MINIMUM WAGE TO BE INCREASED By Vivian Tyson Come April next year minimum wage earners in the Turks and Caicos Islands should see a 25 percent increase in their pay cheques as Cabinet has taken the decision to raise the minimum wage from $5 (five dollars) per hour to $6.25 (Six dollars and twenty-five cents) per hour. A Cabinet report released on Friday November 21st, 2014 stated that the Dr. Rufus Ewing administration has agreed in principle to the increase and will invite views on the proposal to be submitted to the email address tciminimumwagereview2014@ gov.tc by December 31, 2014. When contacted by the SUN, Minister of Finance Hon. Washington Misick said that government was hoping to have a consumer price index established prior to the increase, but because there was a delay its establishment, decided that the wage raise could not wait. “By now we thought we would have had a consumer price index on which to peg the minimum wage. We still haven’t been able to produce the consumer price index. But we don’t want that to hold us back in increasing minimum

wage, because we believe that it is the right thing to do,” Misick said. He added: “And so, what we will be attempting to do, once the CPI (consumer price index) is ready, is to have another look at what it (minimum wage) should be, but we have not had a minimum wage increased in a while, so the intention is to increase the minimum wage by 25 percent.” The minister could not say at the time of the interview as to when he believed a consumer price index would be established, but from all indications, a rise in the minimum wage will come before consumer price index is set up. “I don’t know if the CPI will be ready for April (2015), but we believe that the consumer price index will probably indicate that possibly the minimum wage should be more than 25 percent - what we are suggesting now. But we feel confident that that is a reasonable increase,” the finance minister said. The former Chief Minister said that the increase should have negligible impact on businesses’ bottom line, since the majority of them are already paying above minimum wage.

She said that a number of measures that the government is seeking to push through now, proved difficult for them at the beginning of their tenure, as they cited constitutional hurdles as their excuse. However, she said no constitutional changes have been in place to establish these measures, yet government is now finding ways to implement them. “It is election time, and a lot of things that we have been fighting for, we expect the government to roll them out. And what the people of

the country need to be thinking; there is no constitutional amendment, there is no amendment to the Financial Regulations. And all of the things that we have been asking them for that they are now doing are happening outside of these changes. “For two years we have heard the government saying they can’t do this and they can’t do that because of the Constitution. The Constitution is still the same, and they are doing a lot of what we championed,” Cartwright-Robinson said.

Provisional liquidator appointed for insurance company BAFS

Connolly, who the court had earlier this year appointed as the administrator for BAFS, was assigned as the provisional liquidator for the company until January 9. He is tasked with the duty of securing a rescue package for the company, and if a package is not secured by that time, the court could call for a full liquidation of the entity. The FSC, after reviewing the financial condition of the company, recommended its liquidation. Katan represented the FSC during the proceedings. By Vivian Tyson The first hurdle in the Financial Services Commission’s (FSC) attempt to liquidate the financially hemorrhaging British Atlantic Financial Services (BAFS) has been cleared after Chief Justice Her Ladyship Margaret Ramsay-Hale appointed auditor Joseph Connolly of PriceWaterhouse as provisional liquidator, in the Supreme Court on Thursday (November 20, 2014). The ruling was made despite vociferous argument from attorney Richard Savory, who reasoned on behalf of a group of policy holders. Savory beseeched the court to defer a decision on the matter until sometime in January 2015, when he would be better able to present a more compelling argument, seeing that he was called into the ring belatedly and did not have time to prepare. Chief Justice Ramsay-Hale ruled that the company has until January 9, 2014, to secure a rescue package, and if one is not locked in by then, could order a winding up of the entity. Jonathan Katan of Miller Simons law firm, who represented the FSC, said that if the provisional liquidator believes that he needs sufficient time to secure a rescue package, he could always return to the court and apply for an extension. Katan, during the hearing, argued that BAFS was in serious financial problems with no clear sign of

it ever climbing from the financial hole any time soon. He said that a report from Wilbur Caley, former managing director of BAFS to the FSC, in May, 2013, painted a depressing picture of the company finances. He said however, that the FSC gave the company time to recover, which it never did, as every month its finances continued to plummet, and with no further capital injection being made. Katan said that according to Caley’s report, the asset of the company was $3.2 million, while the liability was $10.8 million, which amounts to a shortfall of $6.2 million. He said that BAFS has been racking up losses after losses, and the bleeding needed to stop. He said that Connolly, who was appointed as administrator for BAFS since March, 2014, has made the determination that the enterprise should wind up based on its insolvency problem, also emphasizing that such a decision was not taken by the FSC. Katan further argued that if a full winding up of the company was not granted, then a provisional liquidation should be arranged, since the provisional liquidator could begin to determine what possible route it could take to stem the financially bloodletting entity. He argued that since the FSC would be the first to be blamed in the event that a policy-holder were to make a claim and was told that there was no money to fulfill such request, a decision by the regulatory body to call for a managed winding up was

