Henry regular goes onto his neighbour’s property to pick mushrooms. His neighbour has not consented to this and finds it extremely disturbing as he is worried if Henry suffers injury will he be liable and, he finds Henry’s attitude upsetting as Henry operates as if it is his own land.
Trespass to land is any interference with the possession of land. It could be crossing over another’s property without permission, driving one’s animals onto another’s land to graze, taking produce off another’s land, going in to cut their trees, going in and placing one’s belongings/machinery on another’s land or going in to interfere with another’s land and the items on it. It is a tort or civil Wrong. The action must be voluntary so if one is pushed onto someone’s land one may not be liable, but the pusher may be.
The mere act of trespass even if no damage is caused is actionable and may result in an action for compensation but it may be only nominal compensation if granted if no damage is caused as part of the Trespass.
Defences to trespass may be consent where a person has been granted to the entry, justification on the grounds that it was to save a life or animal, necessity e.g. to escape a raging bull.
In some situations, consent may be given to an entry onto property for a certain purpose but if the entrant exceeds that purpose, it may constitute trespass. Likewise, if a person has been granted permission to be on property for a particular period of time and exceeds that time they may then be trespassing. Special considerations apply to a person’s home as that is protected by the Irish Constitution 1937 and if a person trespasses into a
person’s home, they may also be a breach of the constitutional right to the inviolability of the home.
Trespass is an important tort to deter people from interfering with other people’s possession of their land. The mere fact of the trespass may result in a claim even if no damage is proved. Therefore, it acts as a deterrent and ensures that there is not a free for all in relation to people tramping in and out of other people’s property without permission causing upset and mayhem. Henry’s ongoing behaviour if it continues after he has been warned may result in an action for trespass together with loss and damage resulting from the loss of the mushroom crop.
In addition, it must be noted that if someone enters another’s property or building with the intention of committing an offence or interfering with property and they may be prosecuted under the Criminal Justice (Public Order) Act 1994. There is another offence of trespassing with intent to cause fear to a person. These are criminal offences.

Trespasser: “Well, it’s like this. I saw the sign, but when I read ‘Private’, I didn’t read any further because I thought it wasn’t any of my business.”

To kick off the 50th-anniversary celebrations of The Rose Hotel Circuit of Kerry Rally, Kerry Motor Club is hosting a special launch event and reunion on March 8.
The 2025 Rose Hotel Circuit of Kerry Stages Rally is taking place on March 30. This year’s event is extra special, marking the 50th anniversary of the rally’s start back in 1975. There is an open invitation to everyone involved with the Circuit of Kerry since 1975 – past competitors, organisers, marshals, fans, and anyone with a connection to the event to attend the launch and reunion on March 8 at the Rose Hotel from 6 pm to 9 pm. The evening will begin with a formal launch where clerk of the course Jonathan O’Shea and his organising team will announce further details of the rally.
This will be followed by an informal reunion in Dott’s Bar in the hotel later that evening.
A display of Circuit of Kerry memorabilia, including official programmes and other items of interest, will be on show, and the club encourages attendees to bring along any memorabilia they might have to share.
“It’s a fantastic chance to share stories, reminisce about past rallies, and reconnect with old friends,” said O’Shea.
The 2025 route will revisit the classic Camp Mountain stage, a key part of the original 1975 rally.
Other iconic West Kerry stages will also be included, offering competitors a demanding and exciting challenge.
The Circuit of Kerry is part of the Triton Showers National Rally Championship, the Top Part West Coast Rally Championship, and the Moriarty’s Central Car Sales Kingdom of Kerry Rally Championship. The rally will also host the new Dacia Sandero Cup.
The event will consist of nine stages, run as a three-stage loop repeated three times. The Rose Hotel in Tralee will serve as the rally headquarter.
Following the success of the Kerry
Winter Rally in November, the North Campus of the Munster Technological University will host the rally’s service park.

Minister for Children, Disability, Equality and Kerry T.D Norma Foley has welcomed the Government announcement that a new €10 million Nursing Home Residential Premises Upgrade Scheme has opened for applications. The Nursing Home Residential Premises Upgrade (RPU) Scheme will assist private and voluntary nursing homes in improving and upgrading their premises, help meet compliance with regulations and to meet the needs of residents.
Up to €25,000 is available to each qualifying nursing home for eligible works under the scheme. Nursing homes may claim for works carried out this year between 1 January and
14 November 2025 and also for works previously undertaken during 2024, between 1 January 2024 and 31 December 2024 that meet the scheme criteria.
The Health Service Executive (HSE) administer the scheme and the National Treatment Purchase Fund (NTPF) administer the application process and provide support and advice to the HSE. Scheme details including application forms are available on the HSE and NTPF websites.

