CONTROVERSIAL NEW JUDGE FOR TCI

A
British judge who is best known for ordering two teenage boys to be whipped on the buttocks with a cat-o-nine tails whip, has been chosen as the newest Supreme Judge for the Turks and Caicos Islands. Investigations by the SUN confirmed that Robert Shuster, who has been the Senior Magistrate in the Eastern Caribbean island of Montserrat since October 7th 2013, is expected to assume his post in the Turks and Caicos Islands in March this year. Shuster was selected by the Judicial Services Commission after Madame Justice Margaret Ramsay-Hale was elevated to post of Chief Justice. She is the first female to hold that office here. The Government had also indicated Mr Shuster is being considered as the country’s new Chief Justice. According to media reports, calls for Shuster’s removal came amid concerns
over his performance as a judge, with the Tonga Law Society questioning his competence and understanding of the laws of Tonga. Radio New Zealand correspondent, Mateni Tapueluelu, said the pro-democracy MPs intend calling on Parliament to impeach Mr Shuster. “They are concerned about the
rule of law in Tonga. They have quoted a lengthy series of judgments made by Shuster that were all overturned by the Court of Appeal. And they are quoting certain comments made by the Court of Appeal that imply Shuster is not a competent justice.” Meanwhile, Tonga’s Women and Children Crisis Centre said an
independent Attorney General and Judicial Services Commission are vital for the welfare of women in the country. The NGO’s spokesperson, Ofa ki-Levuka Guttenbeil Likiliki, said the resignation of John Cauchi as Attorney General was a brave move to highlight the reduced level of accountability and transparency in Tonga.
FIRE PARTIALLY DESTROYS HOUSE, RAZES STORAGE: Two families in Five Cays, Providenciales are left to count their losses after a fire on Tuesday (January 6, 2015) partially damaged a dwelling house and completely destroyed a neighboring structure being used as a storage. The SUN understands that the occupants, at the time of the fire, were out of the country. Isaiah Alvarez, who owns the storage, explained that he was at work in the Leeward area of Providenciales when he received a call that his storage was on fire, and when he arrived, met firefighters cooling down a charred heap, which used to be his storage. He said that a number of valuable tools, including a power generator, two compressors and a number of tools. He said that occupants of the partially destroyed house also had items inside the storage. With the steady plummeting of the price of fuel over recent months and today’s release that the price of oil has fallen below $50 a barrel for the first time since 2009, we are concerned that we are not experiencing or seeing a significant savings or reduction in costs at the pumps and also in the provision of electricity. While we understand the multi -port handling and the cost of transportation to the islands, we are certain
that the price should have been positively impacted by now. In the absence of large storage facilities, the lowered costs should have by now been reflected and passed on to the consumer. And so, we believe that there should have been significant reductions in fuel costs by now. There is no doubt that the cost of fuel which includes the government’s tax of $1.00 per gallon contributes to the high cost of living and doing business in these
islands. There can only be significant benefit to our country’s economy if the providers would pass on their savings. The Opposition will continue to visit these merchants this week in an effort to make representations in this area. Nonetheless, we are publicly calling on merchants to share their savings with the customers. This can only help the economy which in turn will benefit us all.
Miss TCI Universe Shanice Williams departs for global contest Miss Turks and Caicos Universe Shanice Williams departed the country for Florida to complete in the world’s most glamorous competition scheduled for January 25th in Miami, Florida in the city of Doral. She will join nearly 90 other contestants from around the world, who will, in the next few weeks, learn golf, salsa, cooking and model swimsuits. The Preliminary competition, to happen on January 21, includes evening gown, swimsuit and interviews. Williams departed the TCI a very confident woman, telling reporters before going through security checkpoint that the country should expect her to do her best. “I would like to make friends, getting to know people, learn more about different cultures, countries and so on. I think it is going to be very exciting,” she said.
She also plans to market the TCI as the preferred tourism destination while on the mission. “I plan to sell the Turks and Caicos from that point of view, and to also let them know that we are a diverse nation, and that they would feel right at home if they were to come here,” she said. Williams is probably one of the best prepared Miss Universe ambassadors ever, having by herself, pursue a great deal of research on the workings of the pageant, including interview skills and how to don the catwalk. “Basically, it is more of a mental training than anything else, because I try to prepare myself for anything that will come up unexpectedly, so that was my plan basically,” Williams said. She is most excited about the interview section because that is segment that her hard work should manifest itself.

Premier Ewing reshuffles Cabinet
Premier Dr. Rufus Ewing and members of his cabinet By Vivian Tyson In what he rationalizes as a move to make the respective government ministries more effective, Premier Hon. Dr. Rufus Ewing has announced a reshuffling of his cabinet. The premier will swop ministries with Hon. Porsha Stubbs-Smith, taking from her the Ministry of Health and Human Services, while giving her the newly-upgraded Ministry of Tourism, Culture and Heritage, which was previously a mere portfolio responsibility in his office. In order for Tourism to be upgraded to a full-fledge ministry, Health and Human Services will have to be downgraded to a quasi ministry, since government is allowed to have just six ministries. Hon. George Lightbourne, who is the Minister of Government Support Services, will trade his ministry with current Minister of Environment and Home Affairs Hon. Amanda Missick. However, Lightbourne will keep the Telecommunications portfolio, previously assigned to the Ministry of Government Support Services. The Ministry of Education, Youth, Sports and Library Services will remain with Deputy Premier Hon. Akierra Missick, so do the Ministry of Finance, Investment and Trade and the Ministry Border Control and Labour occupied by Hon. Washington Misick and Hon. Don-Hue Gardiner respectively. Premier Ewing, who announced the reshuffle on Thursday (January 8, 2015) during a specially

announced news conference, said the measure should take effect on January 19, in the first of two phases. -The second phase, he said, which is to coincide with the passage of the new budget, will be more of a structural change to ministries. The premier emphasized that government has always been looking at ways to improve the competence and functionality of the ministries with a view to bring new energy and breathe new life into service delivery, adding that the move to reshuffle his cabinet was primarily predicated on that initiative. “We are just beyond our midterm in our term in office and we take this opportunity to reassess ourselves, reassess our progress that we have made and look forward to the next two years in looking at the government’s agenda. “Most of the reasons that came into being as to why the ministerial reshuffle, were based on just that; to give persons a fresh look at different ministries, new experiences, and to improve ministerial efficiency and to put specific focus within certain areas within the different ministries,” the premier said. Premier Ewing, in gaining the approval of His Excellency the Governor, Peter Beckingham last evening to move forward with the proposed changes, said: “This shuffle is a very positive restructuring of the Ministerial Government and comes at a critical time in our term in office. In the two years already past there have been tremendous wins in each of the Ministries and the efforts of each Minister should be applauded, as their contributions have

