Career-Altering Accidents B

y very nature of the trucking business, it can be hard to avoid accidents altogether. Kudos to those drivers who manage to get through their careers with impressive safety records, but it isn’t always as easy as they may make it look. You may be the best driver in the world, but the fact is, you have to drive on public roads every day and there are a lot of drivers out there who aren’t as careful as you may be. Even a simple fender bender can turn making a living in the trucking business into a nightmare. A secure job can turn into the unemployment line if your employer deems it a safety violation that hurts their company’s reputation or their insurance rates. Preventable accidents are the ones that will haunt you when it comes to your career, so they are the ones

you need to avoid. Accidents are differentiated between preventable and non-preventable in order to fairly judge a driver’s and company’s safety record, and are often used to determine bonuses and other incentives. One or more preventable accidents on your record or in your employee file may prevent you from landing your dream job, or even lead to your dismissal from your current one. Should you have a preventable accident, however, it does not necessarily have to mean the end of your career. Ben Klassen was fired from his job after what was deemed a ‘preventable incident’. “I was in a customer’s yard where I had to back around a corner to the dock. The yard guy was waving me back, guiding me in. For some reason he forgot about the street

light back there and I ran it over.” Because Ben did not get out and look at the layout for himself multiple times as he was backing up, the company labeled it ‘preventable’ and it cost him the job he’d been at for five years. The repair bill, covered by insurance, was over $3,000. It took Ben eight months to convince another, much smaller carrier to hire him. If you are fired from a company due to an accident or other safety violation, you may have to rethink the type of trucking you do. Working locally — hauling dirt, rocks or gravel — may be one of your best options. It keeps you behind the wheel and gives you a chance to start rebuilding your safety record. The jobs available to a driver with a poor safety record will likely not pay

There may be something you can do to help reduce your rates and improve your record. Taking defensive driving courses and other remedial training may show potential employers that you are serious about getting back on track. A serious accident involving injury or death may not be as easy to recover from. In 1989, Carl

February 2013 Vanderhoof was in a serious accident. Although he was not deemed at fault in the crash, it nonetheless ended his driving career. “I still have the odd nightmare about it, almost a decade and a half later. I just can’t get it out of my head,” says Carl. The accident happened on a little traveled secondary highway near Grande Prairie, Alberta. A sedan carrying a mother and a child lost control on black ice and careened into the path of Carl’s long-nose Peterbilt. “There was no where to go, and no time to react. I wasn’t travelling fast because the highway was slick.” Both the mother and child were killed in the crash. Carl was left unharmed, protected by the weight and size of his semi. “I’ll never forget the look on that woman’s face. I could see it clearly just before the impact,” said Carl.

Delphi Signs Cooperaton Agreement Delphi Automotive (NYSE: DLPH), a leading global automotive supplier, and the Interdisciplinary Centre for Security, Reliability and Trust (SnT) of the University of Luxembourg have signed a fouryear agreement to cooperate on a joint research program involving electronic control systems for automotive applications. This is the first cooperation between Delphi and the SnT. The program, entitled ‘Cost-Effective Automated Testing of ECU-Software,’ initially includes two research projects. One is on

embedded software testing (model-based testing of Electronic Control Modules software) and the second focuses on embedded software safety (early verification of performance and timing properties of automotive software systems). “We are pleased to partner with the University of Luxembourg in these research projects that will enable us to improve the reliability of vehicles in the future,” said Steve Kiefer, president, Delphi Powertrain Systems. “The goal of this joint program is to speed up development of

