LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES The Law relating to metal detectors
Sean is wondering is it legal to buy and use a metal detector in Ireland. It is the National Monuments Acts 1930 to 2014 which impact on the use of metal detectors in Ireland. Generally the rule is that it is illegal to do searches for archaeological objects in Ireland using a metal detecting device unless you have received written consent from the Minister for Arts, Heritage and the Gaeltacht. The burden of proof is on the user of the metal detecting device to ensure that a metal detector is used in accordance with the law. i.e. perhaps to find keys or a metal object lost in the garden or to ensure the law is clear of metal objects prior to lawn cutting. In particular if a person were to use a metal detecting device around preserved monuments and sites of National significance in Ireland this in itself would be strong evidence that they were searching for archaeological objects and it would be hard to dislodge the burden. Therefore it is illegal to be in possession or use a metal detector at monuments or sites protected under the National Monuments Acts. The list of these sites is on www.archaeology.ie The reason behind the law is preservation of Irelands natural national heritage as if people dig in response to the metal detector they can cause untold damage to archaeological remains a bit like a bull in a china shop. Moreover the definition of what is an archaeological object is quite wide and these can only be searched for anywhere in the state under license e.g. coins, tokens, buttons, clothes fasteners, thimbles, keys, seals, weights, strap ends and belt mounts. It all comes down to intent at the end of the day that under no circumstances can people use metal detectors or dig for archaeological objects without a license. Contravention of the legislation can result in fines or imprisonment. Moreover advertising a metal detector to search for archaeological objects is an offence which can result in a large fine. Recently a supermarket chain who had metal detectors on sale with packaging encouraging children aged 8 years and older to use them to find “hidden treasure” has to remove them from the shelves following a complaint. All in all anyone using a metal detector needs to ensure that they have consent/license from the minister and/or a legitimate reason for using them. The law does envisage accidental finding of archaeological objects as it specifies that they need to be handed in/reported within 96 hours to the National Museum or designated local museum . With the local GAA championship season kicking off in August, is there something I can do to minimize the risk of injury?
What is antiwrinkle treatment? Antiwrinkle treatment is a relatively painless procedure using botulinum toxin type A which relaxes the muscles involved during facial expression. i.e smiling(crows feet) , frowning(vertical lines between the eyebrows, raising eyebows(horizontal lines). Is it painful? The treatment is relatively painless using tiny needles which are injected superficially underneath the skin. How long does it last? The procedure itself is relatively fast . Treatment time is approximately 20 mins. If you are new to anti-wrinkle treatment it is important that the doctor assesses suitability for treatment prior to treatment. The treatment lasts approximately 3-4 months . However , this will vary from each individual . What are the risks/side effects There are vey few side effects, these will vary , but include headaches, redness, infection, ptosis(drooping eyebrow or lid). Thorough assessment prior to treatment is essential Who preforms these treatments? In Ireland the administration of antiwrinkle treatment or botulinium toxin type A is well regulated and can only be administered by a suitably qualified /trained medical / dental practitioner. Those administering the treatment should have a thorough knowledge of the anatomy they are injecting. What areas are suitable for treatment? Antiwrinkle treatment can be used to treat a variety of medical and aesthetic conditions , from crows feet and bunny lines , to gummy smiles , excessive sweating, neck lines/bands and muscle spasm of the jaw joint. It is best to consult with a qualified /registered practitioner to determine your aesthetic needs.
I like to lead with a phrase that is often attributed to the Dutch philosopher Desiderius Erasmus in around 1500 which is “prevention is better than cure”. Most clubs are either beginning or are already in a heavy 4 – 6 week block of training. This volume and intensity of training can leave the body fatigued and it’s meant to. There is very high demands placed on your muscles in this phase and it is during this time frame that your body may break down and you may pick up a strain or worse, tear a muscle. Your muscles are constantly being asked to work under strenuous conditions and this can lead to tightness and a potential injury if not addressed. Which Way? The Greenway Of Course! By Georgie Downes
Phase one of the Tralee Fenit Greenway has opened at last. The 6.5 km section of the long-awaited walking and cycling route linking Fenit and The Spa had its official ribboncutting ceremony on Friday 24th June with Minister for Transport Eamon Ryan doing the honours. The rest of the Greenway is expected to open sometime in September. When complete, the Greenway will cover 11.3 km, beginning at Tralee Railway Station and leading out to Mounthawk, allowing folks to cycle, run, walk or stroll all the way to Fenit in a carfree environment, taking in the sights and maybe even stopping for a picnic along the way.
