FRIENDS EASE NIGHTMARE TRAVEL TIMES

ON THE COVER RAZZLE DAZZLE: Everyone was smiling at the recent Lindauer Ladies’ Race Day at Pukekohe Park including our carefree cover ‘girls’, Hannah Turner and Alex Jones. Their obvious enjoyment of the annual event summed up perfectly why a combination of bubbles, racing, fashion and food is a wonderful way to enjoy a sunny day in June far from winter and everyday chores. See page 8 for more.

It’s a wonderful feeling when things aren’t going to plan but friends rally round to make the day, or in my case, the days! Recently I had my husband, my sister and my sister-in-law all in hospital in the same week – different hospitals I might add – Ormiston, Auckland and Middlemore.

One admission was a bit of a nightmare. I arrived at the hospital at 8pm-ish, departed at 3am to reach home at nearly 4am. I then made my way to Auckland Hospital daily for several days, often in heavy traffic.

It was extremely tiring but then my amazing 87-year neighbour had dinner on the table one night as I arrived home after 6pm and on the following night other Puke’ friends bustled me off to The Longkeeper where we all tucked into yummy ribs. On the third night, a group of us gathered at The Franklin Club to unwind!

Although I crashed after each outing, being in bed within minutes of walking through the door and asleep in no time, it was fabulous to come home after juggling work and hospital visits to the heartwarming hospitality of the many precious friends I have made since

moving to Pukekohe. So, it’s a big thank to you all! However, I should add there was one day when I left our Howick office at 2.15pm and finally made it to Auckland Hospital by 3.40pm. I stayed only 20 minutes then took one hour to get just as far as the Greenlane intersection. I arrived home at 6.15pm after spending virtually all that time, bar 20 minutes, gridlocked on the Southern Motorway. I couldn’t help but think had all those cars be electric, the charge on most would most likely have run out and we might have been stuck there for many more hours! I could say a lot more on the Government’s latest electric car scheme which, in my mind is ill thought out, but I’ll leave that to another day. So, why not grab a cuppa, take to the couch and enjoy an hour with SOUTH magazine — there’s plenty to enjoy!

Roger Oliver THE DENTURE MAN Roger Oliver has more than 33 years dentistry experience and has loved every minute of it. Dental prosthetics is his passion and he’s been trained by masters in the field. His initial dental qualifications were obtained at Cape Peninsula University of Technology in South Africa. He also qualified in clinical dental technology at the University of Otago, New Zealand whereby some of his techniques have been passed to other clinical dental technology students. Roger has managed large commercial dental laboratories both in New Zealand and abroad and has been involved in the training of dentistry students. SOUTH magazine asked him about his work.

Healthy, wealthy or wise – if you could be only one of these, which would you choose and why? Wise! I believe a wise person could lead a healthy and wealthy lifestyle. Therefore gaining knowledge is so important. Aren’t all dentures created equal? Are there different types suited to different people (and mouths!) and can you cater for everyone? All dentures are not created equally. Each individual has different needs. Therefore our range of exceptional dentures, which we design and create, caters for every patient’s need. Who typically needs dentures and what are they made of? Dentures are prosthetic devices which replace missing teeth and are therefore often required by people from many walks of life. They are made of acrylic, nylon or metal which can be fitted over the gums to improve chewing and enhance aesthetics. www.southmagazine.co.nz

In addition to full dentures, what are partial dentures? Full dentures replace both upper and lower arches whereas partial dentures replace the missing teeth with some natural teeth remaining. What are immediate dentures and are they suitable for everyone? Immediate dentures is an option for having your teeth fitted on the day you have extractions. The dentures are made prior to extractions, hence you won’t be walking around toothless. What does it mean to reline a denture and does this have to be done regularly?

Typically, how long does it take to adjust to dentures and using them comfortably? Depending on tissue sensitivity, dentures usually settle in within several days. In some cases, patients may require some adjustments due to some tight-fitting areas caused by the pressure of new prosthesis. This all forms part of our after care which is included in our treatment therefore, there are no hidden costs. What’s the best strategy to avoid ever needing your services (ie: to keep our own teeth throughout our lives)? What tips would you offer?

Are a patient’s dentures made on site or elsewhere?

To avoid our service you may need to enjoy a healthy diet by consuming far less sugar and brush and floss regularly. Regular check-ups with your dentist to ensure a healthy dentition is also an important factor to help retain one’s own teeth.

THE FACTS DR NIKKI FROST, senior vet at Franklin Vets Pukekohe, explains what to look for when it comes to chronic kidney disease, how it is diagnosed and how it is managed.