Ensuring the safety and proper performance of ECUs is a major scientific and engineering endeavor. Delphi is a high-tech, global company that develops highly dependable systems and I look forward to many years of collaboration and technical advances,” said Prof. Lionel Briand, program director, SnT. Project intended to develop effective and efficient automated verification and validation technologies for ECU software systems. Modern vehicles are increasingly characterized by electronic control systems. The amount and the complexity of software used in the Electronic Control Units (ECUs) of today’s vehicles is rapidly increasing. As an example, today’s premium cars feature not less than 70 ECUs connected by more than five different bus systems. Driving forces of this growth are the new legislations on exhaust gas emission, the demand for reduced fuel consumption and faster time-to-market, and the rising customer expectations regarding comfort, dependability, and variety. To overcome some of these challenges, the automobile and ECU manufacturers have to rely on cost-effective techniques for verification and validation of their software systems. The research program led by Delphi and the SnT is intended to develop an effective and efficient automated verification and validation technologies for ECU software systems. With the signing of this agreement, Delphi becomes the 15th member to join the SnT Partnership Program. This program enables SnT and its corporate partners to develop research collaborations and new technologies. Research is conducted jointly in partnered projects where SnT and partners contribute know-how and resources to achieve common goals. Partners contribute to SnT at all levels: from a representation on the governing board, to operational support through the industrial advisory board, as well as by contributing resources to projects. b

The Disadvantages Of Tax Savings L

ast article I wrote about the tax savings gleaned from the per deum system, an estimated $8-10k per year. However, the super savings have significant drawbacks. I’ll try and overview the seven disadvantages in 800 words or less. Setup and maintenance cost There are incorporation costs, annual renewal fees plus 2-2½ times more work for an accountant (therefore higher account-

ing fees). Many Operators cut their setup costs by incorporating via the internet and maintaining it themselves, but it’s still a cost not born by the selfemployed. Additionally, there may be tax implications of selling your truck into the corporation (fixed by a section 85 rollover… talk to your accountant for particulars). Source Deductions are moneys in Trust 30-40% of Operators are still paying last year’s

taxes. Payments may not be popular with CRA but they do regularly allow it. However, when an operator uses the per deum system, taxes are remitted at source before the operator even receives anything (not the usual operator way of managing personal cash flow). This can be one of the most intimidating aspects of the system (changing your cash flow methods). The bottom line is, you have the same access to cash except it is trans-

ferred in various steps (actually MORE cash because of the tax savings). It takes anywhere from two to six months before the average person is comfortable with the changes. Bank Financing Using the per deum system will cause an average of $25k drop in T1 taxable income which means a probable large drop in borrowing power. Results may vary, depending on the lender of choice and how aggressive a borrower the operator may be. CPP under contributed According to national averages, CPP contributions will drop by something like 40%. For some this is an advantage but for others it’s a disadvantage (depending on what you believe about CPP). I’ve had some very interesting conversations with some drivers who are convinced that CPP is nothing more than a tax. They believe that by the time they retire there will be nothing. Their opinion is not shared by me. I think there will be something… but I may not be able to collect it until I’m 75. But regardless of

personal opinions it’s an impact that should be discussed. Some (if they are really concerned) voluntarily send in the “top up” to Revenue Canada. Disability issues A huge drop in income on line 150 of your T1 causes a huge drop in disability benefits if the unfortunate situation arises (without the appropriate coverage). Apparently (as I’ve been told) 95% of all disability policies are based on line 150 of your return. We strongly recommend all participants ensure using the 5% (make sure your provider knows the system). Complex The system is complicated. The income tax act is written by lawyers and accountants who designed it so those citizens who could afford the tax savings would be dependent on them. In my humble estimation only about 40% of operators will ever fully use the system due to its complexity, disadvantages, disinformation and unpopularity among some accountants. Training is absolutely essential for success. If you’re not satisfied with the level of training… either demand it or find someone who will meet the need. Possible CRA reassessment liability In my opinion reassessment liability is the most critical factor in the per deum system. Operators regularly ask their accountants/bookkeepers about “defending against CRA” or “standing behind you”, concepts that usually means one thing to one

party and another thing to the other. The bottom line is, when it comes to defending the per deum non-taxable benefit… who pays for the possible court costs? This simple question separates the “Dablers” from the committed service providers. Choose carefully, the best bet is finding someone who specializes in it, maybe even exclusively in it. The accountant must have a vested long term interest in the success of the system (not just success of their firm). The per deum requires a much closer relationship between the operator and accountant and the liability becomes much more of a joint venture than a professional burden (a statement of great debate in some circles). Not many accountants wish to accept additional work AND potential long term liability. MACK Pinnacle Challenges World’s Strongest Men Thirty of the world’s strongest men challenged 19,000 pounds of pure Mack power during the recent MET-Rx World’s Strongest Man 2012 competition. Pulling a MACK Pinnacle Axle Back model tractor was one of the qualifying events during the 35th annual competition conducted at the Commerce Casino and other locations throughout Los Angeles, Calif. The World’s Strongest Man competition, which aired on ESPN on Dec. 30, pitted men from 17 countries against each other, testing the limits of human strength and endurance through a se-

