DEAR READERS, Now that we’re making our way into April, I’m reminded of an old saying. As it’s been said many times before, there are some things you just can’t avoid: taxes and getting older. Well, hopefully our taxes will be taken care of by the 15th day of the month, but getting older is a different story. As much as we wish that aging were escapable, we just can’t seem to avoid it no matter how much we try. Although, after watching the movie “Lucy,” I got a bit more hope, as the storyline insinuates that cells don’t really die. Perhaps, it just lives on our offspring and/or is it something else, like energy that floats through the universe…Well, whether that’s true or false, the idea is definitely worth pondering. We may not be exactly certain of all of the mysteries of life, but as long as we live here on earth, we can continue to develop better and better ways to keep our human race youthful, energetic, and healthy. Now that the chilly weather is finally fading away in the Florida sunshine, let’s take a moment to look at all the wonderful aspects of life, especially those new and amazing developments in the medicine and beauty industries. This “Body & Soul” issue of Orlando Style is here to remind us all to take a break, relax, and enjoy the lovely things of each day. Let’s not just stop and smell the roses, but soak

Style Events, News & Gossip From Around the City By Riesa Pascal Lake Road and even participating restaurants from International Drive, attendees were pleasantly overwhelmed by the huge turnout from some of the city’s best eateries. Held at the Grove and presented by the Central Florida Women’s League, event guests enjoyed delectable mouth-watering bites from the various local restaurants represented including Brio Tuscan Kitchen, Cake in the City, Capital Grille, Copper Canyon Grill, Dexter’s, Il Mulino, Ocean Prime, Red Eye Bar & Grill, Senor Frogs, T-Rex, Jeremiah’s and Marlow’s Tavern. Fine wine tastings provided by Dexter’s of Windermere complimented the fabulous evening. All proceeds from the event went to community grants and scholarships funded by the Central Florida Women’s League Foundation, Inc.

Believe it or not, we’re already four months into 2015 and that’s

no April Fool’s joke! Spring is in the air and the month of March proved to be the perfect segue into this highly anticipated season. From Food and Wine Festivals to Shamrock shaking on Wall Street Plaza, we’ve got all the highlights for you right here, just in case you missed it! Live Free! Ride Loud! Party Hard! Last month Orlando’s annual Bike Week returned for nine wild days of motorcycle fun. From March 6th15th, more than 100,000 Harley-Davidson enthusiasts and motorcycle fans were in hog heaven at Harley-Davidson of Orlando, the official Orlando Bike Week headquarters. Hundreds of thousands from across the globe turned up to the Historic Factory Dealership, a detailed recreation of the 1910 factory and the 1903 “shack” in which the Harley legend was born. Just a few of the many festivities that highlighted this thrilling event were live music, games, shows, motorcycle stunt rider exhibitions and delicious food and drinks from the Tilted Kilt Pub & Eatery. Attendees also had the opportunity to take advantage of the various vendors selling everything from new bike accessories and sunglasses to classic leather attire and heavy metal jewelry.

March 8th saw the introduction of an exciting, brand new fundraising initiative to the city of Orlando! The Mad Hatter Luncheon was a phenomenal event put on by Kids Beating Cancer in order to raise funds in support of the beloved organization. Held at the Waldorf Astoria Orlando, the event showcased a variety of Orlando’s favorite talents. It was a wonderful afternoon of lively entertainment featuring acoustical band Violectric, the singing of excerpts from the Phantom of the Opera by Keith Workowski and Cheryl Lugo, four performances by the Orlando Ballet and more. Celebri-Teas Tracy Stern and Celeste Miller, of Tracy Stern Tea CO, co-hosted the event, which saw attendees and guests showing up in hats ranging from sophisticated couture to wacky, and fun in order to win special prizes and awards.

On March 7th, the 5th annual Taste of Windermere returned to the city for a delicious evening of fine dining. Taste of Windermere showcases some of the best restaurants and wines in Central Florida. From Windermere and Dr. Phillips to Restaurant Row[s] on Sand 20