legitimate. Savory, who told the court that policy holders had been making request of him to represent their interest up to the night before the liquidation petition. And so, a delay in the matter until sometime in could allow him to properly prepare. He said up to Wednesday (November 19, 2014) approximately 35 policy-holders requested him to represent them. He argued that a delay in the matter would have no adverse bearing on the public since the entity is a private company with private policy holders. He said, too, that seeing that government was interested in saving the failing entity was all the more reason that a deferment would be necessary. He said policy-holders believe that they would suffer tremendous loss if the company were to go under at this stage, since many of them have been longstanding investors. He begged the judge for time to allow him the latitude of conducting more research on the matter, pointing to numerous reports of public outrage on the FSC lobbying for liquidation at this stage. He argued further that so far the company’s insolvency was only on paper and thereby should not be the determining factor for liquidation. Savory warned that a winding up could send the wrong signal to the outside world on the country’s financial image, since the BAFS liquidation happens almost on the heels of the TCI Bank liquidation. He told the court that at this stage the cost to keep the company running was minimal. Savory, said further that it was a bad idea when administrator took the decision to stop collecting from the clients, since a number of them were still willing to pay, seeing that they want to see the company staying afloat and their investments saved. He said that BAFS could have continued for another few months, arguing that if a full hearing was done, an actuary could be called to give expert assessment as to what options would be available to the company. He said that BAFS was not as far gone as it was made out to be, since it had the ability to make small debt payouts. Meanwhile, Katan argued that the administrator’s decision to stop collecting from clients was based on his assessment that their funds could become unrecoverable. He said that it was difficult to see how the company’s fortunes could change in the next three months, when it was not able to do so in almost a year. He said a delay could sound the death knell for the policy holders, some of whom already have no chance of redeeming their investments. BAFS has approximately 2,500 policy holders of varying kinds. It is unclear how many shareholders it has. Under a liquidation process, the policy holders would get a fraction of their payment, depending on the policy. In some cases they stand to lose everything. The shareholders, though, will not get anything back.

Premier says Government took economy from ruins to growth By Vivian Tyson

Premier Hon. Dr. Rufus Ewing said that his administration met ruins and a broken people when it came to office is late 2012, but as times went on his government has made significant changes to the point where the TCI is now reaping rick rewards. Making his ministerial contribution in the House of Assembly on Monday (November 17, 2014), Premier his government inherited a country that he said was broken in a variety of ways, including in spirit, financially and in hope for the future. He said that even before his party won the election, his team knew that its task to restore stretched far beyond economics. “We realized that our mandate was not merely the restoration of things measurable and tangible, but the restoration of national pride, the cultivation of the spirit of hope for our people for this generation and future generation. And as we set out compass towards progress with our future and destiny being nationhood,” he said. The premier reminded that he is mindful that no country has embarked

on the nationhood journey without sacrifice, noting that history has shown that those in leadership seeking independence for their nations face challenges of sacrifice and the Turks and Caicos will be no different. “Those in leadership, who are ultimately successful in the quest for self government, have had to face the challenge of difficult decisions. Like these other nations, during these times, we, too, are faced with such decisions, which may at times seem contrary to purpose, such as the payroll tax. Imagine what could have been if we had it. But with our eyes ever focused on our ultimate goals, we must remain steadfast and committed,” the premier noted. The premier said that while the era when blood was shed and lives lost for the sake of nationhood has seemingly past, his government remains resolute that it would use the tools available in today’s civil society to achieve that goal. “As we remember that no victory has never been won without a struggle, and no success achieved without a measure of discomfort, let us give

thanks that we did not live in those times past or in an environment where freedom and independence require the sacrifice of life and blood. “Be assured that this purpose, and the vision that I and my fellow elected members in government held before us, remain strong in our hearts today as it was two years ago when we came to office,” he said. The premier pointed out that government has made tremendous strides especially on the economic home front where it has taken from country from a state of bleeding to condition of healing. He said that before his government took office, investors were running to the hills, while the civil service was at its knees. But said his government has turned the situation around and has been making great improvements. “When my government took office, the economy of this country was in shambles. Austerity measures were the order of the day. The tools to rebuilding were lacking in a weakened civil service, and the rules for the conduct of business on a national level were stringent, giving rise to attrition

in investor confidence. “My government, the first order of business was the restoration of a state of positive economic growth and generation of sufficient government revenue to meet our numerous social and debt obligations, and I assure that after hearing the presentation from the minister of finance, you would say mission accomplished,” the premier said. The premier added: “As part of our commitment, we halted the implementation of Value Added Tax, with the assistance of our colleagues opposite, which, in our analysis, would have a detrimental impact on the economic growth in the short term and the long term of these islands. We instead implemented a number of short term taxation measures to bridge the fiscal gap. “A combination of this taxation strategy, a rebound in the global economy and in our efforts in tourism, has resulted in unprecedented growth in government revenue with real surpluses, especially during the course of this financial year, as communicated by the minister of finance earlier.”