ries of extreme events. Competitors in the truck pull qualifier wore a harness connected to a rope and were required to pull the Pinnacle tractor more than 30 meters (32.8 yards) in the shortest amount of time. Hafpór Björnsson, of Iceland, won the qualifying round for the second year in a row, finishing in 26.93 seconds. New Bridge Between Windsor & Detroit By Mark Wolfe The construction industry is expected to receive a major economic boost in the coming years as a result of last summer’s governmental approval for the creation of a new bridge, border plazas, and access routes connecting the border between Windsor and Detroit. Known as the Detroit River International Crossing (DRIC), the

new bridge will be located approximately three kilometres west of the Ambassador Bridge. In addition to the DRIC project, the Herb Gray Parkway (formerly the Windsor-Essex Parkway) is currently under construction, and will connect Highway 401 to the new bridge. The entire project will cost $3.5 to $4 billion to complete. The new border crossing is ex-

pected to create 10,000 to 15,000 construction jobs in both Ontario and Michigan. Not only is this good news for the thousands of contractors, heavy equipment operators, and other industry professionals who will be hired to work on the project, it will also deliver major benefits to the trucking industry by creating a quicker and smoother artery for trade in and out

of Canada. But the building of the bridge will not be without its challenges. “From the construct-build perspective, this is a challenging project because we are not allowed, through the process of the environmental assessment, to put piers into the water,” says Mark Butler, spokesperson, Transport Canada, Windsor Gateway Project. As a result, construction professionals will need to find appropriate locations for the piers on land, plus an area that will be narrow enough to locate a span with the piers far enough apart. “The actual bridge itself will be built through a public-private partnership. The private sector concessionaire … would then go out and contract firms, and logically they

Page T-7 are going to be looking at local firms and local workers,” Butler says. “It’s going to be good for Windsor-Essex, Ontario, and Canada. They are going to be sourcing workers and products from both sides of the border.” Once all permits are approved, industry standards indicate that it will take approximately two years to finalize the bridge design through the RFQ/RFP process. Subsequently, it is estimated that construction will take four to five years to complete. However, construction of the Herb Gray Parkway has been progressing steadily since 2011. As of December 2012, approximately 4,100 project staff and subcontractor personnel from over 350 companies, agencies and organizations

completed the mandatory training required to work on the parkway, with 98 per cent of subcontracts and 90 per cent of major purchase orders awarded to local or partially local companies. Ongoing parkway projects include road construction, tunnel and bridge construction (including the pile driving necessary for support), utility and sewer relocation, drainage, and excavation to create the below-grade extension of Highway 401. Upon completion by the summer of 2015, the 11-kilometre parkway will ease the movement of goods and people to and from the Windsor/Detroit border, separate local and international traffic, and eliminate stop-and-go traffic in residential areas. b

The Truck Transportation And Equipment Freightliner Trucks Launches Cascadia MTO Provides Hours Of Service Relief Showcase Is Coming To Southern Alberta 113 Natural Gas Demonstrator Program During Idle No More Protests Southern Alberta’s transportation and construction industries finally have a trade show they can call their own. The Truck, Transportation and Equipment Showcase (TTE Show) will launch Thursday September 19 and Friday September 20, 2013 and will feature over 100 exhibitors and sponsors. Some 2,000 contractors from greater Calgary and southern Alberta are expected to attend the exhibition at the centrally located and historic Strathmore Stampede Grounds. Everything is going to be held under the big blue sky of this multiacre, outdoor venue less than 25 minutes east of Calgary. For exhibitors featuring hand tools and other services, the TTE will feature several tents for 10’x10’s as well as smaller spots for nonprofit associations and special interest groups. For bulk exhibits (larger than 400 square feet) that will feature the latest “iron” a variety of configurations from 20’x20’ to 40’x100’ will be on offer. A prominent feature of the annual TTE Show will be three active demo areas. At the recent American Trucking Associations’ Summit on Natural Gas in Trucking, Freightliner Trucks announced that it is now offering a customer demonstrator program for its all new Freightliner Cascadia 113 natural gas day cab. Five customer demonstrator tractors will be available in the United States and Canada to provide customers direct experience with Freightliner’s newest alternative fuel product. Equipped with the new Cummins Westport ISX12 G heavy-duty natural gas engine, the Allison 4000HS transmission, and 115 diesel gallon equivalent compressed natural gas (CNG) fuel tanks, the Cascadia 113 natural gas tractor is ideal for regional haul and less-than-truckload applications. The 12-liter ISX12 G natural gas engine is based on the Cummins ISX12 diesel heavy duty engine platform and will operate on either CNG or liquefied natural gas (LNG). It features ratings of 400 hp and 1,450 lb-ft torque, optional engine brake, and manual and automatic transmission capability. “Natural gas products can result in significant fuel cost savings, making it a smart choice for increasing profitability while benefitting the environment,” said TJ Reed, director, product

