LEGAL MATTERS CORNER
MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
Mary and Sarah are cousins who went on holidays along with their parents, aunts, uncles, and cousins. There was 16 of them who flew to Lanzarote in total. Mary was in a bad mood from as soon as they got to the airport, she had wanted to bring her boyfriend along on the trip, but the family insisted on it being family only, this really vexed her. Mary was very angry even after landing in Lanzarote. One evening the girls went out for a meal, conversations between Mary and Sarah got heated. Mary jumped up off her seat and raised her fist at Sarah, she shouted ‘I’m going to box your big nose’, Sarah was petrified she taught Mary was going to box her into the face and was surprised when she stormed off without doing so. The following morning, they were down at the pool and Mary started giving out to Sarah again telling her once more she was going to ‘box her big nose’, this time however Sarah laughed and said you will not, she figured if she didn’t do it last night, she wouldn’t now either. Sarah was correct Mary once again stormed off. Sarah did not report this to the Spanish authority but since coming home she has decided she wants to teach Mary a lesson as she feels she ruined her holiday and wonders can she bring a claim against Mary.
Sarah could potentially bring a claim against Mary under trespass against the person. This tort is actionable per se thus it does not require damages. There are four types of trespass to the person 1. Assault, 2. Battery, 3. False imprisonment, 4. Infliction of emotional distress. Assault is the
threat of, or attempt to apply, force to another, which must put that person in reasonable apprehension that immediate force will befall him, it must also be a voluntary act. There will be no assault if it is obvious to the plaintiff that the defendant is unable to carry out the threat. It must also be emphasized that words alone will not usually constitute assault. Sarah has described two incidents the first being at meal and the second at the pool. It would seem that Mary committed an assault against Sarah at the meal, Sarah was scared and genuinely believed immediate force was about to fall on her, Mary’s threat was accompanied by gesturing of her fists and jumping up off the chair, all of this was voluntarily and an act Mary was capable of. However, at the pool Sarah did not believe she was in a situation where immediate force was going to fall on her and Marys actions will not constitute an assault. Battery is defined as the direct application of physical contact upon another without his consent or any other lawful excuse. There was no direct application of force in either instance. False imprisonment is any act of the defendant which directly and either intentionally or negligently causes the confinement of the plaintiff in an area controlled by the defendant, Sarah has not provided any information that would suggest a claim of false imprisonment. It may be possible to bring a claim of emotional suffering, as Sarah claims Mary ruined her holiday however this has proven difficult to establish before the courts.

THIS MONTH, BALLYSEEDY HOME & GARDEN CENTRE, BERNIE FALVEY SHARES SOME ADVICE AROUND CONTAINER PLANTING.
Container Planting is a simple and versatile way to add a sea of colour and scent to your garden, patio, balcony or window sill. Plenty of enjoyment can be had with container planting, and by experimenting with the height and texture of various plants, it can lead to a wonderful and unique aesthetic. A few easy steps include, planting to the level of the original pot, incorporating a seaweed based granular feed and firming the soil, while at the same time being gentle around the plant. Just like us, flowers need time to adjust and in particular to a new home or space. Water them daily during dry hot spells, and with a little time, the flowers will grow and bloom to their best potential. As each plant finishes flowering, deadhead and new flowers will emerge very quickly, this extends the flowering period.
With container gardening you have less disease to contend with and with seaweed-based feeds, very few pest and disease issues arise. Geraniums both scented and traditional, begonias both upright and trailing, lobelia, petunia/surfinia. Container gardening is super for less disease problems than plants grown in soil, and weeding is unlikely.
Another element not to forget is fragrance planting, by placing the plants in containers near the front door, patios or pathways, the beautiful fragrance will greet you in an abundance of scented sweetness, while also invoking memories.
Plants that work well in hanging baskets, quality ceramic or terracotta containers include, Geraniums, annual and perennial & scented, Lavender, Echinacea, Coreopsis, Dahlia, Nemesia and grasses in variety, to name just a few, available at Ballyseedy Home & Garden Centre.

Tralee Rowing Club take honours home at Skibereen Regatta
At the Skibbereen regatta, 45 rowers spanning Junior 14 to Masters categories, including men and women, competed for two days at the National Rowing Centre. This event marked the first of four grand league regattas of the season and featured favorable rowing conditions despite the lack of sunshine in May. Tralee RC, primarily a sculling club, entered two sweep crews, a junior 18 women’s pair and a men’s club 1 four, for the first time since racing with an 8+ earlier in the year, providing its members with more challenges, options, and learning opportunities. Many of Tralee RC’s rowers competed for the first time in this regatta, including first-timers to finals or winning, earning the club committee’s congratulations. The club celebrated successful performances, including medalists
such as Daragh Morris in the Men’s Junior 15 1x, Sean Morris in the Men’s Junior 18B 1x, and Paula Moloney, Edel O’Sullivan, Fiona Morris, Heidi Giles, and cox Clodagh Morris in the Women’s Masters 4x+. Other commendable results include Luke Passway’s second place in the Men’s J14 1x, Sean Morris’s qualification for the A final in the Men’s Division 1 1x, and Daragh Morris’s win in the C final of the Men’s Div 2 1x. Sadhbh Cadogan and Rosie Giles also secured third place in the C final of the Women’s Division 1 2-, their first time rowing together, while Grace O’Sullivan and Catherine Steward placed third in the B final of the Women’s Div 2 2x, their first time rowing as a double. With this success, Tralee RC looks forward to the rest of the season and hopes to continue learning and
improving.

