lights. The Candlelight Processional, a favorite of all ages, included celebrity guest narrators accompanied by a massed choir and orchestra for a retelling of the Christmas story.

A new year is upon us and it’s time to fall in love once again with all the wonderful events that happen month-to-month throughout our great city! Let’s dive right in by taking a look back at the fun we enjoyed in December and January. Here are all the highlights, just in case you missed it! On December 1st, the City of Orlando’s Annual Tree Lighting Celebration was held at the Walt Disney Amphitheater at Lake Eola Park. In addition to live performances and tasty food from TheDailyCity.com Food Truck Bazaar, the event also featured an exciting countdown to the lighting of Orlando’s extravagant 72-foot Christmas tree. On the other side of O-town, IDrive was also getting into the spirit of Christmas with their own Holiday Tree Lighting ceremony on December 1st. Along with the lighting of a 50 foot Christmas tree, guests also enjoyed special musical performances, dancing, dining and plenty of shopping discounts. The event also featured free 3D holiday glasses and photos with Santa himself!

On January 6th, Harry P. Leu Gardens presented an amazing, award-winning outdoor exhibit which was a delight for all ages! Nature Connects - Art with LEGO Bricks by Artist Sean Kenney was an incredible exhibit that featured many largerthan-life sculptures built with LEGO bricks. Over 450,000 bricks were used in this exhibit to bring nature to life, with 16 sculptures in 13 displays throughout the 50-acre garden. If you missed the show, fear not! Nature Connects runs until April 22nd.

The Festivals of Speed returned to the Ritz-Carlton Orlando, Grande Lakes on December 2nd for its 12th annual event! Attendees experienced an extravagant display of luxury lifestyle with a showcase of over 300 exotic cars, motorcycles, watercrafts and luxury brands. The event has become renowned for its unique diversity, showcasing both vintage and contemporary vehicles of all makes and models placed for display amongst the splendor and hospitality of the beautiful Ritz-Carlton Orlando, Grande Lakes. On December 9th, Orlando rocked in the holidays with the top strings sensation Violectric at the 5th annual “Violectric Holiday Show” at the Walt Disney Amphitheatre in Lake Eola Park. The free and public concert featured all your favorite holiday songs mashed up with classic rock tunes and modern hits in a fun and energetic show. Attendees were encouraged to bring their pets to the show, and anyone who brought a pet supply or mades a donation for Pet Alliance received a pet photo opportunity with Santa and Mrs. Claus.

On your mark... get set... go! January 20th was the Park Ave 5k, a 3.1 mile run/walk event for participants ages 8 and above as well as a free kids’ run for kids 10 and under. The 5k benefitted the Track Shack Youth Foundation, a non-profit organization that promotes physical fitness to children and teens through a wide variety of community organizations throughout Central Florida.

Throughout the holidays, Magic Kingdom played host to Mickey’s Very Merry Christmas Party! The series of nighttime holiday fun events for the entire family included holiday shows, fireworks and magic treats with Minnie and Mickey. Next door at Epcot, Holidays Around the World was taking place with storytellers, a daily character tree-lighting ceremony and a stunning display of snow-white

On January 20th, guest of Orange County’s Magnolia Park participated in the 6th annual Birdapalooza festival. Guest of the free, familyoriented event enjoyed photo walks, bird banding, guided bus tours, and guided walking and biking nature tours for children and adults on the Lake Apopka Loop Trail. Birdapalooza also featured live animal demonstrations, music, owl pellet dissections, bounce houses, face painting, exhibitors, nature-oriented merchandise vendors and tasty food trucks.

With the return of Praise Wave Music Festival on January 20th, guests were able to enjoy a celebration of Christian fellowship and fun at SeaWorld Orlando. Uplifting, live concerts from the hottest names in Christian music lit up the stage at Nautilus Theater for three consecutive Saturdays. In between live performances by award-winning artists such as Lecrae, Steven Curtis Chapman and MercyMe, guests also enjoyed SeaWorld’s thrilling rides, shows and world class attractions.