Minister Ryan, a huge bike enthusiast, said the new facility demonstrates how greenways can play an important role in connecting communities in a sustainable manner. “This new infrastructure from Fenit to Spa is accessible to all and allows those living on this route to commute safely to school, work or other amenities by foot or bike.” “It also provides an attractive amenity for visitors to the area and I look forward to the delivery of the rest of the greenway which will further support tourism and sustainable transport in the region,” said the Minister.
Mayor of Tralee Johnnie Wall was on hand to praise the efforts of Kerry County Council staff and to thank everyone who turned up for the ceremony despite the unseasonably wet weather.
But then again, a few drops of rain has never stopped us enjoying ourselves here in Tralee.

Open Call for Culture Night 2022 extended! The Arts Office at Kerry County Council have extended the Open Call deadline for Culture Night Kerry 2022 programme to 5PM Thursday 7 July. Culture Night invites everyone, everywhere, on one night to discover and celebrate all that our culture is today. One night for all. On Friday 23 September, Ireland will become a cultural playground. Special events are programmed throughout the country in various locations and unique settings. This is an opportunity for local community groups, businesses, charities, artists, and performers in Kerry to get involved and showcase their

talents and skills. A safe and enjoyable night time experience is central to Culture Night. Activities planned for later in the night – beyond 9pm – are encouraged. Thanks to the continued support of the Arts Council as well as local authorities such as Kerry County Council, all activities are made available to the public free of charge. When considering an application to be part of the programme, ensure all creatives and performers are supported. The Arts Council’s #PayTheArtist policy is being highlighted in terms of participation to ensure that artists who are invited to perform and participate are paid. The Culture Night experience is across a wide range of sectors – culture, arts, heritage, education, hospitality, tourism, health, and commercial and corporate enterprise. Writing groups, choirs, dance classes, knitting circles, history enthusiasts, and many more are encouraged to apply. As Cathaoirleach of Kerry County
Council, Councillor Jimmy Moloney, says; “Culture Night is for everyone. A Night with Legends!! Fossa’s Fundraiser! Fossa GAA Club is organising a fundraiser for club activities and has put together ‘A Night with Legends’ at the INEC, Killarney on July the 5th @8pm Some of the greatest legends ever to grace a Gaelic football pitch will share a stage on July 5. Kerry greats like Pat Spillane, Mikey Sheehy, Jack O’Shea, Darragh O’Se, Mike Frank Russell, Paul Galvin Eamon Fitzmaurice and Darren O’Sullivan will be joined by heroes from across the border, counties like Niall Cahalane, Jimmy Barry Murphy and Larry Tompkins – Fossa will also have the privilege of having all time greats like Peter Canavan, Colm O’Rourke, Bernard Brogan Senior and the one and only Joe Brolly. Killarney and East Kerry
hero’s - Colm ‘Gooch’ Cooper and Ambrose O’Donovan will also be there. The event will be styled on RTE’s popular pre-All-Ireland Final show ‘Up for the Match’ where footballing legends will tell some of their life stories in between music and songs and will be hosted by author and raconteur Billy Keane and horseracing photographer Pat Healy. “We promise that it will be a night full of fun and laughter and some great memories and stories will be remembered from some of the greats of the GAA world,” Siobhan Kissane, chairperson of the organising team, said. This event is one of the key fundraisers for the expanding Fossa GAA Club.“The club is expanding, there are a lot of new people moving into the area, and our traditional income streams were reduced
during the pandemic,” added Siobhan, who is also the club’s Coiste na nÓg officer. The fundraising drive is a joint effort between the men’s, ladies and youth arms of the club with backing from the club’s executive.There is a greyhound for auction on the night and a super raffle including All-Ireland tickets,

Minister Foley welcomes CE reforms Education Minister and Kerry TD Norma Foley welcomes this weeks announcement of a number of significant reforms to Community Employment, Tús and the Rural Social Scheme (RSS). The following changes are announced : •

Removal of the sixyear time limit for all participants on the Rural Social Scheme. Eligibility for Tús extended to persons in receipt of Disability Payments New flexibility to allow CE schemes to directly recruit eligible candidates to fill 30% of places. Intreo to significantly increase the number of referrals to CE with schemes required to offer places to at least 60% of candidates referred.

