CA Senate Bills You Need to Know About SB 201, 159 and 233 all aim to make a change for LGBTQ+ members — find out who they aim to protect.

Although the current political administration has made serious efforts to rollback protections and rights for the LGBTQ+ community, it seems as though California’s state government does a great deal to protect the community. Take Governor Gavin Newsom, for example. Newsom was advocating for same-sex marriage rights long before it was popular for Democratic candidates to do so. Most recently, Newsom has appointed an array of LGBTQ+ people to administration positions, according to The Sacramento Bee. That’s where advocacy groups like The Human Rights Campaign and Equality California come into play. Currently

these groups have their sights on three little-known pro-equality bills: SB 201, SB 159 and SB 233. Not sure what those bills are meant for? The Pride L.A. is here to help.

SB 201: Safeguarding intersex youth Senate Bill 201 seeks to protect the bodily autonomy of intersex people who are below the age of consent. The bill aims to accomplish this by setting new standards on surgical practices of this kind. These procedures have been controversial for decades, according to Human Rights Watch. Doctors normally operate on the gonads, internal sex organs and genitals of intersex children, who are too young to make any decision regarding the operation. This bill aims to safely defer these practices. As many as 1.7 percent of babies are born with features different than what heteronormative societal standards expect a “boy” and “girl” to be. Some intersex traits include atypical external genitalia and chromosomes that don’t match the assigned sex according to societal standards. However, an intersex minor can be raised as either sex without surgery. Ultimately, one of the greatest risks produced by these kinds of surgeries is surgically assigning the child to the wrong sex, according to Human Rights Watch. The bill, which was introduced by Senator Scott Weiner, would also implement an unprofessional conduct clause for doctors who decide to go through with these surgeries even after the bill has passed. “Doctors would no longer be allowed to opine

on intersex minors' “psychosocial development” — that is, their ability to function and be accepted in society — as a relevant factor in recommending surgeries,” according to Them, an LGBTQ+ online news organization.

SB 159: Increasing access to PrEP and PEP This bill, introduced by Sen. Weiner and Assemblymember Todd Gloria, aims to reduce the barriers, set in place by insurance companies, to access HIV preventative medication, widely regarded as either PrEP and PEP. Pre-exposure prophylaxis (PrEP) is a daily medication, taken by HIV-negative people, that almost completely eliminates the risk of contracting HIV, according to Centers for Disease Control and Prevention. Its counterpart, post-exposure prophylaxis (PEP) is a medication taken by HIV-negative people that have been exposed to HIV. It’s meant to prevent the virus from replicating within the exposee’s system. In a nutshell, SB 159 authorizes pharmacists to provide PrEP and PEP to patients without a physician prescription, according to Equality California. Similar to how California pharmacists are already authorized to provide emergency contraceptives without a prescription. Furthermore, SB 159 would expand where PrEP and PEP is available. This includes increasing the number of healthcare professionals and facilities that can provide HIV preventative medications.

SB 233: Sex workers’ rights Sex workers face an adamant amount of danger in their profession. The death rate for sex workers in the United States alone is 204 out of every 100,000, according to online legal directory HG.org. The fact that these workers face a serious likelihood of being arrested after reporting a crime, such as rape, does not help that grim figure. “After 40 years in the sex trade, and being trafficked for 10 of those years, I never thought that we would see a change in my lifetime,” Pearl Callahan, Outreach Director for the Sex Workers Outreach Project Sacramento, Sex Worker, and Trafficking Survivor, Proud Supporters said in a press release regarding SB 233. “Allowing sex workers to carry condoms and – of the – report violent offenses will be lifesaving.” LGBTQ Community! Trump’s New Healthcare Plan to Harm LGBTQ+ Community