been impactful and commendable. By swapping ministerial responsibility, we are able to capture a fresh wave of ideas and energy and it is on that momentum that we seek to maintain the pendulum of success.” The Premier explained that the once powerful Ministry of Tourism was dismantled after the British took charge of the government in 2009, and was never reestablished after his government came to power, but it was always his intention to reinstate it as a full ministry. “So, it is our intention to restructure and reform a new ministry of tourism with all of the various support staff, including the ministers, the permanent secretaries, the various deputy secretaries that that ministry should have. With such an important sector, which is the number one bread-winning sector in Turks and Caicos, it is important that that ministry is reformed,” the premier said. He said that come April, there will be reshuffling of departments and changing of ministries to coincide with their respective mandate, saying that changes in the budgets are being made to reflect those initiatives. “It is unfortunate that we are not able to implement those structural changes now, because to do so we will have to have supplementary budget. We will allow the current ministers to engage with their ministries, the various permanent secretaries, and between now and April, get to know their ministries very well. And by the time the budget is passed in April, they will be well versed with what is in their budgets, with what they are working with, and their permanent secretary likewise, will do the same,” the premier said. He said also that those changes should attract reassignments of permanent secretaries and deputy secretaries. Those changes, according to the premier, are to be marshaled by His Excellency Governor Peter Beckingham and his deputy Her Excellency Anya Williams.

Chief Justice Margaret Ramsay-Hale has been described as mental gymnast because of her capacity and flexibility to preside over different nature of cases sometimes on the same day. The compliment came from seasoned legal campaigner and Queen’s Counsel, Ariel Misick, who was speaking at the opening of the 2015 Hilary Session of the Turks and Caicos Islands Supreme Court at the old Myrtle Rigby Complex in Providenciales on Monday, January 5. “What I am most impressed about in 2014, was to the extent that the court was able to grapple with the very heavy workload that has arisen in these islands with only two Supreme Court Justices, following the departure of the former chief justice. I can speak personally about civil and commercial litigation. “It must be the case that you (Chief Justice) was exercising some sort of mental gymnastics when you moved from one place to another, given the fact that some of them are of different nature, and sometimes on the same day,” he said. He said that the chief justice’s dedication has been reflected in the court staff, including the registrar, the deputy registrar and all clerical officers. Misick, who congratulated Justice Ramsay-Hale for bringing back the ceremonial opening of the Supreme Court, brought a wish list he would like granted during this fiscal and calendar year. He would like to see a greater allocation of resources to the judiciary and law reform, since this jurisdiction is far behind on that front. “It would take more than several pieces of legislation because we have become so far behind both in terms of substantive law and procedure that it would take probably the next five years actively working on law reform on a constant basis,” he said. Jonathan Katan, who spoke on behalf of the Bar Council, also batted for resources to the judiciary and law reform. He said, too, that there needs to a statute of limitation
law in place. “It is a significant issue in this jurisdiction. Theoretically, you can be sued for things that happened many, many years ago. And there is a great deal of uncertainty as to ongoing liability to the people in this jurisdiction. It is important for both individual and corporate entities,” Katan said. Katan also calls for a legislation to protect local lawyers against their foreign counterparts who would endeavor to use the local justice system just to bolster their Curriculum Vitae before moving on. Katan also called for the court to make cases and decisions by the court readily available to members of the bar and the wider audience. “The Bar would support that and do whatever it can to assist in moving that forward,” Katan said. He told the Session’s opening that there is need for attorneys to continue educating themselves to keep up with the latest in the profession. He thanked the chief justice for attending the last session held by the Bar Council recently. “Education for attorneys should not be finished once you pick up your degree certificate. Education is a lifelong part of being an attorney,” he said.

BAFS insurance company officially liquidated By Vivian Tyson Chief Justice Margaret RamsayHale on Friday (January 9, 2015) approved a petition that the Financial Services Commission (FSC) mounted for the liquidation of the failed insurance company – British Atlantic Financial Services (BAFS). CEO of the FSC Kevin Higgins, commenting on the liquidation approval, said that the winding up of the company was approved after the court was told by the provisional liquidator Joe Connolly, that the six weeks that the court granted for prospective investors to come forward or government to intervene financially, nothing happened. “The judge said we gave them six weeks for a bailout proposal to be presented. We heard nothing from the government, nothing from any group of investors or policyholders or management, like Mr. (Wilbur) Caley. So therefore, we have no option but to appoint the liquidator in full,” Higgins said. Connolly, when contacted to get a sense of the ramification involved in the process and how much money is left in the financially troubled company’s coffers, said via text
messaging that he would not be available before the coming week, to divulge any information on the matter, since he was tied up with conference calls for all of Friday. Chief Justice Margaret RamsayHale put BAFS in provisional liquidation when the matter came up in the Supreme Court on November 20, 2014. The provisional liquidation period was to give Connolly time to secure a rescue package, and if one is not locked in by then, a winding up order would be enforced. The government, at one point, was interested in the rescuing of the company. Premier Hon. Dr. Rufus Ewing, on learning of the company’s financial woes, decided to explore the possibility of assisting it, calling a news conference in November to highlight his government’s intention. He said at the time that assisting BAFS would depend on the extent of the hole that it has dug itself in. Attorney Jonathon Katan of the lawfirm Miller Simons O’Sullivan, who appeared on behalf of the FSC on November 20, told the court that BAFS was in serious financial problems with no clear sign of it ever climbing from the financial hole any time soon. He said that a report from Wilbur Caley,
former managing director of BAFS to the FSC, in May, 2013, painted a depressing picture of the company finances. He said however, that the FSC gave the company time to recover, which it never did, as every month its finances continued to plummet, and with no further capital injection made. Katan said that according to Caley’s report, the asset of the company was $3.2 million, while the liability was $10.8 million, which amounts to a shortfall of $6.2 million. He said that BAFS has been racking up losses after losses, and the bleeding needed to stop. He said that Connolly, who was appointed as administrator for BAFS since March, 2014, has made the determination that the enterprise should wind up based on its insolvency problem, also emphasizing that such a determination was not taken by the FSC. He argued that since the FSC would be the first to be blamed in the event that a policy-holder were to make a claim and was told that there was no money to fulfill such request, a decision by the regulatory body to call for a managed winding up was legitimate.