New Pilot Scheme to extend eligibility to Qualified Adults to be explored Continue to allow schemes to extend individual placements and retain existing participants in cases where no replacement candidate has been selected. This means that local services should not be impacted due to an inability to replace participants.
The purpose of CE and Tús is to provide long term unemployed participants with work experience in their local communities to help them find employment. There are currently over 19,000 participants on CE, almost 5,000 participants on Tús and just under 3,000 participants on the Rural
Social Scheme nationally. Government investment in the three schemes will amount to over €500million in 2022. Minister Foley said: “I welcome these positive initiatives announced by my Government colleagues Minister Humphreys and Minister O’Brien. These significant reforms will provide
further security and targeted supports to those social scheme workers who continue to provide vital services in areas such as childcare, meals on wheels, the maintenance and upkeep of local amenities and other key services across the county.”

FAI NATIONAl P.R.O. OF THE YEAR PARNELLS ENTITLED TO THE HEADLINES: In a week where there were wins for the Kerry senior Men’s and Women’s teams the headlines are going to an underage side! It is only fitting that Tralee Parnells u15 Feile win takes top billing as this was a huge achievement for the players, manager Brian Shannahan, the coaches, club and parents. Club history was made in County Meath as the boys brought home the All Ireland Division 3 Feile na nGaeil championship title for 2022. Sending a team to a competition like this in any sport is a huge undertaking and the club is grateful for all the support they received. They beat Mount Leinster Rangers, Castlebar Mitchels and Donaghmore Ashbourne in the Group stages, Padraig Pierces of Kilcummin in the semi-final and Trim 0-09 to 0-02 in the final. KERRY THROUGH TO THE FINAL FOUR: There is not much more to say on Kerry’s 1-18 to 0-13 win over a disappointing Mayo side. David Clifford, whose ankle will be a concern to the management, hit a cracking goal as Kerry ran out easy winners in the end. Mayo were not helped by black card for Aidan O’Shea and this is probably the end of this squad with manager James Horan stepping down. Kerry will now turn all their attention to the semi-final and a mouthwatering clash with Dublin on Sunday July 10th. KERRY PLAYERS ON TEAM OF THE WEEK: After the Mayo game two of the Kerry seniors were named on the GAA’s Team of the Week – Rahilly’s David Moran and Dingle’s Tom O’Sullivan. This will be especially sweet for Moran who has been out of the game for nearly a year and came back at the highest level and delivered a superb performance. IS PENALTY SHOOT-OUT THE WAY TO DECIDE A GAA GAME? While a lot of attention rightly on the brawl as the Galway and Armagh players went off the field the fact that a historic penalty shoot-out was needed to decide a cracking game was somewhat overlooked. Firstly all the teams knew the rules before the Championship started so it is strange to see the Galway manager complaining even after he won the game. And while a penalty shoot-out is more associated with soccer why is it not acceptable for GAA players to face the same pressure when a winner needs to be decided on the day? It is not enough to say the players don’t practice penalties – I doubt if behind closed doors every Inter county doesn’t practice them!! However there is probably a case for games from the quarter finals on to go to a reply but then will counties complain about playing two weeks in a row and the winners having a week less to prepare for a semi-final.