The Fenway Institute of Fenway Health recently released a policy brief outlining the harm to LGBTQ+ people likely to result from a new health care regulation proposed by the Trump Administration last month. The public has until August 13 to offer comment on the proposed regulation, and the authors of the brief urge health care professionals and advocates to submit comment urging the Trump Administration to reconsider the proposal. The policy brief, “New rule proposes removal of LGBT nondiscrimination provisions from Section 1557 and other health care regulations” On June 14, 2019, the Trump Administration released a proposed regulation that would reverse the 2016 final rule implementing the nondiscrimination provision of the Affordable Care Act (ACA).That measure, known as the 2016 Section 1557 rule explicitly prohibits gender identity discrimination, including discrimination against intersex and non-binary people, in health care facilities and programs receiving federal funding. The rule also prohibits some forms of sexual orientation discrimination that take the form of sex stereotyping. “Initial news reports about the proposed rule characterized it as anti-transgender,” said Fenway Institute Health Policy Fellow Katherine Laurila,

author of the brief, titled “New rule proposes removal of LGBT nondiscrimination provisions from Section 1557 and other health care regulations.” “But the scope of the proposed regulation extends far beyond the gender identity and sex stereotyping provisions of the 2016 nondiscrimination provisions of Rule 1557.” Included in the Trump Administration proposal are provisions that would revise several other important health care regulations that explicitly prohibit both sexual orientation and gender identity. If finalized, the proposed rule would remove explicit sexual orientation and gender identity nondiscrimination provisions from: • Regulations governing the health insurance exchanges, including 34 federally facilitated exchanges and 17 state exchanges; • Regulations governing Qualified Health Plans; • Medicaid regulations, including language that explicitly prohibits sexual orientation and gender identity discrimination in Medicaid enrollment and availability of services, and language highlighting the importance of access and cultural considerations that calls on states to care for LGBT patients and others in a culturally competent manner; • Regulations governing the access to services provided by the Program of All-Inclusive Care for

the Elderly. “This proposed regulation would have far-reaching implications for the LGBT community, all of them negative,” said Carl Sciortino,Vice President of Government & Community Relations at Fenway Health.“If this rule is enacted, the Trump Administration will succeed in reversing much of the progress made in federal health policy over the past decade.” Anti-LGBT discrimination in health care is widespread, correlates with poorer health and well-being for LGBT people, and makes LGBT people less likely to access health care. This exacerbates health disparities that LGBT people experience. Since 2011, the Joint Commission has required sexual orientation and gender identity nondiscrimination policies in health care institutions that it accredits. The Joint Commission is a nonprofit organization that accredits hospitals and other health care organizations. Other anti-LGBT policies enacted by the Trump administration that are harming the health and access to care of LGBT people include: • Dismissing Peace Corps volunteers and Air Force service members who tested positive for HIV, and refusing to provide pre-exposure prophylaxis for HIV prevention (PrEP) to at-risk Peace Corps volunteers;

• Placing transgender inmates of the Federal Bureau of Prisons, especially transgender women, at much higher risk of rape by incarcerating them according to their biological sex at birth instead of their gender identity; • Prohibiting transgender people from serving in the U.S. military; • Removing sexual orientation and gender identity questions from federal surveys of older adults, people with disabilities, and victims of crime; • Filing a brief with the U.S. Supreme Court arguing that gender identity is outside of the scope of Title VII of the Civil Rights Act of 1964, which prohibits discrimination based on “race, color, religion, sex and national origin;” • Filing a brief in the Masterpiece Cake Shop case before the U.S. Supreme Court supporting discrimination against a gay male couple and stating that there is no compelling federal government interest in prohibiting anti-gay discrimination; • Attempting to repeal or weaken the ACA, which has cut the uninsured rate in half for LGBT people. Opposition to Trump DOD’s Discharge Policy for HIV-Positive Airmen

Military leaders, medical associations, public health groups and HIV advocates joined three friend-of-the court briefs filed recently in support of a federal lawsuit challenging the Pentagon’s discriminatory policies, which prevent service members living with HIV from deploying to most locations outside the United States. These deployment restrictions recently resulted in decisions to discharge a number of Airmen. The briefs being filed today in Roe and Voe v Shanahan before the U.S. Court of Appeals for the Fourth Circuit urge the court to uphold a preliminary injunction preventing the Air Force from discharging service members with HIV. “Given the assessment of military experts and the advances in HIV treatment, the Pentagon’s policy of refusing to deploy—and now to discharge—HIV-positive servicemembers who honorably serve our country is utterly discriminatory, outdated and unnecessary,” said Scott Schoettes, HIV Project Director and Counsel at Lambda Legal. “As the world’s largest employer with 2.5 million employees, it is outrageous that the Department of Defense has a harmful and unlawful policy that perpetrates stigma, jeopardizes public health, and dishonors servicemembers.” In the lawsuit, Lambda Legal and the Modern Military Association of America (OutServe) represent two active duty airmen, identified anonymously as Roe and Voe, who served their country honorably for years until they were discharged in 2018 for being HIV-positive. The briefs argue that the Pentagon’s categorical ex-

