LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES

Deirdre is working for a big multinational as a software engineer, and she is wondering what the new pay gap legislation means for her. The gender pay gap is the difference between women and men’s earnings in a workforce. The Gender Pay Gap Information Act 2021 requires big organisations with more than 250 employees to report on pay differences between male and female workers in 2022. but will be extended to organisations with 150 or more employees in 2024 and organisations with 50 or more employees in 2025. Employers will have to report their gender pay gap information annually. The mean and median hourly wage gap. The mean hourly wage gap reflects the entire pay range in an organisation. The median hourly wage gap excluded the impact of unusually high earners. Also data on bonus pay. The mean and median pay gaps for part-time employees and for employees on temporary contracts. It has to include the proportions of male and female employees in the lower, lower middle, upper middle and upper quartile pay bands. The new regulations Employment Equality Act 1998 ( Section 20A) ( Gender Pay Gap Information) regulations 2022 provide a framework for employers to calculate the gap in pay between males and females, and to publish reports outlining specified information about the gender-pay gap. In the regulations are calculations that will serve as a guide to employers when compiling their reports – including the calculation of the total number of working hours, mean hourly remuneration, median hourly remuneration, and bonus remuneration. Under the new measures, employers must place their pay report on their website, or make it available in a physical form. It must remain on the website, or be physically available, for a period of three years from the date of publication. The gender-pay report should contain a written statement in which the employer sets out its opinion on the reasons for any differences in pay between men and women. It should also outline the measures being taken to eliminate or reduce these differences. If it turns out that there is a gap between men’s and women’s pay in the organisation the business needs to explain why that is and the steps that are taking to deal with it. This legislation will supplement the employment equality legislation which enshrines the principle of equal pay for equal work. Pay under this legislation includes any payment, whether cash or otherwise, that you receive either directly or indirectly from your employer in respect of your employment it includes allowances, bonuses, performance payments and non-cash benefits, for example cars and mobile phones. The Irish Human Rights and Equality Commission has already developed a code of practice on equal pay that the Gender Equality legislation builds on. It gives guidance on the right to equal pay, the elimination of pay inequality and the resolution of pay disputes and sets out procedures for dealing with formal and informal disputes about pay. Information on pay can be obtained within an organisation to support an equal pay claim. Hopefully Deirdre will see equal pay for women in her lifetime. Law quip: “If you believe the gender pay gap is a myth do the math” If you have a legal query or need further information on any item addressed in this column please send in your query to miriam. mcgillycuddy@gmail.com Miriam McGillycuddy, Solicitor, Derryana, Ballyard, Tralee, County Kerry. AND NOW FOR THE GOOD NEWS... from The Tralee Advertiser Team and Tralee Chamber Alliance

Fortnight Stay for Family of Four at Under €600? Tralee Has You Sorted By Georgie Downes

Good news! Tourism in Tralee is booming again. Hotels, B&Bs and guest houses are reporting massive volumes of bookings this year and our very own town-centre Kiosk is getting through more maps, guides and leaflets than ever before. Things are definitely on the up. The flip-side, of course, is that high demand equals high cost, so you’d probably need pretty deep pockets if you’re planning a fortnight’s hotel break here in the Kingdom. But fear not. Tralee’s only campsite, The Woodlands Park, with its perfect location and exceptional facilities, (I’ve seen them and they really are outstanding) offers a very attractive alternative. How does a two-week stay for a family of four at just €574 sound? Music to the ears, right? And that includes showers and wifi.

Jane McDonnell, Marketing Manager from the Woodlands Park tells me business is thriving. There are still some spots available for the rest of the summer but they’re filling up fast. “We are delighted with how things are going and it’s lovely to see all of our regulars return. We’ve invested in the campsite over the years and our new facilities have gone down really well with our campers. We have a new family-shower room, basketball hoop, a magic woodlands area and a football pitch, plus the playground and if the weather isn’t so good, we have an indoor games room too.” Jane said. Not only is there plenty to entertain the kids at the Woodlands Caravan Park, but it also has the Aquadome, the Omniplex and the beautiful Tralee Town

Kerry Airport post strong recovery 2021 Results KERRY Airport has released the Annual Report & Accounts for the 12-month period ended 31st December 2021 reporting an Operating Profit after Taxation for the period of €2,439,515 as compared to an after Taxation Operating Loss of €144,996 in the previous year. Gross Revenue in 2021 reflects the recovery in passenger numbers from a low in 2020 of 82,959 to 115,398 in 2021, complemented by a growing Corporate & General Aviation sector during the period. Outside of Dublin and Shannon Airports in 2021, Kerry had the highest business aviation aircraft movements in the State. This year has continued the upward trend and passenger numbers in 2022 will increase significantly. Focus is now firmly set on continuing that recovery whilst carefully monitoring for any possible return to the unfortunate downturn we witnessed in 2020 and 2021. Commenting on the financials and the on-going operations of the Airport for the year, John Mulhern, CEO of Kerry Airport, said: “Recovery is underway in 2022 and better days are ahead for