Cheers to the Irish! St. Patrick’s Day was back last month and the city of Orlando wasted no time in throwing on green attire and throwing down green beer. Just like last year and every year, the only place to celebrate was Wall Street Plaza of course! From March 14-17th, downtown Orlando’s popular hangout spot was a sea of green as the city came together for several days of partying with live Irish music and plenty of green beer. The St. Patrick’s Day celebration kicked off a couple days early on Saturday night with the St. Practice Day Block Party. The St. Patrick’s themed weekend continued with a Sunday Funday like no other, but of course Tuesday proved to be the main event as the biggest and best St. Patrick’s Day Block Party to date rocked Wall Street Plaza with tons of beads, giveaways, green beer and jello shots. Doors opened at high noon so everyone could start their week off right— with more Guinness, more Jameson and even more green beer! Live music from Off Kilter, The Lighter Exchange, Who Rescued Who, Pipes & Drums and more took the party to another level as merry attendees (and even a Leprechaun!) laughed with friends, shook their shamrocks and drank to the Irish. From March 20th-22nd, the art community of Orlando came together in celebration of the 2015 Winter Park Sidewalk Art Festival. As one of the nation’s oldest, largest and most prestigious juried outdoor art festivals, more than 350,000 visitors flooded the streets of downtown Winter Park to enjoy the three-day event. Over 600 artists were spread out in Central Park and along Park Avenue from Fairbanks Avenue to Canton Avenue and on all cross streets. The beloved festival featured live concerts in the park, fantastic food, the Children’s Workshop Village, fabulous sidewalk cafes and more. Run by an entirely volunteer board of directors, over 1,000 artists from around the world applied for entry to the 56th annual show, which has been named America’s Best Juried Fine Art Fair by Art Fair Calendar. If you’re a gourmand or wine enthusiast, there was only one place for you to be from March 20th-22nd. The three-day weekend saw the highly anticipated return of the 7th Annual Wine & Seafood Festival at Lakeridge Winery. Located on the rolling hills of Clermont, the signature event marks the beginning of springtime and the warmer weather. Central Floridians, as well as visitors from all over, came out to enjoy the fun-filled weekend of spectacular live music and outdoor entertainment. In addition to Lakeridge wine, beer, soft drinks and a variety of tasty seafood specialties, attendees also enjoyed beautiful displays and works of art from local artists and crafters. A two-dollar donation at the door benefited the Autism Society of Greater Orlando. It’s officially time to hit the gym and get that beach body ready for spring swimwear! On March 27th, divas and fashionistas joined Style FX and Orlando Style Magazine for a Swimwear Fashion Show at Gilt Nightclub. Attendees received an exclusive unveiling of 2015 swimwear from Florida’s favorite designers. Proceeds from the event benefited Fashion Funds a Cure in support of the Pediatric Cancer Foundation. DJ and Host Scotty B, produced positive vibes throughout the evening as stylish guests enjoyed complimentary cocktails, tasty hors d’oeuvres, great company and plenty of fashion with the city’s most fashionable magazine and it was hot! GIDDY UP, ORLANDO!

In case you haven’t heard, Uber and

Orlando are frenemies. Sure, they work together, but they don’t have to like it. So what’s the beef all about? The enactment of a new local ordinance (Orlando Ordinance 2014-64 made enforceable February 1, 2015), requires rideshare drivers to pay a $250 vehicle permit and charge a minimum fare of $2.40, more than double Uber’s $1 base charge. These charges have been said to serve no practical purpose other than to prevent competition between “transportation network companies” (TNCs) and veteran yellow cab companies like Mears. Wait. Prevent competition and innovation? That doesn’t sound very American.

Since its enactment, there have been little, if any, citations issued to unpermitted drivers. Could this be because hiring an Uber is notoriously inconspicuous? Is it because Uber promised to reimburse drivers for any citations they may receive, thereby deincentivizing drivers to obtain permits? Or perhaps our local code enforcement officers simply choose not to tilt at windmills? It is, after all, fairly obvious the rideshare model is revolutionary to the transportation sector and intends to grow onward and upward. Even market trend-setter Apple shared some Uber love: at Apple’s “Spring Forward” event in San Francisco on March 9, 2015, the company unveiled the Apple Watch and fired up the Uber app to demonstrate how to hail a cab from your wrist. Apple doesn’t just hitch its wagon to any ol’ company. With all the positive reinforcement going on, it’s no wonder rideshare drivers seem unfazed by local ordinances. Legally, the ordinance and other similar laws attempt to regulate TNCs as if they are taxicabs. This has forced Uber’s existential crisis: am I a taxicab subject to regulation under the Department of Transportation? Regulations are reserved for licensed industries, and the DOT imposes regulatory framework upon traditional taxicab companies. TNCs such as Uber, however, are merely cab brokers who provide smart-phone apps to sign up drivers (using their own vehicles) and match them with passengers. Uber sets the rates depending on market conditions. The TNC business

model is arguably a market economy subject to competition, not government oversight and regulation. The inability to compete is generally the death toll to innovation, change and advancement. Need an example? Larry Downs from Forbes magazine puts it perfectly: “Look inside a typical taxicab today and you’ll find little in the way of technological sophistication. Just a meter (introduced in 1897), a two-way radio (circa 1940), and maybe a GPS device (not likely– after all, getting lost earns you more money).” This doesn’t mean our fair City’s ordinance is completely misplaced. It certainly has teeth if enforced, and crafting regulatory framework around TNCs is a current national trend for state and local governments. But for now, Orlando’s ordinance seems fairly benign. Perhaps its enactment was a respectful tip-of-

Naturally, there will soon be bigger fish to fry. The State of Florida is currently contemplating statewide regulation over TNCs. (They just can’t help themselves!) Senate and House bills have recently been filed: the Senate version will require insurance and background checks and impose fees similar to Orlando’s ordinance; the House bill will require the same insurance and background checks, but will preempt

local regulation. The best approach may be to impose a minimum regulatory framework, and then watch and see how the industry develops. For now, take solace in participating in the new global “sharing economy”. Hire an Uber to take you to your Airbnb condo, and share your experience on Facebook. Our online community is fairly new to lawmakers (who are generally not on the cultural forefront of innovation), so give them a chance to craft some basic rules and ride on, Orlando, ride on….