clusion and discharge of HIV-service members is outdated, irrational and discriminatory given the strides in HIV medicine that allow people living with HIV to suppress HIV to undetectable levels, return to health, and lead full lives. The briefs further argue that the Pentagon’s policies lacks scientific support and justification, enact real world harms, and undermine broader public health— debunking erroneous claims by the government. Three amicus briefs were submitted today: One from military leaders led by former Secretary of the Navy Ray Mabus and former Secretary of the Army Eric Fanning, submitted by Dentons LLP; another from groups representing over 5,000 physicians, scientists and healthcare professionals, led by the HIV Medicine Association and the Infectious Disease Society of America (IDSA) and submitted by Jones Day ; and a third brief from health and HIV advocacy organizations AIDS United, the American Public Health Association, and the National Alliance of State & Territorial and Directors (NASTAD), submitted by Kevin Minnick, Brian Breheny along with attorneys at GLBTQ Legal Advocates and Defenders (GLAD). “It is long past time for the U.S. military to integrate the latest medical science regarding HIV into military policies and to stop discriminating against servicemembers with this medical condition,” said former Secretary of the Navy Ray Mabus. “I urge the Pentagon to update its policies to allow HIV-positive members to serve fully. There is only one qualification required to serve in our military: the ability to do the job.And these

individuals can do the job as well as anyone else.” “Health policies should be based on the best available evidence, and military policy should reflect the current reality of treating and preventing HIV—including the scientific facts that a person with durably suppressed HIV will not transmit the virus, that servicemembers have access to high-quality health care, and that the risk of exposure in military settings is vanishingly low,” said Dr. Judith Feinberg, chair-elect of the HIV Medicine Association. “HIVMA will continue to urge that no one should be excluded from any opportunity, including military service, on the basis of HIV status.” “As a former Air Force officer, I’m disappointed that the military is reversing course to implement discriminatory policies that will result in the discharge of qualified servicemembers based solely on their HIV status. This new policy contradicts President Trump’s plan to end the HIV epidemic by 2030, shirks the military’s role in this effort, and denies the military’s own history, research, and best practices.” William McColl,Vice President for Policy and Advocacy,AIDS United. “These military experts know that policies on military service should be based on standards and up-to-date science," said Modern Military Association of America (MMAA) Executive Director Andy Blevins. "There have been tremendous advances in the treatment of HIV that enable troops living with HIV to serve without restriction, but Department of Defense policies remain outdated and unjustified. Simply put, in light of

modern science, there is no legitimate reason to deny HIV-positive service members the opportunity to deploy or continue to serve in the military." This appeal will be heard in the Fourth Circuit in Richmond,Virginia on September 18. The case is set to go to trial in Alexandria,Virginia on September 9 along, with Harrison v. Shanahan, with attorneys from Lambda Legal, the Modern Military Association of America, Greenberg Traurig and Winston & Strawn representing the plaintiffs. Background: These lawsuits challenge the Pentagon’s discriminatory deployment policies, which prevent service members living with HIV from deploying to most locations outside the United States. For years, these outdated policies have restricted the opportunities of service members living with HIV, including being used to deny a commission as an officer to enlisted member Nick Harrison. Now the Air Force is using these unjustifiable deployment restrictions to discharge Airmen solely based on HIV status. OutServe-SLDN is also an organizational plaintiff in this case to advance the interests of its members who are living with HIV and serving in the military. Along with Roe and Voe v Shanahan and Harrison v. Shanahan, Lambda Legal and OutServe-SLDN have brought a third lawsuit, Deese and Doe v. Shanahan, to challenge similar policies that have resulted in the refusal to allow two military academy graduates to commission as officers and begin their military careers.