We’ve all heard of Niagara Falls, but few know that this

destination has so much more to offer visitors than its namesake tourist attraction. I used to be one of those unaware individuals, but I recently had the opportunity to go on my own Niagara Falls excursion and am now left with the seemingly impossible task of finding the words to share this great adventure with you. I’ve had experience writing dozens of travel articles, but today I was completely and irrevocably stumped as to where to start this particular story. How does one even begin to describe the amazing and breathtaking beauty of Niagara Falls USA? Do I start with the obvious and gush over their magnificent falls, or do I take the path less traveled and tell you about the destination’s many other hidden gems? I spent several long minutes staring at a blank word document as these questions spun around my head. Finally, I decided to just start writing down the first thoughts that came to my mind in a feeble attempt to retell my once-in-a-lifetime adventure in Niagara Falls USA.


TRAVEL ‘N STYLE

Upon landing at Buffalo Niagara International Airport, I met up with my travel companions and enjoyed a brief, scenic ride to the downtown area of Niagara Falls, New York. Our very first stop of the day was Third Street Retreat Eatery and Pub, a fun and casual dining joint. The popular hangout spot was filled with personality and great conversations as we enjoyed a oneof-a-kind local dining experience with amazing homestyle food. The eatery was the ideal spot to fuel up on some delicious grub in preparation for a busy day in Niagara Falls State Park. With awe-inspiring scenery, thrilling attractions, interactive exhibits, miles of hiking trails, and delectable dining options, Niagara Falls State Park is an action-packed experience! We kicked off our own adventure with the Maid of the Mist tour, a favorite local attraction for more than 150 years. Generations of visitors have described the tour as one of the highlights of their trip, and it doesn’t take long to see why. After receiving a souvenir rain poncho to wear aboard the double-decker tour boat, the Maid of the Mist ferried us past the base of the American Falls and onto the basin of Horseshoe Falls. The dramatic passage led us through massive rock formations and the powerful waterfall

whitewater. Needless to say, we returned to shore with a newfound appreciation for ponchos (you’ll definitely need it!) and more importantly, for the power and grandeur of Niagara Falls. As if it wasn’t enough for us to “explore the roar” from the Maid of the Mist, my companions and I also had the opportunity to experience the power of the Falls from the Cave of the Winds. Before getting up close and personal with the Falls, we traveled through the World Changed Here Pavilion, which educates guests on the rich history of the Falls that truly changed the entire world. After being outfitted in souvenir sandals and more ponchos, we descended 175 feet into the astonishing Cave of the Winds. A series of wooden walkways led us within feet of the violent, yet majestic Bridal Veil Falls. I can’t tell you what an incredibly surreal feeling it is to stand on that deck and realize that nowhere else on earth will get you closer to Niagara Falls. For the more adventurous guests, a little further up the wooden walkways is the astonishing “Hurricane Deck” where revelers are surrounded by tropical storm-like conditions—even on the calmest of days! Poncho or not, prepare to get wet!

Without a doubt, only accomodations at the region’s premier destination resort could follow such a powerful and energetic start to my Niagara Falls adventure. Fortunately, I experienced exactly this for two glorious nights all while being just minutes from Niagara Falls State Park. An elegant and adventurous dinner at Carmelo’s proved to be the perfect close to our second day as we relished in creative, seasonal fare in an intimate setting. The following morning, my companions and I enjoyed a mini hiking trail from Schoellkopf Power Station that led to awe-inspiring views of the Niagara Gorge. I knew my return flight home was just hours away, but I didn’t have a care in the world as I stood there breathing in the most refreshing air and memorizing the magnificent scenery as far as my eyes could see so as to not forgot a single detail. How anything could be both heart-

stopping and heart-stirring is beyond me, but Niagara Falls USA made me experience all those feelings and more from day one, and that feeling never stopped. I know what you’re thinking, what is microneedling? In Hollywood, female celebrities constantly undergo pressure to appear pimple-free, so much that in the past year, a no-makeup movement has immersed. Prominent stars such as Alessia Cara and Alicia Keys have lashed out against Hollywood beauty standards, provoking a natural, bare-faced trend. Which celebrity star will be next in joining?

