A LAW SUBJECT TO ABUSE law enforcement agency in a hearing to determine whether there was probable cause to seize the Corvette. The Circuit Judge reasoned that possession of a pipe which contains only a trace of methamphetamine was a misdemeanor and therefore the Corvette should not have been seized. The Court of Appeal’s reversed the lower court’s ruling and said that even though the glass pipe contained only a trace of methamphetamine, its possession was a felony and seizure was legal.

By Mark L. Horwitz | Criminal Defense Attorney Over the past several years complaints concerning seizure and forfeiture of property have increased. Everything from cars, currency, airplanes, and real estate have been taken by law-enforcement under the Florida forfeiture law. The use of civil forfeiture by police has been called ‘policing for profit’ because law enforcement agencies financially benefit from the sale of forfeited property. The Florida Legislature in 2016 amended Florida’s civil forfeiture law to address some of the complaints. The change did not impact forfeiture of property in criminal cases. Prior to the 2016 changes, seizures of cars, currency and other property frequently occurred without a person being arrested. Police seizures of bank accounts and currency caused individuals as well as businesses severe financial hardships. People who were never arrested or charged with a crime had the burden of proving that their money or other seized assets should not be forfeited. A recent case decided by Florida’s Fifth District Court of Appeal’s provides an example of the harsh results possible under the Florida civil forfeiture law. Police executed a search warrant and found a glass pipe containing methamphetamine residue inside a 1997 Chevrolet Corvette. The Circuit Court ruled against the

Florida Contraband Forfeiture Act (FCFA), under its previous as well as current provisions, allows the forfeiture because the possession of any amount of methamphetamine, even if just a trace amount, is a felony. Under the current law, an arrest would have to be made in order to seize the automobile in which the pipe with a trace of methamphetamine was found. The police may choose to make an arrest in order to seize an expensive car. Because the FCFA provides for civil not criminal forfeiture, the owner must prove that the car should not be forfeited. Under the current FCFA, real property cannot be seized but may be subject to forfeiture. The State can proceed with forfeiture by filing a notice of lis pendens against the real property. It is not beyond possibility that law enforcement could seek to forfeit a house or business if a glass pipe is found that contains residue of methamphetamine, cocaine or other controlled substances when possession is a felony. A forfeiture could also result from police discovering and seizing pain medicine such as oxycodone obtained without proper prescription. The past as well as current law provides that in any incident in which possession of a contraband constitutes a felony, the vehicle, aircraft, other personal or real property in which the contraband article is located shall be subject to forfeiture. The law presumes that the vessel, motor vehicle, personal or real property in which the contraband article is found was used in a manner to facilitate the transportation, carriage, conveyance, concealment, receipt, possession, purchase, sale, barter, exchange or giving away of the contraband. The FCFA requirement of an arrest before seizure may curb some of the abuses of forfeiture. A major problem still exists because the burden is on the property owner to prove that the property should not be forfeited. The State should be required to prove that the forfeiture of the property is justified. In criminal forfeiture cases, the burden is placed upon the state to prove that the property should be forfeited. Many believe that Florida should do away with the Florida Contraband Forfeiture Act and rely on criminal forfeitures which require the State to prove that the property should be forfeited.