Kerry Airport. By no means will we reach the levels of activity we enjoyed in 2019 this year, but certainly we can proclaim with much conviction that the doldrums of the past two years are, for now, behind us. The coming years will require extraordinary enterprise to survive the financial insult of this pandemic and PSO loss. Be assured we will work tirelessly to return to the success we enjoyed and then to further growth. Kerry Airport is requisite to the entire Region’s revival.” Throughout 2021, the Airport met and exceeded Safety and Security Protocols. During the extended suppression of travel, the Airport continued to take every opportunity to improve its facilities and successfully prepare for the return of normal operations. All areas of the Airport have undergone improvements and renovations and the feedback thus far by passengers is overwhelmingly positive. John Mulhern thanked the Chairperson, Mr. Denis Cregan, and the Board of Directors, for their continued selfless support and direction, and the elected representatives in Kerry and the Department of Transport

for their unwavering support throughout the year. He also conveyed huge praise and thanks to the management and staff of Kerry Airport who despite it all came to work, worked tirelessly, and kept the Airport operating. Addressing the loss of the Kerry-Dublin Public Service Obligation (PSO) route following the collapse of Stobart Air in June 2021, John Mulhern said: “Despite our unabated efforts to support the Airline and our very public campaign to reinstate a new carrier, the PSO programme is no longer available to us presently.

Ryanair have stepped in and taken on the route on a commercial basis. Under EU Legislation once a commercial operator takes over a route no Government can financially support it. “Although at different scheduled times of operation, Ryanair have made every effort to recover the route and recent passenger numbers exceed even the numbers experienced in 2019 when it was at its most successful. Thank you, Ryanair for your support and your great efforts to recover connectivity to our Region.”

Luxury gifting ideas for Teachers

It is that time again when our schools close their doors and their saintly stewards, ‘our teachers’ release our children back to us. With that, comes the last minute scramble to find a token of appreciation for the immeasurable work they do. Teaching is after all “the profession that teaches all other professions” and at The Killarney Plaza Hotel & Spa, we could not agree more. Teachers, we revere your diligence to the betterment of our mini Einstein’s, Eleanor Roosevelts and everything in between. The teacher’s apple also known as the ‘gift of knowledge’ has been replaced by the modern equivalent, self-care products. The Spa at the Killarney Plaza offers carefully selected luxury products, at prices we know you will appreciate, starting at just €20. Our expert team have carefully selected their favourite luxuriously branded products to give your teacher the acknowledgement they deserve. Some of our favourites include the Rituals Rebalancing Collection giftset, Rituals Sakura scented candles, as well as the Decléor magnolia hand and nail cream. Call into the spa and browse our full range for the perfect teachers token that says ‘Thank you teacher now take some R & R.’ For regular skincare tips, spa news and product recommendations, follow on Instagram or Facebook @ KillarneyPlazaHotel

I have been a fan for years and really find it gives the skin a radiant and healthy looking glow, which is also loved by celebrities; Victoria Beckham, Millie Macintosh and Jen Atkin to name but a few. Skinade is a collagen drink supplement that supports the skin all over your body. It contains collagen peptides, Vitamin B complex, Vitamin C, lysine and omega 3&6. It works from the inside out to rebuild your collagen matrix below the skin surface. It boots hydration and reduces the appearance of fine lines and wrinkles. As we age, we loose collagen at the rate of 1.5% per year from our early twenties. This loss results in wrinkles, fine lines, dry, blemished and thinning skin. Collagen is a critical part of the structure of the dermis and gives our skin its plumpness.

Kingdom Swimming Club hosted a Butterfly Development Clinic ,led by our Head Coach, Ger McDonnell

Drinking Skinade results in firmer more even toned, radiant and healthier looking skin. As well as working on your skin, it will also works on healthier and faster growing hair and nails, so it really is a win-win solution!

Mary Last Friday the U8s girls had a fantastic training session. All the girls really got stuck in and had great fun! Leia Long was the player of the week. Congratulations Leia.

Minister Foley welcomes over €280,000 in funding for 221 local Kerry projects

Minister for Education and Kerry TD Norma Foley, welcomes the announcement of €284,817 in grants for 221 successful projects in Kerry under the 2021 Community Activities Fund. The 2021 Community Activities Fund was launched in November 2021 with funding of €9m available. The key theme of the fund is to support groups, particularly in disadvantaged areas, with their running costs such as utility or insurance bills, as well as with improvements to their facilities. Minister Foley said: “I welcome this funding which will provide continued vital support for over 200 local projects across Kerry with targeted grants awarded to provide equipment and assistance with maintenance fees and running costs. More importantly this funding will support key community enterprises throughout the county, ensuring that these important grassroots organisations can continue to serve their localities and to carry out a myriad of much valued events and services.”