Employers could face punishment for ex-con discrimination By Vivian Tyson
Employers who discriminate against ex-convicts whose criminal record has been expunged could face judicial punishment under the Rehabilitation of Offender Legislation, passed last year, according to Attorney General Hon. Rhondalee BrathwaiteKnowles. Speaking with a handful of media practitioners shortly after the opening of the Hilary Session of the Supreme Court at the old Myrtle Rigby Health Complex on Monday (January 5, 2015), the Attorney General said that the Rehabilitation of Offender Legislation seeks to give persons who committed minor offenses a second chance a normal life. “That is very important because not unlike the mention of the Limitation of Actions Legislation, which is very needed, and is one of our priorities, but also because there are lots of young people in particular that have relatively minor offenses, some years ago, and are unable to obtain employment and other services. Effectively, they just got a blot on their lives. She said that the heart of the ordinance is to assimilate back into the community those who have been conviction of minor offenses, telling the
media that the state would expunge the conviction three years after the convict has served his or her sentence. “The purpose of conviction and penalty is punishment, but there is also rehabilitation, so you then have to allow people to have an opportunity to reintegrate in society and to seize that opportunity to make a better life, and to make a better contribution to the islands. The function of that legislation is to spend conviction. “Essentially what will happen is, a person, who say, was convicted of an offense more than three years ago, and the sentence was, let’s say 12 months, that person would have been able to serve their time, come out of prison, and the rehabilitation period would be three years after that,” she said. She added: “That (convicted) person would be treated as if they were never convicted of that offense. And so, they could go into a place of employment and apply for work, and say they do not have a conviction on their record. They would be able to obtain from the commissioner of police a clean police record, and so the opportunity that is open to such a person is meaningful.” She said that employers accused of discriminate against such demographic would face the court themselves. “The legislation says that anyone

person is guilty of an offense, and so, it really provides some protection for that person. Not only for themselves for not having the requirement to mention it, but also employers and other persons, who would seek to use that against them,” she warned. She said that government also plans this year to pass a series of what she classified as meaningful legislations, some of which she said do not need much work to get passed because they are already on the book, and need tweaking. “Our focus will be to assisting the government on those efforts, assisting the new chief justice in efforts that she has for those areas of law – meaningful law reform. Some of them don’t take extensive bit of work, they just may be publication of an order in the case of a piece of legislation that’s been on our books since 2005, dealing with enforcement of overseas judgments. “For example, orders made in other jurisdiction, say Canada, involving maintenance of children or child custody orders and so on, can then be implemented in this jurisdiction if people choose to come here to avoid those orders. So, all we need to do is to publish an order that lists those jurisdictions, where there would be reciprocal enforcement,” she said.

out in the first phase of dredging in the development. Approval was granted on the basis that it will kick start the development resulting in new employment, new recurring revenue for the Government and other related social and economic benefits and subject to the dredging being carried out within 12 months from the Planning approval for that dredging; •Congratulated the Attorney General Hon. he Hilary Session of the Turks and Caicos Islands Supreme Court took place on Monday (January 5, 2015) at the new court building located at the former Myrtle Rigby Health Complex in Providenciales. High expectations for Advance Forensics graduates By Vivian Tyson Expectations are high for a group of Royal Turks and Caicos Islands Police Force officers, who recently completed an advance three week forensic identification course. The course was mainly conducted by a pair of retired forensic consultants from Royal Canadian Mounted Police – Victor Gorman and Craig Tomash – and ended recently with an award ceremony on Friday. Seven officers from the forensics department, including a female, sate the course. The course focused on mass disaster investigations, dead body investigation, crime processing and strategy, constructing a court case in consultation with prosecutors and the medical examiner’s office, evidence presentation in court, team playing, communicating and briefing with the Criminal Investigation’s Department (CID) and team approach to crime scene examination. Tomash said that the training was done in both practical and theory, saying that theory was done in the morning and practical in the evening. He said that as part of the practical programme, crime scenes were set up on which examinations were done. “At the end of the day, they would have to write report, proper documentation and then present individually to the class,” Tomash
Randy Ellis explained.
Asked to give his overall assessment of the participants, Tomash said: “It was a very difficult course, but the candidates did very well. At the beginning of the training, the feeling I got was that they were not quite sure of themselves, but after three weeks, the change in their demeanor and the ability to give evidence in court was tremendous. “We actually did three court sessions with them, and we went to the Supreme Court and did one session with the prosecutor and the confidence is unbelievable from day one to the end of the course.” Latasha Williams, Acting Director of Public Prosecution, told the graduates that the country will be depending on them to use their skills to enhance crime-fighting, so that the Turks and Caicos Islands can be a safer place.

Kenneth Walters talks about losing his son
Kenneth Walters By Vivian Tyson Imagine losing 11 family members over a twoyear period – two of them siblings and two them off-springs. Well, that is the situation that Kenneth Walters’ a resident of Blue Hills, Providenciales has found himself in. Walters in was Jamaica making funeral arrangements for his brother, Donald, who was killed in a motor vehicle accident along the Leeward Highway, at the end of November (2014), when he heard that his son, Kenley Walters, was stabbed to death at Club 2005, located on the Five Cays Main Road. It was when The SUN visited Walters at his retail store in Blue Hills, that he told about the loss of so many family members since 2012, beginning with his daughter. “Since 2012, there were 10 members of my family who died. My daughter was the first one, followed by the rest. I had two nephews that died, a sister, and now with Donald – that is two brothers- then two
brothers-in-law, and a niece. A total of 10 persons since I buried my daughter, that died in the family,” he lamented. Walters described his son, who would have celebrated his 20th birthday in May, as promising and talented young man who did not deserve to die the way he did. “Kenley was a talented boy. Kenley was great at basketball. He was offered a scholarship, but he couldn’t take it up because he wouldn’t study his lesson to get it; the average that he needed (was not sufficient). That is why Kenly didn’t get the scholarship. “Away from that, he was a good, good, kid. Like any kid, sometimes you have to talk to them because of things that you don’t like and companies that you see them keeping, and you don’t like and you talked to him about it,” he said. He said that the news of Kenley’s death hit him like a ton of bricks. “Man, that impacted me greatly. When I heard the death of my son, I was dumbstruck, I couldn’t

