LEGAL MATTERS CORNER
Tenants Rights
Elaine is fresh out of college and in her first job and is renting out an apartment from a local landlord that she knows and is wondering what she should look out for in the lease.
If the landlord uses the standard Residential property Board lease this lease is a very good example of balancing the rights of landlord and tenant and setting out their respective legal rights and duties. For Elaine taking over the property it is important that she is not found liable for damage in the future so it is important to take photos of the premises and its contents and hopefully both the landlord and tenant will both sign a contents list which they both verify are in situ. A BER rating should be available for the premises which is important for Elaine in determining what her energy costs will be going forward. It is also important to check what the rental amount includes- does it include management fees and refuse for the estate which would mean that would be paid by the landlord and not the tenant. Also, in general contents are not covered by the landlord’s insurance and it would be important to get one’s own tenants cover for contents like laptops, bicycles, jewellery, and other valuables. In general, in Ireland properties come furnished and if the landlords’ contents are particularly valuable it is even more important to have the inventory mentioned above and to make sure that the landlord has insured the said contents. Many leases have specific prohibitions on pets so if you are planning to bring in the pet snake or the parakeet it would be important to ensure one has a clause in the lease to allow this occupant as well. Many leases are personal to the tenant and do not allow other tenants without landlord consent. If one is planning to sublet a room this should be flagged with the landlord in advance so there is no difficulty once one has vetted the person down the line. If Elaine has a car, she should check for car parking availability and if the car parking space is included in the lease. The residential tenancy legislation provides that certain basic facilities and health and safety features e.g. fire blankets and smoke and carbon alarms are in all rented property so it is no harm to download the list from the www.rtb.ie website and make sure they are all present. Check you have hot and cold running water and that heaters, the hot press, the cooker, microwave, dishwasher, fridge, freezer washing machine/dryer and hoover are actually working and that there is proper ventilation in the bathroom. Also check security on the doors and windows that they have proper fastenings. Also, that the lighting is all in place and lightbulbs are not blown. If Elaine has any further queries on tenant’s rights, then the Residential Tenancies Board website referred to above or www.threshold.ie are good ports of call. One of the most important rights of tenants is peaceful possession so a landlord should not be over friendly and calling regularly unannounced.

St John’s Parochial School Fun Run
To Help Fund more Play Space!
PUPILS in St John’s Parochial School on Ashe Street, Tralee are “desperate to make the most of their play areas”
but there is no Government funding available to bring the “children’s dreams to fruition”.
The children, their parents and staff are planning the school’s second annual fun run in Tralee Town Park on Sunday 19th May to help fund school yard and play space upgrades.
The Principal of St John’s Parochial School, Mike O’Toole, said: “Our numbers have doubled in recent years - from 38 to 75 students and from two to four teachers - since 2022. The play
spaces have become more crowded and we would love to make these areas as productive and play friendly as possible.
“Astro Pitches and Playgrounds cost up to €20,000 and €45,000 respectively and proceeds from this year’s fun run will go towards our Yard Rejuvenation Fund. Unfortunately, and despite being a DEIS school, there is no funding from the Department or grant available to bring our children’s dreams to fruition.”
St John’s Parochial School is thrilled to promote its second annual family fun run on 19th May, which will bring the school community together, and anyone who wants a
fun day out, while keeping fit at the same time.
Participants need to register from 10.15am at the park entrance opposite the KDYS on Denny Street while the run itself will start at 11am. Anyone who is not in a position to take part in the fun run can support the school’s fundraising efforts by making a donation online at https:// www.gofundme.com/st-johnsparochial-school.

Q & A – What are DOMS?
Q. I’ve recently started a new exercise regime and my muscles feel tired, achy and sore. Is this normal?
A. Yes, this is completely normal. What you’re feeling is DOMS, Delayed Onset Muscle Soreness.
Q. What are DOMS?
A. DOMS is due to temporary muscle damage and inflammation caused by unfamiliar and unaccustomed exercise.
Q. Is it a good thing to have DOMS?
A. Having DOMS is usually a positive sign post exercise. It indicates that the muscle is healing into a stronger state than it was before the activity and hence it means the exercise was indeed effective. It is a normal feeling to experience when starting a new exercise regime, or when you increase the intensity or frequency of your exercise
Q. What can be done to ease DOMS?
A. First of all, try to make sure you are getting adequate nutrition and hydration through the foods and fluids you are taking in. Gentle exercises like walking, swimming, mobility work or cycling can help to ease DOMS. A sports massage or deep tissue massage can also help ease DOMS. Massage can work directly onto the areas of tension, restoring blood flow, flushing out the muscle tissue and relaxing the muscle tissue.

Labour Local Election candidate Ben Slimm has decided to prioritize sustainability and road safety by avoiding the use of corriboard posters in the upcoming campaign. Ben outlined three main reasons for this choice:
1. Single-Use Impact and Climate Emergency: Corriboard posters are often discarded after use, contributing to plastic waste. Ben believes reducing singleuse plastics is crucial in the face of the climate emergency, setting an example for environmentally conscious politics.
2. Safety Concerns: Placing posters on lampposts and poles can obstruct visibility, posing risks to pedestrians, motorcyclists, cyclists, and other road users. Ben aims to eliminate these hazards.
3. Financial Responsibility: Corriboard posters are costly, especially during a cost-of-living crisis. Ben sees this as an unnecessary expense.
Instead, Ben’s campaign will prioritize direct voter engagement through meetings and digital outreach. “Our actions should align with our values,” says Ben. “By avoiding corriboard posters, I’m advocating for a cleaner, safer, and more sustainable Tralee.”
New
political Party “The
Irish People” brings Independent candidates together!
The Irish People” is a fully registered political party established late 2023 to bring together individuals who would normally run as Independents Candidates. By running under a common brand, the shamrock logo (on the ballot paper) and shared principles, our aim is to increase their electoral chances, starting with the Local and European elections in June 2024. Rather than being bound by a strict party line, our members are encouraged to act, speak, and vote
according to their own conscience once elected. We have over 50 candidates running. The plan is simple. Get as many candidates elected as possible so we can break the current dysfuntional system, replacing it with politicians who will Listen to and Serve the people.

AHHHH, OLD ROMANCE . . .
Janet was lying in bed one night. Art was falling asleep, but Janet was in a romantic mood and wanted to talk. She said: “You used to hold my hand when we were courting.”

MY MARRIAGE IS OVER.
I loved my wife Lorraine in the beginning, but for the longest time I’ve had a crush on my friend ClaireLee Robins, who I know feels the same way about me. Eventually Lorraine found out about my secretive feelings, and just like that, she packed her bags and left. I do feel bad about it all.
“Both of my children have attended Tralee Sports Centre Camps for the past number of years. Not only have they made lifelong friendships but they have many wonderful memories.
As a parent I love that they are safe, well cared for and are actually looking forward to spending time doing physical activity and away from technology”.

Mildly irritated, he reached across, gave her a peck on the cheek and settled down to sleep. Thirty seconds later she said: “Then you used to bite my neck.”
But then I realised; I can see Claire-Lee now Lorraine has gone.
“I have been very impressed with the Activity Camps run at Tralee Sports Complex. They are extremely well organised and supervised by Hayley and the children get to participate in a safe environment.
