If you are like me, you attend several auctions, which means the savings can really add up. There are a few simple steps to take once you are ready to redeem one of your coupons at the auction. Before you pay for the vehicle you will first need to see one of the auction staff at the front desk who handles vehicle purchases. Tell the auction employee that you want to redeem your auction coupon. Important: next,

pull up that particular auction within the app and let the auction employee push the redeem button on your mobile device. Once the redeem button has been touched, it will be grayed out and that coupon will no longer be available for use. If you accidentally push the redeem button before the auction employee has a chance to do so — whoops! You just lost your coupon. You will need to contact the TIADA office for them to correct your redeem coupon. But just don’t do that, because this will take some time to correct and cannot happen while you are standing there at the auction. One of the benefits the world of technology has to offer us is the potential for up-to-the-minute savings opportunities. The staff at TIADA is working with the various auctions to add even more benefits to the app. So once you’ve redeemed your coupon for a particular auction, don’t assume the savings for that auction are spent for the year. We can continue to add savings opportunities with each auction represented on the app. When you go to the auction, always check the app for up-to-the-minute discounts. You don’t want to miss an added value that might only be available for a limited time. Obviously, we‘ve leveled up from the paper coupon of old. This transition would not have been possible without the help and input from the participating auctions themselves. Throughout the development and launch of the app they have worked with TIADA staff to ensure it was working smoothly and members could receive these fantastic discounts. he Texas Quality Dealer of the Year Award is the highest honor TIADA bestows each year. Additionally, the winner will be eligible for the National Quality Dealer Award presented by NIADA at their convention the following year, most recently won by Robert Blankenship of Texas Auto Center in 2017. As TIADA prepares to announce another winner at the Annual Conference & Expo this month at the Hilton Anatole in Dallas, Texas Dealer reached out to previous winners from the past to find out what winning the award meant to them, changes they have seen in the industry since then and what advice they have for other dealers new to the industry.

What did it mean to you to win the award?

It’s a great honor and responsibility to be recognized along with so many other elite dealers in Texas.

How did you become involved in TIADA originally?

Mike Dunagan (TIADA General Counsel) gave me that extra push to get involved and help make a difference. I always listen to legal counsel, so I did.

Community involvement is an important factor in the award. How has this played a role in your success throughout the years and why do you feel it is important?

Negative stereotypes for car dealers is a constant struggle. The best way to fight those stereotypes is by helping our communities become better places to live and work, and it’s the right thing to do. One of my favorite quotes is from Margaret Mead, “Never doubt that a small group of thoughtful, committed citizens can change the world; indeed it’s the only thing that ever has.” We as dealers can make a difference in this world.

How has the industry changed since you first joined TIADA and since you won Quality Dealer of the Year?

The level of sophistication among dealers is drastically different since I first joined. Car dealers today are better educated and more willing to use data in their decisionmaking process. The speed of change is also accelerating.

What advice would you give to somebody who is just now starting out in the industry? I’d start with some questions. “Why?” and “Are you sure?” come to mind. All kidding aside, I’d ask where they see the industry in five or ten years? How will they compete with autonomous electric vehicles? Truthfully, it doesn’t seem like the best time to invest millions in the used car industry. If they remain convinced, I’d suggest getting as much education as quickly as possible through associations like TIADA and NIADA, as well as 20 groups, and other industry training provided by TxDMV and others. What did it mean to you to win the award?

It was a really, really nice honor. My father-in-law, Sonny Rice, was a used car dealer. He had won the award and was a long time TIADA member. He told me when I first started working for him, before I was even a dealer, that I needed to join TIADA. After being a member myself and winning the same award, it was a great honor.

Community involvement is an important factor in the award. How has this played a role in your success throughout the years and why do you feel it is important?

A lot of people know who I am and about my dealership because of our community involvement. Those that haven’t heard of us before, when they start Googling us they will be able to see some of our charitable works. Mostly, I think it is important to help out the community so we do what we can, where we can.

How has the industry changed since you first joined TIADA and since you won Quality Dealer of the Year?

It has become a more competitive industry, especially with all the subprime finance lenders. We are a pure buy-here, pay-here dealership so it affects us.

