Running a residential Owners Association in Florida is a business, not a social function.
Condominium and Homeowners
Associations are corporations structured similarly to wellknown public and private companies in which the Board of Directors has specific responsibilities and obligations. Your Board is an elected group of owners responsible for making decisions which protect the interests of the Association as a whole.
Holding such a position of trust and responsibility requires specialized education and training in order to competently fulfill the duties attached to being a Director of the Association.

• 1/2 teaspoon garlic powder
• 1 heavy pinch dried dill
• 1/2 cup hot sauce
• 2 green onions, chopped

Heat oven to 400 F.
In bowl, mix shredded chicken, cream cheese, sour cream, 1 1/2 cups shredded cheese, onion powder, garlic powder and dried dill until combined. Add hot sauce; mix until combined. Transfer mixture from bowl to oven-safe dish. Top with addi tional shredded cheese, to taste. Bake until cheese is melted, approximately 15 minutes. Top with blue cheese crumbles and chopped green onion. Serve warm with chips and vegetable sticks.

• 1 pound ground beef
• 1 package (1 ounce) taco seasoning
• 1/4 cup water
• 2 tablespoons minced cilantro
• 1 can (16 ounces) refried beans, zesty salsa flavor
• 1 jar (16 ounces) thick and chunky salsa, medium or hot
• 2 cups guacamole
• 1/2 cup sour cream
• 3 packages (5 ounces each) Fresh Express
Butter Supreme
• 1 1/2 cups shredded sharp cheddar cheese
• 1 cup tomatoes, chopped
• 1 can (2 1/4 ounces) sliced black olives, drained
• 1 package (14 ounces) tortilla chips
In skillet over medium-high heat, cook beef 5 minutes, or until no longer pink. Sprinkle with taco seasoning; mix well. Add water; cook 2 minutes, or until water is absorbed. Transfer to bowl; cool to room temperature. Add cilantro; mix well.
In 9-inch pie plate, evenly spread
refried beans; top with seasoned ground beef and salsa. Add spoonfuls of guacamole across top of salsa then carefully spread to smooth. Place sour cream in small resealable bag; cut off corner. Pipe sour cream to create football shape on guacamole. Put pie plate in center of 15by-18-inch tray. Arrange salad blend around pie plate. Top with cheddar cheese, tomatoes and olives. Coat both sides of wings in flour mixture then evenly space among butter cubes on baking sheet. Bake wings 30 minutes. Turn wings over and bake 15 minutes, or until crispy and fully cooked. Serve with dipping sauces and sprinkle with fresh parsley, if desired.

In this way, under the guise of pseudobenevolence, the government has meted out this bureaucratic tyranny in such a way as to nullify the inalienable rights of the individual and limit our choices to those few that the government deems safe enough.
Yet limited choice is no choice at all. Likewise, regulated freedom is no freedom at all.
Indeed, as a study by the Cato Institute concludes, for the average American, freedom has declined generally over the past 20 years.
The overt signs of the despotism exercised by the increasingly authoritarian regime that passes itself off as the United States government (and its corporate partners in crime) are all around us.
Yet as egregious as these incursions on our rights may be, it’s the endless, petty tyrannies that illustrate so clearly the degree to which “we the people” are viewed as incapable of common sense, moral judgment, fairness, and intelligence, not to mention lacking a basic understanding of how to stay alive, raise a family, or be part of a functioning community.
When the dictates of petty bureaucrats carry greater weight than the individual rights of the citizenry, we’re in trouble, folks.
Federal and State Governments have used the law as a bludgeon to litigate, legislate and micromanage our lives through overregulation and overcriminalization.
Overregulation is just the other side of the coin to overcriminalization, that phenomenon in which everything is rendered illegal, and everyone becomes a lawbreaker.
Yet while there are endless ways for the Nanny State to micromanage our lives, things become truly ominous when the government adopts mechanisms enabling it to monitor us for violations in order to enforce its many laws.
