LEGAL MATTERS CORNER
MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
We spoke about wills last week which are usually done in conjunction with a solicitor to ensure your wishes are implementable and tax effective and legally compliant. The other document which a like a living will or advance healthcare directive (AHD) can be arranged by people themselves and costs nothing and is setting out your wishes in relation to healthcare if you are ever in a position where you have temporarily or permanently lost your capacity e.g. road traffic accident, stroke or coma.) It is a written statement of the medical or surgical treatment you want or do not want should you not be in a position at a given time in the future to make those wishes known. Treatment is defined as “for a therapeutic, preventative, diagnostic, palliative or other purpose related to the physical or mental health of the person and includes life sustaining treatment.” Examples of treatment you might refuse or request might be cardiopulmonary resuscitation (CPR), mechanical ventilation, tube feeding Dialysis, antibiotics or antiviral medications, electro-convulsive therapy (ECT) And chemotherapy for treatment of cancer. It is possible for people to do separate advance healthcare directives for physical and mental health. An AHD is done up by a person and signed in the presence of two witnesses one of whom must not be a family member. Usually also the AHD maker would appoint a main healthcare representative and a sub who would communicate one’s wishes when one is not able to do so. Certain categories of people e.g. owners of nursing homes are excluded from these positions. The health representative keeps a record of health care decisions made. One can revise or revoke an AHD at any stage. To make an AHD one must be over 18 and have decision-making capacity. While there is no obligation to do an AHD it is a good idea as it gives clarity to relatives about one’s wishes and can be helpful for next of kin liaising with medical and other professionals as they are required to respect a person’s wishes in relation refusal of medical treatment. It would be particularly important to people who have health issues and fluctuating capacity or have been diagnosed with a terminal illness. On a practical level they are very easy to do there is guidance and a form on the www.decisionsupportservice.ie website and also through the www.thinkahead.ie website they have an AHD form and then a short form summarising the AHD for your doctor. Before finalising your AHD it is a good idea to discuss with next of kin and your medical advisor. At present there is no central register of AHD’s but hopefully there will be eventually so it is important to give a copy or summary sheet to your GP to have it on your medical file. Further information on Advance Healthcare Directives available from https://www.citizensinformation.ie/en/health/legal-matters-and-health/advance-care-directives with links to obtain the forms.

What is the Best Broadband provider for business in 2024?
Today's businesses depend on fast broadband to keep up with their daily operations. More than ever, being able to have a reliable internet connection is what makes businesses run smoothly . The best business broadband in Kerry can be di cult to nd since you'll often want a more powerful connection. With Kerry been having such a rural landscape it can be di cult to nd a good broadband connection.
What de nes a good provider is how they respond to a fault . If I was to recommend a provider it would be a local company Ivertec .The product and support is excellent from my experience. They provide VOIP phone connection. They have a failover solution which acts as a backup plan for your business to ensure that if one connection goes down your business keeps connected without interruption.
I would also recommend them for the home user. For more details www.ivertec.ie
GOOD NEWS ONLY!
Minister Foley announces new Special Needs refurbishment works in St Brendan’s national school in Fenit
Minister for Education and Kerry T.D. Norma Foley has this week announced new refurbishment works to provide a special needs classroom in St Brendan’s national school in Fenit.
An existing classroom in the school will be redesigned to provide for a special educational needs classroom and for two special education teaching rooms.
Minister Foley said: “I would like to congratulate St Brendan’s national school in Fenit for the excellent work in education that takes place there
every day. These reconfiguration works are important in providing a welcoming, safe and suitable environment for the educational needs of all pupils. I look forward to seeing them progressing in a timely fashion.”
The Department of Education has design guidance for classrooms for pupils with special educational needs. Pupils who have difficulty with aspects of communication, speech and language need classrooms with good acoustics and good sound insulation in walls, floors and ceilings to minimise noise between rooms and outside noise.
