AN INTRODUCTION

The Swinton Sale includes a selection of fine English and Continental Furniture, Paintings, Sculpture, Chinese Works of Art, Silver, Meissen, Sèvres, Books and Objets d’Art from one of Yorkshire’s most important landed estates.

The Swinton Estate, which spans approximately 20,000 acres, encompasses some of the most beautiful landscape in North Yorkshire and has been in the ownership of the Cunliffe-Lister family since the 1880s. The Earl of Swinton is a title in the Peerage of the United Kingdom. It was created in 1955 for the prominent Conservative politician Philip Cunliffe-Lister, 1st Viscount Swinton. The 1st Earl, who was a close friend of Sir Winston Churchill, was succeeded by his grandson in 1972 because his son, Major the Hon. John Yarburgh Cunliffe-Lister lost his life whilst serving his country in the Second World War. The 2nd Earl, David Yarburgh Cunliffe-Lister, notably served as Captain of the Yeomen of the Guard and deputy Chief Whip in the House of Lords under Margaret Thatcher from 1982 to 1986. In 1959 the 2nd Earl became engaged to Susan Sinclair, the daughter of Sir Ronald Sinclair of Dunbeath Bt. Shortly before their marriage, Susan, the future Lady Masham, suffered a life changing injury when she was thrown from her horse causing her to be paralysed from the waist down.

Undeterred by this tragic accident the marriage went ahead and was widely reported in the national press. The newly married couple proceeded to design and build a spectacular house not far from Swinton Park to accommodate Lady Masham’s injury, which became the family seat and was named Dykes Hill House. The 2nd Earl died in 2006 and his widow Susan Cunliffe-Lister, Countess of Swinton, Baroness Masham of Ilton, DL, continued to lead a full life as a British crossbench member of the House of Lords. Amongst her many achievements, she was a former Paralympic athlete and was also the founder and lifelong President of the Spinal Injuries Association. She died on 12th March 2023.

Whilst a number of the chattels have been retained by the family, the remaining contents of Dykes Hill House provide a rare glimpse of what epitomises the quintessential taste of the English aristocracy. Amongst the many items included in the sale are a pair of William IV Silver Candelabra by John Houle (estimate: £8,000-12,000 all figures exclude buyer’s premium), which belonged to the former Prime Minister Sir Robert Peel, and a spectacular painting depicting a view of Santa Maria della Salute at the entrance to the Grand Canal in Venice, attributed to a Follower of Bernardo Bellotto (estimate: £7,00010,000). There are finely mounted pieces of Chinese ormolu porcelain acquired by Samuel Cunliffe-Lister, 1st Baron Masham of Swinton, around 1890 for Swinton Park. There is also a handsome Charles II Black Japanned Cabinet on Stand highlighted with gilt decoration dating from the late 17th century (estimate: £3,000-5,000) and a highly chased William IV Silver-Gilt Kettle on Stand by Paul Storr (£6,000-8.000), and a George II Silver-Gilt Cup and Cover, presented to Lt. Co. Thornton Sn by the non-commissioned officers and soldiers serving under him in the Yorkshire Regiment in 1795 (estimate: £4,000). Of historical interest are a George VI Silver Seal Matrix of the Duchy of Lancaster and a George VI Silver Seal Matrix of the County Palatine of Lancaster, which belonged to Philip Cunliffe-Lister, Viscount Swinton and later 1st Earl of Swinton, who held the position of Chancellor of the Duchy of Lancaster (estimate: £3,000-5,000 each). As tradition dictated, holders of this office were presented with the official seals on the death of the monarch.

Overall, this sale offers an exceptional opportunity to acquire works of art that have been collected over many years with taste and foresight.

Philip Cunliffe-Lister, Viscount Swinton and later 1st Earl of Swinton (1884-1972) as Chancellor of the Duchy of Lancaster and by descent.

An earlier example of the seal-matrix made for the County Palatine of Lancaster is in the collection of the British Museum (1981,03030.2). Used during the reign of Edward VII it was presented to Jack Pease, 1st Baron Gainsford (1860-1943) during his time holding the office of Chancellor of the Duchy of Lancaster, an office he held on the death of Edward VII in May 1910. As was tradition for holders of this office on the death of the monarch he was presented the seal as a perquisite of office. That example was designed by George William de Saulles and made by Frank Bowcher. It was to remain in the possession of Lord Gainsford until 1941 when it was sold at Sotheby’s, being purchased by Baldwin’s who in turn sold it to a private collector.