LB Library to be Named After Billie Jean King

The City of Long Beach recently approved to name the City’s new library after LGBTQ+ icon, Long Beach native and tennis star Billie Jean King. “This honor would represent my life coming full circle, and my complete belief of having a commonplace for the communi-

ty, where all are equally welcome and have access to visit, learn, and grow,” King said in a letter to the City. The 93,000 square foot library will be located downtown at the southwest corner of the intersection of Broadway and Pacific Avenue. It is scheduled to open September 21. It will be 30 percent smaller that the original main library branch, covering 135,000 square feet.

The city has more than 100 buildings and facilities, but apart from Harvey Milk Park and Billie Jean King Tennis Center, near Woodrow Wilson High School and Park Estates, no other public spaces have been named for people who identify as LGBTQ. Naming the library would increase LGBTQ visibility in Long Beach. Since the campaign to More than 1,000 people have sent letters, emails, and petitions to the city in support of the idea since it was announced about a month ago. King has been celebrated for her fight for Title IX of the Civil Rights Act, which was signed into law in 1972. It prohibits sex discrimination in all federally funded school programs, including sports. Previous to its passage, only 1percent of college athletic budgets went to women’s sports programs. At the high school level, male athletes outnumbered female athletes 12.5 to 1. Since being passed, female participation at the high school level has grown by 1057 percent and by 614 percent at the college level. On the tennis court, King is renounced

for defeating Bobby Riggs, 55, in the “Battle of the Sexes,” which took place Sept. 20, 1973. King was 29 at the time. It is considered one of the greatest moments in sports history. King is a former World No.1 professional tennis player with 39 Grand Slam titles.

New at the Fairmont Miramar, Dogtown Coffee Honors the Z-Boys’ Skateboard and Surf Culture By Robert Spuhler

The spirit of Southern California’s surfing and skating culture can be seen across every inch of Dogtown Coffee, from photos and murals that line the walls to the surfboards suspended from the ceiling and skateboards preserved at the entrance. To understand Dogtown Coffee, one must first understand the Dogtown of the ‘70s. Stuck between Santa Monica and Venice jurisdictions, this stretch of Main Street was run down, with gang and drug problems making it difficult for local businesses to stay open. Ho’s Surfboards was a meeting place for the Zephyr surf team, including its junior division. Over time, the Z-Boys, as they were known, revolutionized skateboarding. They took what was essentially ice skating on wheels and added aggression, speed, and an

attitude that would eventually bleed over into Southern California’s punk-rock scene. Some of them became the biggest names in skating, while superstars like Tony Hawk cite them as role models and influences. It is this history that Dogtown Coffee seeks to preserve. Founded in 2012 by Assaf and Itay Raz and Itai Klein, all of whom lived nearby, the store itself is not a part of the “Dogtown” era. Instead, the shop is a place to house the voices of that era, which is why so many of the still-living Z-Boys have made their way here at one point or another over the course of seven years. “We’re not Dogtown,” Raz says. “We were not here. We were not the ones creating the history. And we don’t pretend to be Dogtown. We are custodians, and we feel blessed to be that.” Dogtown Coffee has a new connection with the Z-Boys’ history through their much-anticipated second location at the Fairmont Miramar, in the heart of Santa Monica. Back in 1978, the young men and women who reinvented the art of skateboarding came into this very neighborhood for what would become known as the Dog Bowl sessions. They were a little older and a lot more famous, but still Z-Boys in spirit. A teenager sick with cancer asked his family to empty out the swimming pool so his heroes could come skate, and so the story goes, the

Z-Boys crossed the line from rundown Dogtown to upscale Santa Monica. The Fairmont Miramar is also a fitting place for Dogtown’s exclusive new outpost thanks to its location. Just like the original Dogtown Coffee, the beach is just a short distance away, and this influence can be seen on Dogtown’s menu. Hand-held wraps, sand-

wiches, and breakfast burritos, all foods that can be taken down to and eaten at the beach. “You need to make the kind of food that if a surfer comes out of the water with a hole in the stomach and dripping water from his wetsuit, [it’s] the kind of food that they will buy and feel at home,” Raz says. Happiness is Hawai’i When Drag Was All the Rage (But Queerness Wasn’t)