talk for a while. The only thing I said: ‘Kenley got killed’? It impacted me greatly, man, because the boy had a good future ahead of him,” Walter said. He explained that he heard of his son’s death in the wee hours of Saturday, December 27, 2014, a day before his brother’s funeral. “About 3:15 Saturday morning (December 27, 2014) I got the news that he was killed. I was getting ready to bury my brother on Sunday afternoon (December 28, 2014). That was a few hours before my brother was buried he got killed,” Walters said. Walters added: “I heard that there was fight between him and some guys. I hear that the whole thing started from Maskanoo (which was held on Friday, December 26, 2014). I understand that the police had held him for a while, and then the police released him and told him to go home, but he ended up at Club 2005. “So, therefore, it appears that the same guys that he was in a fight with, followed him down there. I heard he was in the bathroom, and when he was coming out of the bathroom, the guys just came up and stabbed him.” The grieving father declared that he does not understand the reason no one has come forward to identify his killer or killers, since the club was packed with patrons, who must have seen the incident. “There was a lot of people there, so I don’t understand why no one wants to come up and say what happened. That is the problem they have around here. People don’t really talk,” Walters said. He said that despite his being rendering, he still a place to forgive him, but urged him to give himself up or face retribution from God. “The guys who killed my son, I forgive him, because I am Christian person, and I don’t carry grudge for anybody. But I wish that we get justice out of it. I am still appealing to the public that who knows about Kenley’s death; I wish they would come forward. It could have been their child; it could have been their brother; it could have been their uncle. So I wish somebody would come forward,” he said. Speaking directly to the killer, Walters said: “Come forward and give up yourself, because remember, God is looking down and he knows who does it. You might get away with this today, but remember, it may come back to haunt you, and whatever a man sows he will reap it. It might not be now, but soon and very soon, probably you may experience the same thing in your family. So, give up yourself.”

Nearly half of criminal cases in High Court discontinued Nearly half of the criminal cases filed in the Turks and Caicos Islands Supreme Court in recent times were discontinued. This was revealed by Chief Justice Margaret Ramsay-Hale while delivering remarks at the opening of the new Supreme Court session last Monday. She said: “There is (a) statistic of some interest there were 82 cases dealt with involving 88 defendants. Of that number, 33 cases were discontinued by the Crown, whether by entering a nolle prosequi or offering no evidence or withdrawing the preferred charges. Without further inquiry, it is impossible to say why the Crown decided not to pursue the charges: whether because of reluctant witnesses or otherwise but it is significant that 33 cases were discontinued at or before trial.” The chief Justice added: “The preferring of charges would causes the Administration to incur significant expenditure on legal aid
and administration of the process, including court time. If the cases had no legal merit to begin with then those prosecutions only serve to clog a system that is already overloaded and as I have said, waste resources, which are already stretched to breaking point.” She noted that 82 legal aid certificates were issued at a cost to the country of $450,000. The Chief Justice noted there were 58 criminal cases filed and dealt with in the Supreme court in 2014 compared 87 in 2013 and 96 in 2012. She said: “What is interesting to note is the decrease in the number of criminal prosecutions brought between 2012 and now. The difference between 96 cases and 58 is statistically significant. I am not sure whether it speaks to a reduction in crime - anecdotal evidence would suggest otherwise - or whether it is a change in police or prosecution policy.” She said that a further 10 cases were stopped by the Court and a not guilty verdict directed. ARIS -- Two police officials say at least four people, including the attacker, have died at a kosher grocery in Paris where a gunman took several hostages. Security forces stormed the grocery minutes after their counterparts assaulted the building outside Paris where two brothers suspected in the Charlie Hebdo killings had holed up. The two police officials, who could not be named speaking about the quickly developing situation, confirmed the attacker died. One of the officials said three of the dead were hostages. The gunman has been identified as Amedy Coulibaly. None of the officials could say what has happened to the woman listed on a police bulletin as his accomplice. Earlier, two al-Qaida-linked brothers suspected of slaying 12 people at a Paris newspaper came out with guns blazing Friday, prompting an assault on the printing plant where they had been hold up with a hostage, a French police
official said. They were killed and their hostage was freed, authorities said. France has been high alert since the country’s worst terror attack in decades - the massacre Wednesday in Paris at the satirical newspaper Charlie Hebdo that left 12 people dead. Two groups of terrorists had seized hostages at separate locations around the French capital Friday, facing off against thousands of French security forces as the city shut down a famed Jewish neighborhood and scrambled to protect residents and tourists from further attacks. By Friday afternoon, explosions and gunshots rang out and white smoke rose outside a printing plant in Dammartin-en-Goele, northeast of Paris, where brothers Cherif Kouachi, 32, and Said Kouachi, 34, had holed up with a hostage. Security forces had surrounded the building for most of the day. After the explosions, a police SWAT forces could be seen on the roof of the building and
one police helicopter landed near it. Audrey Taupenas, spokeswoman for the town near the Charles de Gaulle airport, said the brothers had died in the clash. Minutes before the storming, a gunman in a Paris kosher grocery store had threatened to kill his five hostages if French authorities launched an assault on the two brothers, a police official said. The two sets of hostagetakers know each other, said the official, who was not authorized to discuss the rapidly developing situations with the media. Trying to fend off further attacks, the Paris mayor’s office shut down all shops along Rosiers Street in the city’s famed Marais neighborhood in the heart of the tourist district. Hours before the Jewish Sabbath, the street is usually crowded with shoppers French Jews and tourists alike. The street is also only a kilometer (a half mile) away from Charlie Hebdo’s offices. At the kosher grocery near the
Porte de Vincennes neighborhood in Paris, the gunman burst in shooting just a few hours before the Jewish Sabbath began, declaring “You know who I am,” the official recounted. The attack came before sundown when the store would have been crowded with shoppers. The official said the gunman is also believed responsible for the roadside killing of a Paris policewoman on Thursday. Paris police released a photo of the gunman, Amedy Coulibaly, and a second suspect, a woman named Hayet Boumddiene, who the official said was his accomplice. Several people wounded when the gunman opened fire in the kosher grocery were able to flee and get medical care, the official said. US court removes roadblock to Keystone pipeline Washington - A US state court on Friday dismissed a suit challenging a proposed route of the Keystone XL oil pipeline through Nebraska, giving a dramatic victory to supporters of the controversial project. The decision by Nebraska’s Supreme Court reversed a 2012 ruling that determined that the governor had violated the state’s constitution by bypassing regulators and approving the route of the Canada-to-US pipeline. “On appeal, the state contends that the landowners lacked standing to sue and that L.B. 1161 is constitutional,” the court said in a statement, referring to law which allows major oil carriers to bypass regulatory procedures. The verdict comes on the day the House of Representatives votes on a measure authorizing construction of the pipeline. The high-court ruling removes one of the biggest legal roadblocks to constructing the mega-project, originally proposed in 2008 by builder TransCanada to allow crude oil from Alberta to be transported south to refineries on the US Gulf Coast. President Barack Obama has declined to sign off on the project, expressing environmental concerns, and the White House re-stated Friday he would veto the measure if it reaches his desk.