Alessia Cara The anti-makeup movement is nothing without Canadian singer-songwriter Alessia Cara. The 21-year-old soulful voice, who never wears makeup, gave a striking performance last year in the 2017 VMAs, leaving the crowd speechless. As Cara performed “Scars To Your Beautiful,” the singer’s fiery red lips matched her floor-length gown. Her hair, perfectly styled in a straight, short bob, represented the clean and sleek look she was expected to have in front of the spotlight. Caught in a romance with the past but in love with the future, Del Rey’s album is a contribution that pushes her moody and brooding fans—and even her melancholy self—to find a new, grown-up perspective and embrace the joys of the moment. CELINE DION – ILE GAGNON, QUEBEC The Canadian songstress owns a private island, Ile Gagnon, located between Boisbriand and Laval. The best feature of this island is the Laval mansion which she and her late-husband Rene Angelil had custom-built in 2001. The 24,000 square-foot home has six bedrooms, nine bathrooms, a stone wine cellar with tasting area, an elevator, an in-ground pool, a grand staircase and even a games room. The mansion was the most expensive property for sale in the Montreal area until it sold in 2016 for $25.5 million. NICHOLAS CAGE – LEAF CAY, BAHAMAS In 2006, Nicolas Cage purchased Leaf Cay, an Exumas in the Bahamas, for $3 million. Today, the 35 acre property can be yours for a cool $8.5 million. The island features three unspoilt white sandy beaches, protected deep water access suitable for anchorage and docking of large yachts, and decent elevations. There is also a small pond on the island that would make an ideal private harbour if the new owners wish to create one! JOHNNY DEPP – LITTLE HALLS POND CAY, BAHAMAS Johnny Depp first laid eyes on Little Halls Pond Cay while shooting Pirates of the Caribbean in 2004. He snapped up the 45 acres of private island that same year for $3.6 million. The island is located in the south of the Bahamas and has a palm tree-lined lagoon, solar-powered houses and six beaches named after Depp’s children and former partner Vanessa Paradis. EDDIE MURPHY – ROOSTER CAY, BAHAMAS In 2007, one of Hollywood’s highest paid actors bought Rooster Cay island in the Bahamas for $15 million. The 15+ acre island is located off the coast of Nassau in the Long Cay region. There are reportedly no such plans of resort development even though it would appear to be an ideal place for such recreation. According to Private Island Magazine, the comedian used to own another Bahamian cay called Pearl Island. SHAKIRA – BONDS CAY, BAHAMAS In 2011, the Colombian singer invested $16 million in a 700-acre island with Pink Floyd frontman Roger Waters and Spanish singer Alejandro Sanz. Bonds Cay already boasted a hotel and 18-hole golf course at the time of purchase, but the trio were reported to have plans to develop it as both an artists’ retreat and a destination for the rich and famous with boutique hotels, luxury condominiums and private beaches. LEONARDO DICAPRIO – BLACKADORE CAYE, BELIZE The Wolf of Wall Street star bought a 2.2 miles long island off the coast of Belize for $1.75 million in 2005. Leonardo is an outspoken environmental voice and has plans to develop the 104 acres island into an eco-resort and wildlife preserve. The resort will feature 36 resort bungalows and 36 estate homes, all of which will be powered by 100% renewable energy harvested from solar panels. Even rainwater will be collected and filtered on-site to meet the resort’s water needs. MEL GIBSON – MAGO ISLAND, FIJI Mel Gibson reportedly paid $15 million for his Fiji island in 2004, just after the release of his film The Passion of the Christ. The island is practically its own country at 5,400 acres, which also makes it one of the largest private islands in the southwestern Pacific Ocean. Mago Island is relatively undeveloped at present and inhabited only by a few Fijian caretakers. TYLER PERRY – WHITE BAY CAY, BAHAMAS In 2009, Tyler Perry purchased White Bay Cay in The Exuma Cays in the Bahamas for $6.4 million to celebrate his 40th birthday. The award-winning actor even took pilot lessons so he could fly his own private plane to the property which consist of a 25-acre island and a seven-acre island relatively close by. He spoke of the purchase with People saying, “I’m a loner by nature, so when I’m out there on these islands, I just feel like the only person in the world.”