Nanny State, meet the all-seeing, allknowing Surveillance State and its sidekick, the muscle-flexing Police State.
You see, in an age of overcriminalization—when the law is wielded like a hammer to force compliance to the government’s dictates, whatever they might be—you don’t have to do anything “wrong” to be fined, arrested or subjected to raids and
seizures and surveillance.
You just have to refuse to march in lockstep with the government.
This is the Police State’s superpower: empowered by the Nanny State, it has been vested with the authority to make our lives a bureaucratic hell.
Indeed, if you were unnerved by the rapid deterioration of privacy under the Surveillance State, prepare to be terrified by the surveillance matrix that will be ushered in by the Nanny State working in tandem with the Police State.
The groundwork laid with COVID-19 is a prologue to what will become the Police State’s conquest of a new, relatively uncharted, frontier: inner space, specifically, the inner workings (genetic, biological, biometric, mental, emotional) of the human race.
Consider how many more ways the government could “protect us” from ourselves under the guise of public health and safety.
For instance, under the guise of public health and safety, the government could use Mental Health Care as a pretext for targeting and locking up dissidents, activists and anyone unfortunate enough to be placed on a government watch list.
When combined with advances in mass surveillance technologies, artificial intelligence-powered programs that can track people by their biometrics and
behavior, Mental Health sensor data (tracked by wearable data and monitored by government agencies such as HARPA), threat assessments, behavioral sensing warnings, precrime initiatives, red flag gun laws, and Mental Health First-Aid programs aimed at training gatekeepers to identify who might pose a threat to public safety, these preemptive Mental Health Programs could well signal a tipping point in the government’s efforts to penalize those engaging in so-called “thought crimes.”
This is how it begins.
On a daily basis, Americans are already relinquishing the most intimate details of who we are in order to navigate an increasingly technologically-enabled world.
Having conditioned the population to the idea that being part of society is a privilege and not a right, such access could easily be predicated on Social Credit Scores, the worthiness of one’s political views, or the extent to which one is willing to comply with the government’s dictates, no matter what they might be.
We should all be leery and afraid.
All the government needs is proof of your law-breaking. They’ll get it, too.
Whether it’s through the use of surveillance software such as ShadowDragon that allows Police to watch people’s Social Media activity, or technology that uses a home’s WiFi router
and smart appliances to allow those on the outside to “see” throughout your home, it’s just a matter of time.
At a time when the government has a growing list—shared with fusion centers and Law Enforcement Agencies—of ideologies, behaviors, affiliations and other characteristics that could flag someone as suspicious and result in their being labeled potential enemies of the state, it won’t take much for any of us to be considered outlaws or terrorists.
In an age of overcriminalization, you’re already a criminal.
After all, the government likes to use the words “anti-government,” “extremist” and “terrorist” interchangeably.
As I make clear in my book Battlefield America: The War on the American People and in its fictional counterpart The Erik Blair Diaries, at some point, being an individualist will be considered as dangerous as being a terrorist.

candidates to compose a 1-page outline of their qualifications, previous experience, skills, and motivation for being part of Association leadership. Before the election is held, management sends these to all voting owners so they can get to know the candidates. At this point, potential Directors are not yet familiar with their: required fiduciary duty to all owners, obligation to oversee building and grounds maintenance, and administration of a corporation with a large annual budget and high-balance bank accounts.
It is NOT an easy job...and Directors do not get paid for their time or effort.
Florida’s Condominium Act (Florida Statutes Chapter 718) and Homeowners Association Act (Chapter 720) both require that each newly-elected or appointed Director “shall certify in writing to the secretary of the association that he or she has read the association’s declaration of (condominium or covenants), articles of incorporation, bylaws, and current written policies; that he or she will work to uphold such documents and policies to the best of his or her ability; and that he or she will faithfully discharge his or her fiduciary responsibility to the association’s members” within 90 days of being elected or appointed.