Help Castlegregory Longboarder Ruby KnoxReach Her Dream at the World Championships in El Salvador
Kerry local & Irish longboarder Ruby Knox is gearing up to represent her country at the World Longboard Championships in El Salvador. Alongside one other woman, Knox is one of the first women to represent Ireland in the sport at this level.
Knox, who has been selected for the Irish team this year, is set to travel to El Salvador with the team on May 1st. She also hopes to travel to Portugal in July for the Euros. For Knox, surfing is a passion that gives her focus, happiness, freedom, drive, frustration, and accomplishment. “Surfing guides me through life,” she says. “It’s what I love to do, and it brings me so much joy.”
Knox never expected to become a longboarder, but she quickly fell in love with the gracefulness of every step, the feeling of flying while noseriding, and the strength and power she feels from being able to move such a big board. Being able to catch wave after wave with ease and never needing to stop is just the cherry on top.
“I’m so grateful and honored for the
opportunity to represent my country for longboarding,” says Knox. “And even more proud to be one of the first women to represent Ireland at the world longboard champions. It’s amazing to see the change and growing community of women in the water, in Ireland, and I hope to help inspire younger generations of women to continue to push the norm and see that surfing is for everyone and comes in many shapes and forms.”
As she prepares for the upcoming championships, Knox is seeking your support. She’s hoping that people will support her in competing this year in whatever way they can, even if it’s just the price of a coffee.
“I appreciate any support that I can get,” she says. “Every little bit helps, and I hope to make Ireland proud.”
If you’re interested in supporting Ruby Knox’s journey to the World Longboard Championships in El Salvador, you can donate by searching ‘Ruby Knox’ on www. gofundme.com. She would greatly appreciate any support that you can give, and every little bit helps her reach her goal.

Susan , part of Irish delegation to Reggio Children in Italy
Susan Quirke-Crowley, Director and Founder of the Mounthawk Montessori School Group in Kerry, was selected as one of only 24 delegates to represent Ireland at Reggio Children in Reggio Emilia, Italy. The Irish delegation was part of a global gathering that included 406 international delegates from 27 countries across five continents. The event, which took place from April 17th to 21st, was the first of its kind since the COVID-19 pandemic struck. Susan was the only Kerry representative at the event, which was organised by Early Childhood Ireland.
During the event, Susan attended workshops, conferences, and ateliers in Reggio Emilia’s early years
environments, which she found to be filled with a palpable sense of calm. Children and adults were given the time, space, and opportunity to engage in their experiences and projects. Collaborative relationships with parents and children were evident everywhere, and this allowed for the generation of content and ideas that supported children, educators, and families to enjoy and immerse themselves in their day-to-day living as coconstructors.
As an Irish early years professional and interested sectoral stakeholder and policy maker, Susan believes that the experience in Italy has brought nothing but inspiration to her team. She plans to merge
the best of Reggio Emilia with the best of Aistear, the Early Years Curriculum Framework, and Síolta, the Quality Framework, in their Montessori school in Ireland. Susan is proud to represent Kerry and is looking forward to cascading the learning through the provision of free continuous professional development opportunities and workshops for early years educators and students. The Reggio Emilia approach is an educational philosophy based on the image of a child with strong potentialities for development and a subject with rights which aligns with our image of the child in Ireland.

Kerry College fun run raises funds for CRITICAL Charity
This week over €2000 was raised for the CRITICAL Charity through the 5K fun run/walk organised by Kerry College, Clash Road Campus, Tralee with large numbers of walkers and runners coming out to support the event .Event organiser and final year student , Aoife Angland says “ The fundraiser aims to generate funding for CRITICAL - Emergency Medical Response. They currently have 9 rapid response unit cars operational in Ireland. We are very fortunate here in Kerry to have one of them. This service is run by volunteer doctors and medical first air responders. (All voluntary). It can be the difference between life and death literally and every bit of publicity and fundraising that can be done for them serves the people of Kerry and beyond. One never knows when they will need this service”.
“The funds raised by the students in the college was so much more than I could have anticipated. I am overwhelmed by the support and generosity of all and I want to thank everyone who took part in the event. From the outset, Kerry College staff and students rolled in behind this
fundraiser and it truly was a team effort in making it the success it was.
I wish to thank the many business sponsors who gave so generously in supporting this fundraiser and all who raised funds by selling the sponsorship cards. As the final student event of the academic year it
will be remembered fondly by all. “ Jess Wright - Donar Care Officer with CRI+ICAL Emergency Medical Response Charity says We are thrilled with this fundraising effort by Kerry College. The funds raised will go towards our ground services and towards kitting out our
emergency medical responders. It costs about €5000 to kit out a medical responders bag so this will go a long way to setting another medical responder up with the tools needed to save lives.
