Health Insurance Exchanges This is the second in a series of articles to keep you informed about Health Insurance Exchanges (HIX) in Texas. The HIX is an online marketplace tool enabling consumers to shop, compare, and enroll in a health insurance plan. Future articles will focus on helpful reference Web sites and other information about the HIX.

TDA Perks at Southwest Dental Conference

As reported last month, the Patient Protection and Affordable Care Act requires each state to have an insurance exchange by 2014 and health plans participating in state exchanges must provide an “essential health benefits package,” (EHB) including a pediatric oral health benefit. The U.S. Department of Health and Human Services (HHS) has the responsibility to publish rules that specify the specific benefits included as part of the EHB. In December, HHS issued guidance on the HIX.

TDA Perks Program and several of its partners exhibited at this year’s Southwest Dental Conference in Dallas January 12-14, 2012. The Organized Dentistry Coalition responded to the guidance by sending a letter expressing concern that HHS needs to take additional steps to help ensure that the pediatric oral health benefit in the EHB package, “more accurately reflects the current market and provides a meaningful and comprehensive level of benefits for children.” In Texas, the TDA signed onto a letter from the Texas CHIP Coalition to HHS also advocating that the benchmark approach outlined in the guidance does not address the unique health care needs of children. Furthermore, the letter informed HHS that Medicaid, with the comprehensive coverage available through Early Periodic Screening, Diagnosis, and Treatment (EPSDT), would be the ideal national standard for children. The TDA will continue to closely monitor the HIX landscape in Texas and will publicize new information as it becomes available. Southwest Dental Conference TDASF co-hosted a party with DENPAC at the Southwest Dental Conference in Dallas in January. The party’s theme was Night Cap, where the décor resembled that of a 1940’s parlor room, and the food was complete with signature brandy drinks and cigars. Thanks to DENPAC Manager Leigh Ann Montague for allowing TDASF to be a part of such great event. During the party, TDASF held a silent auction to raise money on behalf of the Bragging Rights Campaign. The auction featured an array of items, including a beautiful crystal decanter, an exquisite selection of wines, and a solid Spanish cedar cigar humidor. It was a huge success and TDASF sincerely appreciates everyone that attended and contributed.

opening session of the House will convene at 8:00 am on Thursday, May 3, 2012, in Ballroom B on the street level of the San Antonio Convention Center in San Antonio, Texas. The second meeting of the House will be at 8:30 am on Saturday, May 5, 2012, in Ballroom B. The Sunday, May 6, 2012 meeting will be in the Marriott Rivercenter Hotel, starting at 8:30 am.

Every year it happens, but many do not even know. This “happening” is the election of officers of the Texas Dental Association, as well as Delegates and Alternate Delegates of the American Dental Association House of Delegates. The slate of nominees/ candidates comes from the caucus meetings of each division (NE, SE, SW, NW), held on the Friday of the Annual Session at 5:15. The election is by the TDA House of Delegates on the final day of the House. The entire membership of the association can attend the caucus meetings, but the turnout for these elections is usually sparse.

REFERENCE COMMITTEE HEARINGS: Reference Committees will meet on Thursday, May 3, 2012, in the Convention Center (please see the on-site program for specific room assignments). Reference Committee A will start at 11:00 am or 15 minutes after the adjournment of the House of Delegates, whichever is later. Reference Committee E will start at 12:00 noon. Reference Committee B will start at 1:00 pm Reference Committee C will start at 1:30 pm. Reference Committee D will start at 2:00 pm. The agendas for these meetings will be sent to the Delegates and Alternate Delegates prior to the meetings.

The reason for this reminder is to make as many aware of the election process within the Texas Dental Association. We need leaders and we need an ever flowing contribution and participation of the membership. The policies and directives of organized dentistry are driven by these elected individuals. It is necessary for the association to have as many viewpoints on the issues of the day as possible; therefore a diverse participation of the dentists in Texas is primary to accomplishing that goal. Please make it a point to not only participate, but also to consider placing your name in nomination for an elected position at the caucus meeting for your division of the TDA.