Today, it’s not hard to find drag culture wherever you are. From VH1, to Netflix, to Twitter, the language of drag has become culturally omnipresent since RuPaul’s “Drag Race” turned America’s gayest pastime into a contact sport. But what about everything that went down before Ru hopped on the ballroom scene? How did drag artists survive and thrive in a world that didn’t quite understand them? As it turns out, rather swimmingly. Back in the 1920s and ‘30s in Los Angeles, drag artists weren’t just big. They were fairly mainstream. Despite anti-crossdressing laws in Los Angeles, drag performers like Julian Eltinge, Gene Malin and Rae Bourbon were some of the hottest nightlife attractions on the scene. Yet, the repressive laws that threatened to throw any man or woman wearing more than two pieces of “gender-inappropriate” clothing were still prevalent. So how did they do it? Mainly by being sensational onstage. Gene Malin, a Broadway chorus boy who made a name for himself in NewYork as a drag performer, was such a vibrant entertainer that he had no trouble drawing crowds. At one point during a performance in New York, Malin went into the audience and punched a too-drunk audience member, causing a then-young Ed Sullivan to proclaim: “Jean Malin belted a heckler last night at one of the local clubs.All that twitters isn’t pansy." Malin’s large, intimidating appearance was part of the joke. Described by a biographer as “a sixfoot-tall, 200-pound bruiser who also had an attitude and a lisp," Malin performed songs with titles like “I’d Rather Be Spanish Than Mannish.” He also paved the way for L.A. drag artists like Ray Bourbon and Bruz Fletcher, a regular performer at the L.A. queer night spot Club Bali in the 1930s. Drag culture, in the ‘20s and ‘30s, was about being shocking. It was about seeing how much you

could get away with.While Malin only made a few film appearances, they were enough to send him packing for the West Coast. After making a name for himself there, he continued to perform in small gay clubs and bars all over Hollywood. It was in Venice where Malin met his tragic end. Leaving the old gay bar and celebrity hot spot “Ship Cafe” in 1933, Malin, along with his partner and the lesbian actress Patsy Kelly, got into his car and accidentally reverse-gear plummeted into the pier. Other crossdressers didn’t fare much better. Bruz Fletcher took his own like in 1941. Rae Bourbon died in prison after being accused of murdering a kennel owner in Texas. Before that, she’d been arrested several times for “impersonating a woman.” Drag has always been a hopeful art form. At heart, it’s a vision of the future. A future in which people are more forgiving, more understanding, and way more fun. People like Gene Malin might not have known it, but they were creating a movement that continues to shape the world today.

EXPLORING QUEER ART ON THE WESTSIDE

Be sure to add this exhibit to your itinerary before it ends! “Tomboys” features a collection of over twenty mixed media oil paintings by Christina Schlesinger that examines the intersections between gender, identity, fashion, sex, and representation. Schlesinger’s body of work explores self-portraiture, feminist nudes, and lesbian sex. It fills a void of lesbian imagery in art and revisits a time in the artist’s life where she felt empowered and brave. Schlesinger started at Cal Arts in the Feminist Studio Workshop and left to paint murals across Los Angeles. Feminism and activism have been core to Schlesinger’s work since she co-founded the Social and Public Art Resource Center (SPARC) in 1976. She has received public art commissions and been a part of gallery exhibitions in California, New York, Massachusetts, Colorado and New Hampshire. Her activism extends to her involvement with the Guerrilla Girls where she is known as Romaine Brooks. Visit www.christinaschlesinger.com for more information about the artist. DEAR AIDAN: No OOMPH in My New Relationship? Dear Aidan: I have currently started seeing a guy two weeks ago. Everything is wonderful and perfect on paper he is kind, caring, loving etc... but I am just not really feeling that OOMPH feeling. The excited feeling in my heart when I get his text message. I also have a feeling that he is only halfway in because he has a family and it makes me ambivalent about moving forward. What do you think I should do?