This seal-matix for the Duchy of Lancaster, and the previous lot for the County Palatine of Lancaster, are rare survivals as, while it was normal that the holder of them would be allowed to keep them as a ‘perquisite’, or ‘perk’, of office it was however expected that the keeper would deface them so that the seal could not be used by anyone who did not have the authority to do so. It was tradition that the owner would use the silver the seals were made from to produce an item to commemorate the original use. For example, Sir Nicholas Bacon (1509-79) used the silver from the ‘Great Seal of Englande’ as used by Queen Mary I to produce three cups, one for each of his children, one of which is now in the collection of the British Museum (1915,0313.1). Perhaps the most famous example is the salver made for Sir Robert Walpole by Paul de Lamerie. This example, engraved by William Hogart with the seal of the Chancellor of the Exchequer, is now in the collection of the Victoria and Albert Museum (M.9-1956).

Presented along with the Freedom of New Ross to the Reverend James Thomas O’Brien, Bishop of Ossory, almost certainly given to his daughter Dora Letitia O’Brien who married Lieutenant-Colonel Yarburgh George Lloyd-Greame (1840-1928) and by descent.

The inscription reads ‘The Freedom of the Corporation of New Ross Presented to the Rev’d Ja’s Thomas O’Brien F.T., C.D. As a Testimonium of their high regard for his character as Scholar and a Gentleman 1827’.

A silver-gilt snuff-box of very similar profile and with nearly identical borders by the same maker, though set with a micromosaic depicting the Colosseum, is in the Rosalinde and Arthur Gilbert collection, on loan to the Victoria and Albert Museum, London (Museum no. Loan:Gilbert.9272008).

Numerous other caskets of a similar form, usually marked for Augsburg are known, for example one by Johann Balthasar Sedletzky which as sold Sotheby’s, London, 23 January 2014, lot 126 and another by David Schwestermuller which was sold from a distinguished Swiss Collection, Christie’s, London, 8 July 2015. The applied busts are reminiscent of those on two pairs of wall sconces by Friedrich Kettwyck, Hamburg, circa 1670. The four sconces were made for Georg Ludwig, Elector of Hanover and descended through the German Royal family until the 1920s when they, along with much of the other royal German silver was sold through the Austrian and English trade.

A Pair of Charles II Silver-Gilt Bowls and Covers, Apparently Unmarked, Probably London, Circa 1680, In the Manner of Thomas Jenkins each compressed circular and on short octagonal foot, the sides chased with four landscape vignettes with foliage scrolls and grotesque masks between, all on a matted ground, with leaf-cast scroll handles, the detachable covers similarly decorated and with fruiting melon and leaf finial 15cm wide, 20oz 7dwt, 649gr (2)

The inscription on the cover reads ‘Veritas Prevalebit August 15 1795. The Committee request that these lines may be added to the Plate. To Lt. Col. Thornton Sn. The uniform steady conduct of the soldiers of the York at Robio Tiverton & Barnham Camps, will transmit your name with that degree of credit few attain to the latest posterity. Lt Col. Thornton entails the Plate voted by the Soldiers of the York to his Heirs’

The inscription on the bezel reads ‘The Non Commission’d Officers & Soldiers of the York Reg’t. requested Dr Trusley [?] to present to Lt. Col. Thornton in their name an Elegant Sword & Service of Plate, for which each Man would Subscribe one Week’s pay as a Testimonia of Their love & Veneration for him. which was done in the presence of Forty officers of rank, on the 3rd of May at the Turf Tavern, that day being the Colonel’s Birth day’.

Other items from the service are known to exist, for example a soup-tureen and cover by Charles-Louis-Auguste Spriman which is owned by the Musées Nationaux Récupération and on long-term loan to the Louvre, Paris (item number OAR426). The tureen is oval and with robust rams maskcapped handles and a finial formed as a hunting dog and its prey. In common with the present silver-gilt cup and soup-tureen tureen is engraved with an extensive presentation inscription to Lt. Col. Thornton and further engraved on each side of the cover and body with a crest.

