TEAM MEMBERS JOAN HARNED Joan has lived in Eagle County since 1972 and has been selling real estate with Black Bear Real Estate Co., predecessor of Keller Williams Mountain Properties since 1986. Joan was the 1998 Vail Board of Realtors “Realtor of the Year,” served on the Vail Board of Realtors as a Director for six years and was Chairman of the Vail Board of Realtors for 2003-2004. Joan also was appointed by Governor Owens to be a Director on the Great Outdoors Colorado Trust Fund Board. In 2004, Joan became an owner and Managing Broker for Black Bear Real Estate. In 2005, Joan became Managing Broker & one of three owners of Keller Williams Mountain Properties. She is a graduate of UC at Santa Barbara. After graduation, Joan worked as a flight attendant for a major airline for 20+ years, prior to her real estate career. Joan has been married to Tom Harned for over 41 years, has one son and nine delightful grandchildren. She enjoys walking, golfing and snowshoeing in addition to working at least full time.

LAURA SELLARDS Laura is a Colorado native and has lived in the Vail Valley since 1992. Before settling down in Eagle County, Laura spent several years teaching skiing in various Colorado and European resorts. She has owned and managed ‘Travel Vail’ a full service travel agency since 1999 and serves a wide range of clients from around the world including visitors and local residents. Buying a Short Sale Property For many buyers, going through the short sale process can be an interesting and sometimes time consuming journey. However, the reward can be a wonderful property at a great price. In a short sale, the lender must approve the sale of the short sale after an offer has been accepted by the Seller. The bank will most likely come back with a counter offer. If the counter is accepted the short sale process will quickly complete. This is not a complicated process, except that often there are many layers that need to be gone through to get to the decision makers and sometimes having the lender see today’s fair market value can also be a process. Here are some common questions when purchasing a short sale. : 1.
I made an offer on a short sale but it’s taking forever to hear a response from the bank? Can I withdraw my offer without a penalty? Yes, you can rescind your short sale offer any time before the bank accepts your offer. To cover all bases, you should have signed a short sale addendum that spells out your rights. An experienced short sale Realtor can help you with this.

I need to move into a house soon. Can I buy a short sale? If you are not prepared to wait for 3 to 6 months for that house, then you might not want to write a short sale offer. Short sales can take different amounts of time, depending on the lender you’re working with. Some are quick, some are slow…and some will not make it to closing at all. You have to be prepared to wait..

How long does it take to buy a short sale house? The timeline can vary greatly. We have had short sales approved in two weeks, and also had one that took well over a y ear. We like to shoot for 60-90 days to get all of the approvals and then close in 30 days after the approval. The best we can do is keep you updated weekly on the progress so that you can make informed decisions about going forward, or choosing to go another direction.

Should I buy a short sale property? If you have the luxury of time, then by all means put in an offer on a short sale, if it is a home you would like to own. If you use a competent Realtor, knowledgeable in short sales, such as those found on Team Black Bear, you will get the information and guidance you need to make an offer that will allow you to have the opportunity to get great value for your money. You will get weekly updates and be given all the information you need to make the best decisions all along the way in the process. We have had clients acquire fabulous properties, at great prices, out of short sales.

Buying a Foreclosed Property What are foreclosed properties?
A foreclosed property – also known as a Real Estate Owned (REO) or bank-owned property – is a home that was once customer owned but is now owned by the mortgage holder.
A foreclosure can occur when mortgage payments are not made over a period of time and efforts to resolve the default are unsuccessful.
How quickly can I take ownership?
The home appraisal, inspection and financing processes are similar to when you buy a traditional home. It is usually with 30 days after lender approval.
If it is a cash sale, it could be done as quickly as 10 days after Bank or REO approval.
Are bank owned properties sold at a discount?
Most banks are using fair market values that reflect the local market and property condition.
Properties range in condition from fully distressed to move-in ready. o
A distressed home may be sold at a slight discount if it is sold “as-is” with no repairs.
o
Move-in ready homes are typically priced at market value.
Do homebuyers get an advantage over investors buying foreclosed properties?
Some lending institutions provide a special five-day window that provides owner occupant buyers with a chance to bid on a home before we accept offers from investor buyers.

Definitions of Real Estate Brokerage Relationships A broker is required to advise you of the type of services the brokerage is going to provide. Colorado Law recognizes these services as the brokerage relationship. Different brokerage relationships are available which include seller agency, buyer agency or transaction-brokerage. Seller's Agent: A seller's agent (or listing agent) works solely on behalf of the seller to promote the interests of the seller with the utmost good faith, loyalty and fidelity. The agent negotiates on behalf of and acts as an advocate for the seller. The seller’s agent must disclose to potential buyers all adverse material facts actually known by the seller’s agent about the property. A separate written listing agreement is required which sets forth the duties and obligations of the broker and the seller. Buyer's Agent: A buyer's agent works solely on behalf of the buyer to promote the interests of the buyer with the utmost good faith, loyalty and fidelity. The agent negotiates on behalf of and acts as an advocate for the buyer. The buyer’s agent must disclose to potential sellers all adverse material facts actually known by the buyer’s agent including the buyer's financial ability to perform the terms of the transaction and if a residential property, whether the buyer intends to occupy the property Transaction-Broker: A transaction-broker assists the buyer or seller or both throughout a real estate transaction by performing terms of any written or oral agreement, fully informing the parties, presenting all offers and assisting the parties with any contracts, including the closing of the transaction without being an agent or advocate for any of the parties. A transaction-broker must use reasonable skill and care in the performance of any oral or written agreement, and must make the same disclosures as agents about all adverse material facts actually known by the transactionbroker concerning a property or a buyer's financial ability to perform the terms of a transaction and if a residential property, whether the buyer intends to occupy the property. No written agreement is required. Do you have to hire an agent if you just want to see a property? Absolutely not. However, you will be asked to sign a disclosure document which says that the licensee has explained Colorado Brokerage Relationship law to you. Page 12 of 12