What advice would you give to somebody who is just now starting out in the industry?

I think it is important to make contacts and join TIADA. The association has really helped me network and get to know other car dealers. That has been one of the things that helped me the most throughout the years.

To be recognized by your peers was a great honor. It is one of the things I am very proud to have accomplished in my life. It also wasn’t just about me. It was my whole team that contributed to winning.

We are heavily involved in our community. It’s what we do! We are in Taylor which has a population of probably about 14,000. We give and donate to many different causes. We actually don’t do any advertising. 7


We just give back to the community and everybody already knows our name. It’s also played a big role in our success. We sell just as many cars as I can afford to sell.

How has the industry changed since you first joined TIADA and since you won Quality Dealer of the Year?

What did it mean to you to win the award?

After I won the Quality Dealer of the Year award, I later went on to win the national award, so this was a great honor. To me, it meant I was at the height of my profession. You can’t go any higher. The customers noticed too. We got a good deal of publicity from winning the awards. It helped our business quite a bit.

I am glad I won it then, because there are some great dealers out there now! I don’t know if I could compete every year. It is just unbelievable what some of these dealers are accomplishing across Texas and even nationally. It’s amazing. I think the quality of our industry just rises each year. It’s not just the dealer that receives this award. I have been in the buy-here, pay-here business for 30 years, and there are just some amazing dealers out there today. One of the things that has helped that happen has been the education offered by TIADA and NIADA. It has brought people together and made us all smarter and stronger.

Join TIADA as quick as you can. You can learn from other people’s mistakes and it will save you thousands and thousands of dollars. This will allow you to see what other people did right and what they did wrong. For me, this has been some of the best money I have ever spent.

My lots were in Oak Cliff and we worked hard to support the local community. All of those efforts help you build a bond with the neighborhood. By helping them it helped our business too.

Well I won it 24 years ago and since then, I have half retired and half come back. Before the award, I served as TIADA president back in 1971. So, I have seen a lot of changes, some good and some not so good. To me, though, it is still a great business and it is still great to us.

What advice would you give to somebody who is just now starting out in the industry?

It’s funny that you ask that, because my son is getting into the business right now. I tell him, “You do things right. The only way you will learn how to do things right is through education. TIADA really helps provide that education.” To anyone starting out in the industry, I would say study the industry and take advantage of all the education opportunities you can.

Sales Tax Issues Often Overlooked As Dealer Compliance Concern by Michael

F

or some Texas dealers, the appearance of auditors from the state comptroller’s office at their dealerships is a rare and frightening experience. Much attention has been paid to coming into compliance with seller finance issues because of frequent examinations by the Office of Consumer Credit Commissioner (OCCC), and, to a lesser extent, visits, letters or calls from the Motor Vehicle Division. In fact, the emphasis on meeting compliance issues being looked at by the OCCC and MVD has caused many dealers to forget — or to at least put on the back burner — issues raised by motor vehicle sales tax and the state’s limited sales tax. The current seller-finance sales tax scheme has generally made payment of motor vehicle sales taxes a painless, routine procedure. It is because the administration of deferred sales tax has become so simple and so automated that some of the finer points of motor vehicle sales tax and non-motor vehicle sales tax may have been overlooked by dealers in recent years. So assuming a dealer has bought into the deferred sales tax system, and has been diligent in filing reports and paying the prescribed amounts, what are the areas that could still prove troubling in an audit?

The Sixty-Day Rule

As part of the negotiations with the comptroller when sales tax reform was obtained, it was agreed that a dealer would have to transfer title to a vehicle in order to take advantage of sales tax deferral and

avoid having to front the total sales tax. Initially, the comptroller’s office wanted to tie transfer to a 20-day limit. We were able to convince the powers that be, however, that there are some occasions when title certificates get hung up and immediate transfer is impossible. Agreement was finally reached that the right to defer sales tax on a vehicle would be waived if the title wasn’t transferred within 60 days of the date of sale (this time limit only applies to taxation and doesn’t affect other areas of the law that address when titles must be transferred). The tax auditors review transfer statements and compare the date of sale to the date of transfer for determining if any 60-day transfer violations have occurred. Where violations are found, sales tax is accelerated retroactive to the 60th day, and sales tax on the original cash price is assessed (less credit for amounts paid on the account). Understated Sales Price