Kerry FC made a dream start to the 2025 SSE Airtricity Men’s First Division, securing a 2-0 win over Finn Harps in front of a roaring home crowd at Mounthawk Park. Under the Friday night lights, Conor McCarthy’s side delivered a professional and confident performance, marking their first-ever opening day victory on their third attempt.
The game began cautiously, with
both teams adjusting to the new season. Finn Harps controlled possession early, but Kerry FC’s new star, Joe Adams, quickly made his presence felt. In the 24th minute, Adams finished brilliantly after a clever flick from Ronan Teahan, sending the home fans into celebration. Adams continued to threaten, testing the Finn Harps keeper with a powerful free kick before halftime.
Kerry’s defence, led by Chris McQueen and Abel Alabi, was rock-solid throughout, denying the visitors any clear-cut chances. The home side doubled their lead in the 67th minute when Niall Brookwell smashed home a loose ball from a set piece, putting Kerry in control. Despite a controversial red card for Adams in the 73rd minute, Kerry FC stayed disciplined and saw out the game in dominant fashion. Finn
Harps failed to take advantage of their extra man, as Kerry’s determined defence and attacking intent ensured a well-earned three points.
Kerry FC now turn their focus to next Friday’s clash with Cobh Ramblers, aiming to build on this historic season-opening triumph.

For the salsa:
Preheat your oven to 200°C/fan 180°C/gas 6. Spread out the chips on a large non-stick baking tray in a single layer. Spray with low-calorie cooking spray and bake for around 40 minutes or until golden, turning halfway. When the chips have been cooking for 30 minutes, spray a large non-stick wok or frying pan with low-calorie cooking spray and put it over a medium-high heat. Stir-fry the onion and pepper for 5-6 minutes or until so ened and a little coloured, then stir through the spring onions and set aside. Once the chips are cooked, toss with the veg. Lightly season with salt and a generous twist of black pepper to serve.

BALLYMACELLIGOTT GAA NOTES
Senior Men
Our senior men faced Churchill in the second round of the district board league on Sunday. Despite a depleted squad, Niall Collins stepped in as goalkeeper. Tadhg Brick and Darragh O’Regan each netted goals, while Donal Daly and Collins scored two-pointers. With a strong wind advantage, we led by one point at halftime but lost 2-18 to 2-14. Training continues Tuesday and Friday under lights as we prepare to face Ardfert in Round 3 next weekend.

KERINS O’RAHILLYS GAA NOTES Seniors
We return to action in the Tralee/St Brendan’s League on Sunday, February 23rd against Na Gaeil in Killeen (throwin at 12 PM, subject to change).
The Kerry Petroleum Club Championship draw places us in Group 4 of the Intermediate Championship alongside Glenbeigh/Glencar, Beaufort, and Gneeveguilla. The top two teams will advance to the knockout quarterfinals in August/September.
Congrats to Ben Hanafin, who played wing forward for UCD Freshers in their All-Ireland A Final win over DCU. Also, Darragh O’Connor finished joint top scorer of the Sigerson Cup with 2-19 despite MTU Kerry exiting at the quarter-final stage.
Our Club Social takes place on Saturday, March 22nd at the Rose Hotel. The night will honor the 1985 & 1999 County League-winning teams and the 1999 Minor County Champions. Tickets (€75) are available via kerinsorahillysevents@gmail.com or 085 2095001.

BIDL Women’s League – Round 5 Garvey’s Tralee Warriors 65 - Titans 47 Warriors Women are now joint second in the league after a 65-47 win over Titans at Mercy Mounthawk. They sit one win behind leaders St. Mary’s Castleisland, their next opponents on Friday, February 28th, at 7:30 PM. The Warriors dominated from the start, leading 19-0 early on, with Niamh Collins, Holly O’Brien, and Claire O’Mahony leading the charge. Titans fought back in the second half, reducing the gap to 53-41, but Warriors regained
control, sealing victory with key scores from Collins, O’Brien, and Grace Lucid.
Warriors BIDL Men Stay Unbeaten Basketball Ireland Men’s Development League – Round 6
Garvey’s Tralee Warriors 102 - Atlantic Eagles 76
Warriors Men remain unbeaten with six wins from six, defeating Atlantic Eagles 102-76. Despite missing key players, they controlled the game from the start, with Dan Bowler, Padraig Fleming, and James Fernane leading the attack. The Eagles fought back in the second half, with Karolis Gunka (35 points) impressing, but Warriors’ firepower ensured a comfortable win.

Garvey’s Tralee Warriors 103 - EJ Sligo All Stars 70
Warriors marked their first game at Mícheál Ó Muircheartaigh Sports Hall in style, dominating EJ Sligo All Stars with a 103-70 win. A 20-point unanswered run in the first quarter set the tone, securing their third-place position ahead of a crucial week of fixtures.
Mark Stephens scored the opening basket at the new venue, with Daniel Jokubaitis and Rap Buivydas quickly adding to the tally. Sligo’s Jevonnie Scott (21 points) kept them in the game early, but Warriors’ defensive lockdown saw them lead 33-13 at quarter time.
Sligo mounted a comeback in the third quarter, cutting the deficit to 65-53, but Warriors responded with Stephens, Jokubaitis, and Mahan pushing the lead to 77-55 entering the final period. Adon, Mahan, and Osayanrhion closed out the game in dominant fashion, ensuring a comfortable victory.
Next up: Three games in five days, starting with a local derby against Killorglin on Feb 28, followed by Neptune (March 1) and Ballincollig (March 3).