Considering the fact that nearly 30 million tourists visit the Caribbean annually, there is a very high possibility that it holds a special place in your heart as well. Now this beautiful region is greatly in need of our love and support, but I think it’s the kind of help that you’re going to have a great time providing. Grab your bathing suit, dust off your sunglasses and dig out your passport—it’s time to plan your 2018 vacation to the Caribbean. Nearly six months after the islands took a harsh beating from hurricanes Irma and Maria, the question for many concerned vacationers is still this: When can I expect to travel to the region again and which island’s are open for tourism? Believe it or not, right now is actually the perfect time to book your 2018 tropical getaway! Though there are parts of the Caribbean that are still in the midst of recovery operations, many islands were untouched by either storm and most that took a hit have resumed tourism and are welcoming visitors with wide open arms. THE INS & OUTS OF TITLE IX SEXUAL HARASSMENT & SEXUAL VIOLENCE CASES IN SCHOOLS With sexual harassment and sexual violence matters dominating much of the headlines of late, one important area of concern has not been given the attention which it deserves. Title IX of the Education Amendments of 1972 (“Title IX”), is a federal civil rights law that prohibits discrimination on the basis of sex in education programs and activities. All public and private elementary and secondary schools, school districts, colleges, and universities receiving any federal funds must comply with Title IX. Under Title IX, discrimination on the basis of sex can include sexual harassment or sexual violence, such as rape, sexual assault, sexual battery, and sexual coercion. When a student alleges a complaint stating that they are a victim of sexual harassment and/or sexual violence, the school must respond “promptly and effectively” and begin its investigation. If the school becomes aware of conduct that would constitute sexual harassment or violence, they must act regardless of the student’s desire. Every school must have a written procedure they make available to the parties involved. The complainant must prove his or her case by a “preponderance of the evidence” standard. This means that they must convince the Title IX investigator that the misconduct is more likely to have occurred than not. This is not a very high standard (think 50.1 percent chance the claimant is being truthful) and is much lower than the “beyond a reasonable doubt” standard of proof used in criminal court. One can be accused civilly with this standard but not be prosecuted criminally. While the respondent is given a summary list of allegations, he or she is not entitled to see the written statement of the claimant or given all of the details of the accusation. Even worse, most schools merely have the investigator interview all the relevant witnesses and review any items of evidence submitted and have the investigator make a decision based on what they have seen and heard. In these cases, there is not a formal “hearing” where the respondent can hear the details of the accusation or cross-examine witnesses, pointing out inconsistencies with their prior testimony or with testimony from other witnesses.