Auditors will compare the sales price on contract documents against the amount declared on the transfer document. We have found

that the switch to deferred sales tax has removed any incentive for buy-here-pay-here dealers to fudge on sales prices, and most violations in this area are committed by individuals and curb stoners. Also, auditors will look at dealer transactions involving a trade-in where a trade deduction from sales price has been made. Auditors verify that (a) the vehicle actually existed; (b) the vehicle was brought into the dealer’s inventory, and (c) the correct value of the trade-in was properly reported. And while other types of property can be accepted in trade, only 13


a motor vehicle trade can be used to reduce the taxable value.

Dealers are required to handle the transfer of title and sales tax collection on all sales they make, including cash sales (the exception being out-of-state sales — see below) . Auditors are looking for evidence that the dealer simply signed off on the title certificate and gave it to a cash buyer. (Also, county tax office personnel are on the lookout for dealer sales being handled by nondealers and will report such transactions to Motor Vehicle Division.)

Sales or Assignment of Contracts

In order that deferred sales tax would apply only to seller-financed transactions, and not to third-party financing (both direct and indirect), the comptroller insisted on inclusion of a “due on sale” provision. Thus, if dealer paper is sold or assigned to a third party (other than a related finance company), all sales tax is immediately due and can no longer be deferred. Auditors are looking for evidence that a contract upon which a dealer is continuing to defer sales tax has been assigned. In order for an assignment of a contract to a related finance company (that is, one with at least 80 per cent common ownership between the dealership and the finance company) to fit within the exemption to the acceleration rule, the RFC must be permitted by the comptroller’s office. Form AP-222-1 must be filled out and filed. Because of legislation promoted by TIADA and approved by the comptroller’s office, a $600 annual fee is no longer required, and permits no longer have to be renewed each year.

Use of Resale and Out-of-State Certificates

Everyone knows that sales of vehicles to other dealers are exempt from sales tax. However, the Comptroller

of Public Accounts has put dealers on notice that auditors will not automatically recognize a wholesale transaction as tax-free. The seller must obtain a resale statement from the buyer in order to avoid being assessed tax. The form promulgated by the comptroller’s office for use as a resale statement can be obtained from the comptroller’s website (the back side of Form 01-339). The absence of such a statement will result in assessment of sales tax on the transaction, with the statutory penalties and interest. The use of “blanket” resale certificates for multiple sales to the same buyers has been approved by the comptroller and the contents of resale certificates can be incorporated onto other sales documents. Wholesale auto auctions typically have blanket certificates signed by buyers to assist auction consignors. Another sales tax exemption that dealers could come across is for vehicles that are sold for out-of-state use. For instance, if a Texas dealer sells a vehicle to a New Mexico resident who is taking the vehicle directly to New Mexico to register, no Texas sales tax is due. The dealer must, though, obtain a statement to this effect from the buyer to avoid being assessed with tax upon an audit. While the seller is not responsible for the truthfulness of contents of the statement, some evidence, such as a copy of the buyer’s out-of-state driver’s license, should be kept with the statement to demonstrate good faith. All resale and out-of-state delivery statements should be kept for at least four years in case an audit is performed.

Sales Tax on Repossession Fees

According to Comptroller personnel, charges for collection and repossession services are taxable charges. Repossession agents are obligated, under the Comptroller’s interpretation of the law, to obtain a sales tax permit. They then are required to collect sales