Church of England appoints first female bishop
Libby Lane LONDON - The Church of England on Wednesday named the first female bishop in its 500-year history, promoting saxophone-playing, soccer-loving vicar Libby Lane to bishop of Stockport. The announcement came five months after the church ended a long and divisive dispute by voting to allow women to serve as bishops. Lane, who called her promotion “an unexpected joy,” made her first act as bishop leading a prayer for the victims of the Taliban school massacre in Pakistan. “I am very conscious of all those who have gone before me, women and men, who for decades have looked forward to this moment,” she said. Archbishop of Canterbury Justin Welby, who succeeded where his predecessors failed in elevating women to church leadership, said he was “absolutely delighted” by the appointment. Man throws 5-year-old daughter off bridge A Florida man with a troubled past threw his 5-year-old daughter over the side of a bridge on Thursday and she was later found dead after the 62-foot drop into frigid Tampa Bay, police said. While it was not immediately clear if kindergarten student Phoebe Jonchuck was alive when thrown, an off-duty officer who witnessed the incident thought he heard her scream, said St. Petersburg police Chief Anthony Holloway. The grim episode unfolded just after midnight, when the girl’s father, John Jonchuck Jr., 25, of Tampa sped past an officer at 100 miles per hour and headed toward the Sunshine Skyway Bridge over Tampa Bay, police said. Jonchuck stopped his car near the top of an approach to the bridge, appearing to wait for the officer, then removed his daughter from the vehicle, police said. He threw her over the bridge railing, then drove off at a normal speed as the officer began
searching for the child, Holloway said. “You just throw this baby away like it’s nothing,” the chief said at a news conference. Phoebe Jonchuck’s body was found in the water about an hour and a half later and roughly a half-mile from the bridge, police said. Her empty pink car seat was sitting in the back of her father’s car when authorities stopped him in nearby Manatee County. Jonchuck was arrested on charges of first-degree murder, aggravated fleeing and eluding, and aggravated assault with a deadly weapon on a law enforcement officer. Police did not release a motive or cause of death on Thursday. UN and Canada call for end to political impasse in Haiti Less than a week before the Parliament in Haiti becomes dysfunctional, the United Nations and its international partners noted with deep concern that no solution to the political crisis has yet been found. The Secretary-General’s Special Representative in Haiti, Sandra Honoré, and other members of the international community represented in the “Core Group” – comprising the Ambassadors of Brazil, Canada, France, Spain, United States, and the European Union, as well as the Special Representative of the Organization of American States – stressed the need for an urgent end to the political and electoral impasse in line with the recommendations of the Presidential Advisory Commission. “In order to strengthen stability, preserve the democratic gains and ensure sustainable development in Haiti, members of the Core Group urge all the political actors to come together, to find a solution before the end of this week,” said a news release issued on Wednesday. In the statement, the Group reiterated its support for the interHaitian process that was essential to the formation of a consensus government and a Provisional Electoral Council to create the conditions necessary for the conduct of free, fair, inclusive and transparent elections in 2015. Canada urged the Haitian government on Thursday to call
elections soon, as the Caribbean nation teetered yet again on the brink of collapse. But while Haiti tries to resolve a mounting political crisis, Canadian officials say aid money will continue to flow to help rebuild a nation still struggling with the devastation of a deadly earthquake five years ago. Meantime, Canada has been reviewing its aid commitment to Haiti for nearly a year and says problems persist with co-ordination of aid efforts, largely as a result of a lack of accountability and transparency on the part of the Haitian government. “Yes, we have a strategic review going on, but our support to Haiti hasn’t stopped,” said a Foreign Affairs official who spoke on the condition of anonymity. “Ongoing projects are going on, humanitarian assistance is still being provided.” But the Harper government has concerns about how Haitian authorities track aid efforts and whether they are providing the best benefit to the Haitian people — and whether Canadian taxpayers are getting the best bang for the buck. Haitian Health Minister Florence Duperval Guillaume was named interim prime minister last month following several weeks of protests. Her predecessor, Laurent Lamothe, resigned after a special commission issued a report urging his departure amid widespread allegations
of corruption. But a permanent replacement for Duperval Guillaume must be approved by Haiti’s parliament before its mandate expires at midnight on Monday. Coincidentally, that is the fifth anniversary of the devastating Jan. 12, 2010 earthquake. The United States and other countries, along with the United Nations, have also urged Haitian lawmakers to get their act together and call national elections. “Canada along with other donor (nations) have encouraged the (Haitian) government to resolve the political issues that are at play,” said an official in Ottawa. “And we are hoping that there’ll be elections soon.” Haiti is the poorest country in the Western Hemisphere. Much of its capital, Port au Prince, was levelled by the 7.0 magnitude earthquake that killed tens of thousands. Death toll estimates following the disaster have ranged from 230,000 to more than 300,000 people. Since then, many Haitians have struggled to find the most basic of necessities, including food and clean drinking water. Canada has contributed $1.4 billion in development and humanitarian assistance to Haiti since 2006 — about $850 million of that since 2010.
Five years after the earthquake, the Canadian Red Cross says the record of what’s been achieved through donations from individuals, companies, provincial governments and the Canadian government is impressive. It received $222 million in donations in the days and months following the massive tremblor and the money has allowed for a sustained effort, the agency said in a statement. “Some five million people have received Red Cross assistance, which means one in two people in Haiti have been helped,” noted Conrad Sauve, the organization’s CEO and secretarygeneral. The Red Cross said the recovery effort has provided some 19,000 families — or 95,000 people — with either a temporary shelter or financial assistance for housing. The agency pointed out that a significant portion of its effort has focused on the health-care system, which was severely affected by the disaster. Those activities have included rebuilding the hospital in Jacmel and restoring services at four health centres that serve a population of 600,000. Sauve said nearly 90 per cent of the Canadian Red Cross funding has already been spent and two-thirds of the remainder, or $28 million, is earmarked for sustainable health-care initiatives.