Government crafts bill to bring back TC Invest In its quest to promote the creation of more local businesses in the Turks and Caicos Islands, government intends to take two bills to parliament which it hopes to get passed while seeking to establish a policy to undergird the development of such enterprises. Premier Hon. Dr. Rufus Ewing, while giving a wide-ranging interview to talk show host Dr. Conrad Howell, earlier this week on the Radio Turks and Caicos’ Expressions, said that his government aims to establish an enterprise support similar to that of the now defunct TC Invest. He said unlike TC Invest, this business agency would not carry a banking arm. “This will be a TC Invest-like agency that does not have the banking arm, but the one that really market, promote investment and developing both domestic and foreign investment in Turks and Caicos as well as to support small businesses development in the Turks and Caicos. “The funding has already been made available for the reestablishment of that agency. It will be supported by the MSME policy. Amanda Missick’s Contribution to Trail Without Jury Bill on November 17th, 2014 “Indeed, in a free Government, almost all other rights would become utterly worthless, if the Government possessed an uncontrollable power over the private fortune of every citizen”.

Minister of Environment and Home Affairs Hon. Amanda Missick Mr. Speaker, to be accused by the crown, charged by the crown, tried by the crown and judged by the crown is a gross representation of “uncontrollable power.” Mr. Speaker, even in the courts of the United Kingdom and Wales, the use of a trial without jury was first approved in 2009 and prescribed for three main uses in extreme situations where there is “real and present danger” to jurors and suspected jury tampering. That, despite Police protection there is suspected likelihood of interference and that is the only recourse in the interest of justice. The other use, Mr. Speaker, is in cases of domestic violence following the trial of the accused on sample counts in a jury case. The final instance, Mr. Speaker, is when the accused pleads guilty autrefois.

Mr. Speaker, in the prescribed instances mentioned, these followed either failed attempts or successful trials by jury. To deny citizens the right to a trial by jury is an infringement of their very rights and one that I cannot support. A jury trial is a legal proceeding in which members of the public are invited to listen and assist with the decision making or outcome of a trial. Jury trials date back to the 12th Century when Henry 2nd took a major step in developing the Jury Trial. Trial by Jury also became a fairly explicit right from as far back as 1215 as outlined in the magna carte signed by King John. By its very appearance, the presence of a jury gives the accused, as well as the community a sense of fairness and impartiality. To have a group drawn from your peers, one is more able to accept the verdict as these persons are drawn from the community in which one lives. A community, a country, a nation is made up of individuals: They come from all walks of life, they are all shapes and sizes, they come with different backgrounds and different experiences speaking a common language. They are representatives of the community and symbolize each and every one of us. They are not lawmakers, not professionals or experts in the field of law. They are common men who are expected to use a common sense approach to arrive at a just verdict. They are sworn to listen, to bring their collective wisdom and common sense to bear on the matter and they are charged to weigh the evidence and the facts and render a verdict. They are answerable to each other, to their conscience and they have to live in the community in which they have made that decision. The public has confidence in, and a willingness to trust, a jury trial as such a trial brings the power and expression of an entire citizenry to bear upon the administration of justice. To suggest that in some instances trials by jury cannot bring a fair judgement is to suggest that the citizens of the Turks and Caicos Islands are without integrity, void of the ability to absorb and comprehend details specific to that case with

impartiality. This Mr. Speaker, in my mind, bears insult to my people, to me, even, Mr. Speaker, to this Honourable House. But even if this were to be the case Mr. Speaker, in my mind’s wonderings, for a jury of many to have less integrity than a sole person in the role of a judge is unimaginable to me. I ask this honourable House to weigh that probability. To take away the opportunity for an individual to be heard and judged by a panel of their peers is to take away the rights, freedom and opportunities that should be available to all men in all democracies. This is injustice: undiluted; pure and simple! Trial without jury bears high degrees of prejudice and a higher likelihood of injustice with no opportunity of reasoning of the facts. A trial without jury, Mr. Speaker, was meant to be as recourse for failed jury trials, not as a punishing stick for those select few that the crown has prejudged to be guilty before having their day in court. Trial without jury Mr. Speaker, was brought into the laws of the Turks and Caicos Islands for a specific purpose, after the actions of individuals were brought into question, after the crown deemed they had reason to suspect those individuals, after, after, after, Mr. Speaker, and this tells me, that by this very fact, that the crafters and drafters of trial without jury, at least within the Turks and Caicos Islands, have motives that bear questioning, which lack the very integrity, impartiality and justice that they claim to be protecting. Mr. Speaker, members of this Honourable House, we have a duty to protect the rights and freedom of our citizens and to ensuring that we have a fair judicial system that provides fair opportunity for all tried within its laws. We have a duty to remove from our systems any instrument that does not promote the wellbeing of our people. Mr. Speaker as a citizen of these beautiful islands, as a leader and representative of my people, I must stand for integrity, I must stand for impartiality. I must stand for justice. I must stand, Mr. Speaker, for the repeal of the Trial without Jury Legislation.

