fter delaying for more than a month, the United Kingdom’s (UK’s) Foreign and Commonwealth Office (FCO) has overturned the Turks and Caicos Islands Cabinet’s decision to deny funding for defendants in the corruption trial and instructed the Governor to pay the $2.6 million requested. This was confirmed by Dave Moore, Head of the Governor’s Office, who told The SUN that Governor Peter Beckingham “duly instructed” the Chief Financial Officer to take the necessary action” on September 13th, and informed the Premier Hon. The UK Government, having intervened in the Turks and Caicos Islands, has a responsibility to follow through with the required financial commitment. Not to do so would be to risk the UK Government’s credibility in its use of reserved powers. Fourth, it is unreasonable to expect the small population of the TCI to bear the financial burden, through debt or taxation, for funding the investigation and prosecution of corruption for which they were not responsible. We recommend that the UK Government fully fund the work of the SIPT or
risk severely undermining its own credibility in its use of reserved powers, both in the TCI and in all the Overseas Territories,” the report said. Special Prosecutor Helen Garlick is on record telling the Governor and the Foreign and Commonwealth Office that it would be wrong in principle to pay her huge sums of money while forsaking the people of the Turks and Caicos Islands. She said: “There is a real prospect there will be months when the SIPT’s expenses and salaries will be met, whilst TCI Government servants, including police officers, with whom we may be working, will not. There is also a distinct possibility that other important government expenditure
that has a real impact on the well being of the Islanders will be subordinated to the SIPT’s needs.” Garlick added: “I have asked the question why a separate source of funding from HMG cannot be found for the SIPT. I have been told that it is impossible. My understanding is that the FCO has no budget for this type of expenditure and that there is no other realistic government source of funding, with the exception of DFID. I am aware that there is a traditional objection to providing support for a prosecution, I assume because DFID and other government departments do not wish to appear to be adopting a partisan stance. If that is a material objection in this case, then I would comment that
larger issues are at stake here than simply securing convictions against particular individuals. The Public Inquiry was initiated by Her Majesty’s Government, as a direct result of the recommendations of the Foreign Affairs Select Committee and it was also Her Majesty’s Government that decided upon the partial suspension of the Constitution and my appointment. Through no fault of their own, the TCI police and the Attorney General’s office lack the experience or the capacity to conduct this investigation and in the case of the former, largely because of the size of the population and family interrelationships, they do not have public confidence. “
TCI To Host First Annual Lionfish Festival The Turks& Caicos Islands are to host its first annual Lionfish Festival. The Festival, hosted by the Ministry of Tourism, Environment, Heritage and Culture’s Department of Environment & Coastal Resources (DECR) and the Department of Culture, in conjunction with the Turks & Caicos Reef Fund, will be hosted on Providenciales and Grand Turk respectively and will include a REEF-sanctioned Lionfish Derby. “Although it is a beautiful animal, lionfish are not supposed to be in the wider Caribbean region, but were introduced off the coast of the US and spread down through the Bahamas. Some TCI fishermen have been catching lionfish on a small scale for many years, and they know that although it’s invasive, lionfish is a very tasty fish. However, these fishers do not typically target lionfish heavily because crawfish, conch, and other finfish are more profitable. So, we hope that the festival results in many lionfish being caught (and eaten) which will give our reefs a helping hand and also raise awareness about this invasive species. Above all we hope the events are fun and that many people from all walks of life come to take part. ” said DECR Director, Dr John Claydon. Provo’s Lionfish Festival is slated for October 29th at Turtle Cove Marina and Grand Turk the following week on November 5th 2016,
at the Library. Fishermen, watersports and dive operators are all encouraged to participate in the derby, which will kick off early in the morning. Family fun will follow with games for the kids, live music, watching of the scoring, free lionfish samples, filleting and dissection demonstrations, and a Q&A session about lionfish. The Lionfish derbies will be a single day competition to collect and remove as many lionfish as possible. Teams will collect lionfish by spearing while free diving or snorkelling. Teams will begin competing at sunrise and will be required to bring their catch to the scoring station by 3:00 pm (South Caicos residents can participate in the Grand Turk Derby and the School for Field Studies will conduct scoring on South Caicos and report it to the organizers on Grand Turk. Each fish will then be measured, and cash prizes are awarded for teams catching the most, biggest, and smallest lionfish. Not known to have any native predators, lionfish are greedy predators that prey on native fish and crustaceans in large quantities. Invasive predators, such as the lionfish, can pose a major threat to marine fisheries, habitats, and eco-system function. The First Annual Lionfish Festival hopes to draw attention to the Atlantic Lionfish invasion and help promote development of the commercial Lionfish market. Lionfish

