LEGAL MATTERS CORNER
MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
Dessie has lost the title deeds for his house and is wondering what he can do about it. There are ways of reconstituting/reconstructing title but there is a big difference as to how one might do this depending on which of the two different types of title that one potentially may have for one’s property.
There are two types of land registration in Ireland one is registry of Deeds title, and the other is registration through the land Registry. They are both operated under what used to be the Property Registration Authority and is now Tailte Eireann.
In relation to the registry of deeds title this is where the title to the property consists of all the title documents which have transferred the title over the years. To give an example say we say 8 Moran Street in a town in Ireland a fictitious address but most of the towns in Ireland would still have a lot of unregistered/registry of Deeds title. The original title document was a fee farm grant from the owner of the land on which this house was built in 1860 and then it was transferred from owner to owner and the present owner has all these Deeds of Transfer/ conveyances. If a person died on the title the Grant of Probate or administration is taken out and then an assent is done, and these original documents are with the title deeds. Summaries of all the Deeds called memorials are lodged in the Registry of Deeds which has a record of all the various title documents which were put in place over the years. If these are lost some form of reconstitution can happen if there are copies of the original deeds available or with copies of memorials from the Registry of Deeds office but because the title is all the original title deeds it is more of a big deal if they are all lost.
On the other hand, with the land registry title has the proof of title validated by the state available through the land registry. This is in the form of a folio and file plan(map). The folio sets out a description of the land, who it is owned by, if there are any charges/mortgages or burdens on the property and a map of the property. The beauty of this system which applies to over 90% of the land in Ireland is that it is not as fatal as if the bundle of title deeds referred to above is lost as the title can be obtained by ordering a foliofileplan from the Land Registry. It is as if the government office holds the details of the title and can give copies out to whoever needs them.
HAIRSTYLIST
Professional Grooming for Men & Women
Of course, whether the property is registered or unregistered there are other documents which are relevant to title e.g. BER Certs, confirmation that any financial contributions have been paid, planning permissions, declarations by engineers that a property is built in compliance with planning and that the map is correct but provided the planning and mapping is correct it is only a matter of getting these verified and certified again by an engineer. The message from all the above is that if one happens to have a property with unregistered title where the title subsists in a bundle of title documentation that one must be extra careful to ensure that these are not lost.

The ‘Real’ reasons why to become a host family to an international student
Invite a French, Spanish, German, Italian into your home for a couple of weeks this Summer and you will get paid for it! Celtic School of English (part of Greenview Language Group) organise short stays for adult and teenage students coming to Tralee to learn English and enjoy Irish culture. They fit into your day to day family life, eat the same meals, do whatever you are doing – the most important thing is that they feel part of a family and experience Irish culture in that way. You don’t need to entertain them all day – they have English classes in the morning and activities in the afternoon. But the extra money they earn is only part of the reason why families welcome the students into their home again
and again .Anne from Greenview has compiled some of the most popular comments she regularly hears from her students after their stay in Tralee with their host families .
‘I love my family!’ ....‘‘I had a good time with them. Beautiful family’ ....‘I met a very nice and helpful family’ ... ‘Our foster family was so nice. The mother always cared about doing the best for us and I really enjoyed staying with the family. It was an incredible experience’ ....‘So welcoming’ .....‘Very friendly and very attentive – she always tried to make me feel happy’ ....‘ She is like a second mother to me !’ .....‘This is my second trip to Tralee and its like my second home ! I will be back again! ....‘I can’t wait to welcome my
new family to my home in France’
One host family said: ‘We really enjoy taking a student from Celtic School of English every summer and the extra bit of cash goes a long way towards paying for our family

The new national park includes the Conor Pass, as well as new sites at Inch Peninsula, Mount Brandon and the Owenmore River.
It is the first time that a second national park has been established in the same county, following the designation of Killarney national park back in 1932.
Minister Foley said:
“This will be an incredible amenity. It is a transformative moment for West Kerry and the entire county, allowing us to showcase the very best of our natural environment locally, nationally and internationally.”
Minister Foley has engaged consistently with Minister Darragh O’Brien since the Conor Pass and additional areas came up for sale last year. She said that the new national park would now be in place for the people of Kerry and for tourists from all over the world.
“I am delighted that the astounding
beauty of my home county and her pristine seas has been recognised today by the creation of a second National Park in Kerry; Páirc Náisiúnta na Mara, Ciarraí.” Páirc Náisiúnta na Mara, Ciarraí is Ireland’s eighth and largest National Park, with more than 70,000 acres of lands and seas in public ownership.
It brings together new acquisitions by the National Parks and Wildlife Service, such as the Conor Pass, the Owenmore River catchment, lands at Mount Brandon and the sand dune system at Inch Peninsula,

‘nearly there‘ as Bord Pleanála demand ‘more information’
Ned O’Shea Construction was recently informed that their approved plan for 235 new homes in Lisloose, Tralee, was overturned by An Bord Pleanála. The project, developed in collaboration with Kerry County Council, went through the Large Scale Development (LRD) process for early engagement between the developer and the planning authority. Despite receiving permission from Kerry County Council last November, the decision was appealed to An Bord Pleanála in December 2023, leading to its recent refusal.
An Bord Pleanála cited a single reason for the refusal: the lack of precise information on the route of