Both Acts go on to say: “In lieu of this written certification, within 90 days after being elected or appointed to the board, the newly elected or appointed director may submit a certificate of having satisfactorily completed the educational curriculum administered by a divisionapproved condominium education provider within 1 year before or 90 days after the date of election or appointment.”
Here are a few observations and discussion points on how the Florida Statutes address Director education:
• Under the “self-certification” method, it is unlikely that any incoming Board members are able to accurately interpret and apply what is written in COA or HOA Governing Documents. They can be notoriously confusing, even after reading them multiple times.
• Neither the Condominium Act nor the Homeowners Association Act requires new Board members who “self-certify” to read any parts of either Act, which are the highest levels of jurisdiction and regulation (State laws) over Florida residential Owners Associations. Both Acts only require new Directors to say they have read their own Association’s Governing Docs. (I am NOT making this up.)
• Directors’ self-certification statements and class attendance certificates become part of the Association’s Official Records, though it is very rare for anyone to ever follow up on whether they were received. The “penalty” for non-compliance (only determined after 90 days has elapsed) is limited to suspension from the Board only until a self-certification statement is given to the Board Secretary.
• Any self-certification or class completion certificate is good for as long as the Board member continues to be re-elected or unchallenged at term expiration, and wants to remain on the
Board. Since 2018, the term limit for COA Directors stands at 8 consecutive years. There is no term limit for HOA Board members. (Yes, really)
• There is NO requirement for re-certification or Continuing Education at any time during a Director’s term in office for either a Condo or HOA.
• Florida’s statutory Board “education” requirements are embarrassingly insufficient. Association Directors oversee financial accounts containing hundreds of thousands of dollars in owners’ money, are responsible for maintaining the Association’s common elements and areas, and must adhere to State laws and the Governing Docs at all times. Sitting through a 2-hour class (or just signing a paper saying they read something) is just the start of preparing new Board members to make decisions that affect all owners in the building or community.
Without properly guided initial education, newly-elected Board members don’t know what they don’t know. How can interested owners prepare themselves to be competent, effective Association Directors?
• Do NOT even think about “self-certification.”
Trying to read through your Association’s Governing Docs on your own will raise countless unanswered questions, frustrating you even further. Current Board members, Property Managers, real estate agents, pickleball partners, or other owners CANNOT explain Association Governing Docs to you. Only Florida-licensed attorneys can interpret and explain Florida legal documents to others. (Yes, Governing Docs are legal documents.)
• Before running for a Board seat, attend a Director certification class offered for free by quite a few very good law firms throughout Florida. They are presented in person and via Zoom. The attorneys teaching these classes are specialists in Condominium and Planned Development (HOA) Law, classes last about 2 hours, there is time for questions at the end, and you will receive a completion certificate along with a written class outline. (Be sure to list the class completion on your candidate qualifications sheet mentioned above.)
• Wherever you are in Florida, if you would like a referral to an attorney-conducted Board certification class, send me an email. I am not affiliated with any law firms, though do communicate regularly with many of them.
• After you take the initial class and are elected to the Board, pursue your own Continuing Education even though it is not required. There is always new information about Florida COA and HOA governance. Stay in touch with the law firm who presented your initial certification class and sign up for their newsletters on COA and HOA issues.
When you actually know what you are doing, this Director job gets MUCH easier!
Regrettably, ongoing education for Association Directors is NOT required by Florida Statute. In my opinion, this is one of the more disturbing omissions in our State’s Condo and HOA laws. There is the potential for Directors to remain in office for 8 years (in a COA) or even longer (in an HOA) without ever attending a refresher class or being aware of new legislation. This circumstance inevitably leads to “stale” and inefficient administration.
Remember - Continuing Education for Board members is FREE, just like the ini-
tial certification classes. There is no excuse for Directors not to continue learning while they serve on the Board.
Many of us involved with Association governance topics in Florida are still trying to have State Representatives and Senators address some of the weaker spots in the Condominium and Homeowners Acts, one of which is Mandatory Board Member Education.
