EvidenceBased Practice Tip of the Month

The ATDA is a connected and active group of dental spouses that supports many aspects of dentistry. ATDA serves individual communities promoting well-being of the dental family, dental health education, and legislative projects, and often collaborate for state-wide events.

Free Privacy-Compliance Webinar Series On March 23, 2013, the HIPAA Omnibus Rule was finalized; and on September 23, 2013, it will go into effect. Now, paying attention to your responsibilities of adhering to appropriate privacy and security policies for your office staff and business associates has become even more important. No one intends for Protected Health Information (PHI) to become easily accessible at their practice, but data breaches are happening too frequently in the dental industry. Explaining why his or her office experienced a PHI data breach is not something a dentist would want to do to patients, the Texas Attorney General or U.S. Department of Health and Human Services. Staying informed through compliance education is only a part of privacy-law compliance. You and your practice team must also be proactively involved in preventing PHI data breaches. To facilitate this, TDA Perks Program partner, Smart Training LLC,* is offering TDA members a free 3-part lunchtime-learning webinar series to inform you and your practice on how to be compliant with HIPAA/ HITECH, and answer questions related to business-associate agreements, risk-management responsibilities, and compliance-training requirements for your staff. “The Anatomy Of a Data Breach: What to Do When the Unthinkable Occurs,” takes place on Wednesdays, July 31 through August 28. Each webinar runs from noon to 1:00 PM and covers a different topic as follows:

July 31 • Cyber-security Risk and the Penalties Associated with Business-associate Negligence of PHI: Presented by cyber-security attorney Shawn Tuma.

August 14 • Risk and Reporting Inside the Data Breach: Risk Management Specialist Christine Marciano will discuss the underpinnings of a data breach and how to avoid problems through risk assessment. But if and when a data breach should occur, what should you do and how can you protect your practice from fines and penalties?

August 28 • Requirements of the Omnibus Rule, and How They Relate and Interface with The Texas Medical Privacy Act: National HIPAA training consultant Jim Moore will present. He will also cover the need for a privacy officer and how to monitor and control business associate agreements to maintain compliance for your practice.

Please visit tdaperks.com to register for the series. Questions? Please call TDA Perks Program at 512-443-3675. *Smart Training, LLC is also the provider of TDA Perks Program’s popular HB300-compliance training.

On June 28-29, Amarillo hosted its second TMOM event. Sixtythree dentists volunteered their time and expertise, providing 857 patients with more than $664,000 worth of care. One patient wrote, “I have stayed away from the dentist for years and suffered in pain, but the compassion and professionalism I was shown was amazing.”

President’s Statement

TDA MEMBER

David A. Duncan, DDS, TDA President

As I prepare for my trek to South Padre Island and the Dentists Who Care Conference, and I do mean a trek considering it is 802 miles from Amarillo. I can’t help but wonder how much a dentist from the panhandle has in common with a dentist in “the valley”? The majority of dentists in the valley are heavily involved in Medicaid; we for the most part are not. The valley dentists have border issues with a foreign country, we do not (unless you consider Oklahoma a foreign country). The valley dentists have one season; hot, and our seasons would be described as windy with frequent temperature changes.

SPOTLIGHT Tonya Fuqua, DDS – Southlake “I love kiddos. They’re my first passion.”

However, I believe we have one very important thing in common, we really care for our patients. Through the multiple TDA Smiles Foundation Texas Mission of Mercy events across the state to the valley’s Mobile Dental Unit that visited 16 schools and treated more than 450 children last year, I can say that the dentists in Texas truly care for people in need of dental care.

When Dr Tonya Fuqua of Southlake participated in the American Dental Association’s (ADA) inaugural Give Kids a Smile (GKAS) campaign in 2002, she was hooked. She thought their local community knocked it out of the park. She is a champion for the underdog; a woman willing to take on anything, especially when that someone is a child.

It is something we can all be proud of – and something we should be proud of.

Aaron Washburn, TDA Executive Director

Last year the TDA Board of Directors invited Sarah Sladek, CEO of XYZ University and author of The End of Membership As We Know It, to Austin to work with the Task Force on Relevancy and offer suggestions on how TDA can evolve to meet the changing needs of its membership. Ms Sladek reviewed TDA, its governance structure, and met with members to better understand TDA’s strengths and weaknesses. The results of her analysis were provided to the TDA Board of Directors and the TDA House of Delegates. Most of her report focused on “the value of membership.” We must show why TDA is worth the money and time of today’s busy doctors. We must show why being a TDA member makes you a better business owner and practitioner. We must show how membership can make a difference in your life. TDA provides a great return on investment through our efforts on behalf of the profession at the Capitol and through access to educational programs and information. While the impact on the profession is obvious, it is also incalculable. What is the dollar value of these services? Luckily other TDA benefits are much easier to calculate. You can directly compare the pricing you receive for products or services to the negotiated rates TDA Perks can provide. You can directly calculate the benefits of patient financing and accounts receivable assistance on your business. You can clearly distinguish the impact a strong website or appointment reminders have on your bottom line. If you haven’t already, visit the TDA Perks website (tdaperks.com), or give General Manager Donovan Osio or Marketing Specialist Josh Epstein a call. See what impact TDA membership can have on you.