CANDIDATES FORUM: As a reminder, the TDA / ADA Candidates Forum will be held on Friday, May 4, 2012, from 2:00 pm to 4:00 pm in the Convention Center (please see the on-site program for specific room assignment).

DIVISIONAL CAUCUSES: Divisional Caucuses (Northwest, Northeast, Southwest, Southeast) will be held at 5:15 pm on Friday, May 4, 2012 (please see the on-site program for specific room assignments). DELEGATE BOOK: In accordance with TDA Bylaws, the Delegate Book will be sent 30 days prior to the Annual Session. The supplement to the Delegate Handbook, containing the agenda and subsequent reports, will be sent after the spring TDA Board of Directors meeting, March 23-24, 2012. Delegates and alternates will receive their House book in a searchable PDF format. When the House Book becomes available, the minutes of the TDA Board of Directors and the reference committee assignment reports will be posted on the member’s side of the TDA Web site and available to the general membership according to Resolution 164-2011-RCAS-H.

DETA to Highlight Achievements and Opportunities in Dental Academia Currently, Texas is home to three accredited dental schools with national recognition and rankings in various specialties. While many may view these incredible schools and programs as merely an entry into a privileged health care profession, the reality is that dental schools play a much larger role in the health care industry. The esteemed faculties in Texas dental schools enrich the dental profession through revolutionary research, international publications, mentorships, community service, academic enterprise, and much more. Because of the incredible undertakings in the halls of dental schools and their impact on the dental industry, the Council on Dental Education, Trade & Ancillaries (DETA) will begin highlighting some of the achievements and opportunities in dental academia. Through quarterly publications in the TDA Today and biannual articles in the Texas Dental Journal, DETA wishes to keep the TDA membership informed about life inside the dental schools and the opportunities that dental schools present.

Preston’s Press J. Preston Coleman, DDS, TDA President By the time you read this I will have visited more than 20 of the component societies of the Texas Dental Association. I must tell you that I have enjoyed every visit. The warm welcomes and Texas hospitality have made every hour on the road well worth the effort. At each meeting I have tried to give a brief update of current issues that TDA has been involved in. The message changes a little each month so the information I deliver is not too dated. At the end of each presentation, I try to answer any questions members might have about the material presented or about issues or questions they have for me or the TDA staff. One such question was, “Why did the TDA allow the HB 300 legislation to pass last year?” I can attest to the fact that the TDA Council on Legislative and Regulatory Affairs is formidable and effective. When a lawmaker says that this legislation is a priority and “will” be passed, CLRA with all of its legal and lobby support analyses the bill and looks for ways to minimize the impact of the bill on the practice of dentistry. CLRA works with the legislative bodies to help to formulate an effective bill that our members can comply with as easily as possible. This was the case with HB 300. Another question was, “If I comply with HIPAA regulations do I have to comply with HB 300?” The answer is “yes” but compliance with HB 300 (The Texas Medical Privacy Act) should be easier with your compliance with HIPAA done. HB 300 requires that each employee including the dentist who has contact with a patient’s health information must have training every 2 years. This can now be done by each staff member on the internet by taking a course and passing a test online. The discounted course can be obtained by going to tda.org and clicking on the “TDA Perks” tab. A more recent question has been, “With the retirement of Mary Kay Linn, our executive director, will the Association be prepared in all aspects for hiring a new ED? The TDA Board and the ED Search Committee have been preparing very thoroughly not only to hire the best person for the position but to make the transition as smooth and seamless as possible for the staff and the membership. This month your Board of Directors will consider the 2013 Budget that will include the new ED as well as other important matters. I know they have the best interest of our membership in mind and will do an admirable job of guiding us through this important transition. Thank you for the wonderful welcome you have extended Sue Ann and I on our visits. We look forward to seeing you in May!

