Florida property owners agree to have local real estate licensees list and offer their houses and condos for sale to the public. While reviewing their Listing Agreements, just about all of them notice that the relationship between seller and Broker has been designated as “Transaction,” which is the default brokerage relationship in Florida unless another is agreed to in writing. Listing licensees explain to sellers that in residential sales, the Transaction Broker relationship is a limited form of representation in which a real estate salesperson can assist the seller, the buyer, or both by having all parties give up their rights to that agent’s undivided loyalty. A real estate licensee working under a Transaction Broker relationship does not represent either a seller or a buyer in a fiduciary capacity. Florida’s Transaction Broker relationship is described in Florida Statutes Chapter 475, Section 278 (http://www.leg.state.fl.us/ Statutes/index.cfm?App_mode= Display_Statute&URL=04000499/0475/Sections/ 0475.278.html).

Unless another form of representation (Single Agent or No Brokerage) is specified by separate written disclosure, a Transaction Broker relationship is established between a seller and a listing licensee’s Broker when the Listing Agreement is signed, long before the property is even offered to potential buyers.
In Florida, all relationship agreements for residential real estate services are between a seller or buyer (principal) and the office’s Broker, NOT the individual licensee (usually a Sales Associate) who will be directly interacting with the seller or buyer. Any form of brokerage relationship (Transaction, Single Agent, or No Brokerage) applies to all individuals whose licenses are attached to that Broker and office. Brokers who manage offices and supervise Sales Associates call Transaction Brokerage a “non-agency” relationship.
A Transaction Broker relationship does not require separate written disclosure to principals in order to apply. All relationships between Brokers and sellers/buyers in Florida are automatically Transaction
FPL Engineer Chases Gold at the 2024 Paris Olympics
Every day after work, Alonzo Russell trains for the Olympics at Joseph C. Carter Park. When he clocks out of his job as a service planner for Florida Power & Light Company (FPL), where he engineers and designs solutions for the community to receive power, he swaps his steel-toed boots for sprinting shoes – in pursuit of a gold medal.
The two-time Olympic sprinter begins his daily four-hour workout at the park’s track, crouched at the starting block, with his fingertips delicately grazing the line where the red track and white line meet. Every muscle in his body is coiled like a spring ready to propel him forward. He mentally prepares like he does before every 400-meter race in the Olympic Games.
“I just take a deep breath and walk through the race in my mind before it hap pens. So while I’m running the race, it’s almost like I’ve already done it,” Russell explains. “As I’m in the blocks, I’m also just thinking about all the pain I’m about to endure.”
Russell’s journey to the Olympics began in his homeland, the Bahamas, in the town of Hunter just southwest of the islands’ largest city, Freeport City.
(see the above link) establishes Transaction Brokerage as the default relationship:
“ b) Presumption of transaction brokerage. — It shall be presumed that all licensees are operating as transaction brokers unless a single agent or no brokerage relationship is established, in writing, with a customer.”
A Single Agent relationship includes the fiduciary duties of Loyalty, Obedience, and Confidentiality, while a Transaction Broker relationship does not. Transaction brokerage is non-fiduciary and involves “Limited Confidentiality,” which is a confusing concept to many sellers, buyers, and even real estate licensees. Florida Statute 475.278 (link above) describes and attempts to define Limited Confidentiality.
Listing Agreements indicating (or defaulting to) Transaction Brokerage establish the relationship with sellers. However, if buyers have not signed a Single Agent or No Brokerage agreement with their real estate licensee’s Broker, Transaction Brokerage status automatically extends to their representation relationship.
(Important - The use of written Buyer Broker Agreements now required under the recent and widely-publicized NAR lawsuit settlement will establish licensees’ and Brokers’ relationships with buyers. The new requirement becomes effective between August 1 and August 17, depending on the local MLS. Look for my article on the practical application of NAR settlement terms next month.)
Local real estate Boards refer to Transaction Broker limited representation
and referring both sides to attorneys or title companies for closing. Under a Transaction Broker relationship, buyers and sellers are referred to as customers, not clients.
Transaction Sales Associates are expected to provide marketing services and property/market information in order for sellers and buyers to make decisions on their own. Providing negotiation suggestions and/or advice may be interpreted as over-stepping the limitations of a Transaction Broker relationship.
When Transaction Sales Associates give sellers or buyers advice or opinions about whether an offered price is too low, whether or not to counter with different terms or price, or which side should pay for certain negotiable items, they may be violating the limits of their Transaction Brokerage relationships.
This could be interpreted as implied agency and is the basis for many misunderstandings (and sometimes lawsuits) between buyers, sellers, and Sales Associates and their Brokers. Even when one Transaction Sales Associate handles the seller side, and a different one handles the buyer side, both of them are there as neutral parties to facilitate the transaction and assist (not advise) both the buyer and the seller.
Either one may be creating implied agency by not adhering to the limitations of Florida’s Transaction Brokerage relationship.
Transaction licensees can be viewed as neutral third parties helping both buyer and seller navigate a Florida real estate deal.
Real estate attorneys tell us that han-
dling sales and purchases under Transaction Broker relationships reduces potential liability on Brokers, offices, and companies for individual licensee errors and omissions. The majority of real estate Sales Associates in Florida operate as non-employee independent contractors to the companies where their licenses are attached.
Speak with a Florida-licensed real estate attorney for details and application on agency relationships and implied agency. Being the default real estate brokerage relationship in Florida since 2003, Transaction Brokerage is valid, accepted, and works adequately when properly adhered to, then competently and ethically applied in actual practice. Issues and misunderstandings arise when one side (seller or buyer) feels that their interests have not been looked after or protected as well as they assumed or expected. When interviewing real estate Sales Associates to handle your side of an upcoming deal, be sure to have each one discuss Florida’s Transaction Broker, Single Agent, and No Broker relationships with you. Depending on how you would like your interests addressed, you should know the differences and have the opportunity to ask questions. Do you prefer to be a customer or a client?

