“Hi Grandma I Need Help” Scam

After telling the targets over the phone the falsified story about the grandchildren in jail, the fraudsters pressured seniors to provide bail money.

Attorney General Ashley Moody’s Office of Statewide Prosecution announced recently the arrest of six fraudsters for stealing nearly $250,000 from Florida seniors through grandparent scams. The Miami-Dade Police Department’s Vice Intelligence Squad reports that the defendants contacted seniors posing as lawyers or legal representatives of one of the victim’s grandchildren. The fraudsters told the targets that the grandchildren were arrested after hitting a pregnant woman with a vehicle and needed bail money, then arranged for the victim to send payment.

According to the investigation, the defendants directed the victims to obtain the bail amount in cash, then place it into a box to be picked up by a courier. The couriers — unknowing ride - share drivers booked by the criminals — picked up the cash and transported the money back to the scammers at an arranged ren dezvous spot. In a few instances, the scammers contacted the same victim multiple times pressuring for more cash. In one instance, a Palm Bay victim made an initial bond payment of $9,000, but fraudsters told the victim that the pregnant woman miscarried and the grandchild required an additional $18,000 because authorities upgraded the charges. The defendants then told the same victim the baby’s father attacked the senior’s grandson for causing the miscarriage, and during the course of the attack the grandchild elbowed a police officer, causing an additional $20,000 needed for bail, as well as

Combating Antisemitism requires ongoing efforts to raise awareness, promote understanding, and foster an environment of respect and inclusivity. The law provides a robust foundation, but it is the collective responsibility of all Floridians to build upon it. Representative Gottlieb’s words resonate strongly in this context: “We must remain vigilant in protecting our communities. We must do everything within our means to thwart the unparalleled rise in Antisemitic incidents.” This sentiment underscores the importance of community involvement and solidarity in the fight against hate. duty is equally applicable to all forms of real property, new and used.”

The same duty to disclose obligation also extends to real estate licensees who are involved with the transaction.

Today, the Johnson v. Davis’ ruling continues to affect and influence residential real estate transactions throughout Florida by attempting to discourage misrepresentation and reduce misunderstanding regarding the property’s condition between sellers and buyers. The court’s decision resulted in specific language being included in Florida residential real estate sales contracts, and eventually brought about the widespread use of written Seller’s Disclosures.

As a direct result of this oftenreferenced court case, residential sales contracts used in Florida contain some version of language such as “Seller knows of no facts materially affecting the value of the Real Property which are not readily observable and which have not been disclosed to Buyer.”

However, the Johnson v. Davis’ decision by itself did not require the use of separate written Seller’s Disclosures in Florida. Discussion and practical application of the legal concepts presented in the court’s ruling eventually led to the use of disclosure forms as tools to help ease some of the “buyer beware” exposure, and make it easier for sellers to voluntarily describe the property’s condition as accurately and completely as possible.

VERY important - latent defects are NOT the same as Defective Inspection Items as defined in the purchase contract. Some earlier articles on this site discuss seller and buyer handling of Defective Inspection Items revealed in a Home Inspection.

Now that we have a little background, let’s discuss how Seller’s Disclosures work in residential real estate transactions. They are usually completed before owners put their house or condominium on the market, often part of signing a Listing Agreement with a licensed real estate Broker.

It is important to note that Seller’s Disclosures still do not have to be in writing, though having a written, signed Seller’s Disclosure contributes greatly to buyer comfort and confidence to proceed with submitting an offer.

Many Florida real estate companies, offices, and organizations have preprinted blank Seller’s Disclosure Forms for sellers to fill in when putting their prop-

erties on the market.

Going through the checklist format, sellers are prompted to consider most aspects and systems of the property, helping reduce the possibility of missing any known issues or defects. When filled in honestly and accurately, the buyer gets a good snapshot of the current property’s condition as known and represented by the seller.