Internal Resorption and Inflammation A 2012 article in the Journal of Endodontics describes a study of freshly extracted teeth that were examined for internal resorption and pulpal status (1). In a limited sample, teeth with normal pulps demonstrated no internal resorption. Seventy-seven percent of teeth with necrotic pulps and 50% of teeth with pulpitis showed internal resorption. TSBDE Rule Update

This recurring section is designed to help TDA members keep up with important Texas State Board of Dental Examiners (TSBDE) rules, other regulations, and state law affecting their practices. This TSBDE Update will address Texas State Board of Dental Examiners (TSBDE) — 22 TAC §110.7 — Portability. A dentist’s sedation/anesthesia permit (Nitrous Oxide — Level 4 Deep Sedation/ General Anesthesia) issued under Chapter 110 is valid for the dentist’s facility, as well as any satellite facility. After June 1, 2012, a Texas licensed dentist seeking a portability permit must: 1. Hold a Level 4 Deep Sedation/General Anesthesia permit; or 2. Hold a Level 3 Moderate Parenteral Sedation permit based on education received in conjunction with the completion of a oral and maxillofacial specialty education program or a dental anesthesia program; or 3. Hold a Level 3 Moderate Parenteral Sedation permit based on the completion of training following American Dental Association (ADA) Commission on Dental Accreditation (CODA) recognized or approved programs (i.e., a specialty program, a general practice residency, an advanced education in general dentistry program, or a continuing education program). Dentists seeking portability privileges based on a continuing education program must complete no less than sixty (60) hours of didactic instruction and manage no less than twenty (20) dental patients by intravenous route of administration.

Applicants holding a Level 3 Moderate Sedation permit must also submit proof of administration of no less than thirty (30) cases of personal administration of Level 3 sedation on patients in a primary or satellite practice location within six (6) months preceding the portability application, but following the issuance of the Level 3 Moderate Sedation permit. Acceptable documentation shall include, but not be limited to, patient records demonstrating the applicant’s anesthetic technique, as well as provision of services by the applicant within the minimum standard of care. A dentist providing anesthesia services utilizing a portability permit remains responsible for providing these services in strict compliance with all applicable laws and rules. The dentist shall ascertain that the location is supplied, equipped, staffed, and maintained in a condition to support provision of anesthesia services that meet the standard of care. Texas licensed dentists holding portability permits issued before June 1, 2012 will automatically continue to hold the permit provided the dentist complies with the renewal requirements. Dr Patricia Blanton Inducted Into Baylor College of Dentistry Hall of Fame

On January 20, 2012, Emeritus Professor Dr Patricia L. Blanton was inducted into the Texas A&M Health Science Center Baylor College of Dentistry Hall of Fame. Dr Blanton chaired the Department of Gross Anatomy in the 1980s, served the Baylor College of Dentistry Alumni Association as president, American Dental Association Commission on Dental Accreditation a site visitor, and the National Institutes of Health as a study section chair. Currently, Dr Blanton’s priorities are her Dallas-based periodontic and implantology practice as well as serving in leadership positions with the American Dental Association and the American College of Dentists.

ADA Celebrates 10 Years of Give Kids a Smile Program February is National Children’s Dental Health Month and the American Dental Association (ADA) marks the 10th anniversary of its Give Kids A Smile (GKAS) program. The GKAS program kicked off February 3, 2012, and dental professionals across the nation mobilized to provide free dental care to approximately 450,000 children and adolescents from underserved families throughout the year. GKAS was designed to encourage parents, health professionals, and policymakers to address the year-round need for oral health care for all children. The ADA offers free downloadable oral health resources for dentists, dental team members, school nurses, and teachers to provide fun tools to promote the benefits of good oral health to children. The program planning guide includes easy-to-do classroom activities, program planning timetable tips, and much more.