Consider the following a much-needed reality check, an antidote if you will, against an overdose of overhyped campaign announcements, lofty electoral promises and meaningless patriotic sentiments that land us right back in the same prison cell.
FACT: According to a scientific study by Princeton researchers, the United States of America is not the democracy that it purports to be, but rather an oligarchy, in which “economic elites and organized groups representing business interests have substantial independent impacts on U.S. government policy.”
FACT: Despite the fact that the number of violent crimes in the country is down substantially, the lowest rate in sixty years, the number of Americans being jailed for nonviolent crimes such as driving with a suspended license continues to skyrocket.
FACT: Thanks to an overabundance of 4,500-plus federal crimes and 400,000plus rules and regulations, it is estimated that the average American actually commits three felonies a day without knowing it. In fact, according to Law Professor John Baker, “There is no one in the United States over the age of 18 who cannot be
indicted for some federal crime. That is not an exaggeration.”
FACT: Despite the fact that we have 38 million Americans living at or below the poverty line, 13 million children living in households without adequate access to food, and 1.2 million veterans relying on Food Stamps, enormous sums of taxpayer money continue to be doled out on wasteful programs that do little to improve the plight of those in need.
FACT: Since 2001 Americans have spent $93 Million every hour for the total cost of the nation’s so-called War On Terror.
FACT: It is estimated that 5 million children in the United States have had at least one parent in prison, whether it be a local jail or a state or federal penitentiary, due to a wide range of factors ranging from overcriminalization and surprise raids at family homes to roadside traffic stops.
FACT: At least 400 to 500 innocent people are killed by police officers every year. Indeed, Americans are now eight times more likely to die in a police confrontation than they are to be killed by a terrorist. Americans are 110 times more likely to die of foodborne illness than in a terrorist attack. Police officers are more likely to be struck by lightning than be made financially liable for their wrongdoing.
FACT: On an average day in America, over 100 Americans have their homes raided by SWAT Teams. Most of those SWAT Team Raids are for a mere warrant
service. There has been a notable buildup in recent years of heavily armed SWAT Teams within non-security-related federal agencies such as the Department of Agriculture, the Railroad Retirement Board, the Tennessee Valley Authority, the Office of Personnel Management, the Consumer Product Safety Commission, the U.S. Fish and Wildlife Service, and the Education Department.
FACT: For all intents and purposes, we now have a fourth branch of government: the surveillance state. This fourth branch came into being without any electoral mandate or constitutional referendum, and yet it possesses superpowers, above and beyond those of any other government agency save the military. It is allknowing, all-seeing and all-powerful. It operates beyond the reach of the president, Congress and the courts, and it marches in lockstep with the corporate elite who really call the shots in Washington, DC.
FACT: Everything we do will eventually be connected to the Internet. By 2030 it is estimated there will be 100 trillion sensor devices connecting human electronic devices (cell phones, laptops, etc.) to the Internet. Much, if not all, of our electronic devices will be connected to Google, which openly works with government intelligence agencies. Virtually everything we do now—no matter how innocent—is being collected by the spying American police state.
FACT: Americans know virtually nothing about their history or how their govern-
ment works. In fact, according to a study by the National Constitution Center, 41 percent of Americans “are not aware that there are three branches of government, and 62 percent couldn’t name them; 33 percent couldn’t even name one.”
FACT: Only six out of every one hundred Americans know that they actually have a constitutional right to hold the government accountable for wrongdoing, as guaranteed by the right to petition clause of the First Amendment.
Perhaps the most troubling fact of all is this: we have handed over control of our government and our lives to faceless bureaucrats who view us as little more than cattle to be bred, branded, butchered and sold for profit.
As I make clear in my book Battlefield America: The War on the American People and in its fictional counterpart The Erik Blair Diaries, if there is to be any hope of restoring our freedoms and reclaiming control over our government, it will rest not with the politicians but with the people themselves. One thing is for sure: the reassurance ritual of voting is not going to advance freedom one iota.