There also needs to be appropriate levels of glare-free controllable lighting and appropriate finishes, colour and colour contrast including the avoidance of strong patterns and textures.
There are currently 99 special
classes in schools in Kerry at primary and post primary level, with more than 3,000 in existence nationally. Each special class has a teacher, two special needs assistants and six pupils.
Hospitality Leaders Urge Government to Reinstate 9% VAT on Food Services
‘Supporting Irish Hospitality’ - Joint Statement by Coalition of Industry Groups
A joint statement from the chief executives of the Irish Tourism Industry Confederation (ITIC), Restaurants Association of Ireland (RAI), Vintners Federation of Ireland (VFI), Irish Hotels Federation (IHF) and Licensed Vintners Association (LVA) in advance of a ‘Supporting Irish Hospitality’ industry briefing being held today in Buswells Hotel, Dublin:
“On behalf of hospitality businesses the length and breadth of the country, we are calling on the Government to commit to reinstating the 9% rate of VAT on food-related services. It is essential that last September’s VAT increase be revisited in the upcoming Budget given the severe impact it is having on hospitality businesses, many of which are facing enormous financial pressures. “These businesses are now at a cross-roads, struggling to deal with very tight margins and reduced profitability due to ever-increasing operating costs. To a large extent, this is being driven by the Government’s own economic policies including a series of employment-related cost increases coming into effect in close succession. The impact of these measures has been particularly acute for hospitality businesses given
the
labour-intensive nature of our industry
“Businesses throughout the sector are forecasting worrying cost increases over the next 12 months at levels significantly outpacing inflation within the broader economy. This is on the back of a period of unprecedented cost increases in recent years. Meanwhile, these businesses are struggling to deal with the effects of last September’s VAT increase coupled with the impact of significant pressures on consumer finances – all of which continue to reduce profitability and erode
competitiveness. This poses an enormous concern given the implications for the long-term recovery of tourism and hospitality, our largest indigenous employer supporting some 270,000 livelihoods. “While we have been repeatedly assured by the Government that it understands the extent of the challenges facing hospitality businesses, regrettably this has yet to translate into meaningful supports. It is now vital that the Government does everything possible to help put our sector and wider tourism industry on a more stable footing. At a minimum,
this must include the reinstatement of the 9% VAT rate for food-related hospitality services.”

Free Petmania Puppy Class for Tralee this July
Petmania in Tralee is reintroducing its free puppy care classes on Saturday, 13th July. These classes are designed to equip new or soon-to-be puppy owners with essential knowledge for welcoming their new furry friend into their home. The goal is to help families integrate their puppies and establish lifelong good habits. The puppy care classes will cover everything new owners need to know about caring for, feeding, and protecting the health and well-being of their puppies. Held at the local Petmania store and other locations nationwide, these free classes require advance registration due to limited spaces. Participants can sign up at www.petmania.ie/puppy-careclass and will receive a free puppy care gift pack.
Delivered by trained Pet Care Advisors, the hour-long class includes topics such as diet and nutrition, grooming, dental care, exercise, and play. Petmania’s experts will also provide advice on house training, settling a puppy into a new home, and essential products for new puppies.
Emily Miller from Petmania highlighted the importance of these classes, stating, “Bringing home a new puppy is a big responsibility. The reality of day-to-day commitments can be overwhelming for new pet families. Our puppy care classes aim to alleviate some of that pressure and offer expert guidance and advice on all aspects of a puppy’s new life.”
The classes cover everything from
the first night home to feeding, healthcare essentials, and house training. They last approximately one hour and are recommended for anyone who has just gotten or is preparing to bring home a new puppy. While puppies are welcome to join (once vaccinated), the focus will be on training the owners, not the puppies.
Petmania also offers the Petmania Puppy Club, providing free access to expert guidance on all aspects of a puppy’s health, diet, training, and grooming. Members receive timely
emails and exclusive discounts throughout their puppy’s first year. For more information, visit www.petmania.ie/puppy-club.