The Colonel Thornton referred to in the inscription on both the present cup and cover and on the Spriman tureen is possibly Colonel Thomas Thornton (d.1823), the celebrated sportsman who at one time owned Allerton Park in Allerton Mauleverer. He was a colonel of the 2nd West Yorks Militia, which his father had also been a member of but a dispute in 1794 resulted in a court marshall and Thornton’s resignation from the regiment. The date of the inscription is interesting and suggests that the service was perhaps a gift to him by other members of the regiment who remained loyal to him. He was to later to describe the incident as ‘mutinous conspiracy’. He was a keen collector and Francophile, marrying twice. £2,500-3,500

The present bowls and covers would originally have formed part of a toilet-service, an important component of aristocratic silver and silver-gilt plate in the 17th century. The services, often given as a wedding gift from a groom to his bride, would include a mirror and the various dishes, bowls and boxes that a lady would require as well as, in some cases, candlesticks and other items. One such service is the Calverley Toilet service, made by William Fowle in 1683 and now in the collection of the Victoria and Albert Museum (museum nos. 240&A to M-1879). The Calverley service, so called as it was given by Sir Walter Calverley to his wife Julia Blackett, also includes a pair of covered bowls comparable to the present examples. It is suggested that ‘they might have been used for breakfast porridge, presented to the guests on the two salvers or tazze (the plural of tazza, a standing dish that may have been used to present food or as a stand for a bowl). Alternatively, they could have contained an oatmeal face wash, which was popular with both men and women’.

Another pair of bowls and covers formed part of a silver-gilt service made for Jane Bickerton, Duchess of Norfolk, (16441693). These bowls are very similar in form, size and weight to the present examples, with each described as being chased with landscapes within foliage and with bud finials. The Norfolk service comprised fifteen pieces of which only a pair of flasks are marked with the maker’s mark only of Thomas Jenkins. Despite being mostly unmarked it was suggested that the similarity of decoration makes it likely the pieces from the service all came from the workshop of Thomas Jenkins. The Norfolk service was to end up in the collection of Frederick, 2nd Baron Hesketh, eventually being offered for sale by Sotheby’s as part of the contents of Easton Neston, 17 May 2005, lot 950 £4,000-6,000

The crests are almost certainly those of Samuel Cunliffe-Lister, later 1st Baron Masham (1815-1906). He was elevated to the peerage in 1891, taking his title from the market town of Masham which was near Swinton Park, the country seat he purchased in 1888.

The crests are almost certainly for Philip Lloyd-Greame who later changed his name to Philip Cunliffe-Lister and was created 1st Earl of Swinton in 1955. He was married in 1912, the year the present mustard-pots were made, to Mary Constance Boynton, granddaughter of Samuel CunliffeLister, 1st Baron Swinton.

Born in Antwerp around 1676, de Grof trained as a sculptor in Paris, eventually entering into the service of Louis XIV. Whilst living in exile in Paris, Maximilian Emanuel, Elector of Bavaria, commissioned the bronze bust of himself in 1714. Following the Elector’s return to power in 1716, de Grof moved to Bavaria, where he became court sculptor. Modelling the now lost lead garden sculptures for the Nymphenburg and Schleissheim Palaces. Telephone Bidding

Requests for telephone bidding must be registered at least one hour prior to the close of the View Day. We will not accept requests on the Day of Sale. Telephone Lines are booked on a first-come, first-served basis and are subject to a minimum lot value of £500 for Fine Art Sales and £200 for all other sales.

Absentee Bidding

Whilst reasonable endeavours will be made to execute absentee bidding up to the Day of Sale, Tennants will not be liable for any default or neglect in connection with this service. All such arrangements therefore are made entirely at the Prospective Buyer’s risk.

AML Due Diligence

We conduct appropriate Due Diligence checks to comply with current Anti Money Laundering regulations for any buyer exceeding the threshold of £6,000. We reserve the right to withhold the purchased lots until such checks have been completed.

VAT

Value added tax or any equivalent tax chargeable in the UK or elsewhere.

Agency

We act as agents for the Seller, whose details remain confidential. If you buy at auction your contract is with the Seller, not us.

Export / CITES Regulations

CITES-restricted items and Ivory Exempt items will be accompanied by a current CITES Article 10 licence/Ivory Exemption Declaration where applicable and the licence/exemption declaration number will be displayed within the original catalogue description (required by UK law). Both CITES Article 10 licences and Ivory Exemption Declarations are non-transferable and buyers must apply for a new Article 10 licence/Ivory Exemption Declaration in their name if they wish to sell to a third party.

It is the sole responsibility of the buyer and/or contracted shipping agent to have in place the correct CITES re-export and import licences into the buyer’s chosen country before shipping can be undertaken.