ON THE BRAWL: Like the Kerry game there has been plenty said about the brawl and the ‘alleged’ eye gouging and we will wait to see how the GAA Disciplinary handles things. While Galway will be waiting anxiously to see if any of their players face sanctions and possibly miss the semi-final. For Armagh, who were already involved in two previous brawls, the have more to lose. The question is when will any sanctions kick in? If players miss League games would that be the worst outcome? But if two or three miss the opening rounds of the Ulster Championship then that could have more serious consequences. Like everyone with an interest in sport we are all awaiting to see the referees report and then the actions of the GAA’s Disciplinary Committees. KERRY LADIES IMPRESS AS THE REACH THE LAST 8: When the Kerry GAA Senior Ladies side won the League it was substitute Danielle O’Leary who came on to change the game. In their final Group game Rachel Dwyer came off the bench at half time and hit 1-5 as they side defeated Westmeath 2-17 to 0-09 to top Group C. Their reward is a quarter final spot on July 9th when they will take on Armagh. The other three games will see Meath face Galway, Dublin against Donegal and Cork taking on Mayo. GARVEY’S SUPERVALU SENIOR HURLING CHAMPIONSHIP GETS UNDERWAY: With two qualifying from Groups of 3 the first games in the Senior Hurling Championship are vital to get something from. The game between Kilmoyley and Abbeydorney finished at 15 points each while Causeway beat St Brendan’s 2-12 to 0-12. CLUB NOTES: PARNELL’S NEWS: The u8’s enjoyed their game against Causeway while the u10’s took on the same opposition with all four teams showing off their skills. At Senior level the team are ready for their Intermediate Club Championship game when they take on Kenmare Shamrocks away tonight (Friday night). The club is hoping for lots of support as its bi-weekly lotto gets underway with the first draw this Monday July 4th. BALLYMACELLIGOTT NOTES: The seniors enjoyed a hard fought win over Rahillys 2-06 to 0-10 in the County League while this Saturday the B’s play Listowel Emmets B in the Division 2 Final in Mountcoal. The Senior Ladies enjoyed a 2-09 to 1-07 win over Fossa in the Donal Curtain Cup quarter final. They will play Listowel Emmets in the semi-final. The u14 girls continued their winning run defeating Emmets and play Firies next.
AUSTIN STACKS STORIES: The Seniors drew at home to Killarney Legion in the County League 1-11 to 0-14. Next up is a game away to Spa. The B’s need to win against Beale and hope results go their way to retain their Division 4 status. The C team plays Listry B in the County League Shield final this Saturday evening at 7pm. In the Lotto there was no winner from the numbers drawn 12,17,18 and 22 with the next jackpot being e2600. The All Stars had a weekend off due to the weather but will be back out this Sunday morning. All the underage sides train as normal and are in Go Games action. The under 15 boys are heading to Dublin this weekend for their John West Feile competition. ST PATS NEWS: There was one winner of the Lotto, Maura Murpy, from the numbers drawn 4,11,17 and 21 and the next jackpot will be e2000. Registration is now open and members are asked to sign up as soon as possible. The Mary Gardiner Walk takes place this Saturday July 2nd. The club thanks everyone who has raised money for this very worthy cause. The Academy was off due to the rain but all ages will be back in action this weekend. The u11’s are due to take on Finuge in the Go Games. The u12 Girls were in the B Final in mid-week. The older ages are in Central Region Phase 2 action. The Seniors went down away to Glenflesk in the County League in a game played in horribly wet conditions. KERINS O’RAHILLYS NEWS: The seniors went down to Ballymacelligott 0-10 to 2-06 in Round 10 of the County League Division 1. There are big games for a number of the teams in the coming week. The u12 Girls enjoyed their games this week and looked great in their new jerseys sponsored by Eleanor and Roy of Sandy Feet Farm. The Blue team will