Where did you grow up? I was born and raised in the Sun City — El Paso, Texas. Where did you go to school and what did you do before you came here? I attended Texas State University in San Marcos where I received my bachelor’s degree in accounting. Currently, I am finishing up my accounting hours at Austin Community College. I am hoping to start studying for my Certified Public Accounting Exam this fall. Before coming to work with the Texas Dental Association I worked in the accounting department for retail, tax, audit, and construction companies. I still have kept my second job that I had during college, working for the City Wide Garage Sale where I have spent too much money on Star Wars vintage items. This is probably the reason I will not leave. You can never have too much Star Wars stuff. Why did you decide to come to the Texas Dental Association? I decided to join TDA because I was getting the opportunity to learn non-profit accounting and because (TDA Finance Director) Dee Dee Delagarza seems like a great CPA from which to learn. What is your favorite thing about the job? After being here for 4 months now, I can say that I really enjoy working with my department and the staff here at TDA. It is nice to be a part of a company that is a little bit more laid back. What is one thing about you that might surprise people? I have a music obsession like a woman who is obsessed with buying shoes. My music collection consists of all types of music from classical to hip hop, all the way to punk and metal. Going to see live music is one of my favorite things to do. In 2009, I started collecting my concert tickets on a cork board, which has now accumulated more than 100 concert tickets. I’m hoping to add a David Bowie concert ticket to that collection one day.

Dr Fuqua received her dental degree from the University of Texas Health Science Center at San Antonio Dental School. She is a general dentist and is married to prosthodontist Steven Fuqua, DDS, MS. They practice together in Southlake and have 2 daughters, 11-yearold Sabrina and 8-year-old Courtney.

When Sabrina was a baby, Dr Fuqua noticed sores in her mouth. The Fuquas visited many physicians trying to find answers. “We were ‘frequent fliers’ at Cook Children’s Medical Center,” says Dr Fuqua. “We couldn’t figure out why Sabrina’s hemoglobin counts were down; she wouldn’t eat and she wasn’t thriving.” At the age of 3, doctors at Cook’s diagnosed Sabrina with an aggressive form of Crohn’s disease, a chronic inflammatory condition of the gastrointestinal tract. Seeing her young daughter struggle with a painful disease, Dr Fuqua started a support group for families of children with Crohn’s and Colitis and became very involved with the Crohn’s and Colitis Foundation of North Texas. This is not the only non-profit that Dr Fuqua tirelessly donates her time and efforts. Her personal life and professional career began to overlap because of years spent at Cook’s with her daughter and through her involvement with GKAS. The board of directors at Cook’s asked Dr Fuqua to create a local program similar to GKAS, but year round. In 2003, “Save a Smile” was born. Cook’s is the lead organization, providing administration support of the program and Dr Fuqua, as the program manager and founder, recruits volunteer dentists and works with the program’s social workers and community health workers. “We find children who we think most need our help,” says Dr Fuqua. “Title 1 schools in Tarrant County are preselected by the program, and volunteer dentists screen every child, pre-Kindergarten through third grade Almost 100 volunteer dentists in Tarrant County are involved with Save a Smile. The program has provided more than $5.8 million charitable, comprehensive care to more than 5,000 children. “What’s so rewarding is that we can treat the child comprehensively. With this program, you see the child until they’re healthy. It’s just amazing.” Dr Fuqua is a mother who is fighting for her daughter’s future, but she’s also an incredibility capable woman who is determined to end the suffering of other people’s children as well, whether it’s from Crohn’s disease or dental disease. This recurring section highlights the lives of TDA members outside of the office. If you have an interesting story about yourself, if you are working on a project that your peers might find interesting, or if you have a hobby that keeps you busy, please contact TDA Managing Editor Nicole Scott, nicole@tda.org, 512-443-3675.

Another Election A humorous bumper sticker reads, “Just when you think everything is running smoothly, there’s another election!” Organized dentistry and DENPAC can certainly relate. The legislature recently concluded its regular session of business and it continues to work in special session…and legislators and candidates are already in campaign mode. Every election brings new personalities, new challenges, and new opportunities. In order for TDA to successfully achieve its legislative goals, dentists must be active advocates at home. The grassroots activities of dentists at the local level provide the foundation on which all else is built. Please be an advocate this election cycle. Your efforts will make a difference to your profession. DENPAC wants to hear from you. If you have a relationship with an elected official or candidate seeking office or wish to make a contribution, please contact Jess Calvert at jcalvert@tda.org or Leigh Ann Montague at lmontague@tda.org. * denpac.org

TSBDE Rule Update

This recurring section is designed to help TDA members keep up with important Texas State Board of Dental Examiners (TSBDE) rules, other regulations, and state law affecting their practices.

Q: A:

I am a dentist wanting to include in an advertisement that I offer free teeth whitening for new patients. Is that permitted under the Texas State Board of Dental Examiners (TSBDE) Business Promotion/Advertising rules? Yes, a dentist may advertise and provide free or discounted dental service(s) to new patients.

The advertisement must include appropriate disclosures as required by TSBDE rules and new patients must first receive a proper examination, diagnosis, and treatment plan per the TSBDE’s definition of a “patient of record.” A dentist is also permitted to offer non-cash gifts (eg, gift card) valued at no more than $10 to new patients in order to secure them as patients. A dentist may provide gifts of any value to current patients (ie, patients of record). The information in this TSBDE Update came from 22 Texas Administrative Code §§108.51, 108.53, 108.57 & 108.58. For more information, please contact TDA Policy Manager Diane Rhodes at 512-443-3675, diane@tda.org.