attorney or advisor. This means that the attorney or advisor can prepare the respondent for his or her interview but it is the respondent that must answer all questions, assuming that they decide to participate in the interview process to begin with. Because the claimant has the burden to prove the charge, it is theoretically possible for the respondent to win the “hearing” without participating, but choosing not to participate severely limits the chances of success as the investigator will only have one side of the story to consider. A respondent may choose to not participate if there are criminal proceedings pending or they believe charges may be forthcoming in the future. All witnesses appear voluntarily and neither the claimant nor respondent have the power to subpoena witnesses or documents, depose witnesses, or to submit written questions for witnesses. Once the investigator has reviewed all of the evidence, they generate a report and if any of the allegations were found to be true, the school imposes a sanction. The sanction can include a no contact order, the respondent changing classes, moving to a new residence hall, suspension, or expulsion. The appellate process will vary from school to school, but must be the same for both the claimant and the respondent. Title IX investigations are very different from court cases and while the respondent can face severe sanctions, he or she is not entitled to the same due process requirements that the court cases give to a defendant. It’s dangerous out there. More injustices occur with sex related cases than with any other. More innocent people are falsely accused and more guilty people beat charges than any other type of case as it’s often a swearing contest between two people and the subjective evaluation as to which is the most believable. Times have changed and the public’s understanding as to what is permissible and actionable will keep this issue in the forefront for a long time to come. Lawson Jr. developed his love for history, teaching, and sports while a student at Gilman School in Baltimore. While at Gilman he lettered in basketball and lacrosse – two passions that followed Byron to the University of Chicago, where he studied history. When he started at the University of Chicago, he had already determined to follow in the footsteps of his great teachers and invest in the lives and minds of students. Byron’s teaching career spans the Kinkaid School in Houston and St. Marks School in Dallas, where he began to pay forward the passion that was instilled in him by his teachers. In fact, one of his earliest students, Connor Cook, went to serve as the Head of Middle School at St. Francis Episcopal School. Whether on the lacrosse field or in the classroom, “Byron taught in a cerebral and intentional way” said Cook. “He taught us how to be accountable people in the world, and I will always be thankful for his guidance.” During Byron’s tenure at St. Marks, he led the school to the Texas Boys High School Lacrosse Championship, served as chair of the history department, was assistant to the head of school, and served as director of St. Marks Fellows Program. It was this breadth of experience and knowledge that led Trinity Preparatory School to name Byron Lawson its fifth head of school before the 2016-17 school year. Byron is also committed to enhancing education, learning, and teaching. He serves on the Board for the Florida Council of Independent Schools and is the treasurer for the Central Florida Episcopal Schools Association. Outside the classroom, Byron is on the boards of the Orlando Philharmonic and the Down Syndrome Association of Central Florida. He is married to Courtney A. ANDREA ELISCU Innovator and Connector

Whether in her professional work as president of the healthcare marketing firm she founded or in her many community and philanthropic pursuits, Orlando’s Andrea Eliscu sparks innovative solutions by forging creative connections. A nurse by training, Eliscu arrived in Orlando in 1971 with her husband Edward, an interventional radiologist, and decided the best way to serve her new community was to volunteer as a nurse one day a week so for three years, she donated her paycheck to a nursing scholarship fund. Later on, while raising her family, she continued her involvement in fundraising for community healthcare causes. Then, in 1984, after completing her bachelor’s degree at Rollins College and observing the changes taking place in the healthcare marketplace, she founded her consulting firm, Medical Marketing Inc. Her mission was to introduce physicians to the concept of marketing and help them position their practices for success. Over the past 35 years, Eliscu has continued to grow her consulting business, authoring four books, including the recently released “It’s Personal: The Art of Building Your Practice,” and serving as a national speaker and resource. However, beyond her business acumen and accomplishments, Andrea is best known locally for her passion for health and wellness, and her countless hours of service, leadership and contributions to Central Florida causes, ranging from the UF Health Cancer Center to the Orlando Ballet.

Since 2011, her greatest passion has been the Dueling Dragons of Orlando “cops and kids” dragon boat team — a program she founded as a creative way to bridge the divide between inner-city youth and police officers. The first of its kind in the country, Dueling Dragons focuses on breaking down barriers and forging long-term mentoring relationships between youth and law enforcement as they learn to work together not on the streets, but paddling in a boat on the water as a competitive racing team. Eliscu’s innovative initiative has achieved results and garnered national attention, including a feature story on the Today Show, a TEDx talk, and a documentary that premiered at last fall’s Global Peace Film Festival. Most recently, Andrea oversaw the transition of Dueling Dragons from a volunteer-led, privately funded effort to a full-fledge program of the Boys & Girls Clubs of Central Florida, helping to foster growth and replication. Already, this affiliation has spawned the newly formed Orlando Fire Dragons — a team of low-income youth and Orlando firefighters. “I believe in the power of relationships,” shares Eliscu. “And because I have lived and worked in this community for so many years, I do my best to create connections among those who can help each other. At the age of fifteen he had been given 6 months to live. “I was born with a severe heart condition called aortic stenosis.” People suffering from this condition have an aortic valve in their heart that gradually degenerates and therefore the heart cannot function properly. Heart surgery in the sixties was not as successful as today. He also had bad allergies. His mother was not ready to give up. On a friend’s recommendation, she took her son to a chiropractor. “The aortic valve stopped closing by 92 percent and my allergies were gone.” Dr. Mattia said. He was able to live to the age of 35 when he received his first new aortic valve and the success rate of heart surgery was higher. Dr. Mattia became a chiropractor because of this. He earned his chiropractic degree from New York Chiropractic College and opened a practice in 1977. Dr. Mattia practiced in New Jersey from 1977 to 2001. During that time he received many awards: Chiropractor of the Year 1996 and Sports Chiropractor of the year several times. He was appointed to the Board of Chiropractic Examiners, on which he served for six years, by the governor of New Jersey. He was also a board of director for the International Chiropractic Association and the Northeast Regional Director. Dr. Mattia has been the president of International Chiropractic Association Sports Health and Fitness Council from 1996-2011 during which he joined Arnold Schwarzenegger every year in Columbus Ohio for the ICA Fitness Symposium. The Symposium is held in conjuncture with the Schwarzenegger Fitness Weekend.