At least 10 % of dogs and 30% of cats over the age of 10 will have some degree of chronic kidney disease. In cats this percentage increases to 50% by the time they are 15 and 80% of those who are 18 years old. The kidneys are responsible for maintaining water, electrolyte and acid balance in the body as well as excreting waste and producing some hormones. The main clinical signs seen with chronic kidney disease are weight loss, drinking and therefore urinating more. Later in the disease we can see poor appetite, weakness and vomiting. Diagnosis of kidney disease is made by blood and urine tests. Newer blood tests can pick up when 40% of kidney function is lost (traditional tests only increased when 75% of kidney function was lost) which gives us a chance to intervene. The mainstay of treatment involves diet change. Kidney diets are: • Lower in protein as the kidneys have to work to excrete the

waste products of protein break down • Lower in phosphate as in kidney disease this builds up and higher levels of phosphate hasten the progression of kidney disease • Higher in potassium as renal animals tend to be low in potassium, which can lead to weakness and the diets are also designed to try and maintain pH balance of the blood. Other interventions depend on the individual animal. Some have high blood pressure and some have increased protein in the urine, both of which need to be addressed as both can speed up the progression of kidney disease. Prognosis depends on how advanced the kidney disease is when it is diagnosed. As it is a progressive disease, function does decline over time. If diagnosed early, however, survival time from diagnosis is years. Senior blood tests screen for kidney disease and the earlier we can intervene, the better the life expectancy and quality of life expected from these animals.

Pukekohe-born Samantha Winn’s life was all about horses until she and her yachting enthusiast husband decided to change tack. Their latest venture, a five-star bed and breakfast luxury lodge out of Drury, has just won two industry awards for excellence. ANGELA KEMP visited.

It has sweeping, panoramic views of Auckland, taking in Pukekohe, Glenbrook, the Manukau Heads, the Sky Tower and beyond. It’s simply spectacular. The lodge is next to the family’s architect-designed home amongst two acres of garden from which visitors can watch gliders soar above Auckland Gliding Club below. It’s easy to see why Samantha fell in love with the property three years ago and persuaded her husband, Hamish Ross, to move. She says she has always loved entertaining and the opportunity to run a private lodge for paying guests was too good to miss.

Now, the couple are thrilled to have won both the 2021 Rising Star B&B Award and the booking.com Traveller Review Award 2021 for consistent, outstanding hospitality. Judges described Quail Lodge as ‘an immaculate property in both presentation and hosting’. The accolades have come less than two years since the lodge opened. Samantha grew up on Chelsea Farm in Rutherford Road, Pukekohe. Her father David Winn, a past president of Counties Racing Club, bred thoroughbreds so unsurprisingly horses became Samantha’s life. “From a very young age I slept and breathed horses. After school I competed in everything — dressage, show jumping and eventing,” she says.

“I rode competitively to a high level, ran a riding school and produced young horses for the international market.” Samantha is well known in Franklin and beyond for her special skill of teaching middle-aged riders to get into the saddle for the first time. “I have always taken great pleasure in hosting and entertaining. My equestrian background taught me to leave no stone unturned in the pursuit of excellence.” Husband, Hamish, is more used to riding the waves than a horse. A keen yachtsman, he is a world expert on all things America’s Cup and has been the legal advisor for several America’s Cup teams. After Samantha meet Hamish 10 years ago, the couple set up home

in Whitford before moving to St Heliers where they renovated a house overlooking the sea. Hamish wanted to take a step back from the America’s Cup so they bought a kitchen manufacturing company in Papakura for him to run. “After seven years the commute was getting worse and I began looking for properties out here,” says Samantha. “I had to twist Hamish’s arm to get him to move but he admits I was right. We both just love it here.” In December last year, Samantha threw a party for Hamish’s 60th birthday and surprised him, and most of the 80 guests, with a marriage proposal. “He’d been asking me to marry him www.southmagazine.co.nz

for years and I’d said, ‘no’ for a variety of reasons. But then I thought this was the perfect opportunity.

They were Canadian and were supposed to be having a beautiful Canadian white wedding but they couldn’t go home.

“I gave him this big speech and at the end gave him a card with a marriage licence in it. He looked at it and didn’t say anything and finally everyone was asking, ‘well, what does it say?’

“They wanted to be married somewhere where they could take their dog and stayed for two days.”