We would like to see mandatory initial and continuing Board education classes be made part of the Florida Statutes, and “self-certification” removed completely as an option. As stated at the top of this article, the huge majority of problems that occur within COAs and HOAs are preventable through competent, informed administration. FAR too many Directors (both newly-elected and experienced) still try to wing it.
Today’s article has been a collection of discussion points urging owners and Directors to address the business of running their Associations and be more aware of the need for proper Board member education, both initial and continuing. As the seasons change from summer to fall and families spend more time inside, the Jewish community of South Florida will celebrate the annual holiday of Sukkot by heading outdoors. Sukkot, also known as the holiday of booths, began this year at sundown on Friday, September 29th and will conclude on the evening of Friday, October 6th. The two day holiday of Shemini Atzeret and Simchat Torah immediately follows Sukkot, beginning the evening of Saturday, October 7th and ending on Sunday, October 8th.
During Sukkot, we remember G-d’s kindness to us during our journey through the desert by dwelling in a sukkah--a hut of temporary construction with a roof covering of branches--for the duration of the Sukkot festival. For seven days and nights, we eat all our meals in the sukkah and otherwise regard it as our home. The temporary booths emphasize how the world and the Jewish people rely on G-d’s protection. Eating under the stars allows us to truly thank G-d and see the blessings that surround us. Sukkot is a wonderful way for us to continue celebrating and connecting with our Judaism after the High Holidays.
Another unique holiday practice is the gathering of four different species. The taking of the Four Kinds: an Etrog (a rare citrus fruit, originally from Italy, but now also commonly grown in Morocco & Israel), a Lulav (palm frond), Hadassim (myrtles) and Aravot (willows), tied together with Lulav leafs. Chabad Houses and many synagogues throughout Florida will be available to help each family plan a sukkah during the weeks leading up to the start of the holiday. They will also all be equipped with a Lulav & Etrog set for anyone to use, free of charge. Many Chabads will also have available Etrog and Lulav sets for you to order, as it is preferable to actually own your own set. They will be offering guidance and classes for all community members interested in learning more about the holiday.
Drawing from the gravity of Rosh Hashanah and Yom Kippur, Sukkot gives us the chance to celebrate the sweetness of nature and to thank G-d for His protection. Sukkot touches all five senses: the sweet smell of the Etrog, the feel of the palm branch and twigs in your hand, the sights and sounds of the sukkah around us and the taste of the festival’s feasts.
Sukkot, referred to as the holiday of rejoicing, comes just five days after Yom Kippur, the day of atonement. The group of four plants, including the Etrog fruit, are replete with symbolic meaning, including the fall harvest and gathering season, and the unity of the Jewish people.

Participates in High Visibility Enforcement Campaign

Miami-Dade County ranks in the top 25 counties in Florida for traffic crashes resulting in serious and fatal injuries to pedestrians and bicyclists. To help reverse this trend, the Sunny Isles Beach Police Department is participating in the Florida Department of Transportation High Visibility Enforcement (HVE) Program aimed at educating motorists, bicyclists, and pedestrians on Florida’s traffic laws to improve safety on our roads.
Starting this month through May 2024 the Sunny Isles Beach Police Department will have additional officers on patrol at specific corridors with a high occurrence of pedestrians and bicyclists’ crashes. Special attention will be directed towards increasing awareness of the dangerous behaviors that are contributing to serious and fatal injuries at these locations. Officers will look for drivers speeding, failing to stop for pedestrians in crosswalks, conducting improper turns or signal violations, and using hand-held devices while driving.
Officers also will watch for pedestrians who cross the street illegally or fail to yield to motorists who have right-of-way. Bicyclists will be stopped for riding against traffic, riding at night without lights or not abiding by the same laws as motor vehicles. Officers will issue warnings and citations only when appropriate.
“Whether you are on foot, behind the wheel, or on a bike, you have a responsibility to share the road safely,” said Chief Edward Santiago. “Understanding the rules of the road helps ensure we all arrive at our destination safely and makes our streets safer for everyone.”