It is the first time that the Tourist Board has held the franchise, and now we are able to say what the production team should look like; we can lean on the producers to bring standards to the competition,” Higgs said. Higgs said that the Tourist Board secured the franchise in a bid to raise the standard of the local pageant. “We pay a franchise fee to the Miss Universe Pageant every year. We took the decision some three years ago to rescue and hold the franchise, and for the first time, in many, many years that the country has been participating in the Miss Universe Pageant, we can now hold the producers of it to account,” he said. In the meantime, Higgs said that based on the expressions of interest already been shown by individuals and groups in the community, to take over the production of the event, the Tourist Board will have no problem signing a suitable candidate or set of candidates to move forward with the event next year.

“I am absolutely sure we will have no difficulty finding a person or a group of persons to be the producers of the pageant. And I think we have the right formula to attract capable persons to do so. “The country holds the franchise, we can set the standard, because, after all, Miss Turks and Caicos is an ambassador for the Turks and Caicos brand, and we want to make sure that we have the best system in place to select a Miss Turks and Caicos. “And then we want to be sure that once one is chosen that the whole system is in place to ensure that she is prepared to represent the country overseas. I think the standard has been raised. We have attracted some beautiful and beautiful Turks and Caicos Islanders and propelled them into the spotlight,” he said.

TCI delegation visits Haiti HE The Governor Peter Beckingham, Permanent Secretary Ministry of Border Control and Labour Clara Gardiner, and Deputy Commander (Marine Division) Inspector Warrican visited Port au Prince on 13 and 14 November at the invitation of the Haitian Ministry of Foreign Affairs. The working visit was to finalise a Memorandum of Understanding (MOU) between Haiti and the Turks and Caicos Islands and to discuss with the Haitian Government and other representatives in Port au Prince issues of common interest. “I am pleased to say that the Haitian

Members of the Haitian and TCI delegation Government have agreed the final text of an MOU,” commented the Governor. “This will be signed by representatives of the two Governments, after which we will release the text, and it will cover economic ties as well as illegal migration and people-to-people links.”

“The MOU will not suddenly change the relationship nor immediately reduce illegal migration,” the Governor continued, “but it is an indication of the seriousness with which both Governments view the growing relationship.”

The Ministry of Education, Youth, Sport and Library Services is once again inviting candidates to submit applications for its annual scholarship Program for studies beginning September 2015. Although the deadline for submission is April 30th 2015, the Secretariat is asking that interested applicants begin to consider their applications from very early and be guided by the information below. The Ministry advises that the National Scholarship Program is a government scholarship program aimed primarily at meeting the development needs of the Turks and Caicos Islands. As such the government has listed a number of priority areas for which it aims to address and for which consideration for scholarships will be aimed in the first instance. A list of priority areas along with the policy document and applications forms will be uploaded on www.gov.tc. All interested applicants are asked to visit this site for these relevant documents. Applicants are also advised that government can announce or reserve a block of funds for a particular area in any given year as it did with the area of Education for 2014. This is an indication of areas of importance for the country’s needs. INTERESTED APPLICANTS ARE TO BE GUIDED AS FOLLOWS: •Consideration will be given to applicants who have applied to schools in the United Kingdom and the Caribbean in particular the University of the West Indies. It is in these areas we are able to gain maximum economic efficiencies and ensure value for money. •Applicants wishing to study medicine: Our preferred school is the University of the West Indies. Our recent country contributing status will allow TCI’s students to qualify for fee discounts and so make it possible for more students to access tertiary level education. •Support for study for medicine in the US and other private instructions will not be considered. UWI and UK based schools are the institutions of choice. •Scholarships will not fund foundation programs, all applicants must have matriculated to the degree level. •All awards are up to Bachelors’ level. In some instances other levels may be considered but they are not awarded automatically. A separate application is needed for each level of study. •Applicants are asked to ensure that their University/College is either on the recommended list or are fully accredited schools. The list published is in no way an exhausted list. The Secretariat will conduct research to determine if your school is a fully accredited school. •There are a limited number of scholarships that will be awarded. Please note that not all applicants who apply for scholarships are guaranteed an award. The basic criteria will be used to make a judgment on who receives an award for study. •Given the limited awards, it is expected that some applicants may meet the criteria and still not be able to be granted an award. •Applicants are asked to begin to consider alternative sources of funding in the event that you do not win a full scholarship. •Ensure that you have applied to a University and can show at least a conditional acceptance to that school. •For students already on scholarships: Extensions to scholarships are not automatic. Extensions reduce the availability of funds for new scholarships. These will be considered in very extenuating circumstances. •The only automatic awards are those awarded to students named National Scholars. These are usually awarded two to three years prior the year of the uptake of the award. These students must also show proof of being accepted to a fully accredited University in the Caribbean or United Kingdom. •You must be a Belonger and show proof of this at the time of application. •Ensure that your application form is fully completed and that there is no missing information. •If you grade point average is below the acceptable level, we urge you to repeat some of your subjects or find means to improve your eligibility in this area. •There will be instances where you meet the eligibility criteria but do not win an award. The board is limited in the amount of scholarships and so will weigh each criterion and compare the quality of the applications to determine the successful candidate. •The National Secretariat Officers will commence their round of meetings for this year within the month of November to all High School and the Community College. They will also meet with guidance counselors so that they can support the applicants with their applications. •The Secretariat urges schools, guidance counselors, parents and caregivers to work with the young applicants when submitting their applications and help to guide them with career choices.