The Ontario Trucking Association is giving the Ministry of Transportation the thumbs up for applying the "Adverse Driving Conditions" provision of the Hours of Service Regulations to drivers impacted the by Idle No More events that took place across the province on January 16. Below is information specific to the directive sent out to MTO officers across the province late last evening to accommodate any drivers and carriers impacted by these events: This is to inform you that several “Idle No More” protests have resulted in Highway blockades across Ontario. These blockades have resulted in unforeseen delays for commercial motor vehicle traffic, some lasting up to several hours. Drivers of commercial motor vehicles who have been delayed in these blockades may utilize the increased driving times provided for in Section 15 of O/Reg 555/06 – Adverse Driving Conditions. Officers are reminded that these provisions provide for: Up to 2 additional hours of driving/on-duty time in the 13/14 hour day rules; Up to 2 additional hours of driving/on-duty time in the 13/14 hour workshift rules, provided the driver does not exceed the 16 hours elapsed time requirements; Up to 2 additional hours of driving/

on-duty time in both the 7 day - 70 hour cycle and the 14 day – 120 hour cycle. MTO has also requested OTA remind drivers and carriers who were required to use the adverse driving conditions provision that they document it in the remarks section of their daily log as required by the regulation. This notation will serve as a reminder to officers who may check hours of service compliance in the days or months to come. “MTO should be commended for their quick understanding of the situation facing trucking operations in many parts of the province yesterday and their willingness to work with the industry during this challenging time, while maintaining all compliance with the hours of service regulations,” said OTA president David Bradley. b

Alberta Makes Permits Available To Accommodate LNG Powered Vehicles AMTA has clinched a victory for Alberta fleets. Following months of discussion with the province, Alberta Transportation announced it will help make it easier for Alberta carriers to switch to liquefied natural gas (LNG) to power commercial vehicles. Alberta Transportation has told AMTA, effective immediately, carriers will be able to obtain overweight steer axle permits for the purpose of accommodating the extra weight of LNG fuel tanks. Permits are available from Alberta Transport’s Central Permit Office in Red Deer by calling 1-800-662-7138. “Many of our members are interested in switching to LNG power vehicles, but the extra weight of

the fuel tanks, which can be 1500 kgs heavier than conventional fuel tanks, erodes the amount of cargo commercial vehicles can carry,” says Don Wilson, AMTA’s executive director. “That was an impediment to using LNG. With this move, the province has paved the way to allowing LNG fuelled units to carry an equivalent maximum load compared to conventionally fuelled units.” AMTA is heartened by the province’s timely response to AMTA’s concern. “Just weeks ago, Alberta Transportation Minister Ric McIver toldAMTA that his ministry was reviewing our request and would respond soon,” says Wilson. GAO Recommends VMT Pilot Program The Government Accountability Office (GAO) released a report examining vehicle-miles-traveled (VMT) fees as an equitable and efficient alternative for long-term highway revenues. The report, “Pilot Program Could Help Determine the Viability of Mileage Fees for Certain Vehicles,” examined mileage fee initiatives in the United States, the consumer effect of the rates needed to adequately fund the Highway Trust Fund (HTF), and state departments of transportation (DOT) projections for future revenue demands. GAO found that privacy continues to be a concern and that collection costs associated with such fees

