constitute over 85% of forfeitures by the Federal Government and well over 50% of forfeitures in most states. Critics complain that police agencies use civil forfeiture to generate money to fund items not otherwise in their budget. This has been called “policing for profit” which many critics contend take police priorities away from traditional law enforcement goals. The Florida Legislature in its last session reacted to the many complaints concerning civil forfeitures and amended the Florida Contraband Forfeiture Act. The new law has significant protections for citizens and will become effective on July 1, 2016. Some of the changes are: 1) the State must prove its case beyond a reasonable doubt in order to forfeit property; 2) there must be an arrest of an individual that forms the basis for seizure of property (there are significant exceptions to this requirement); 3) every Florida law enforcement agency is required to submit an annual report concerning seized or forfeited property to the Florida Department of Law Enforcement that includes the receipts and expenditures of all funds from forfeited property; 4) law enforcement officers’ employment, salary, promotion or other compensation may not be dependent on officers meeting a quota for seizures. There are several exceptions to the requirement of an arrest for a seizure to occur. The most important of these exceptions is that if the item to be seized is money or its equivalent, no arrest need occur. This exception will leave open a major area for abuse. Many police seizures are undertaken with the knowledge that the costs of fighting the seizure and forfeiture will prohibit many from trying to recover their property. In one case, a person at the Orlando International Airport traveling to another city in the U.S. was stopped and $150,000 in cash was seized. No arrest was ever made and no one was ever convicted of any crime related to the $150,000. The forfeiture was contested and after 18 months the funds were returned. In another case the contents of a bank account belonging to a local business was seized thereby crippling the business. No arrests or convictions were ever made. After several months most of the funds were returned, however, state authorities were able to get a portion of the money as part of the settlement.

NEW FLORIDA LAW Takes an Important Step to Curb Abusive Civil Forfeitures

Horwitz | Criminal Defense Attorney For several years the press has reported stories of innocent people being deprived of their money, vehicles and property including real estate through law enforcement’s use of civil forfeiture laws. Most Americans are surprised to learn that the state can forfeit a person’s property even though the person was never convicted or even arrested for a crime.

While the changes to Florida’s forfeiture laws are a step in the right direction they do not go far enough to protect citizens from abusive civil forfeitures. The way to stop the abuse of civil forfeitures is to do away with all civil forfeitures and instead rely upon criminal forfeitures.

A criminal forfeiture, on the other hand, provides significant safeguards to an individual. Before a person’s property can be forfeited, the defendant must be charged and convicted by proof beyond a reasonable doubt and then the prosecution must prove that the property should be forfeited. This basic concept of American justice does not, however, apply to civil forfeitures. Studies have revealed that civil forfeitures