pediatric pulmonary and sleep medicine practice in Florida, with its own behavioral sleep medicine specialist. It offers a wide range of sleep services: sleep evaluations, sleep studies, psychology and cognitive behavioral services. It has the most expansive network of office locations in Florida with 15 offices spanning from the east to west coast. Each office offers full pulmonary function testing, sleep testing, apnea monitoring, allergy testing and immunotherapy. Conditions such as sleep apnea and sleep fragmentation can mimic behavioral disorders associated with ADHD; hence early identification and treatment is important to avoid stigmatizing a child. When treating a child with conditions such as asthma, it is important to correctly diagnose and characterize the severity of the condition. Asthma affects how children sleep, play and learn. It is my goal to make sure kids can do all of these things with ease.

I emphasize the importance of consistent sleep/wake schedules, teaching school staff and families about how to facilitate the development of independent sleep skills in children of all ages, and quickly and accurately identifying children who are at-risk for sleep disorders. Teachers have a unique ability to observe students on a daily basis and are often the first to become aware of behavioral, learning, and emotional symptoms that may be a sign of inadequate or disrupted sleep. Since this is the Doctor Knows Best issue, let’s first acknowledge that without the patient’s willingness to heal and learn, therapies do not work. We hope the following three snippets are relevant and apropos. First is travel. When travelling do some research. Visit the Center for Disease Control and Prevention (CDC)’s travel specific website https://wwwnc.cdc. gov/travel. Don’t fret when reading CDC’s information. Note vaccination requirements as wells as the availability of clean water. If you are going to be around large groups in an enclosed environment (subway, cruise ships, etc.), wash your hands often. Just enjoy the experience and keep it simple. Second is the use of antibiotics. A common question is whether the symptoms are due to a virus or bacteria. Antibiotics treat certain infections caused by bacteria and do NOT work on viruses. Taking antibiotics has a cost in terms of side effects and long term resistance to that medicine. Again the CDC has fantastic educational material (https://www.cdc.gov/drugresistance/). If you have any questions, please talk to your physicians. Lastly is the flu season. By the time you are reading this, we should have moved past the peak number of cases. Every year there’s a new flu vaccine. That vaccine is a best guess about the strain that will be the most active. Go get vaccinated. In the event you are inflicted with the flu next season, remember it’s a virus (see above). Refer to the CDC site (https://www.cdc.gov/flu/) for updates. In 2008, Dr. Shah founded Premier Infectious Disease Care in Winter Park. Over the last year, three physicians have joined the practice. She has been practicing at Winter Park Memorial Hospital for over 12 years, but with the help of the additional physicians, the practice has expanded to cover additional campuses of Florida Hospital (Orlando and East) and Oviedo Medical Center. Over the course of these years she has been blessed to work with a wonderful office staff as well as the many nurses, physicians, and caregivers in the region. Dr. Shah’s kids are growing up too fast. One is in college and the other is about to enter high school. In her spare time, she enjoys dancing and travel.