My campaign team is mystified by the actions of my PDM opponent, Ralph Higgs who barged into our campaign office,
showed complete disrespect for our staff and forcefully removed materials from the office which caused me to seek the intervention of the police to retrieve our property.” He added: “The police were quick to respond and have since retrieved our property from Mr. Higgs. TCI and other UK overseas territories could be affected by EU tax crackdown Eight British overseas territories and crown dependencies, including Turks and Caicos Islands, the British Virgin Islands and Cayman Islands, could face EU economic sanctions after Brussels identified them as having low or no corporation tax. According to reports in the UK media, experts have published a scorecard showing red flag warnings set against a list of the 81 countries that may attract companies or individuals seeking to avoid or evade European taxes. The scorecard will be discussed among member states before a shortlist of countries is selected for further screening and whittled down to a definitive EU list of tax and secrecy havens, to be published at the end of next year. In the meantime, discussions are under way as to sanctions that the EU could impose on countries included in the final list. Options being discussed include the introduction of additional taxes, known as “withholding taxes”,

Dominican man shot dead during home invasion Police are investigating the death of a 56-year-old Dominican man who was shot dead during a home invasion on the night of Sunday, September 11th. According to police spokesman Kevin Clarke, the man, Feliciano Antonio Garcia Quin was near a house on Walter Cox Drive in Kew Town, with another man and a woman around 8:06 p.m., when they were approached by an unknown man dressed in dark clothing with a mask over his face and gloves on. The man pointed a gun and forced them inside the house and demanded cash. Whilst inside the house, there was a scuffle and Quin received a single gun-shot wound. The suspect then fled the scene and Quin was later pronounced dead by Dr. Adolphus. Clarke said a 26-year-old man is in police custody assisting with the investigation. However, he said, it is still too early in the inquiry to determine whether this man was involved in the murder, therefore police are urging anyone with information about this incident to contact police and the information will be treated in the strictest of confidence.

Man jailed for cocaine Eddy Cerant, 44, appeared before the Magistrate on Friday September 9th, and pleaded guilty to possession of controlled drugs. Acting on information last Wednesday, police officers responded to the Providenciales International Airport in search of Mr. Cerant who had just arrived from Grand Turk ariund 6:3o p.m. Officers detained and
searched him and found a quantity of suspected cocaine wrapped in a transparent condom from his anal area. When questioned by officers about the finding he made no reply. He was arrested and later charged. Mr. Cerant was sentenced to 9 months in prison for being in possession of the 114grams of cocaine. Deportation was recommended after serving time.
Responsibility of persons to safeguard themselves from becoming victims of crime By Kevin Clarke The Royal Turks and Caicos Islands Police is committed to ensuring public safety and reducing the fear and incidence of crime in the Turks and Caicos Islands. However, there are many things each and everyone can do to reduce his or her chances of becoming a victim or prevent the incidence of crime from happening. From time to time Crime Prevention tips are posted on our website, Social Media pages, and the newspapers for awareness to the public, but they apparently are not taken seriously. There are reports of persons getting burglarized because they left their window or door unlock and went to bed or went out. We still get reports of vehicles being stolen because the owners left the keys in the ignition, or vehicle being vandalized because owners left items such as handbags, purse or valuable items visible where they can be seen. All these are crimes of opportunity and makes persons vulnerable to becoming victims. Crimes occur because we open ourselves and our families to criminal opportunities. Talking to strangers, taking for granted one’s safety outside the home, etc. make us easy prey to criminals. In the fight against crime, knowing that the worst can happen makes you less prone to be a victim and more confident of avoiding disasters. Protecting yourself, your family and your home is a matter of responsibility that cannot be taken on by anyone else. You can make the difference. What can you do to protect yourself and family at home? 1.Ensure all doors and windows have locks in working condition. Keep only that is used to enter the house open, all other entry points to your household should be securely locked to prevent unnoticed entry into your home. 2.Make it a habit to check that all doors and windows are locked at night before going to sleep. If you and your family are going on a vacation, ask a neighbor to watch your home, or ask a relative to stay in your home while you are away. An empty house is a prime target for criminal elements.