Funding for this program is provided through a contract with University of North Florida’s Institute of Police Technology and Management (IPTM) funded by the Florida Department of Transportation. The Sunny Isles Beach Police Department will receive funds for overtime hours for officers to conduct operations and for special training on Florida’s bicycle and pedestrian laws, procedures and best practices.
To keep the public safe, the Sunny Isles Beach PD offers the following tips when biking, driving or walking:
• Drivers: obey speed limits, never drive impaired, and always watch for pedestrians and bicyclists
• Bicyclists: obey traffic laws, ride in the direction of traffic, and use lights when riding at night
• Pedestrians: cross in crosswalks or at intersections, obey pedestrian signals, and make sure you are visible to drivers when walking at night
The Florida Department of Transportation (FDOT) developed Florida’s Bicycle/ Pedestrian Focused Initiative in 2011 to lead all efforts to improve pedestrian and bicycle safety in the state. The public education campaign was branded “Alert Today Florida.” The goal of this initiative is to eliminate traffic crashes on Florida’s roads that result in serious or fatal injuries to pedestrians and bicyclists. Objectives include advancing data collection, analysis, and evaluation to guide the implementation of comprehensive safety strategies directed towards areas with the highest representation of traffic crashes resulting in serious or fatal injuries to pedestrians and bicyclists.

The Price Of Paradise Keeping Sunny Isles Beach Mosquito-Free
As the sun graces the skies and temperatures rise, summer in Sunny Isles Beach is a little bit of paradise which brings joy to residents and tourists alike. However, paradise comes with a cost, with the warmth also comes an unwelcome guest – mosquitoes. These buzzing insects can put a damper on outdoor activities and, more importantly, pose health risks. But fret not, because the City of Sunny Isles Beach is taking proactive measures to combat these pesky intruders.
When summer arrives, so does peak mosquito season. The City of Sunny Isles Beach has an arsenal of mosquito mitigation efforts in place to ensure that residents and visitors can enjoy the outdoors without being constantly swarmed by mosquitoes.
Regular Inspections and Code Compliance
One of the cornerstones of the city’s mosquito control strategy is regular inspections by the Building and Code Compliance departments. These diligent teams routinely check properties for standing water, which is a prime breeding ground for mosquitoes. Any violations of the city’s code regarding standing water are promptly addressed.
In cases where compliance isn’t immediately achievable, the city takes swift action to treat the affected areas, preventing mosquito breeding and keeping the population in check.
The city doesn’t stop at inspections; it also employs comprehensive mosquito treatments throughout Sunny Isles Beach. This includes treating stormwater retention areas and drainage
catch basins, effectively blocking mosquitoes from breeding. Additionally, parks and beaches receive regular mosquito control treatments to ensure outdoor spaces remain pleasant and mosquito-free. The city contracts with a licensed and environmentally-friendly mosquito control company, ensuring that these treatments are both effective and eco-conscious.
Treatment Schedule
To ensure maximum effectiveness, the city has established a treatment schedule. Bi-weekly mosquito control treatments take place on Tuesdays, starting at 8:30 AM. These treatments typically last 5-6 hours and cover all public roads, moving at a leisurely 5 mph pace. Here are the upcoming treatment dates:

The products employed in mosquito control are crucial for ensuring effectiveness while minimizing environmental impact. In the case of city streets, the primary product in use is Merus Adulticide. This solution is OMRI Listed and meets USDA standards for organic mosquito control. It utilizes natural pyrethrins and is compatible with organic farming practices.
For city parks, Talak 7.9% is the product of choice. This water-based formula provides lasting protection from insects without harmful odors or solvents, making it ideal for use in public recreational spaces.