Manitoba’s Infrastructure Renewal Plan A Good Start The Manitoba Trucking Association is encouraged by the recent announcement by Manitoba that the focus for Manitoba Infrastructure and Transportation in 2013 will be bridges and roads, according to a recent release by Manitoba Infrastructure and Transportation Minister Steve Ashton. Some of the projects announced include work that has been identified by the Manitoba Trucking Association as a priority, including repairs to Highway 6 and upgrades to Highway 16. “We have been telling governments for years that an increasing and serous infrastructure deficit has been created and

will only continue to get worse unless it is properly addressed. While we are obviously pleased that the government is focusing its efforts on roads and bridges, the reality is that much of the work is simply rehabilitation projects on items that have been left to deteriorate for far too long,” explains MTA Executive Director Bob Dolyniuk. “Rather than being able to spend time and money on new projects, a significant number of the projects, especially bridges, are requirements simply to bring infrastructure up to an acceptable standard. Two organizations received the top grant of $100,000: • Clean Nova Scotia, based in Dartmouth, Nova Scotia for their project “Drive Wiser-Drive LessGet More”; • Credit Valley Conservation Foundation in Mississauga, Ontario for their project “Conservation Youth Corps”. “Clean Nova Scotia is incredibly excited to be a top grant recipient from Shell’s FuellingChange,” said Andrea MacDonald, Transportation Manager for Clean Nova Scotia. “Funds received will enable us to develop our new Drive Less initiative; encouraging Nova Scotians to discover sustainable transportation options available to them.”

FuellingChange winners come from across Canada. Other recipients include Edson & District Recycling Society in Edson, Alberta and NEAT Green Freight in Fort St. John, B.C. Since 2011 FuellingChange has invited Shell customers to vote on-line for pre-selected projects that restore, protect and enhance Canada’s land, air and water. All preselected projects receive $10,000 and those with the most votes are eligible to receive grants of $25,000, $50,000 or $100,000. Annually Shell grants $2 million to participating environmental projects in land, air and water. “FuellingChange allows our customers to have a say in the environmental projects we fund,” said Shell Canada’s President and Country Chair, Lorraine Mitchelmore. “Almost five million votes have been cast in less than two years and we’ve awarded close to $3 million in grants to environmental projects across Canada. I’d like to thank all the organizations for submitting their projects and our customers for voting.” b

Kirkland Lake Breaks Ground On Wastewater Treatment Plant The local economy is getting a boost in the Town of Kirkland Lake, where a new wastewater treatment plant is being built. This project includes building a new wastewater treatment facility next to the existing plant which will be decommissioned and converted into a pumping station to provide additional storm water capacity during peak flows. It is scheduled to be completed in spring 2014. “This new wastewater treatment plant will reduce pollution, protect the environment and create jobs here in Kirkland Lake,” said Jay Aspin, Member of Parliament for Nipissing-Timiskaming. “This is great news for the local economy. Our Govern-

ment is proud to invest in this project that will serve the needs of this growing community for decades to come.” “Ontario has made unprecedented investments in infrastructure to strengthen our communities, support local economies and create jobs,” said the Honourable Bob Chiarelli, Minister of Infrastructure. “The new wastewater treatment plant will protect the environment and improve the quality of life for residents of the Town of Kirkland Lake, now and in the future.” “The Town of Kirkland Lake thanks both levels of government for coming to the table with funding for the new wastewater treatment plant in our time of

need”, said Bill Enouy, Mayor of the Town of Kirkland Lake. “This new wastewater treatment plant is crucial for the town’s sustainability and growth.” The new plant will protect the environment by reducing the amount of wastewater entering local waterways, which will help to preserve the areas around Murdock Creek and Blanche River. It will also enable Kirkland Lake to meet federal and provincial wastewater regulations and ensure sufficient treatment capacity to support population growth over the next 20 years or more. The Government of Canada is providing up to $16 million toward eligible project costs through the Green Infrastructure Fund and the Province of Ontario is also contributing up to $16 million. The Town of Kirkland Lake will contribute the balance of the total estimated project cost of $35.48 million. b