tax on fees billed to vehicle lien holders. Repossession agents are then obligated to file periodic tax returns and remit the amount of tax collected to the state. The pertinent provision of the Tax Code makes “collection fees” taxable. While there is no definition in the Tax Code of collection fees, the Comptroller has defined the term in its administrative rules to include repossession services. Under another section of the Tax Code, the Comptroller can assess unpaid taxes against the user of taxable services when tax is not collected and paid. Thus, dealers have been assessed for sales tax not collected and paid by their repossession agents. The Comptroller’s Office has begun assessing dealers for sales taxes on repossession fees that they claim should have been collected and paid by repossession agents. Auditors have been going back four years in determining how much the audited dealers owe. A dealer (or any other lien holder paying repossession fees) can protect himself or herself by (1) demanding that repossession agents have sales tax permits and add tax on all invoices; or (2) calculating the tax and paying it directly to the comptroller on the dealer’s sales tax return. (This tax applies to the Limited Sales Tax on general merchandise and services; not motor vehicle sales tax which is a separate tax.) Those lien holders who already hold a limited sales tax permit (used for parts and other merchandise sold) can add the tax on the “taxable purchases” line of the limited sales tax return. By paying the tax, lien holders can avoid interest and penalties that would be assessed if unpaid tax is discovered on an audit. Of course, repossession agents have primary responsibility for the tax, and are subject to assessment and penalties if they are audited. Dealers, however, are easier targets for auditors and will likely be the focus of collection efforts. July/Special 2018

Sales Tax on Tracking Devices

Recent audits of BHPH dealers have turned up the fact that GPS tracking devices and air time charges are considered by the comptroller’s office to be a taxable purchase by dealers. Some suppliers are not collecting and remitting sales tax, which would make the dealer vulnerable upon audit. Passion and Ambition

I

n a professional context, passion and ambition are different constructs, though quite related. They are both almost always present within successful people. The question concerns how much of each is productive. What’s the ratio? Let’s think about each for a moment. Passion is about purpose. Generally, it has a strong positive connotation. It’s about moving past a mental attraction to a topic into emotional and behavioral engagement. It manifests in persistence, a willingness to deal with challenges, a desire to share the passion with others, and a feeling of being more fulfilled as a result of association with the focus of the passion. In contrast, ambition is about individual achievement. It has both positive and negative connotations. On the positive side, ambition is about reaching your potential, seeking approval and belonging, desiring respect, and attempting to find security. On the negative side, ambition may be associated with shortsightedness, selfishness, and unproductive rule breaking or otherwise questionable behavior. In practice, ambition can shift from positive to negative. Consider the case of seeking acceptance morphing

They need each other. into chasing accolades, or a desire to be respected evolving into a desire to be worshipped. It’s also important to state that at extremely high levels both passion and ambition can be blinding and cause an unproductive

disengagement from certain people and tasks. Clearly passion and ambition are interrelated. Ideally, one assists the other. Passion without ambition will limit achievement. Ambition without passion will produce empty wins. They need each other. What about that ratio? I like to think that, on average, a successful person needs twice as much passion as ambition. They can both be strong, but passion must be stronger. From a self-reflection and self-improvement perspective, this allows ambition to motivate behavior, yet within the positive confines of purpose. Similarly, one dose of ambition ensures that passion finds focus and proper targets for achievement. If you would like to argue that something closer to 50/50 is preferred, good for you. The exact ratio is not my concern. The point is they both play important complimentary roles, and passion,

most of the time, needs to be the strongest. Let me help you begin to find your productive balance of passion and ambition. Consider these three simple ideas to get started. First, don’t just look at skill and intelligence when you judge those around you and the people you hire. It’s often said you should surround yourself with people who are smarter than you are. Good advice, but incomplete. It’s vital you also surround yourself with people of clearly strong character. People of high character more naturally understand the discussion above. Next, think about explaining to someone why you love trying to achieve new heights. When passion is more dominant than ambition, the explanation will easily flow. People can’t stop sharing when passion rules! If you struggle to answer this question, or if your best answer is “money” or “status,” ambition may have taken over and it’s time