The Prosecution Did Not Prove its Case Against Rodney Adams by Royal S. Robinson

There were in the beginning, at least five charges of corruption being brought against Acting Deputy Commissioner Rodney Adams stemming from the incident of his making a tape recording of a person of interest in two shooting incidents. One of the incidents led to the shooting death of Kaziah Burke. The charges were brought using section 44 of the Integrity Commission Ordinance. After a number of legal maneuverings, only two of those charges were argued before a judge and a Jury of Mr. Adams’ peers. The Jury comprised five women and two men and the Foreperson ended up being a lady. COUNT ONE: ACT OF CORRUPTION: Contrary to Section 44(d) of the Integrity Commission Ordinance, Cap 109, namely, recklessly allowed his private interest to improperly influence his conduct in the performance of his duties as a public official. PARTICULARS OF OFFENCE That you Rodney Adams, on or about 22nd May 2013 in Providenciales, recklessly allowed your private interest in relation to your son Roderick Adams to improperly influence your conduct in the performance of your duties as the Acting Deputy Commissioner of Police in the Royal Turks and Caicos Police Force, by meeting with and recording a conversation with Dorrell Williams, a witness to the murder of Kaziah Burke on 13th April 2013. COUNT TWO: ACT OF CORRUPTION: Contrary to Section 44(h) of the Integrity Commission Ordinance, Cap 109, namely, interfered with

the performance of a duty of a public official with a view to recording a conversation with Dorrell Williams, a witness to the said murder, before he gave his statement to the Investigating Officers. Eventually, the prosecution addressed the Jury and to be truthful, I did not see the necessity of employing outside counsel for this case, save and except that it was another joy ride by foreign elements at our expense. A first year law student could have conducted the case. There were no particular points of law that needed to be expounded on that created the necessity to bring in such a person. It certainly begs the question as to why Ms JoAnn Meloche was hired in the first place, as the Director of Public Prosecutions in the face of opposition from both the Premier and Leader of the Opposition, as well as the Bar Council. The Chief Justice summed up to the jury the important ingredients of the both the prosecution’ and defense’s case and reminded the Jury that no matter what counsel on both sides said, the law belonged to her and the facts belonged to them. They went away properly instructed. They came back and asked for clarification on a particular point and then retired to continue their deliberations. Eventually, they came back with a unanimous verdict of not guilty! This episode should be a serious wake up call for Mr. Adams and many other Turks and Caicos Islanders, in that if the “green is being burnt, what about the dry?”

Anti-government protest in Haiti turns violent

Thousands of Haitians marched in the capital Port-au-Prince in protest at a delay in the country’s legislative and municipal elections. The polls are already years overdue and were scheduled for last Sunday. They were postponed because of an ongoing stalemate between the government and a group of opposition senators over an electoral law. The march began peacefully when a crowd grew to a few thousand people in slums that are opposition strongholds. But as demonstrators walked by an intersection in Delmas 32, the critics of President Michel Martelly’s administration and progovernment residents began shouting and throwing rocks at each other. As the melee quickly escalated, Associated Press journalists witnessed three people apparently getting hit by bullets. One was hit in the neck and appeared gravely wounded. The two others sustained wounds to limbs. As a panic ensued in the densely-packed area of cinderblock houses, officers with the Haitian National Police fired tear gas and most demonstrators dispersed. Police spokesman Frantz Lerebours and other authorities made no immediate comment about

the violence or any arrests. Even after the violence, nearly 1,000 protesters continued their Tuesday march demanding Martelly’s resignation and a chance to vote in long-delayed legislative and municipal elections. The president was supposed to call elections in 2011 for a majority of Senate seats, the entire Chamber of Deputies and local offices. But he hasn’t done so because the Senate has yet to approve an electoral law authorizing the vote. The Chamber of Deputies has approved the legislation, but it is being held up in the Senate by six senators who have blocked a vote, arguing it is unconstitutional and favors the government. Martelly administration officials blame the standoff on the six senators, insisting that the government wants to hold the elections but can’t because the lawmakers are blocking the vote by preventing a quorum. Haiti is the poorest country in the region and is still struggling to recover from a 2010 earthquake. Protesters lit piles of wood in the central neighbourhood of Bel Aire before marching to a wealthy hillside neighbourhood, where riot police guarded hotels, shops and Haiti’s elections office.