Categories on a Seller’s Disclosure Form can include:

• Structural - roof, walls, foundation

• Appliances, HVAC, other mechanical equipment

• Roof - leaks, age, recent repairs

• Electrical supply and wiring

• Plumbing, municipal water and sewer, private well and septic system

• Windows and doors

• Termites, pests, Wood-Destroying Organisms

• Water intrusion, previous flooding

• Mold

• Pool, hot tub, spa

• Automatic irrigation systems

• Radon, defective drywall, lead-based paint

• Environmental hazards / toxic substances

• Municipal code violations, open building permits

• Insurance claims

A Seller’s Disclosure is NOT a replacement for a thorough Home Inspection performed by a Florida-licensed Home Inspector. Always have a Home Inspection performed when buying a house or condo.

Seller’s Disclosure Forms include checkboxes for Yes, No, and Don’t Know responses to each of the questions in the various categories, and lines for details like age of various items, specific comments, property address, and seller signatures.

Best practices suggest that sellers fill in the form by hand (not digitally) and physically sign it with a pen (not a digital “click-sign”) in order to give potential buyers greater assurance of accuracy and good faith in revealing the known property’s condition. Real estate licensees should NEVER fill in a Seller’s Disclosure Form.

Using an As-Is sales contract does not relieve a seller from the obligation to disclose known yet unseen, hidden problems that could affect the property’s value as perceived by a buyer. Seller’s Disclosures are even more critical with As-Is contracts in my opinion. When submitting an offer on an As-Is contract, I suggest that buyers request a written, signed Seller’s Disclosure if one has not been made available. See earlier articles on Inspection and Due Diligence periods.

In my opinion, leaving the discovery of property condition solely up to buyers by not providing a separate Seller’s Disclosure is a very poor business practice. When you are selling something, you want any prospective buyers to be comfortable enough to seriously consider giving you an offer.

Here are a few discussion points to keep in mind:

• Sellers must disclose latent defects because the Johnson v. Davis court decision (case law) estab-

• A condition concern documented in a Seller’s Disclosure cannot be a latent defect because it is then known to potential buyers.

• Blank Seller’s Disclosure Forms are available to sellers, though in Florida there is NO requirement to use them. As mentioned above, they include the seller’s observation of condition for a broad range of a property’s physical components.

• Written Seller’s Disclosures are one of the best methods available for helping buyers feel comfortable enough with going forward and submitting an offer, then having Home Inspections performed after their offers are accepted.

• Navigating and negotiating property condition issues within the context of a real estate sales contract can be very involved. Have a Floridalicensed real estate attorney ready to advise you of your rights and responsibilities with respect to any purchase or sale.

Hallandale Beach Is Examining Their Emergency Operational Plans

It has been two weeks since Mother Nature decided to dump 22 inches of rain in Hallandale Beach, and many are sadly still drying out. My heartfelt prayers go out to all that are still struggling. Last year when this happened everyone discussed it as an anomaly. Fast forward and now the 1,000-year storm has become a year. This new reality of mega unpredictable rainstorms has shown just how vulnerable we all are in South Florida.

I have had the unique opportunity to study the science of Global Warming and Climate Change. As a Chair of the US Mayor Water Council, NASA would come and share with us the imagery from their satellites of just how Mother Earth was changing. Sea levels were in fact increasing. Over 30 plus years many have denied and still deny we have a problem with fossil fuels. It has directly impacted us.

Florida has always dealt with hurricanes. We have planned for years and fine tuned our emergency operational plans. Florida plans have become a blueprint for other communities. I moved here the year Hurricane Andrew hit and witnessed firsthand the devastation. Since then, I have been through many hurricanes. Some were nothing and others were horrific.

When attending US Conference of Mayors meetings, I am always asked what it is like. I always share that we at least get a warning to prepare unlike earthquakes and tornadoes that can strike at a moment’s notice. The biggest fear I share as your Mayor is storm surge and flooding. That is when the potential for loss of life increases. Recovery is the other critical time when residents end up getting injured due to electrocution or misusing chain saws.