Homeowners & Renters Can Apply For Any Losses Due To The Storm

As our residents continue to recover from the flood on June 12th, the Federal Government has finally stepped up and announced a much-needed relief program for residential properties. The program is being implemented by the Small Business Administration. Homeowners and renters can apply for any losses due to the storm to their property contents and even automobiles.
The program application period will be open only until August 30th. It is very important for individuals to apply as soon as possible. If you have insurance, you may apply. They are providing up to $500,000 to repair your home and up to $100,000 for contents. The Loan Rate will be 2.688 percent for Residential and 4 percent for Businesses.

Budget continued:
I have written about our current budget process Tax Rate a few articles back. I shared that we would be lowering our tax rate this year to 7.999 and there was a possibility it could be reduced further. There is good news that we will be able to reduce our rate to roll back to 7.729. The Rollback Rate I explained was the rate set to provide the same level revenue we collected in the previous year.
This means Homesteaded Properties will be seeing a reduction on their taxes. Non Homesteaded Properties depending on their Taxable Value may also be seeing a reduction.
Staff reviewed all the staffing levels in every department to see if positions that were not filled needed to remain in the
in August, we will be providing a report on our Fire Services. I have requested that an outside consultant evaluate the department and the level of services we provide. Fire and Emergency Services have continued to evolve over the years. I have discussed our BSO Contract over the years since, it did not increase the staffing levels and cost approximately more than $1 Million Dollars in costs than having our own department. There was value added in the ability to retain positions, expand training hours and inspection services. The move to the Florida Retirement System did also reduce pension costs. The audit’s information will provide a better basis and understanding of the true needs within our City as we enter BSO Contract negotiations.

Parents of College-Bound Students: How to Help Pay For School
(BPT) - The summer months before college begins are exciting, as everyone anticipates the journey ahead and the educational dreams of every parent and child become realized. It can also be a stressful time, however, as educational costs - plus many other expensesbecome a reality and quickly add up. A recent College Ave survey found that parents overwhelmingly believe in the importance of a college degree for their child’s future (89%), but also agree the costs of college are stressful and surprisingly high. In the survey, 67% of parents say the cost of room and board was much higher than expected, while 65% also find tuition and fees to be more than anticipated. Over half (55%) say they were surprised by the amount their family was expected to contribute when financial award letters arrived. Parents also mention spending more on things like electronics, transportation and dorm room essentials.
How parents and students are meeting the challenge
Because college is viewed as crucial to
their future, families use a combination of methods to fund their child’s education.
The first step in the college funding process is filling out the Free Application for Federal Student Aid (FAFSA), which can be completed online and will determine eligibility for financial assistance like grants, merit aid, work-study jobs and federal student loans.
While 3 out of 4 parents report setting aside money for their child’s college education, just over half were comfortable with their current level of savings. To cover financial gaps, families often use a mix of methods to pay. More than half (62%) say they are using scholarships and grants, 45% will borrow federal, private or parent student loans, and 17% say the parent will take on a side hustle or second job to help cover college costs.
Parents also report using strategies to save money such as placing emphasis on their child graduating within four years (56%) and working while in college (46%).
Most parents manage extra costs by using more of their income and savings, as well as having their child apply for stu-
dent loans and encouraging them to seek more scholarships.