Police say beware of online scams
The Financial Crimes Unit of the Royal Turks and Caicos Islands Police Force continue to investigate instances of individuals being subject to crime on the internet. But lawmen said that despite persons telling their stories of how they have been victims of these criminal activities, persons are still making themselves vulnerable and easy targets by not taking the necessary steps to protect their online activities and sometimes. “Tthey just cannot resist the false rewards offered in partaking in the scam,” the police said in a press statement. The press release added: “In a few short months, the holiday season will begin to heat up, more people will be shopping online, and more criminals will be trying to steal their information and with the advances in electronic communication, they don’t necessarily need to be face to face to steal from you. Scams are always evolving, and criminals can go to great lengths to cause people to part with their money.” It continued: “You might have seen lately
on your Facebook newsfeed-or on other Social Media outlets that Facebook is hiring. It seems that they’re looking for people interested in joining their “Work at Home Program” and making money from the comfort of their bedroom. There are mentions of the program being featured on CNN, US Today, or ABC. This leads you to believe that the program will bring in thousands of dollars a month. You are required to open the application page, then asked to provide your name and email address to ‘check availability.’ A next page will then pop up congratulating you on being eligible. That’s when you are invited you to download a ‘Facebook Millionaire’ kit for only four dollars. However, little do you know that your credit card will be charged $94 per month for continued access. Facebook does not have this program. It’s a fake. Ignore the “Make Millions from the Comfort of Your Home” deals, especially if they come with a “Limited Positions Available” tag. Here are some simple steps to help

$500,000 investment for TCI’s national stadium

Deputy Premier and Minister of Education Hon. Akierra Missick has confirmed that this financial year, a $500,000 investment will be made at the Turks and Caicos Islands National Stadium in Providenciales. The National Stadium which is used by Turks and Caicos Islanders, residents who live here, the schools as well as British West Indies Colligate is currently in serious state of disrepair and will soon get the face lift that people of the TCI want to see. In an interview with The SUN Missick said Government has a $1.2 million project for the upgrading of sporting facilities around the islands. The first phase of that project is the Gustarvus Lightbourne Sports Complex which is currently underway for $250,000. She added: "This financial year it’s about $500,000 investment that would be made at the National Stadium that will fix the bleachers,
the media booth, the bathrooms, the fence, and bits of the track. All of that has been assessed by Public Works and we are awaiting them to complete the necessary tender for the upgrade works at the stadium.” The Deputy Premier said officials from Mondo, the company that specialises in building Olympic tracks, will come down during that process to assess the track. She added, “It’s our understanding that the track can be repaired by them and it’s not their view that we should purchase a new track immediately, but conduct the necessary urgent upgrades so that the stadium can be brought back to a level where international competitions and international timings can be done and hosted there.” Missick stated at the National Stadium the Government is still in negotiations with the education foundation, which is the governing body of the British West Indies Colligate and owners/registered proprietors of the Deputy Premier and Minister of Education Hon. Akierra Missick land which the stadium is currently
built on. That negotiation has come to an end and they have the draft paper with the lease for Cabinet. Missick said that they had to ensure that both parties were "meeting in the middle", and the lease will be approved in Cabinet and then executed by His Excellency Governor Peter Beckingham before his departure. As soon as they’re able to execute the lease and go to tender, the renovations will start. “These are our facilities and we should treat it as best as we can. I want to encourage the fitness that is happening, keep the kids active but remember to treat the stadium and the Gustarvus Lightbourne Sports Complex a little bit better in terms of disposing of your trash but works will be taken place,” she stressed. The National Stadium will be closed to make the necessary renovations, for health and safety reasons but more information will be released once the tender is confirmed, she added

