award-winning chefs behind featured culinary masterpieces. With more food and drink stations spreading out among more space than ever before, guests will delight in numerous opportunities to sip and savor along the hotel’s causeway, private lake, and for the first time, on the resort’s private beach while enjoying live entertainment. Making its festival debut is an immersive area which will transport guests’ palates to the streets of San Francisco’s Chinatown with décor and dishes inspired by the famous neighborhood. Two new dishes were created by hotel’s award-winning culinary team for the area: crispy duck as well as handmade Shanghai dumplings. New beverage stations with suggested pairing options will accompany the new food offerings. Also new for 2016 is a Sunday Bubbles Brunch with J Vineyards and Winery at Il Mulino New York Trattoria, featuring a lavish menu of traditional and unconventional dishes like
various cured meats and imported cheeses along with an array of sushi and trattoriainspired entrees.

As an upgraded ticket option, guests can experience a beer garden, featuring a local and seasonal brews from around the world, alongside Oktoberfest-inspired cuisine.
Guests can enjoy a meet and greet with celebrity chef Todd English, of the hotel’s Todd English’s bluezoo restaurant and meet the only two-time World Champion Pastry Chef – the hotel’s executive pastry chef Laurent Branlard. Branlard, will provide decadent desserts for both evenings including the caramel sea salt éclair with vanilla whipped cream and comfit gingered pears. The Sundae Action Station returns allowing guests to choose their own toppings like chocolate cake and caramelized banana. Two new hands-on educational seminars taught by members of the hotel’s awardwinning food and beverage team are being added to this year’s seminar offerings. The Federal Government has enacted laws designed to keep track of all financial activities. The first of these laws was enacted in 1970 and is called the Bank Secrecy Act. Banks must report a deposit or withdrawal over $10,000 in currency. The bank files a Currency Transaction Report (CTR) with the Department of Treasury, Financial Crimes Enforcement Network (FinCEN). The information is shared with the IRS and other federal agencies. In addition, banks are required to file Suspicious Activity Reports (SAR) with FinCEN. These reports cover various types of activities including cash deposits of less than $10,000 that the bank suspects may have been done to avoid the CTR filing. The filing of CTRs and SARs can result in bank customers coming under IRS audits and criminal investigations. Unfortunately, people without any knowledge of the requirement of a CTR can find themselves being charged with serious crimes. Many people have no knowledge that a bank is required to file a CTR when a deposit is over $10,000. Even if the customer knows that the bank will file a CTR, he or she may think that it is better not to cause the CTR to be filed and therefore divide up the deposit. Many people do not know that dividing a deposit is a crime. In order to be convicted of structuring a bank deposit, the government does not need to prove that the defendant knew that it was against the law to structure the deposit to evade the CTR being filed. The government only needs to prove that the defendant decided to divide up the deposit because he or she didn’t want the bank to file a form with the government.
A federal investigator may decide that a person that makes four $6,000 deposits in two weeks is committing the crime of structuring, even if the bank customer is a small business person who does not want to carry more than $6,000 to the bank at any one time. The bank customer can be convicted of a crime and sentenced to prison. The government can forfeit not only the bank account into which the deposits were made but also other assets such as the customer’s home or business if the funds from the account were used to buy the home or business or to make mortgage payments. It is easy to understand why there’s been a lot of criticism of the structuring statute. It is fundamentally unfair to subject a citizen to a serious felony for structuring a deposit without requiring that the bank customer knew that it was illegal to break up a cash deposit. The federal government should require banks to post notice that it is against the law to make deposits of under $10,000 to avoid a bank filing a CTR. Likewise, banks should be required to post notices to customers that it may file a SAR if the customer brings in cash deposits less than $10,000. Depriving a person of their liberty and accusing them of being a felon because of the way currency is deposited into a bank should require fair notice that the conduct is a crime.