Harris’s matter will now be heard on March 6 and Anthony believes that the elections, constitutionally due by March 10, would be called before the case is heard. During the hearing on Monday, the counsel for the
defendants argued that the affidavits filed by Harris last month put in issues, matters which may need to be resolved by further evidence filed by the defendants and cross examination if necessary. The High Court then ordered that the defendants file any further affidavits by January 26 and that the applications must be filed by February 2. The High Court also ruled that affidavits in response to applications filed are to be filed by February 13, and that the hearing of applications will take place on February 20.

Also there’s no lidocaine, which is used as an anesthesia so anyone who needs to get stitches will feel the pain and this is a huge issue as the doctors have to reschedule many procedures,” the doctor said. “There is no barium enema (a special X-ray of the large intestine), so if you have abnormal bleeding from your rectum you can’t check to determine if it’s cancer or something serious causing the bleeding,” one
doctor said. He also said the X-ray machine has been without film so patients have to be sent to KPH or elsewhere to do their X-ray. The doctor added: “There is also an ultrasound problem, so you have people here waiting for an ultrasound and can’t get a date.” In addition, he pointed to a shortage of toilet tissue, hand towels and bedlinen, which pose a problem when admitting patients. At the Mandeville Regional Hospital, a doctor said basic supplies are often out of stock. “I think either the Government has no money or the hospitals aren’t getting what they’re supposed to get, because basic things like hand towels and tubes for basic blood tests are hardly or never here. The [Accident and Emergency] Department has none, and we have to put off something as simple as a complete blood test because there are no tubes,” the doctor said. He added that, for the last two months, there have been problems with the ECG machine. The hospital also faces a staffing issue, which the doctor explained is a major risk. “...There is one nurse in the department, and you can’t run an A&E Department with one nurse. Ideally three to four should be there,” the doctor said. He said also that, because of the shortage of beds on the wards after surgery, some patients are housed in the A&E Department, while are sometimes placed in a reclining chair, which the doctor said is a further risk to their health. Acting permanent secretary in the Ministry of Health, Dr Kevin Harvey said the complaints were alarming, and an investigation would be conducted in an attempt to alleviate much of the problems the doctors face.

GRA Commissioner General Kurshid Sattaur said the container with an estimated 120 kilogrammes of cocaine was seized Monday night from a Dutch-registered cargo ship that came here to collect a consignment of bauxite. Sattaur said the cocaine, with an estimated street value of US $10 million, was stashed under the wooden base of a shipping container flat rack aboard the Netherlands-registered cargo ship, MV Amstel Trader. Head of the Customs Anti Narcotics Unit (CANU), James Singh said the vessel was leaving Guyana for Spain, The Netherlands and Belgium. Sattaur said the authorities here acted upon information provided by Suriname’s Port Control Unit. “This is a major breakthrough in intercepting drugs. We are very pleased about this as well. It is a joint intelligence sharing that has resulted in this bust,” he told the Guyana-based Caribbean News Desk. The captain and crew members of the vessel have been arrested.
GENEVA – The World Trade Organization (WTO) says the Enhanced Integrated Framework (EIF), a multi-donor programme that helps the poorest countries, including the Caribbean, will have its mandate extended into a new phase. The WTO said the EIF Steering Committee made the decision. “Trade can be an effective tool for economic growth and poverty reduction when the right conditions exist,” said WTO Director-General Roberto Azevêdo, in addressing the Committee. “The EIF was established precisely to help LDCs create those conditions,” he added. The EIF Steering Committee, which includes representatives of all least-developed countries (LDCs) and the donor community as well as EIF partner agencies, decided to extend the mandate of the programme into a second phase, starting from 2016. The Steering Committee urged the EIF to build on the achievements of the first phase while addressing the need for reforms in key areas in order to improve the efficiency, effectiveness and sustainability of the programme. The WTO said the EIF is currently helping 50 of the poorest countries worldwide. The WTO is one of six partner agencies of the programme and also hosts the Executive Secretariat. Azevêdo stressed that the programme is “making a difference on the ground through increased private sector development and employment in some of the poorest countries. “There is no other programme that supports LDCs to address all aspects of their trade capacity in this way – and that puts the LDCs themselves in the driver’s seat,” he said.

One vendor who requested anonymity, said the Antigua and Barbuda Airport Authority (ABAA) stipulated that if they (vendors) wished to get a kiosk when operations move to the new terminal, they must procure maintain a total of five insurance policies. “While we don’t know what the premium is, it would be high given that entire total of EC $20 million. How can someone with a small business afford that? That is to get us out as far as I’m concerned and get bigger companies that can pay that,” one concessionaire said. The “Request for Proposals for Retail Concessions” document presented to the vendors last year, calls on the concessionaires to have insurance from products/liability with a limit of no less than US $1 million per occurrence and US $2 million per period of insurance. The other section to be fulfilled is Commercial General (public) liability, to include but not limited to premises/operations, independent contractors, personal injury, contractual liability where exposure exists, elevators/escalators and others. Oil prices head for seventh weekly loss
Oil prices headed for a seventh straight weekly loss on Friday, slipping back towards $50 a barrel on Friday as key producers show no sign of cutting output in the face of a supply glut. Global oil benchmarks hit their lowest since 2009 this week and are less than half their June levels, with Brent crude futures LCOc1 dropping 67 cents a barrel to $50.29 by 0910 ET. The contract lost almost 11 percent this week. U.S. crude futures for February delivery CLc1 were down 31 cents at $48.48 a barrel despite robust U.S. economic data that brightened the outlook for demand. Brent’s premium to U.S. crude CL-LCO1=R fell near $1.80 a barrel,