Dear All the way IN! OMG GURL, calm down it has only been two weeks and it has not had a chance to UNFOLD yet! You have got to give it time to unfold! You guys are still getting to know each other and everything seems to be going smoothly so calm your ass down and chill out!! In fact I think I would be MORE worried if the relationship were moving at such a breakneck pace in the beginning. A lot of those relationships are all about fire but

burn out because there is not substance to support the fire! What do you do with a flame that doesn't have a candle to support the burn? I blame this kind of "lighting strike" love demands on Hollywood's romantic comedies which is really a grossly distorted depiction of what love is supposed to be like! You are SUPPOSED to meet the man of your dreams in one fell swoop... at like a Starbucks or something like that. "The One" walks in the door and he is gorgeous, the angels sing, he walks over and offer to buy you a coffee and you leave the Starbucks holding hands and you live happily ever after. Let's be honest. A more realistic point of view is something closer to...You find a guy who is kinda cute on grindr, then you meet up and find you have some chemistry, you hook up, stumble into some decent conversation and get to know each other and develop a love OVER TIME. Because really... how much do you know about a person over a two week period. I actually have friends who perpetually fall into relationships in which they claim that they are in

love after four days and then the next day they are out of love again because they don't fold the laundry right. So take this opportunity as a gift to get to know the other person slowly and do not assert or the relationship look one way or another. Another piece of advice that I would like to share with you is that while I would definitely still keep into account what YOU want out of the relationship, I think it would be a great idea for you to maintain a compassionate view of what your partner is going through as well. All relationships are two parts so if you partner has some ambivalence you might want to be considerate and respect their hesitance and give them time to catch upto themselves around this issue. This could flourish into something wonderful! It's like you planted a seed and it's not growing the way you would like so you are ripping it out. I would not recommend you do that. If this turns out NOT to be what you want you will only have lost a few months and you will walk away with more clarity on who you would like your relationship to look in the future .

With ‘Adam,’ has Cancel Culture Missed the Mark?

I can remember a time when everyone, quite literally everyone, felt it was their civic duty to see the latest gay movie in theaters. When there was a cultural under-

standing that the latest gay movie – however shitty – needed to be supported, because if we didn’t show up in numbers, who’s to say Hollywood wouldn’t stop making those

wonderful, sexless movies about the Gay Struggle? I can remember a time when we all believed that if we didn’t show up for “Milk,” they’d stop making movies about us. We live in a different world now. Case in point: Rhys Ernst’s “Adam,” an adaptation of a 2014 Y.A. novel in which a young cis man pretends to be a trans man in order to gain access to the queer world. This film, which might have been seen as groundbreaking in previous years, is now the subject of major debate in the queer community. When a U.K. blogger named Theo spoke out against the film’s themes, claiming that the book exploits the “transsexual deception” narrative and legitimizes it for a young queer audience. Here’s the thing: “Adam” is a book – and presumably a film – about trans acceptance and trans desire. Does it use the themes of deception, secrecy and shame to do this? Yes. But guess what. So did Shakespeare, and somehow we haven’t canceled him yet. In our search for representation, we’ve let the perfect become the enemy of the good. We’ve let the dream of an absolutely flawless, unproblematic narrative stand in the way of a piece of art that might not be flawless, but is important nonetheless. Because believe it or not, the same thing holds true. If we don’t support movies about

us that are made by us, we might not see many more of them. At least, not for a while. Anyone who suffered through “Milk” the first time understands this. Still, people aren’t just calling for a boycott of “Adam.” They’re calling for Rhys Ernst’s head. Despite the director’s attempts to convince the public that he’s reinterpreted Ariel Schrag’s Y.A. novel and made it his own, #BoycottAdam is already a cresting hashtag on Twitter. But if LGBTQ+ viewers attempt to strangle “Adam’s” story before even getting a chance to see it, we’ll have a bigger problem on our hands. Worse than bad representation or even no representation is the possibility of our community becoming too exacting, too cynical, and too self-righteous for its own good.