Some demanded President Michel Martelly’s resignation for his “inability to organise elections in the country”. Two opposition activists who had organised the protest were arrested by police for “public unrest and inciting violence”. Mid-term senate elections in Haiti had been due in May 2012, while the municipal poll is three years behind schedule as Haiti slowly emerges from the earthquake which left much of the country devastated in 2010. In June, President Michel Martelly decreed that the elections be held on 26 October. The date was set after lengthy talks mediated by the president of Haiti’s Bishops’ Conference, Cardinal Chibly Langlois, intended to overcome the political deadlock between the opposition and the government. But after the National Assembly failed to pass an electoral law in time, the office of Mr Martelly announced another postponement on Sunday. No new date has been set, but the statement said that “President Michel Martelly, in his constant concern to guarantee political stability, promises to pursue consultations with the different sectors of national life in order to hold the elections as soon as possible”. Opposition politicians accuse President Martelly of wanting to rule by decree - a likely scenario if no elections are held before the lower chamber’s term runs out in January. The government argues that opposition politicians are also dragging their feet in the hope of extending their time in office without elections.

Bob Marley family launches global marijuana brand

The family of Jamaican-born reggae star Bob Marley launched a first-of-itskind global cannabis brand on Tuesday. Called Marley Natural, it will hit the market in late 2015 – and is aimed at both medical and adult-recreational use (21 and over). It is a venture of Bob Marley’s widow, Rita, who is also a reggae musician, and his children and grandchildren, in partnership with Seattle-based Privateer Holdings, a leading cannabis focused privateequity firm. Bob Marley’s name and legacy – attached to a mass-marketed global marijuana brand – could be a killer app in this booming industry. Legal marijuana sales are expected to grow from $2.4 billion in 2014 to $10 billion by 2018, according to the cannabis investment group ArcView. The meteoric growth in revenue is predicated on an expected transition of marijuana buying habits, from buying it on the illegal black market to purchasing it in state-regulated and taxed retail stores and dispensaries. However, marijuana is still illegal under federal law, and there are many obstacles to success for investors and brands. It is currently extremely difficult for cannabisrelated businesses to obtain banking services, and many business expenses can’t be deducted under federal tax law. Production, processing and distribution can generally be done only within the state where the marijuana is sold. Interstate and international shipping of marijuana is not permitted.

Cayman Islands schools under the microscope Government is spending almost $300,000 on a pair of reviews that will look at the quality of teaching and leadership in all Cayman Islands schools and evaluate the overall standard of the education system. According to the Cayman Compass, a team of six inspectors will visit all 16 government schools as part of a comprehensive “baseline inspection” already under way. That process will take place in tandem with a more general review of the governance of education in the Cayman Islands, which will also evaluate alternative models, including the possibility of putting some schools under private sector management. Mary Bowerman, a former chief inspector of schools in the Cayman Islands, has been contracted to lead the “baseline inspections,” which will focus on student achievement and quality of teaching and leadership, with a specific focus on mathematics and English. The inspectors will produce individual reports on each school, as well as an overarching review, to be tabled in the Legislative Assembly at the end of the school year. It is the first time such a comprehensive review, involving every government school, has been conducted. A team of consultants from U.K.-based Independent Schools Inspectorate, which is sanctioned by the British government to inspect independent schools, has been hired to work with Ms. Bowerman on the $230,000 review. Government’s own internal inspection unit has been effectively disbanded after staff numbers dwindled to zero. No full school inspections have been conducted since 2008. Education Minister Tara Rivers said the unit would ultimately be revived, with possible policy or legal changes introduced to ensure its independence from the Ministry of Education.

Cable and Wireless could be in breach of the licences The Eastern Caribbean Telecommunications Authority (ECTEL) has warned that both Cable and Wireless (CWC) and Columbus Communications could be in breach of their licenses if they engage in activities, which can unfairly prevent, restrict, or distort competition. The ECTEL statement Wednesday was in response to the proposed purchase of Columbus by CWC announced earlier this month. It said that in reviewing the preliminary information available on the planned purchase, under the current regulatory regime, telecommunications license holders including CWC and Columbus maybe in breach of their licenses. “The decision to combine business by the two companies can have a negative impact on the telecoms sector

and this has provided further impetus for the revision of existing legislation and rules governing competition in the sector, including the proposed new Electronic Communications Bill,” ECTEL statement read in part. ECTEL cautioned that this development could potentially result in a negative impact on competition, and reduce choice by consumers of both services and service providers. “Since the advent of liberalisation, the prices of all telecommunications and ICT services have been significantly reduced due to competition in the region. “ECTEL is mindful that over the past 15 years there has been major development in the telecommunications sector under the guidance of independent regulators in the Eastern Caribbean.