Facebook remains most popular social media website
In a new survey conducted in September 2014, the Pew Research Center finds that Facebook remains by far the most popular social media site. While its growth has slowed, the level of user engagement with the platform has increased. Other platforms like Twitter, Instagram, Pinterest and LinkedIn saw significant increases over the past year in the proportion of online adults who now use their sites. The results in this report are based on the 81% of American adults who use the internet. Other key findings: •Multi-platform use is on the rise: 52% of online adults now use two or more social media sites, a significant increase from 2013, when it stood at 42% of internet users. •For the first time, more than half of all online adults 65 and older (56%) use Facebook. This represents 31% of all seniors. •For the first time, roughly half of internet-using young adults ages 18-29 (53%) use Instagram. And half 0f all Instagram users (49%) use the site daily. •For the first time, the share of internet users with college educations using LinkedIn reached 50%. •Women dominate Pinterest: 42% of online women now use the platform, compared with 13% of online men. While Facebook remains the most popular social media site, its overall growth has slowed and other sites continue to see increases in usership. Facebook continues to be the most popular social

The one notable exception is older adults: For the first time in Pew Research findings, more than half (56%) of internet users ages 65 and older use Facebook. Overall, 71% of internet users are on Facebook, a proportion that represents no change from August 2013. Every other social media platform measured saw significant growth between 2013 and 2014. Instagram not only increased its overall user figure by nine percentage points, but also saw significant growth in almost every demographic group. LinkedIn continued to grow among groups with which it was already popular, such as professionals and college graduates, while Twitter and Pinterest saw increases in usership across a variety of demographic groups. The engagement of Facebook users continues to grow, while daily use on other platforms shows little change.
JC Penney, Macy’s to shut several stores and cut jobs
Macy’s mega-store in Mid-town Manhattan, New York NEW YORK — J.C. Penney Co. and Macy’s are both set to close stores over the coming months to save financially and reinvest in other aspects of their businesses. Richmond Town Square in Richmond Heights , Kingsdale Shopping Center in Columbus, and Upper Valley Mall in Springfield are the three Macy’s locations closing in Ohio. Three Ohio locations will be apart of the J.C. Penney Co. closures as well including Eastland Mall in Columbus, North Towne Plaza in Greenville and Upper Valley Mall in Springfield. J.C. Penney Co. will close about 40 total stores this year and cut approximately 2,250 jobs, as it tries to recover from a disastrous attempt to reshape its brand. Macy’s said Thursday it will also close 14 department stores but open two new locations, resulting in annual savings of roughly $140 million and they plan to reinvest those savings into their
business. Most of the J.C. Penney Co. stores, located in malls around the country, will close by April 4. The Plano, Texas, company currently runs about 1,060 stores. All employees at closing J.C. Penney Co. stores will receive career training class, including help writing resumes and filling out applications. The company says that some are eligible to receive separation benefits. Macy’s says its overall workforce of about 175,000 will remain level as it picks up staffing in other functions. The announcement Thursday comes a day after J.C. Penney reported a rise in sales during the critical holiday shopping season. Macy’s Inc. says it is backing its expectations for fourth-quarter earnings per share, excluding restructuring costs.
Facebook’s large base of users continues to be very active. Fully 70% engage with the site daily (and 45% do so several times a day), a significant increase from the 63% who did so in 2013. About half (49%) of Instagram users and 17% of Pinterest users engage with their respective platforms daily, although neither of these represent a significant change from 2013. Some 36% of Twitter users visit the site daily, but this actually represents a 10-point decrease from the 46% who did so in 2013. While the 13% of LinkedIn users who engage with the platform daily is unchanged from 2013, the proportion of users who use the site weekly or less often increased significantly— that is, more users log on less frequently. 52% of online adults use multiple social media sites. Facebook acts as “home base” — it remains the most popular site for those who only use one, and has significant overlap with other platforms. Fully 52% of online adults use two or more social media sites, a significant increase from the 42% who did so in 2013. At the same time, significantly fewer adults use just one site — 28% compared with 36% last year. As in 2013, Facebook remains the most popular site among those who use only one — fully 79% of those who use just one site report using Facebook. As in years past, a significant majority of Twitter, Instagram, Pinterest and LinkedIn users say they also use Facebook, more than any other site. Honda fined $70 million for hiding death and injury data from feds WASHINGTON - Honda Motor Co. has agreed to pay $70 million to the U.S. government in penalties for failing to report hundreds of injuries, deaths and other consumer claims involving its cars, transportation officials said on Thursday. Honda will pay two $35 million fines, making it the largest amount ever paid by an automaker as a result of an investigation by the National Highway Transportation Safety Administration. The agency’s fines are capped by law at $35 million per incident. Other automakers have settled civil claims with the U.S. government over safety defects for far more. The automaker has been under investigation for violations of NHTSA’s Early Warning Reporting regulations. The rules require automakers to report quickly any information about possible defects, deaths and injuries or damage and warranty claims made by consumers. In November, Honda revealed it had failed to report 1,729 cases involving deaths or injuries between July 2003 and June 2014. Eight of those incidents involved Takata Corp air bags that had ruptured and have been the subject of massive recalls and federal investigations. “One thing we cannot tolerate and will not tolerate is an automaker failing to report to us any safety issues, because if we don’t know about these problems, we’re missing an essential piece of the puzzle in the recall efforts we use to fix them and to protect the public,” U.S. Transportation Secretary Anthony Foxx said during a news call. The automaker had earlier attributed its disclosure transgressions to data entry and computer programing errors, and also said it had relied on an “overly narrow interpretation” of its legal reporting requirements “We have resolved this matter and will move forward to build on the important actions Honda has already taken to address our past shortcomings in early warning reporting,” Rick Schostek, executive vice president of Honda North America Inc, said in a statement. The company said it was initiating new training regimens, changing internal reporting policy and enhancing oversight of its early warning reporting process.

What is the role of the TCI Hospital? The TCI Hospital provides the services that are identified by the TCI government and that are covered by the NHIP. The Hospital then collects co-pay fees on behalf of the TCIG. •
TCI Hospital is not responsible for and has no control over setting NHIP co-pay fees.

All NHIP co-pay fees paid at the Hospital are turned over to TCIG and are not retained by the Hospital.

All monthly contributions in accordance with the NHIP Ordinance are deducted by and paid to NHIB and not to TCI Hospital.