DENTAL CORNER is association with

Summer holidays and dental trauma Summer holidays are fast approaching and it is normally dentists busiest time of year. With the long summer evenings more children are playing outdoors and there tends to be an increase in the number of dental injuries. However the majority of these are preventable. How do I prevent Dental Trauma to my childs teeth? If your child plays contact sports it is a good idea to ensure they are wearing a gum shield/mouthguard which is custom made and specific to the shape of their teeth. Some sports guards can be purchased in a sports shop but these have the disadvantage that they do not cover the root of the tooth and therefore the tooth is not fully protected. Trauma to the root of the tooth very often results in extraction. Trauma to front upper teeth is very common, if the childs teeth are very prominent it may be worth exploring orthodontic treatment to prevent injury

Todd’s O Donaghue walk is July 2nd! The annual Todd’s o Donoghue walk will take place a bit earlier this year then usual . It will.now take place on the 2nd of July to coincide with the wonderful event Mary Gardiner is taking part in . As you know we always raise funds for the Kerry Hospice Foundation, a charity very close to my heart ,but this year we will donate whatever is raised to Mary’s fund for Breast Cancer Ireland. Mary is doing 100km in June and it’s hoped what we raise will help . We have been truly blown away over the years by the amazing generosity of the local community and beyond . Since Dad has passed, a whopping €65k has been raised in memory of him ,between gala balls ,lovely legs competitions ,walks and runs . The walk will take place on Saturday July 2nd , and registration will take part beside the wonderful 2beans in a box Coffee Truck in the Windmill car park .It is the same route back the bank into Lohercannon and back to the Windmill . The great man that is Tom Quane will provide food around 5 pm at Skelper Quanes ,and we will have a DJ to belt out a few tunes to end the night .There will also be a chance to donate in Quanes and we may have a few spot prices on the night. All in all it promises to be a great day and hopefully will raise some funds for Marys breast cancer Ireland event .. Looking forward to seeing you all. Andrea O Donoghue

My child has fallen and their adult tooth has fallen out, how do I react? If the position of the adult tooth has moved it should be repositioned immediately. This is usually undertaken by a dentist who will move the tooth back into position and place a wire splint on the teeth to allow healing for three weeks. If the tooth has completely fallen out , it should be placed back into the mouth as quickly as possible normally by a parent and the dentist should be contacted straight away, Care should be taken to handle the tooth by the crown of the tooth and not the root so as to protect the ligament. If it is not possible to place the tooth back in the mouth , the parent should place the tooth in a glass of milk as this environment resembles the PH of the mouth and prevents the ligament from drying out.The sooner the tooth is reimplanted into the mouth the better the prognosis. In general reimplantation should occur within 20 minutes of the event.

The Lighthouse Candle

OFFICIAL OPENING TODAY… Handmade Candles & Soaps

Exciting times ahead for Mary Hannon as the doors open to her new gift shop at the Lighthouse Hotel in Fenit. Please drop by, take in the lovely smells and SUPPORT LOCAL! Below is a bit about Mary…. …I was always interested in learning the art of candle making… everywhere I went I bought candles … the house was always full of them.. and a few years back I wanted all my Christmas presents to be from Kerry, to be locally made. I decided on candles but at the time found it almost impossible to find a local candle that was made from either Soya wax or beeswax… Coming from an artistic background, having a degree in fine art, I decided to start manufacturing my own candles. When I saw the Lighthouse hotel in Fenit , where my little shop is based, it was a no brainier for me. It just felt like the right spot. And being located in Fenit was the icing on the cake so to speak… There is a real sense of being part of something special in the area. I love it here… People greet you every morning as if you’re a long lost friend.. but maybe that’s just a Kerry thing… either way it’s lovely.. I use Soya in almost all of my candles . It is natural and environmentally safe. I have ideas to make more artistically, innovative and creative candles in the future but for now- small steps…My range will increase over the next months so keep an eye out and if you are in the area please drop in and say hello!

FAI NATIONAl P.R.O. OF THE YEAR KENNEDY CUP FOLLOWS ON FROM SUCCESSFUL GAYNOR: It has been a very good two weeks for Kerry’s u14 soccer stars as the girls and boys took part in the 2022 Gaynor and Kennedy Cups. The girls were first in action and they enjoyed a very good week with the highlights including wins over Limerick County and Cork. And they were within a minute of topping the Group but a late late Limerick Desmond equaliser two minutes into added time saw Kerry take second place in the Group. They were unlucky to be drawn in the only quarter of the Bowl and ended their week with a 2-0 loss to Donegal to take 10th place from the 25 teams. Kerry got the ideal opening to their Kennedy Cup campaign with a 1-0 over North Tipperary with the goal coming from Camp Juniors Robert Keane. In the other game in the Group Galway snatched a late winner to defeat Kilkenny 3-2. All 31 Leagues play two games on Day 2 and in the first of these Kerry lost 1-0 to Kilkenny and Galway won 2-0 against North Tipperary. The Group finished with Kerry going down Galway and Kilkenny defeating North Tipperary. Kerry finished 3rd in the Group. We will have details of the knock out stages next week.