Many people are buckling in their feet and taking the plunge to not only get a new perspective on life (literally), but to also reduce lower back pain, stimulate circulation and lymphatic fluids, ease stress, improve joint health and increase flexibility. Used as part of a holistic approach to natural healing, inversion therapy could be your next wellness trend obsession. You’ve probably heard about the benefits of inverted poses in your last yoga class, but maybe it turned out doing handstands isn’t as easy as your instructor previously claimed. Enter the inversion table. A gentler way to angle your heart above your head, inversion tables are an easy-to-use tool for stress-relieving decompression therapy. Ever wonder why you feel shorter at night than in the morning? Because you actually are! Throughout the day gravity and weight bearing activities compress your spinal discs, causing them to release moisture and decrease flexibility. This causes the average person to lose half-an-inch to three-fourths-of-an-inch of height over the course of a day. Not only does this shorten your body, it also pinches the spinal nerves causing lower back pain. Inversion therapy slowly releases the pressure on your spinal discs (called applying traction), allowing them to rehydrate to full size, thus reversing the effects of gravity on your height. Easing into seeing the world upside down will help you to avoid the downsides and just experience the upsides of inversion therapy. Like most things in life, inversion therapy is not universally beneficial to everyone. Because your heartbeat slows and blood pressure increases while inverted, it is not recommended for people with heart disease, high blood pressure, glaucoma, or acid reflux. Dentistry Ministries is a branch of the multitiered tree of service and outreach that is, “Inspired Purpose.” Dr. Wendi and her mission team travel throughout the world providing access for routine and emergency care. This year, Inspired Purpose contributed to the free dental day at Simmonds Dental Center in Metro West treating over 70 patients with extractions, fillings and cleanings. Inspired Purpose is also planning missions in 3 Orphanages in Uganda and Kenya providing dentistry, dental supplies, education, sneakers, and teddy bears through it’s ministry. Inspired Purpose is also scheduled to return to Haiti at the end of the year.

APPEALS FROM A CRIMINAL CONVICTION - BY MARK L. HORWITZ

Everyone convicted in federal or state court has a right to appeal the conviction. Throughout my years of practice in criminal defense, I have received countless calls from those convicted of crimes, or their family members, who do not understand a criminal appeal. An appeal is not a new trial, rather it is a review of what occurred in the trial and sentencing to determine if the trial judge made an error that resulted in an illegal or unconstitutional conviction or sentence. In state courts of Florida, a defendant has 30 days from the judgment to file a Notice of Appeal. In federal court, the Notice of Appeal must be filed within 14 days of the judgment. In criminal cases, the time to file the notice begins on the date of the sentencing. Everyone has a right to appeal a conviction, but that right is lost if the Notice of Appeal is filed late. In Florida, cases are appealed to the District Court of Appeal. A federal conviction is appealed to the United States Circuit Courts of Appeal. An appeal is considered by three appellate judges. These judges determine whether the trial court committed errors that are so serious as to require the conviction or sentence be reversed. The appellate court does not retry the case and there is no second jury. Rather, the appellate court considers only the information and events which occurred in the trial court. This is called the “Record on Appeal� which includes all motions, orders and written transcripts of hearings, trial and sentencing. In addition to the Record on Appeal, the appellate judges consider the argument of the defendant and prosecution lawyers. Those arguments are contained

in written submissions to the appellate court called briefs. The defendant submits an Initial Brief, the prosecution submits an Answer Brief and the defendant can submit a Reply Brief. In addition to the briefs, the appellate court may set an oral argument. The oral argument occurs at the court of appeals and is before the three appellate judges who will decide whether to reverse or affirm the conviction. Oral arguments are usually limited to 15 minutes per side. I have handled many federal and state appeals over the years. As an Assistant United States Attorney I represented the United States in appeals of cases that I prosecuted. As a defense attorney I have handled appeals for my clients who have been convicted. I have also handled appeals for people after a different attorney had represented them at trial. A successful appeal of a criminal conviction requires the attorney to (1) completely review and analyze the record; (2) identify the important issues to raise with the appellate court; (3) write clear, concise and persuasive briefs; and (4) present effective oral argument, even though the time is extremely limited. Successful appeals can result in a new trial, dismissal of the case, or a reduced sentence. Like all areas of criminal defense, appeals are an important part of defending liberty.