National stadium in state of disrepair The National Stadium in Venetian Road, which in April 2007, hosted what is widely regarded as the best CARIFTA Games, has fallen into a state of disrepair. The track which was once regarded as one of the fastest and best tracks in the Caribbean, is now cracked and has several patches, while the field is overgrown. When a SUN team visited the location, damaged high jump beds were seen piled up in a corner and the bleachers were damaged. During the 2007 CARIFTA Games 12 new records were set and many of the athletes who ran there, went on to become world-famous.
Among them are Jamaica's Yohan Blake, who set two records in TCI and is now the second fastest man ever in the 100 and 200 meters and is one of the few persons to ever beat Usain Bolt. Barbadian Ryan Brathwaite, who also set a record here, went on to win the gold medal at the 2009 World Championship in the 110 meter hurdles. Kirani James of Grenada, also set a record at the 2007, won the 400 meters at the World Championships in 2011 and the gold medal at the 2012 London Olympics. Here are some photos of the stadium.

New lunch gazebo opened at Eliza Simons Primary School The Governor Peter Beckingham officially opened a new ‘lunch gazebo’ at Eliza Simons Primary School on Thursday September 15th to replace one destroyed by hurricane Ike in 2008. This marked the culmination of many months of hard work from across the TCI community and beyond. School principal Mrs. Juliet Arthur –Thelwell welcomed everyone, followed by a blessing from school Chaplin, Dr. Linda Williams, and remarks from Mr. Russel l Cox , Deputy Secretary, Ministry of Education , Séamus Day President of Grand Turk Fishing Tournament (GTFT) Inc. and H . E . The Governor, Hon. Peter Beckingham and a vote of thanks by school teacher Mrs. Denise Jagroop. The structure will serve
many functions and has been built to a very high durability standard by Olympic Construction Ltd, and is already seeing heavy use by the students. Mr. Day said the GTFT Inc. fishing tournament raised funds thorough its 2015 tournament to build the structure, and would like to thank the entire TCI community for their incredible support, with far too many supporters and sponsors to mention individually. He added: “Deserving special mention are the principal, teachers and students of Ona Glinton (North) Primary School for putting their allocation of funds raised in the 2015 tournament towards this project, in a true and admirable community spirit. Bermuda Commission of Inquiry granted extension The Commission of Inquiry will be given until the end of the year to complete its investigation, it was confirmed. The panel, chaired by Sir Anthony Evans, was formed to look into the findings of the Auditor General’s report on the Consolidated Fund for the 2010, 2011, and 2012 financial years. Originally it was given 20 weeks to complete its work but has now been granted an extension, an agreement reached before the commission began its work. “Our terms of reference provided that the Commission was to submit its findings and recommendations within 20 weeks of appointment or such longer period as Premier Michael Dunkley may from time to time direct,” said Sir Anthony. “We provided two reasons to the Premier for our request for an extension — the need to prepare fully for our next public hearing, and to be as fair as we can be to the witnesses who will be required to appear at the hearing. “We are grateful to the Premier for granting our request as the extension will ensure we have time to consider all that has been said, to follow up on any issues that arise and are outstanding following the hearing, and to prepare our report and make our recommendations.” According to the Royal Gazette, Sir Anthony noted that the Commission had posted a set of rules on its website at www.inquirybermuda.com in the Documents section that outlines procedures the Commission intends to follow in a number of areas. The Commission’s next hearing will be held on Wednesday, September 28 at St. Theresa’s Church Hall, Laffan Street in Hamilton, beginning at 10.00am. In addition to Sir Anthony, an international jurist and former Bermuda Court of Appeal judge, lawyer John Barritt, businesswoman Fiona Luck and businessman Kumi Bradshaw are members on the Commission. Meantime, Bermuda Emissions Control’s bid to avoid an investigation by the Commission of
Inquiry may have been scuppered by the Supreme Court. A legal effort to prevent the investigation has been ruled invalid. However, according to a Supreme Court judgment, the court has agreed to stay the effects of a summons issued by the commission on the company until further legal arguments can be heard. BEC contends that the decision of the Premier to appoint the COI is invalid, as is the decision by the COI to investigate the TCD emissions centre. Prior to a court hearing, a summons had been issued ordering the BEC to appear before the commission and produce documents. In that hearing, lawyer Eugene Johnson, representing BEC, argued that the scope of the COI was too broad, and any commission which was so broadly framed as to purportedly empower it to determine the scope of its own jurisdiction is unlawful. However, Chief Justice Ian Kawaley found that there was “no serious contention” that the commission was given a roving brief to investigate whatever it saw fit. “There is on what I consider to be a proper reading of the COI’s commission no credible basis for concluding that the commission is invalid because, as is contended, ‘the Premier unlawfully delegated the power to set the scope of the public inquiry to the Commission, pursuant to paragraphs 1 and 9 of the Commission’s Terms of Reference’,” he wrote. On the basis of that ruling, he said the claim that the COI could not investigate the TCD emissions centre also failed. “At the practical level BEC complained that it contracted with the Government before the period covered by the Auditor-General’s report,” the Chief Justice continued. “The COI very convincingly counters that its contract is potentially relevant because, pursuant to the governing contract, funds paid to the applicant are referenced in the relevant section of the report as amounts not approved by