“He said ‘it’s from the Department of Internal Affairs and it’s got my name on it and her name on it, so yes, yes, yes, I’d love to marry you’. “He hadn’t read the date and his mouth just dropped when I said I was going to get changed as the wedding was happening now.” Samantha adds that Quail Farm has hosted three weddings plus Hamish and hers. “One was literally a couple and their dog. www.southmagazine.co.nz

In the dark days after last year’s Covid lockdowns, Samantha ran a successful ‘set your own price’ deal to encourage bookings. “As long as it didn’t cost me money, I would accept it. I filled the lodge every weekend I wanted.” With the move to Drury, Samantha says she feels as if she has come home again; the views from the lodge reminding her of her childhood in Pukekohe. And, while she still gives the occasional dressage lesson, she’s more than happy keeping her feet on the ground and giving her guests the best time she can.

A HOME TO ROOST Samantha named Quail Lodge after the birds which had made their home on the property. “But as soon as we moved in, they disappeared, never to be seen again!” she says. With such stunning views, it’s doubtful guests will notice the absence of quail but will appreciate the plentiful kererus swooping around. Quail Lodge can accommodate up to four people and has a large kitchenette and an elegant lounge. Breakfast is served in the lodge or on its private deck and looking at recent reviews, Samantha’s whitebait fritters come highly recommended. Describing herself as ‘a good home cook, not a chef’, Samantha is also happy to serve guests dinner in the lodge or if they prefer, they are welcome to join her and Hamish for a family meal in the main residence. The Heaphy Track isn’t the hardest of New Zealand’s Great Walks but it is certainly the longest so, when I announced my intention to take it on, I was delighted that two Howick Tramping Club friends, Margaret Freeman and Philip Scothern, said they were keen to come too. A few emails and bookings later and we were set to fly Air NZ to Nelson on May 9, then board a flight with Mit Brereton from Adventure Flights Golden Bay in order to arrive near the Northern end of the track. The idea was to tramp to Perry Saddle Hut on the same day. The weather had other ideas! A low pressure system swept in across the Tasman delaying our landing at Nelson and our flight with Mit. Eventually, on flying out from Nelson, we enjoyed a thrilling 30-minute, small aircraft trip through mist and fog over the Takaka hill before landing at Adventure Flights private Takaka airstrip. We were then delivered to road end in Mit’s Ute. It was clearly too late in the day to attempt the walk to Perry Saddle Hut, about five to six hours away. What’s more, it was raining (moderately) and the light was failing so we just walked the 300

metres to Brown Hut where we spent the night. Other hut users had a roaring fire on the go which kept us toasty warm as we dried off and prepared our evening meal. Day two dawned clear and cool so, after breakfast, and returning a stray weta to the bush, we packed up, swept out the hut and headed for Perry Saddle following a route once surveyed for a road. A steady climb through beech forest took us to Aorere shelter where we had a snack and donned wet weather gear as it had started raining. There were good views over the Aorere Valley as we headed uphill to Flanagan’s corner so, Margaret took a short side trip to the highest point on the Heaphy track at 915 metres. Unfortunately, mist had settled in the valley so there wasn’t much to see. Half an hour later we arrived, sodden, at Perry Saddle Hut which was being buffeted by a strong wind. Stumbling into the lobby, we removed our packs and dripping coats and hoped we could stay for an unscheduled night as we were supposed to have been there a day earlier – as on all Great Walks,

huts must be booked in advance to ensure a bunk. Almost immediately a helpful, young hut warden arrived and, on hearing our predicament, she contacted DOC to see if there were any spare bunks. Luckily, there were; we grabbed a spot, unpacked and put on dry clothing. Soon afterwards, a guided group of eight walkers and two guides arrived, all wearing pink ponchos provided by Bush & Beyond, which was leading the group. In addition, several mountain bikers, carrying their typically minimal gear, also arrived (during the winter season, May 1 to November 30, mountain bikers are permitted to ride the track). With a fire going, and a full hut, the atmosphere was warm and convivial. We woke on day three to shrieking winds and driving rain, which made the 50-metre dash to long drop toilets very interesting! Breakfast and ablutions completed we again donned wet weather gear and gaiters then headed for Gouland Downs Hut for our planned overnight stop.

