TEAM MEMBERS JOAN HARNED Joan has lived in Eagle County since 1972 and has been selling real estate with Black Bear Real Estate Co., predecessor of Keller Williams Mountain Properties since 1986. Joan was the 1998 Vail Board of Realtors “Realtor of the Year,” served on the Vail Board of Realtors as a Director for six years and was Chairman of the Vail Board of Realtors for 2003-2004. Joan also was appointed by Governor Owens to be a Director on the Great Outdoors Colorado Trust Fund Board. In 2004, Joan became an owner and Managing Broker for Black Bear Real Estate. In 2005, Joan became Managing Broker & one of three owners of Keller Williams Mountain Properties. She is a graduate of UC at Santa Barbara. After graduation, Joan worked as a flight attendant for a major airline for 20+ years, prior to her real estate career. Joan has been married to Tom Harned for over 41 years, has one son and nine delightful grandchildren. She enjoys walking, golfing and snowshoeing in addition to working at least full time.

BARBARA HOGOBOOM Barbara has been with Black Bear Real Estate Co., predecessor to Keller Williams Mountain Properties since 1994. She is a graduate of the University of Denver with a degree in accounting and practiced public accounting for 22 years prior to getting her Real Estate Broker’s license. Through further education, Barbara has also obtained the GRI Designation. Barbara is past President of the Western Eagle Valley Rotary Club and is Senior Warden for the Episcopal Church of the Transfiguration. Barbara lives in Eagle with her two sons.

LAURA SELLARDS Laura is a Colorado native and has lived in the Vail Valley since 1992. Before settling down in Eagle County, Laura spent several years teaching skiing in various Colorado and European resorts. She has owned and managed ‘Travel Vail’ a full service travel agency since 1999 and serves a wide range of clients from around the world including visitors and local residents. The travel industry provided a natural progression into a real estate career for Laura. Trust and service you can depend upon, integrity, knowledge and hard work are her ingredients for your success. Tom has been a licensed Real Estate Broker since 1972 and has lived in Eagle County since 1971. He has been a past president and board member of the Eagle Valley Chamber of Commerce and served as a Director for the Vail Board of Realtors. Short Sale A short sale occurs when the bank or lender who holds your mortgage is willing to sell the property for less than what is owed. It is a transaction between you, a buyer and your lender (the bank). When you fall behind on mortgage payments, and your property’s value is lower than the amount owed on the loan, a short sale is one option that can be used to stop foreclosure. The process is the same as a traditional home sale, however, the price has to be negotiated with the lender and they must approve the sale price of the house when an offer is submitted. This allows you to avoid foreclosure, and begin rebuilding credit much more quickly than with a foreclosure. Knowing how to help sellers maneuver the complexities of short sales as well as help buyers pursue short sale and foreclosure opportunities are not merely good skills to have in today’s market — they are critical. And while short sales and foreclosures are not for everyone, Team Black Bear agents have the proper tools and training to assist you. Your ability to close short sales and foreclosures depends in part on your confidence in seeing these transactions through. Several possible outcomes may result from listing your property as a short sale. The best option is, after listing your property, the bank accepts the offer and we can proceed with the closing process. Your house is successfully sold and you are then out from under your mortgage with no deficiency outstanding. After listing the property for sale and submitting an offer to the lender, they may deny the purchase price offered to them and continue to hold out for a higher price. This may result in a failure to get an offer at the lender’s desired price and the foreclosure process will continue on the property. Unfortunately, short sales are not always successful. Lenders are not obligated to agree to a short sale; therefore we cannot guarantee a successful short sale. However, Team Black Bear has an extremely high success rate in bringing short sale listings successful conclusions. We engage a short sale negotiator and will provide legal counsel, if the seller does not have or cannot afford an attorney.

Definitions of Real Estate Brokerage Relationships A broker is required to advise you of the type of services the brokerage is going to provide. Colorado Law recognizes these services as the brokerage relationship. Different brokerage relationships are available which include seller agency, buyer agency or transaction-brokerage. Seller's Agent: A seller's agent (or listing agent) works solely on behalf of the seller to promote the interests of the seller with the utmost good faith, loyalty and fidelity. The agent negotiates on behalf of and acts as an advocate for the seller. The seller’s agent must disclose to potential buyers all adverse material facts actually known by the seller’s agent about the property. A separate written listing agreement is required which sets forth the duties and obligations of the broker and the seller. Buyer's Agent: A buyer's agent works solely on behalf of the buyer to promote the interests of the buyer with the utmost good faith, loyalty and fidelity. The agent negotiates on behalf of and acts as an advocate for the buyer. The buyer’s agent must disclose to potential sellers all adverse material facts actually known by the buyer’s agent including the buyer's financial ability to perform the terms of the transaction and if a residential property, whether the buyer intends to occupy the property Transaction-Broker: A transaction-broker assists the buyer or seller or both throughout a real estate transaction by performing terms of any written or oral agreement, fully informing the parties, presenting all offers and assisting the parties with any contracts, including the closing of the transaction without being an agent or advocate for any of the parties. A transaction-broker must use reasonable skill and care in the performance of any oral or written agreement, and must make the same disclosures as agents about all adverse material facts actually known by the transactionbroker concerning a property or a buyer's financial ability to perform the terms of a transaction and if a residential property, whether the buyer intends to occupy the property. No written agreement is required. Do you have to hire an agent if you just want to see a property? Absolutely not. You will be asked to sign a disclosure document which says that the licensee has explained Colorado Brokerage Relationship law to you.