Jamaica signs cultural MOU with Mexico, Marley statue unveiled MEXICO CITY – A cultural cooperation Memorandum of Understanding (MOU), has been signed between Jamaica and Mexico – symbolizing a commitment between the cities of Kingston and Chetumal to work towards the enhancement and development of their cultural and creative industries. Jamaica’s Minister of Culture and Entertainment, Olivia “Babsy” Grange, who is currently in Mexico said that under the MOU, the parties will focus on several activities. “Such as the promotion of artistic and cultural exchanges; the distribution and sharing of information and research, assistance to support professional development in culture and the arts and collaboration in the creation and protection of cultural content and creative industries.” She said the MOU between Chetumal – located on Mexico’s east coast, and Kingston, was significant and strategic as Kingston was recently designated a UNESCO Creative Music City and one of the components of the designation is pursuing collaborations with other cities in creative sectors. “However we have an opportunity to forge a special relationship with Chetumal,” said Grange, adding that – “Chetumal is the gateway, it is the place where Reggae enters Mexico.” During her visit to Chetumal, Grange also participated in the unveiling of a statue of Reggae icon, Bob Marley done by renowned sculptor, Ricardo Ponzanelli. Cuba says Obama’s easing of embargo hasn’t helped economy HAVANA — President Barack Obama’s easing of the U.S. trade embargo on Cuba has had virtually no positive effect on the island’s economy, Cuba’s top diplomat asserted Friday. Presenting Cuba’s annual report ahead of a U.N. vote on condemning the embargo, Foreign Minister Bruno Rodriguez said the sanctions cost his country $4.6 billion last year. The total cost of the 55-yearold embargo now stands at $125.9 billion, he added. The presentation of Cuba’s update on the embargo is an annual ritual driving home to a mostly domestic audience Havana’s message that U.S. sanctions are to blame for most of the country’s problems. The report contains a detailed accounting of both specific damage from the embargo, such as U.S. government fines on Cuba’s business partners, and scenarios in which Cuba faults the U.S. for the loss of hypothetical business. million cases of Havana Club rum in the United States each year and factors in that theoretical lost revenue, $105 million, to the total damages in the report. However, he said, “there’s been no fundamental change in the application of the blockade, and because of that, I can say, there hasn’t been a greater economic impact of the executive actions until now and there won’t be until we see bigger steps.” Rodriguez acknowledged the problems of Cuba’s centrally controlled economy, which is struggling to increase productivity in the face of an outdated and inefficient bureaucracy and low state salaries that lead many employees to steal from their workplaces or accept small bribes in order to get by.

These and other moments from the trial led the Canadian Judicial Council to open its investigation. Camp, the council said, “engaged in stereotypical or biased thinking in relation to a sexual assault complainant.” Testifying at the hearing Friday, Camp offered this defense for his comments: “a nonexistent” knowledge of Canadian criminal law. The South African-born judge said he didn’t receive training on sex assault cases. In his legal career, he focused mostly on contract and bankruptcy cases, he said. “My colleagues knew my knowledge of Canadian law was very minimal. It was nonexistent,” he said at the hearing Friday. “Please remember I wasn’t in this country through the 1960s, ‘70s and ‘80s.” He also apologized to the woman for his comments, calling them “rude and insulting.”