“Increased monopolisation therefore can erode the gains made by the liberalisation and create challenges for the entrance of new service providers,” ECTEL noted. ECTEL said both itself and the National Telecommunications Regulations Commission in the member states will intensify collaboration with other regulators in the Caribbean region to seek further information in order to advise member governments on the issue. The sub-regional body claims that it urged the OECS Commission to move with some haste to establish the OECS Competition Commission. In its latest comment on the alliance Wednesday Digicel called on all regulatory bodies across the Caribbean “to see through the smokescreen put up by CWC/

NEW YORK - Japan has slipped back into a recession for the second time in two years. That could mean more trouble for a range of U.S companies and industries that count on the country for sales. Best known as an exporter of cars, gadgets and comic books, Japan is also a key consumer of U.S. goods and services from name-brand companies. Japanese customers take a shine to diamonds from Tiffany, strap on handbags from Coach, and ride choppers from Harley-Davidson. “If the Japanese economy continues to shrink, it has a big impact on other countries,” says Sheila Smith, senior fellow for Japan studies at the Council on Foreign Relations. “It’s not like some isolated economy. Having a strong and vibrant Japan is important for everybody.” On Tuesday, Prime Minister Shinzo Abe announced steps aimed at keeping the downturn from getting worse. Abe postponed another hike in the national sales tax and called for national elections next month. An increase in that sales tax earlier this year has been widely blamed for the most recent slump. Here’s a brief look at the economic ties between the U.S. and Japan, the world’s third-largest economy, as well as the American businesses that could be hardest hit by the recession. Now France wants to know why, for some goods and services, women seem to be paying more than men. The question was first taken up by a group of French activists inspired by a study that found American women overpay hundreds of dollars a year for the same products. The activists persuaded the Economy Ministry this month to launch an in-depth study to determine what price differences exist in Fra nce, the reasons behind them and which sectors are most affected. Findings are expected early next year. A quick look by The Associated Press at haircut prices and store aisles in Paris found some disparities. Haircut: women 43 euros, men 26. The group took its cue from a California state government study that found American women on average pay $1,300 more than men every year for identical products. Consumer Reports found similar disparities in 2010. “It’s a first victory if people are asking themselves the question when they walk into a store and compare prices,” said Gaelle Couraud of Georgette Sand. “What we’re asking

for is the end of gendered marketing, that prices be determined not by the sex of the purchaser but by the function of the product or the service rendered.” Monoprix, one of the French chains targeted by the campaign, responded by explaining that the price differences had nothing to do with the sex of the customer. “The differences in price between products referenced for women and men can be explained by their intrinsic characteristics and their sales volumes,” the company said in response to a petition signed by 40,000 consumers. The CEO of L’Oreal, speaking at a press conference on the day the government announced its study, questioned the premise entirely, saying he thought people were “inventing something.” And Fabien Provost, artistic director of the Franck Provost group of hair salons, said it makes no sense to charge women and men the same amount for what is essentially a different service. That view got some legal backing elsewhere in Europe: This month, a Danish appeals court threw out a 2012 ruling that barred different haircut prices for men and women, saying a women’s cut is “so technically more demanding that it is the reason for the price difference.” In the United States, the California and New York City laws remain outliers. The issue went up to the Supreme Court, where lawyers argued unsuccessfully for the abolition of different tariffs for clothing for men and women. “We don’t want to create a unisex world. It’s boring and it’s not accurate,” said Michael Cone, one of the lawyers in the tariff case. “It has to be that the gender discrimination is wrong.” Helene Masse-Dessen, a French lawyer who worked on a 2010 study on how European Union countries implement gender equality requirements, said the price differences could be bridged under current antidiscrimination legislation in France. Bermuda to host 2017 America’s Cup DIEGO — The tax haven of Bermuda has been picked over San Diego to host the 2017 America’s Cup, a person with knowledge of the situation told The Associated Press on Thursday. Members of San Diego’s bid effort, as well as officials with the Port of San Diego, also declined comment, saying they were under a non-disclosure agreement. Mayor Kevin Faulconer wouldn’t comment, his spokesman said, declining to give a reason. The spokesman wouldn’t say if the mayor’s office was also bound by an NDA. FIFA to review World Cup corruption report