As Mayor, I have the responsibility to work side by side with our Emergency Operation Center and to execute State of Emergency declarations. During this past storm we were the first to declare. This meant we put in an order immediately for back up pumps, high clearance vehicles and vacuum trucks. Regretfully, Fort Lauderdale received them even though they declared later than us.

With this new normal of persistent flooding caused by sea level rise, king

our cities. Even with pumping systems there is no guarantee there will not be flooding, especially along the coast and in low lying areas. There is no way to fully engineer our way out of the flooding. We will and must continue to do all we can to prevent flooding.

During pre rain events and storms we activate DPW, Department of Public Works. They check the operation of all our pumps. We also lower the canal. We check all the public drains to see if they are free of debris. As a note this is where and when residents can help. Drains can be cleaned one day and the next day, covered with debris and grass. I know Hollywood has an Adopt a Drain Program. I brought this up last year and will continue to push for it.

Response and Recovery efforts are the other key areas we must adapt to these events. In a typical Hurricane we have time to prepare. Residents batten down their homes, evacuate depending on the severity of the storm and then we wait it out. County and State agencies are already on alert and ready to mobilize. Streets are shut down and cleared. These major rain events necessitated a different approach.

This storm and the delay in receiving any relief from the state has prompted us

and DPW would need in their arsenal to respond independently without support of outside agencies.

I have also been sharing suggestions from residents. The biggest complaint after repeated flooding is shutting down the roads earlier. The other is cars and vehicles creating wakes. Staff will continue to work on how we can achieve a balanced approach while not shutting down the areas prematurely allowing residents to access their homes.

Two months ago, we approved the purchase of 4 high water vehicles for emergency response. Last week we began building up our city’s arsenal. We ordered an additional high-water vehicle, eight portable pumps and two more vacuum trucks. The cost of just this equipment alone was budgeted for $780,000 dollars. Without the hard work of this commission to balance the budget and ensure we have robust reserves we would not be able to make these critical purchases.

We will continue to work on the plan which is still being analyzed. Once it is completed I will be able to share the other items that will be purchased and programs that will be implemented. I have already begun discussions with my contacts in Dade County about flood management. County Vice Mayor Beam Furr

In other business, I along with Dr. Earle and City Attorney Moreno will be sending a special letter to all trailer parks to inform owners of their landowners and management responsibility for flooding. There was so much miscommunication going around about who was even overseeing some parks.

In general, all private property owners need to maintain and clean their drains. Drains on private properties are not all linked to our systems, and many are simply French drains. French drains are dependent on the absorption of rainwater. They are just like gravity systems and are becoming ineffective. They must be pumped out and cleaned at least annually. While we are in the midst of Hurricane Season, we will continue to remain vigilant!

Linguine With Zucchini Carbonara

Prep time: 5 minutes

Cook time: 10 minutes

Servings: 8

• 5 Egg Yolks

• 1 Cup of Pecorino Romano Cheese, grated, divided

• 1/2 Cup of Milk

• Salt, to taste

• 1 Tablespoon of Extra-Virgin Olive Oil

• 1 Medium Zucchini, julienned

• 1 Box of Barilla Linguine

• 1 Tablespoon of Fresh Mint, chopped

• Black Pepper, to taste

Bring a large pot of water to boil.

In a bowl, mix the Egg Yolks, 1/3 Cup of the Pecorino Romano Cheese and the Milk. Season it with the Salt, to taste and set it aside.

In a large skillet, heat the Olive Oil and cook the Zucchini.

Cook the Pasta according to the package’s directions. Reserve a 1/2 cup of the cooking water.

Mix the Pasta in a pan with the Zucchini. Add the Egg Yolk Mixture and 2 Tablespoons of the cooking water and combine it well.

Add remaining the Cheese and the Mint; mix. Season with the Salt and the Pepper, to taste.