play either MKL Gaels or Emmets in their final while the Rahillys team played Scartaglin in mid-week. There were also games for the u14, u16 and senior ladies in mid-week. The weather didn’t deter the juveniles from training last Sunday and will be back out this weekend. The u6’s, u8’s and u10’s go to Churchill on Sunday for their Go Games starting at 9.15am. The u13 Boys lost out to Glenflesk in their semifinal. Anyone interested in signing up for the summer camp that takes place from August 2nd to 5th should book as soon as possible. There was no winner from the numbers drawn 1,2,27 and 29. QUIGLEY MAKE THE FINAL 12: Mark Keenan has named his final squad for the FIBA Basketball EuroBasket 2025 Qualifiers when Ireland will take on Austria and Switzerland. And there was great news for Garvey’s Tralee Warriors star Eoin Quigley as he has made the final 12 man squad. This Sunday they are at home to Switzerland in the Arena in Tallaght tipping off at 5.15pm and its live on TG4. KERRY 14’S GET THEIR LEAGUE OF IRELAND CAMPAIGN UNDERWAY: Having officially signed the players who will represent Kerry in the 14’s League of Ireland they begin their campaign with a tough away opener as they head to Cork City. In a busy weekend on the LoI front the 17’s are at home to Treaty on Saturday and the 19’s home to Longford on Sunday.

SFAI INTER LEAGUE DEFEATS FOR KSBGL SIDES: The Inter League season of SFAI competitions came to an end at the weekend with narrow defeats for the two KSBGL sides that reach their National Finals. The 13’s Girls, coached by Siobhan Cushen, lost out 3-1 to North Tipperary while the 15’s Boys, under head coach Eoin O’Mahony, lost out 1-0 to Limerick District. DEAN IN THE GREEN: Kingdom Wheelblasters Dean McCarthy is one of the new members of the Ireland u23 Wheelchair Basketball team who are in Finland for the Para-Youth Games. They play the Netherlands and Italy on Friday and Portugal and Finland on Saturday with the Play-offs and medal games on Sunday. TRALEE BAY SWIMMING CLUB: From Race 2 the fastest was Hugh Stuart in a time of 14.33 ahead of Matt O’Regan and Brendan O’Connell. The club is also looking for members to volunteer for the various roles needed to run the summer season of races. They are asking everyone to volunteer at least once. COMMUNITY GAMES: Well done to all the athletes in all the various disciplines on and off the track and field who have qualified for the Regionals that will take place in Ennis on the 23rd of July. ON THE GREEN’S – PITCH & PUTT: There was great success for Kerry players at the u16’s Munster Matchplay where the majority of the prizes stayed in the county and credit to all the players at they did not let the inclement weather put them off. Tralee showed again that all the work being done at underage level is paying off. They supplied all four girls in the semi-finals. Ella Moynihan defeated her sister Sophie on the last hole. Lucy Grattan defeated Cliona Murphy 5&4 to take the other final spot. And Lucy carried that form into the final winning 3&2 taking her first ever Pitch and Putt title. The Boys events proved to be happy hunting grounds for the host club, Listowel with Trevin Chute taking the win. Tralee will again be well represented on county teams with the Intermediate and Junior Men’s teams selected. On the Intermediate team are Tralee’s Keith O’Brien, Paul O’Shea and Danny O’Leary with their club mate John Fitzgerald managing the team. On the Junior team from Tralee, heading for Dungarvan in August, will be Michael Creagh, Pa Byrne and Mark O’Regan. This weekend 20 Kerry players are heading for the Men’s Strokeplay Finals with the Seniors and Juniors in Dublin and the Intermediate competition in Louth. TRALEE P&P CLUB: The 2022 Club Matchplay has reached the semi-final stage with some great battles having taken place. Ollie Lynch will take on Keith O’Brien while Mike Conway goes up against Danny O’Leary. GOLF – TRALEE GC: Due to the weather all the weekend competitions were cancelled but the Ladies did get out on Wednesday with Sheila McCarthy taking the win from Mary Mullins.