Research with Results Dr. Steppie goes beyond clinical practice to pursue dermatologic research that may advance skin cancer detection. One of his lines of research, in collaboration with Sanford Burnham Prebys Medical Discovery Institute at Lake Nona, involved identifying biomarkers that may predict susceptibility to melanoma. “The promise of finding cancer early, when it can be most effectively treated, is really exciting,” Dr. Steppie says. “Identifying melanoma biomarkers could be the first step in developing earlier, more reliable diagnostics that could, in turn, reduce deaths.” This collaborative melanoma research was published in the Journal of Investigative Dermatology in April 2017. Dr. Steppie also contributed to a breakthrough study on vitiligo, published only five months later. Spreading the Word “Nearly 8 million Americans have skin cancer, yet only 4.4 million cases have been diagnosed and treated,” Dr. Steppie says. “We need to close that gap. That’s why I work with local and national media to let people know it’s important to be vigilant.” An elite member of the Amonette Circle of the Skin Cancer Foundation, Dr. Steppie has committed significant personal resources to this goal. Through every available medium, he tells people that skin cancer, although the most common cancer in the US, is treatable. “Vigilance is key to detection,” he says. “Be alert for scaly or crusty patches, wart-like spots and new, growing or dark moles. IT MIGHT BE A NEW TAX CODE BUT IT STILL HAS THE SAME PENALTIES In late December, Congress passed sweeping changes to the U.S. income tax laws. There was much debate as to who would really benefit under the new tax code but no discussion concerning the continued emphasis on criminal prosecution of tax crimes. While the tax code may have reduced the number of tax brackets, the complexity of tax returns still poses problems for many. Accountants, tax-return preparers, and large tax-preparation companies will continue helping prepare returns.

The U.S. government contends that we have a voluntary tax system, however, if the Government believes a citizen willfully failed to abide by the voluntary system, consequences include significant civil penalties and time in prison. There are numerous tax crimes set forth by the Federal Government including: tax evasion, false statements on tax returns, failure to timely file tax returns, and hiding assets subject to levy by the IRS. In determining whether a person has committed a tax crime, one of the major factors considered by IRS criminal investigators is whether the person acted willfully. In a tax prosecution, willfulness has a specific meaning and requires the Government to prove that the taxpayer knew what the law required and intentionally chose to not comply. Given the complexity of the tax laws, it is easy to understand how a person may prepare a tax return that is incorrect but not willfully false. In bringing a criminal case, the IRS usually considers conduct that is based on more than one year. For example, charging an individual with tax evasion for underreporting income will often involve an investigation that spans 3 to 5 years. Each year in which tax evasion occurs has a maximum term of imprisonment of five years. Therefore, if a person is charged with tax evasion for three separate tax years and convicted of all three counts, a maximum penalty of 15 years in prison is possible.

The failure to timely file a tax return can be a civil or criminal matter depending upon how the IRS interprets the facts. Each year that a person fails to timely file a tax return is a separate crime punishable by imprisonment up to one year. Therefore, if a person is prosecuted for failure to timely file tax returns for three years and convicted, a maximum sentence of three years in prison could be imposed. The IRS often begins an investigation through its civil branch which seeks to ensure that the correct amount of tax is reported and paid. An IRS audit can result in the IRS finding errors which will justify the imposition of significant civil penalties in addition to the correct amount of tax that should have been disclosed and paid. There are multiple civil penalties, the highest penalty being an additional 75% of any unpaid tax. All taxpayers have rights when dealing with the Internal Revenue Service. Whether an IRS auditor, IRS tax collector or criminal agent is involved, every taxpayer has a right to representation. IRS agents, both civil and criminal, like all people, can make mistakes which may have a devastating impact on the taxpayer in the form of large civil penalties or criminal prosecution. While the new tax laws are touted as being simpler, they are not so simple as to avoid the risk of a person being subjected to wrongful prosecution, incarceration, or assessment of improper taxes and penalties. The hiring of a well-experienced attorney, while costly, may in the long run be economical when compared to the alternatives. Likewise, not having experienced legal representation when a civil or criminal IRS agent comes knocking at your door can impact your liberty. As long as the United States continues to impose the threat of criminal sanctions in relation to the U.S. “voluntary tax system”, citizens must take care to ensure that they are protected against IRS mistakes even under the new tax laws.