to reevaluate your approach to success (or at the very least, you lack passion). Finally, start a conversation. This must be more than a short essay you read or a simple thinking exercise. Conversation keeps things mentally alive and relevant. Think about your boss, a key colleague, mentor, coach, or close friend. Find the right time — just once in a while — to talk about this balance, how you are doing, and how they view the issue. Conversation makes the issue stay relevant. With a little thought and persistence, this balance eventually ceases being a struggle and simply becomes a dance you happily engage. How often do we get to see an unbiased buyer, filmed buying day after day, knowing he will say “yes” if the employee simply offers the sale? Skip forward from 2014 to July 2017, I was in Vermont with a 20 Group and we secretly phone shopped the dealer’s sales staff without their knowledge, prior to the meeting. We recorded the calls and then played each sales call to the group in the 20 Group meeting. Very quickly heads began to shake and eyes began to roll. You could visibly see the discontent on the dealers’ faces as each one took a turn, subjected to the audible punishment of their own staff neglectfully handling inbound calls. Only one dealer had a sales person get the caller’s first and last name, and a phone number. This isn’t a special sample of dealers, we all know if we called 20 or 200 at random the results would be painfully similar. McDonalds asked Morgan Spurlock to Super Size nine times, and he said yes. A 30-day experiment with three meals per day is 90 meals. However, McDonalds didn’t Super Size breakfast, so that reduces the opportunities to 60 meals. Nine attempts to up-sell Morgan, 60 opportunities. That equates to the staff of McDonalds offering an up-sell 15% of the time. There were 17 dealers in the Vermont 20 Group and not one effectively asked EPI-TIADAhalf July2018.pdf

for an appointment. Zero attempts to set an appointment out of 17 opportunities is 15% less than the staff at McDonalds. These are well-intentioned dealers, trying everyday to build great car businesses with best practices and smart processes. If we called every used car lot in the country, it is unlikely a strong ask for the appointment would equal or be greater than the 15% from the McDonalds team (McDonalds discontinued the Super Size program shortly after this documentary was released). Dealers are hunting for an edge over competition like never before, especially through technology advancement. Fundamental phone skills can be easily overlooked. Here is what a dealer’s sales team must be great at.

Sound Great and be Prepared for the Call

When inbound phone calls come in, the prospects commonly hears, “…sales…”, “this is John…”, “XYZ Auto Sales, who are you holding for…”. Think about it, Over 75% of inbound callers by a new or used car within 10 days of an inbound call and this is their very first impression. This is the quality of representation you are receiving after working so hard to build a great business, not to forget how much money you spend to get that phone to ring. Phone calls must be recorded and reviewed periodically. Sales professionals are either unwilling or unable to learn how to ask for an appointment. If they are unwilling, take them off the inbound calls. If they are unable, teach them and they will deliver. This all applies to a BDC as well. behind the wheel Send A Clear Message – Attend the Conference

ater this month TIADA will host its annual conference in Dallas, TX and you will send a clear message. Over the past five years we have used this opportunity to grow the influence of the association by inviting legislators to see our industry in a little different light. With over 500 attendees and almost 300 independent auto dealers in attendance it makes quite an impression on legislators who, for the most part, only know our industry through the stories they read or see on TV. Five years ago we invited the Speaker of the House, Joe Straus to attend our conference. He welcomed our attendees during the opening general session, gave a brief state of state and took a few questions. In those days we only had about 180 dealers attending the conference. We invited Speaker Straus to stay around after the opening general session. And he did! He stayed until about 2:00 pm, had lunch in the expo and walked around meeting with our dealer members. Before he left he told me how impressed he was with the number of dealers that attended and went on about the professionalism of the dealers. Then he encouraged me to have more legislators attend in the future. And so we did. The next year we had three legislators, and the year after that four. Last year we had seven legislators

attend our conference and we continue to hear the same message. They are impressed with the size of the conference and the professionalism of the dealers. It’s obvious, as it should be, that the number of attendees has a positive impact on the legislators. This year we invited nine legislators who will be speaking throughout the conference including during a panel discussion at our legislative luncheon. While there are many benefits to belonging to TIADA, protecting the interest of the industry is by far the greatest benefit. We work hard to keep you informed about what is going on at the Capitol, with the various regulatory agencies and when necessary, we provide the platform needed so your voice can be heard. This month, we will have one of those opportunities. The conference will be fantastic and I know our attendees will make quite an impact in helping legislators better understand our industry. But could we make a bigger impact? Yes, you are sending a very clear message when you don’t attend. I understand it’s expensive and it’s hard to be away from your dealership, but your attendance alone will speak volumes.