The rain was heavy and, as we moved through the bush, we encountered numerous waterfalls and torrents of water running across the path. Caution was needed to cross these and the swollen side streams. Fortunately, we had walking poles to assist with balance. Leaving the bush we found ourselves on expansive tussock downs and an hour later arrived at Gouland Downs Hut, an older but very quaint, eight-bunk building. Although not as popular as the larger huts, we were very happy to have it all to ourselves that night and were most comfortable. Philip lit a stonking fire and we stripped off our wet gear, spreading it around to dry. Hot soup and an early dinner followed. Highlight of the afternoon was a visit from a cheeky weka! As daylight faded and the embers glowed we slid into our sleeping bags for a good night’s sleep. Day four was still wet ahead of our 17km tramp to James Mackay Hut. In no hurry, we enjoyed a nourishing breakfast, filled up our packs and headed off to look at some small caves in nearby bush. www.southmagazine.co.nz

Finally, on track, we had a slightly undulating walk over more tussock downs and crossed several fast flowing streams on what appeared to be recently upgraded bridges. Thankfully, some sections of boardwalk kept our feet dry and protected sensitive flora nearby. We stopped briefly at Saxon Hut for refreshments and encountered three mountain bikers cheerfully making the best of the wet. Later, a gentle climb through more bush took us past the lovely greens of damp mosses, ferns and lichens, while the red hues of horopito and dracophyllum trees were stunning in their brilliance after the persistent rain. By the time we reached James Mackay Hut the weather had improved. Elevated and surrounded by beech forest, this hut enjoyed expansive views to the coast. We could even see the Heaphy River mouth in the distance. A relatively new hut, it has 28 bunks and flushing toilets on a covered deck – absolute luxury! After finding our bunks and rolling out our sleeping bags, we headed for the large kitchen and communal area to whizz up soups and think about www.southmagazine.co.nz

which de-hy meal to have for dinner. Thursday, May 13 came around and it was on to Heaphy Hut, more than 20 km away. A clear sky and frost on the hut deck pointed to a fine day so Margaret and Philip joined others in climbing to a vantage point behind the hut to view the sunrise. Soon everyone was astir being keen to start the downhill trek to Heaphy Hut. The gentle descent through beech forest, interspersed with rimu, kahikatea and matai, was invigorating and we arrived at Lewis Hut for our lunch break after walking 12.5 km. Margaret opted to sit in the sunshine on a log near the Lewis River. As she lifted a spinach wrap to her mouth an audacious Weka swooped past and grabbed the entire wedge in its beak leaving Margaret hungry but very impressed with the bird’s scavenging skill! Crossing the Lewis River swing bridge we continued the drop down to the Heaphy River, encountering the start of a nikau forest and some massive northern rata trees, amongst the largest in the country. At the hut, the sun was bright and warm, perfect for a final dry out

of damp gear! Keen to explore the beach and river mouth we braced ourselves for an onslaught of sand flies and headed off at intervals. After days of hard, wet tracks, it was lovely to walk on soft sand and see surf crashing on the beach. Heaphy Hut is a relatively new hut, with four separate bunkrooms each containing eight bunks. There is a spacious kitchen and communal area and, yes, flushing toilets, too. That evening we again enjoyed the company of the guided group we’d met earlier. What’s more, the guides offered us delicious food they had prepared for their clients but which was extra to their needs. It certainly was a welcome change from our reconstituted dehydrated food. On day six it was Heaphy Hut to Kohaihai River mouth, 16.2 kms. We woke early, keen to start the last leg of our wonderful journey, and, happily, it was clear blue skies with a crisp atmosphere outside. After breakfast we crammed our packs full for the last time and headed for the track which meanders through swathes of well-established nikau palms along the foreshore. It was a stunning day to finish on and as we climbed over the Kohaihai Bluff we saw a giant powelliphanta land snail – terrific! A phone call from Scotts Beach (where there is cell phone coverage) an hour beforehand meant our transport to Karamea was waiting for us at road end. We just had time for a photo by the Heaphy Track sign and then it was off to The Last Resort in Karamea for a hot shower. Despite the rain this was a superb experience and I must thank Margaret and Philip for their companionship and assistance with putting the trip together; I highly recommend others do the same. Mumma J’s BEAUTY START-UP TO WELLBEING STAR Growing interest in plant-based skin care products has prompted one enterprising local to formulate her own brand. HELEN PERRY talked to Julie Holder whose Mumma J’s range has hit a chord with many people including women, who like herself, have survived breast cancer but not without scars.