While the city’s efforts are commendable, residents and visitors can also play a vital role in mosquito control. Following the recommendations of the Florida Department of Health’s “Drain and Cover” Program is an excellent starting point. This program encourages individuals to: Drain standing water wherever it accumulates around their homes, Cover bare skin with clothing and repellent when outdoors, and Cover doors and windows with screens to prevent mosquitoes from entering indoor spaces. If you encounter standing water that hasn’t been addressed within 24 hours, don’t hesitate to report it to the Code Compliance Department. Stay The Course: The Hallandale Beach Budget Has Passed
Our City Budget passed last week 4-1. There were no changes to the Budget at this time with the unified message we will stay the course with our strategic stabili zation plan. As I wrote last week our Budget is a blueprint for the coming year and the strategic plan is a five-year plan. While we are doing great at this time, there is no crystal ball of what will happen with outside economic factors. The super majority agreed to remain cautiously opti mistic and safe rather than sorry. There is a commitment to the plan which includes a reduction of the Millage Rate in the next Budget Cycle.
During the Budget Hearing, we once again had a robust debate due to the fact that we do have Reserves. While we do have Reserves and have a Balanced Budget including much needed Infrastructure Improvements, Programs for Vehicle Replacement, Park Maintenance, Replacement of Water Meters, and many other items the question was to give a lit tle back. I also empathize with those struggling. I feel it important to share a Statewide Tax Program that many resi dents are unaware of over and above the Regular Deductions.
Our State has a Tax Deferment Program available to any Homestead Resident where their Income does not keep up with living costs. It is based on a formula which looks at Income and age. The program is available to anyone through the Property Appraiser’s Office. It allows Owners to not pay Property Taxes until the Sale or Transfer of your Property. There is an Interest Rate Fee that fluctuates with Current Market Conditions. I also discussed that we are not a corporation. There still is this mind set that we can do the same things that private companies do to cut costs, provide various changes to how we reward our employees and provide services. While we all share the mutual goal to run like a business, cutting where we can and streamlining services, we simply are not a private company. More importantly, we do not provide the service of a typical corporation.
We are bound by State Laws and requirements that handcuff the ability to do many things. There are requirements of what services we must provide. There are requirements when it comes to contracting with companies to provide Special
Services. There are requirements for purchasing all products. There are Special Budgeting, Reporting, and Auditing requirements much different than a typical business. This can seem very frustrating for those outside of government. These rules are in place for good reasons. Tax dollars are not ours. As Elected Officials they are entrusted to us. The rules govern the spending of Tax Dollars and what services we MUST provide. When people do question how slowly the government operates this is the main reason. Checks and Balances. The same is with Building and Fire Codes; they are all State Laws.
As Elected Officials we can look at rules and Lobby to make changes. State Statutes that have been in place are very difficult to change. As a matter of fact, there are more new Laws being created that make our ability to govern and do our jobs even harder. This is referred to as the “erosion of home rule authority.” Good examples of recently Enacted Laws that have residents up in arms are the inability to ban vacation rentals and another allowing businesses to operate in residen-
tial areas. More residents need to reach out to our State Legislators and share their views on the Laws that impact them here in the local areas.
I have written, this year will be the year of the shovel. Many projects have already started. The Three Islands Reuse Project is underway. Drainage and Pumping Stations are finally on schedule. These were delayed due to a Supply Chain Issue. Staff has reported that thankfully there seems to be better access. This may change due to many other cities now in the planning stages of Infrastructure Improvements. We are ahead of the curve with shovel ready projects. We have received notice that Broward County will begin Beach Renourishment Segment III this year, on November 1st. This will be implemented with a truck fill process of over 300,000 cubic feet. While this is great news it will impact some access points. They have already started to mobilize fencing and staging of an area of our South Beach Park. remain open but please mind the flag personnel as to remain away from designated areas.
In addition to adding much needed sand there will be an additional Project to enhance our North Beach Sand Dunes. This Project is currently being designed. The goal is to Remove ALL Invasive Species, Replant Sea Grass and reestablish the fencing around our Dune.
As we start this new era in our City, please pardon our dust. We understand there will be road delays and inconvenience during these Projects. The impacts will be temporary, but improvements will be a great step in ensuring our residents, business owners and visitors have Dependable and Resilient Infrastructure!