GENEVA - FIFA will further review the 2018 and 2022 World Cup corruption investigation, putting the status of hosts Russia and Qatar back in question. The head of FIFA’s auditing committee will examine the full 430page confidential report by American prosecutor Michael Garcia into impropriety during the bid process, reviving a probe which seemed closed one week ago. Domenico Scala, a Swiss businessman who serves as the soccer body’s audit panel chairman, will then decide whether to turn over any evidence to FIFA’s executive committee. The decision to hand over the documents to Scala came a week after FIFA ethics judge Joachim Eckert ruled that the case against Russia and Qatar was closed. Within hours of the German judge’s decision being published, Garcia appealed to FIFA, objecting to “numerous materially incomplete and erroneous representations” of his work. That led to a meeting in Zurich on Thursday between Eckert and Garcia, whose appeal appears to still be active. The pair “agreed that it is of major importance that the FIFA Executive

Committee has the information necessary to evaluate which steps are required based on the work done by the FIFA Ethics Committee,” they said in the statement. “The chairmen also offered to answer any questions the chairman of the Audit and Compliance Committee and the Executive Committee might have.” The FIFA executive committee will next meet Dec. 18-19 in Marrakech, Morocco, with 12 of its 25 elected members having voted in the scandal-plagued December 2010 hosting elections. Some of those 12 have been formally charged by Garcia with wrongdoing linked to campaigns dogged by allegations of bribery, favor-seeking and collusion, and an investigation hampered by uncooperative witnesses. “The investigatory chamber has already opened a number of formal cases against individuals,” the joint statement from Garcia and Eckert said, without identifying names or detailed allegations. The suspects could include staffers from the nine bid candidates. In Morocco, the board chaired by FIFA President Sepp Blatter could discuss relaxing secrecy rules and

Scala will step into the heart of the corruption case after more than two years monitoring FIFA’s billiondollar annual revenue. He has evaluated deals with FIFA commercial partners, blocked grants to FIFA member federations and stopped bonuses to executive committee members, while also doubling their annual stipend to a reported $200,000. Scala and Garcia worked together in June when deciding that FIFA board members should not be allowed to accept luxury Swiss watches offered by a World Cup sponsor. Previously, Scala has said the World Cup corruption investigation should have the power to remove a host if compelling evidence was found. The Russian and Qatari bid committees have always denied wrongdoing and have pledged to continue their World Cup hosting plans, costing tens of billions of dollars.

Kidd booed in return to Brooklyn as Bucks coach

NEW YORK — Jason Kidd revealed a distrust of the Nets’ front office and a desire to get past his messy departure from the franchise when he returned to Brooklyn on Wednesday as coach of the Milwaukee Bucks. It was Kidd’s first game against the team he led to two NBA Finals as a player and coached to the second round of the playoffs in 2013-14. He was loudly booed when he came onto the court and again when he was announced during pregame introductions, with a chant of “Kidd’s a traitor!” breaking out in the first quarter. It was a reception that would have been impossible to imagine last season, when the team retired the No. 5 jersey Kidd wore during the greatest career for a Nets player since the franchise joined the NBA. “My teammates, coaches, we did a lot for this franchise,” Kidd said before the game. “But it’s whathave-you-done-for-us-lately motto. I understand everybody has their opinion. It’s business and I work for the Milwaukee Bucks.”

He sought that job during the summer after first seeking additional power within the Nets organization. The Nets declined and eventually let him out of his contract by acquiring a couple of second-round draft picks from Milwaukee. Kidd denied trying to get himself positioned above general manager Billy King but also said they didn’t have much of a relationship. He believes the Nets wanted to fire him in December, when they were en route to a 10-21 start. “I think it really helped me to see what I was dealing with, what type of people I was dealing with, you know?” Kidd said. The Nets rebounded to finish 44-38 and reach the second round of the playoffs, still far below expectations that were created when they acquired Paul Pierce and Kevin Garnett in assembling the highest payroll in NBA history. “The veteran guys I coached last year, I had a great time with,” Kidd said. “We maybe didn’t fulfill our expectations of winning a championship, but we did come a long ways. We won a Game 7 on the road,

we did a lot of good things and it was a fun journey. I respect everyone in that locker room.” He has barely spoken about the terms of his departure and wasn’t comfortable having to do it Wednesday. He said he had spoken to some Nets players since he left and was asked about last month’s comments from owner Mikhail Prokhorov, who said the team made the trade with the Bucks because: “There is a nice proverb in English: Don’t let the door hit you where the good Lord has split you.” “I thought it was a great quote. There have been rumors that Bryant’s early-season gunning was a result of him chasing MJ on that list, and wanting to make sure he passes him while healthy enough to do so. Dan Redmond takes TCI Sprint Triathlon

The TCI Sprint Triathlon took place on Sunday (November 16, 2014) at the Bight Park in Providenciales. Dozens of persons took part in the event, including His Excellency Governor Peter Beckingham, who competed with a team. Governor Beckingham competed in the last leg, which was the road race. The TCI Triathlon comprised swimming, pedal cycle race and road race. The overall winner was Dan Redmond, who competed as a one man team, was the first to complete all his events.