Four years ago, Julie Holder was at crossroads in her life. She had just learned she might lose her job and then came the devastating news that she had breast cancer. After the initial shock, followed by surgery and recovery, this Glenbrook ‘workaholic’ took stock of her life and set out on a new path. “I’d heard people say that when you’re diagnosed with breast cancer you revaluate your life; it’s true, you do.” And, like others unsettled by such a major shift in health, Julie moved in a new direction by changing her job 12 months after recovering from a mastectomy and breast reconstruction. She then looked for other ways to gain greater satisfaction in life. Her daughter suggested training as a nail technician and, having always had an interest in health and beauty, Julie took her advice. “I did the training but realised it would take time to build up a solid client base and to do so would mean giving up my regular job which wasn’t viable. “However, I was doing a lot of running at the time and realised that I didn’t always smell that great after pounding the footpath. I have a certificate in aromatherapy and had long been interested in essential oils so, with that background, I set about www.southmagazine.co.nz

formulating an environmentallyfriendly deodorant which suited me. “But because I was more interested in healing and reducing the look of scar tissue, I turned to developing a cream, and then an oil, to not only help women scarred from mastectomies but also for others with scars resulting from burns or other accidents.” Julie’s cream, which contains coconut, tamanu and calendula oils, has proved particularly beneficial for soothing rashes such as eczema and psoriasis but it is the oil she is most proud of. “I call it ‘My Oil’ because dealing with scars of any kind is very personal and I wanted this product to feel personal to those using it. It includes rosehip and tamanu oil (from the Pacific islands) and helps reduce redness and scar prominence. “My surgeon took to recommending it to other breast cancer patients and I know many customers have found it helpful for a variety of scarring. The main thing is to persevere for longer than a week. Some people try it for a few days and because they see little improvement, they stop. Most products take time to have an effect.” With two successful, products formulated under her Mumma J’s brand, Julie went on to extend her

chemical-free, all-natural skin care range which now includes a green tea and honey cleanser, facial exfoliator, moisturiser, toner and a light night oil. “The night oil is good for softening and strengthening the skin but it also works well on acne too because it ‘tricks’ the skin into halting overproduction of sebum.” Selling online through her website www.mummajs.co.nz and also at Howick’s Saturday street market Julie says she has been a market stall holder for the past 12 months and loves it. “They are such a great group of people and market visitors have been very receptive to all-natural products. I’ve even fulfilled a few requests such as developing an olive oil soap for one client and a nut-free oil for another.” Julie also markets her own extensive range of essential oils and even customises these on request – “that’s the aromatherapy training coming out in me. I love working with essential oils because they can lift your mood, make you feel good and relieve the symptoms of some conditions.” Furthermore, these days, Julie is feeling very good about herself and life. “It took 12 months before I felt really recovered from the shock of breast cancer and subsequent

surgery. It was then my husband Stan, who gives me the most amazing support, suggested our five bedroom, three bathroom, three level home and no kids was now much too big for us. “We opted to move, put a pin in a map and draw a radius of 50 kilometres. We finally decided on Glenbrook and moved to a new home there two and a half years ago. Though initially hesitant, we just love it and wouldn’t go back west even through our children and grandchildren would like us to. “But, no, this is truly home. We love the countryside and, here, I’ve really learned to listen to my body and to sleep when I am tired.” But to some it seems Julie is, in fact, tireless. She still works full time as an operations manager for a wholesaler, makes her skin care range at home and enjoys crossstitch when she can. “I am busy but I make my products in small batches so they are always fresh and, actually, it can be very relaxing. I also use them myself, so gain all the benefits, too. “The next step is to give up my job – but who knows when that will be – and concentrate full time on my business. I’d also like to find space in a local hair salon where I can do nails and perhaps market my products too. That would be ideal.” south | july 2021 | 21

When sleep quality is poor due to physical discomfort, troubling nightmares, or an overactive mind, then staying awake — and alert — throughout the day can become quite the challenge. Here are some pointers to help you get the rest you need:

Physical factors: Changes your body goes through during pregnancy can easily get in the way of a good night’s sleep. Breast tenderness, back pain and seemingly random bouts of nausea can be difficult to keep under control.

Even when those symptoms aren’t present, there’s no escaping the night time bathroom breaks which generally become more frequent as baby grows against the bladder. Every woman is different, so take a trial-and-error approach to find the right sleep solution for you. Start by adding a few extra pillows to your bed, and try sleeping with one between your legs and one under your shoulders. Some women also find it easier to sleep in a reclining chair. Consult your doctor as to whether magnesium, (often recommended) or perhaps a herbal remedy, can be taken to assist with sleeping.