TCI Hospital has no role in determining what services or benefits NHIB makes available to its beneficiaries.

Who makes decisions about overseas treatment? •
If the Hospital’s clinical staff finds that a patient’s medical care needs cannot be provided in the Hospital, the NHIB is advised of that fact and the NHIB then manages the transfer process.

The NHIB is responsible for deciding to which overseas hospital in which country patients will be sent. That decision is not made by TCI Hospital.
What should I do if I have questions about my benefits or concerns with my NHIP card? The NHIB has excellent service representatives located at Salt Mills Plaza in Providenciales (649 941 8861) and in Grand Turk on Hospital Road (649 946 2611). If you have a problem with your card, contact them immediately. The Hospital does not approve NHIP coverage or issue NHIP cards to patients. NHIB has provided the Hospital’s patient registration services with software to allow quick identification of eligibility when the NHIP card number is entered into this system. If there are issues with your card contact NHIB immediately so they can investigate and respond to you. No Bravo, Pollard for World Cup
Dwayne Bravo Dwayne Bravo and Kieron Pollard are not part of 15-man West Indies World Cup squad according to Dinanath Ramnarine, the former West Indies legspinner and former longtime president of West Indies Players Association. “Confirmed Bravo and Pollard are both out of the 2015 WC,” Ramnarine, who was the WIPA CEO and president between 2001 and 2012, said on his personal Twitter account on Thursday afternoon Caribbean time. Ramnarine’s tweet came as a surprise considering the WICB has not yet announced officially the World Cup squad even if there has been a growing speculation about Bravo and Pollard missing out
once they were left out of the ODI series in South Africa. Asked the source of his information, Ramnarine said he could not reveal but said it was true. The WICB, when contacted by ESPNcricinfo, did not want to respond to Ramnarine’s statement, saying that they would “neither confirm nor deny” the news and asked to await a formal announcement likely on Saturday if not later Friday once the first Twenty20 between South Africa and West Indies is over. There have been no public comments made by Bravo and Pollard. The two are currently with the West Indies squad for the three-match Twenty20 series. Last month Clive Lloyd’s selection panel dropped the trio of Bravo, Pollard and Darren Sammy from the fivematch ODI series against South Africa, starting on January 16. Jason Holder, an inexperienced fast bowler, replaced Bravo as the ODI captain while Sammy was later added back into the squad. The change in the ODI leadership came two months after West Indies pulled out of their tour to India with one ODI, one T20 and three Tests pending, due to a protracted disagreement between the players, the board and the players’ association over the payment structure specified by the players’ revised contracts. Bravo had vocalised the players’ stance in several
letters to the WICB and WIPA. According to Ramanarine, the WICB had ignored the advice of its own task force set up to investigate the contracts dispute, which lead to the players pulling out of the India tour. The task force - comprising Michael Gordon, Wes Hall and Richard Cheltenham - said all three parties including WICB, WIPA and the players carried the blame for the debacle. “WICB set up their own Task Force - Task Force findings - WICB wrong, WIPA wrong and Players wrong End result - Pollard & Bravo get dropped,” Ramnarine, who tussled long, hard and frequently with WICB during his WIPA role, said. 24 US cities express interest to host Centennial Cup America Gibson teams up with Usain MIAMI, Florida -- CONCACAF, CONMEBOL and the United States Soccer Federation revealed yesterday that 24 US metropolitan areas have indicated their interests in hosting matches during the 2016 Centennial Cup America. These cities are planning to submit proposals to the event’s Local Organising Committee, US Soccer, to host matches during the historic centennial edition of the South American championship. The 2016 edition of tournament, which will take place in June, will mark the first time this world-class event has been staged outside of continental South America. “We are looking forward to taking the first step in the organisation of this historic event that will unite the Americas and the world in 2016,” said CONCACAF president Jeffrey Webb. “The unique opportunities that
we have with the Centennial Cup America, flanked by the 2015 and 2017 Gold Cups, will help set the stage to demonstrate how our region is ready to welcome back another FIFA World Cup in 2026.” It is anticipated that between eight and 13 stadiums will ultimately be selected. One important factor in determining the winning bids will be a recommended stadium seating capacity of at least 50,000, as this high-profile tournament is sure to draw multitudes of fans to each stadium selected. “The interest level from cities across the nation has been phenomenal,” said US Soccer president Sunil Gulati. “Everyone understands the tournament will be a huge event during the summer of 2016 and it’s exciting to see all of these cities putting together bids to be involved.”
The deadline for proposals is March 16, while winning cities will be announced in May. Florida man pleads guilty to helping baseball star flee Cuba
MIAMI - A Florida man who received $2.5 million after helping to smuggle Los Angeles Dodgers slugger Yasiel Puig out of Cuba pleaded guilty on Tuesday, according to court documents. Gilberto Suarez, 40, faces up to 10 years in prison at a March sentencing for conspiring to bring in or harbor aliens. In his plea agreement, he acknowledged coaching Puig on his 2012 defection from the communistcontrolled island. After leaving Cuba, Puig, now 24, signed a seven-year, $42 million
contract with the Dodgers. Suarez received about $2.5 million, according to the plea agreement, which said the payout came from a Dodgers player, but did not specifically name Puig. Under his deal with prosecutors, Suarez agreed to forfeit a bank account, house, condominium, a 2014 Mercedes-Benz and three handguns. Suarez was “starting to prepare for the next court hearing,” his lawyer, Bijan Parwaresch, said in an email. Suarez is accused of paying
$250,000 to a group connected to a Mexican drug cartel to get Puig from Cuba to Mexico’s east coast, according to an indictment. He later instructed Puig to rent a car after he arrived in Mexico and to drive 750 miles (1,200 km) to the U.S. border at Brownsville, Texas, the plea agreement said. Major League Baseball has voiced concerns over human traffickers helping Cuban players leave the country for the United States and lucrative contracts, although it says its own policies are not to blame.

The pads that rest on your ears can be removed and washed, and despite that feature, silicon seals the internals to keep them dry when you’re all sweaty and gross. Cord tangles won’t be an issue either, as Trainer connects via Bluetooth and claims 10 hours of playback before needing to recharge. The headphones also appear to have onboard controls of some sort, but Gibson didn’t mention those in the announcement, so we’ll seek to clarify that once we get a closer look.