The attack occurred just before 5 p.m. local time near Madison Square Garden, NYPD spokeswoman Sophia Mason said. “Apparently the suspect assaulted one of the officers with some sort of sharp object, likely a meat cleaver, and shots were fired,” Mason said.
Further details on the incident were not available. Both officers were taken to an area hospital and likely to survive, though the extent of their injuries was not immediately available. One officer was injured by the meat cleaver, while the cause of the injuries sustained by the second officer was not immediately available, Mason said. erosion of our tax base,” Treasury Assistant Secretary for Tax Policy Mark Mazur said in a statement. The fight for multinational tax revenues escalated on Aug. 30 when the EU ruled Ireland was giving improper state aid to Apple in the form of a deal for low taxes. The EU ordered Apple to pay Ireland 13 billion euros ($14.6 billion) in back taxes, prompting U.S. Treasury Secretary Jack Lew to express concern the EU ruling could undermine the U.S. tax base. Analysts have speculated whether Apple would be able to cut its U.S. tax bill by claiming foreign tax credits for its extra tax bill in Ireland. Under normal circumstances, U.S. companies can reduce the taxes they owe the U.S. government by the value of the tax credits they claim for taxes paid abroad on foreign profits. No U.S. tax is due on those profits until they are brought into the United States, or repatriated. The new rule will prevent companies faced with back tax bills from “splitting,” a strategy that allows companies to bring foreign tax credits into the United States without
repatriating the income from which they were derived. Apple had no comment on Treasury’s tax notice. The technology giant is not the only U.S. company in the crosshairs of EU state aid investigations. Starbucks Corp has been ordered to pay up to 30 million euros ($33 million) to the Dutch state, while Amazon.com Inc and McDonald’s Corp are under investigation by the EU’s executive arm. The new rule was likely to ratchet up transatlantic tensions over corporate taxes while eliminating one more strategy U.S. companies can use to cushion the blow from increasingly aggressive EU tax collection efforts. The tax notice specifically cited European Union state aid investigations as a risk to U.S. revenues. The Treasury had no comment on whether its notice would have an impact on Apple directly, but a spokesperson said the notice applies to all companies required by a foreign government to pay additional taxes, including those hit by state-aid cases.
MasterCard faces $18.6 billion UK lawsuit over fees LONDON — MasterCard is being sued for 14 billion pounds ($18.6 billion) on behalf of British consumers for allegedly charging excessive fees on millions of transactions over a 16year period. The suit, which is the latest in a string of legal cases around the world over card companies’ fees, could bring a payout to 46 million British MasterCard users, the law firm filing it says. The firm, Quinn Emanuel, says the claim is the largest in British legal history. The suit alleges that MasterCard charged stores unlawfully high fees on credit and debit card transactions between 1992 and 2008, which were passed on to consumers in the form of inflated prices for goods and services. “The filing of this claim is the first step towards consumers obtaining compensation for what MasterCard did,” said Walter Merricks, a former U.K. financial services ombudsman who filed the suit through Quinn
Emanuel on Thursday at the Competition Appeal Tribunal. Merricks callied it “a watershed moment for consumer redress in this country.” MasterCard and its larger competitor Visa have been embroiled in legal battles with merchants over their fees for decades. Simmons' vision did not 'align' with WICB's – Muirhead WICB chief executive officer Michael Muirhead has said there was no one specific reason for the termination of coach Phil Simmons' contract, nor was it a sudden development. In a nutshell, Muirhead said, Simmons' vision did not "align" with the strategic approach of the WICB and the divide widened over the past few months, reaching a point where a final decision had to be made. Tiger can add to 14 majors if he's healthy
Former world number one Martin Kaymer believes back injury victim Tiger Woods can add to his haul of 14 major championship wins as long as he returns to golf with a clean bill of health. Woods said last week that he hoped to make his comeback at next month's Safeway Open in California after spending more than a year on the sidelines.