Recovering lost sleep: If sleepless nights no longer provide enough rest to get through the day, the next weapon of choice is a nap. Tackle any chores in the morning then get your energy levels back on track by taking an afternoon snooze a few times a week, but don’t overdo it. Remember, hitting the hay at a reasonable hour is your best bet against next-day fatigue. Your body needs all the hours of sleep it can get to carry you through your daily routine, which is why health-care professionals emphasise the importance of an early bedtime for pregnant women. ROASTED PARSNIP & GARLIC SOUP Serves: 4-5 | Preparation: 10 minutes | Cooking: 50 minutes

5 parsnips 6 cloves garlic 2 tbsp olive oil 1 tbsp ground turmeric 4 cups vegetable stock 1 cup milk of choice Pinch salt & pepper

METHOD: Preheat oven to 200°C. Peel and slice parsnips into small pieces and place on a baking tray. Drizzle with olive oil and sprinkle over salt. Bake for 20 minutes. Remove tray and add unpeeled garlic cloves. Return to oven and bake for a further 15 minutes until parsnips & garlic are tender Peel the skin off the garlic cloves and set aside. Place the parsnips into a pot with the vegetable stock and bring to a boil Remove the parsnips from the pot and place in a food processor with garlic, turmeric, milk and pepper. Blend until smooth. Transfer mixture back into the pot and mix well. Bring to the boil again, and simmer for 10 minutes Serve warm soup in bowls and garnish with chilli flakes, sprouts, coriander leaves and cashew nuts. south | july 2021 | 27

Nasty spills and problem stains are not unusual but dealing with them can be at problematic. Home insurance experts st money.co.uk have now revealed the mo common cleaning disasters and offer solutions for some of them.

Clogged drains are obviously a problem worldwide as they topped the list of common cleaning disasters with 17,300 average monthly global searches seeking a solution. The home insurance team at money.co.uk suggested pouring hot water down the clogged drain and following it up with baking soda and vinegar, letting it sit for 30 minutes and then adding more hot water to clear the clog. Second spot went to removing

pet hair, with average monthly searches of 15,200. Using rubber gloves to remove the hair was a recommended approach because when rubber is brushed against clothes, it generates static and will attract those unwanted hairs which are hard to get rid of. Not far behind in third place, with 14,400 average monthly searches, was lime scale removal. A simple solution to this chore is a combination of soda and vinegar and letting it sit for 10 minutes.

Second spot went to removing pet hair, with average monthly searches of 15,200. In fourth place was removing dirt from grout — 12,400 average monthly searches. Tackling grimy grout can be tiresome but scrubbing with an old toothbrush and some whitening toothpaste may help or try 30 Seconds Indoor Mould Remover. Placing fifth was cleaning a dirty toilet with 10,800 average monthly searches. Cleaning experts recommended using essential oils and/or baking soda and vinegar as a DIY toilet cleaner.

Stains on the carpet came in at sixth with 6200 monthly global searches while chipped paint was seventh. The last three places rounded off with water stains in eighth place, dirty windows in ninth and finally, cracked or chipped tiles in tenth. A simple way to tackle the tile issue is to simply squeeze out a small amount of regular toothpaste and apply it evenly to the cracks. Find a toothpaste which matches the colour of your tile for the best finish.

Keen to protect your assets? ZAID MOHAMMED from Wynyard Wood outlines the importance of Contracting Out Agreements when couples wish to protect their own assets. Typically, at the end of a de facto relationship or marriage, the general presumption under the Property (Relationships) Act 1976 is that all relationship property (including the family home, family vehicle, furniture and chattels regardless of when or how it was acquired) will be divided equally between the parties who have been living together in a relationship for more than three years. Often, people don’t want their assets shared, especially if they are bringing into the relationship substantially more assets than the other party. To protect their assets, parties are able to enter into a contracting out agreement (or more commonly referred to as prenup) to determine the ownership and division of their property upon death or separation. When should you enter into a Contracting Out Agreement? Talking about what should happen if the relationship ends can often be overwhelming and overly negative, but if your new relationship is becoming serious and you have property you want to protect, it is probably a conversation you should have as soon as possible.

Other times when you may also wish to discuss this option is when you purchase your first home and make contributions of unequal amounts or if you have children from a previous relationship and wish to protect their future inheritance. It is important to note that this process takes time. It is not a process you want to rush because you are getting married or have been in a relationship for three years. There are certain requirements that must be met for a Contracting Out Agreement to be valid. These are: • The agreement must be in writing and signed by both parties. • Each party must obtain independent legal advice before signing the agreement. • The signature of each party must be witnessed by their lawyer. • The lawyer who witnesses the signature must certify that they have provided independent legal advice as to the effects and implications of the agreement.
